4 1 Technical Report 1.1 Summary of Activities and Results Information about the activities that have been realized since the beginning of the project (from 5 January 2005 to 20 October 2005), and their results are described below. The project was initiated by Ekodenge Limited upon sending the draft Partnership Agreement to Technopark on December 10, After the approval given by Rectorate of HU and the authorization by the Dean of HU Faculty of Engineering on 05/01/2005 (Annex 2 OL), Technopark was charged for the project with the protocol signed between HU Engineering Faculty and Technopark (Annex 1.2) The Partnership Agreement (Annex 1.3) mentioned in Article 4 of LIFE Standard Administrative Provisions (hereafter SAP) was signed between partners, i.e. Hacettepe University (hereafter HU), Hacettepe University Technopark Inc. (hereafter Technopark), KOSGEB Small and Medium Industry Development Organization (hereafter KOSGEB), OSTIM Organized Industrial Zone (hereafter OSTIM) and Ekodenge Environmental Engineering and Consultancy Ltd (hereafter Ekodenge) on 01/03/2005. In order to carry out studies related with the project, Ekodenge rented an office (see photos at Annex 13) in Technopark and signed a Rental Contract (Annex 1.8) with Technopark valid from 01/01/2005. Details on sharing responsibilities and the way of coordination were clarified at the first progress assessment meeting (meeting No 8) held between project partners on It was decided to organize progress assessment meetings regularly. Following Tasks started on time, Task 1- The project web page for the dissemination of project results was prepared. Project introduction file and a leaflet used for project announcement and introduction were prepared. The mentioned information was started to be publicized under the project web page ( which is being hosted by KOSGEB server. Inventory of Turkish Environmental Legislation was prepared and presented by a CD in a file (Annex 4) to all project partners at meeting No 008, which also involves the English translation of the inventory. The CD was sent to the relevant institutions on with an official letter (Annex 2). Task 2- Industrial sectors were determined to be covered within the framework of the project. Detailed analysis of Turkish Environmental Legislation was started up from recently published and transposed regulations. Official letters were sent to the related institutions and Turkish Translations of EU directives were asked. Unfortunately the project team has not received any support for this issue. 5 Task 3- Web demonstration (Annex 7.2) for water and air quality, EIA, hazardous waste management and management of waste oils in chemicals sector was prepared. During the preparation of this web demo, relevant legislation was analyzed in detail and an analogy to be used by software developers was developed. The issues learned during the development of this demo, guided through the preparation of SRS (Annex 8), which details information about software development methodology, properly without overlooking any details. Task 4- Studies at OSTIM have started earlier Relevant with the pilot study to be carried out at OSTIM, a reference and training document (Annex 6) for industrialists was prepared, printed and distributed. Task 5- Preparation of Approximation Strategy on End of Life Vehicles Directive (EoLV) as a sample, which was planned to start up at January 2006, has started before its scheduled time. Meetings regarding mentioned task were held with Automotive Manufacturers Association. The project manager has provided information regarding documents given in digital format (annex 12) in order to ensure Automotive Manufacturers Association to carry out the studies regarding DSIP preparation, efficiently and effectively. Task 6- Collection of the supplementary information which will also be available in the information system about Best Available Techniques, Integrated Product Policy, ISO 14001, EMAS, funding opportunities for SMEs, and governmental strategies regarding environment was started (Annex 9). During the period covered by this report, the uncertainty regarding VAT Exemption was clarified with Ministry of Finance. The official letter and certificate were received from MoF (Annex 2). In respect to received official letter and certificate goods, works and services to be purchased within the scope of the project are exempted from VAT. The issue on project sustainability was discussed with project partners and for detailed discussion an official letter (Annex 2) was sent to the related institutions, and a meeting was held on During the period covered by this interim report thirty meetings were held in order to take necessary decisions and monitor studies involved in Tasks 1, 2, 3, 4, 5 and Project Management No difficulties were faced during the management of the project. The studies regarding project implementation are successfully coordinated by the Dean of Hacettepe University Engineering Faculty. The responsibilities and duties of project partners relevant with tasks, which were detailed in the Partnership Agreement given in (Annex 1.3) was implemented as planned. Project Partners contributed to the project as indicated in the agreement. MoEF has also contributed to the project by monitoring and supervising activities although not being a partner of the project. October 2005 Hacettepe University 2

6 All project partners are provided with Turkish translation of SAP and informed about provisions and requirements. All meetings and correspondence are followed up by project code. 7 Partners Meeting External Assistants Mr. Norman Sheridan (Legal Expert- Freelance) Mr. Erdem Evren (Local Legal Expert-Freelance) Mr. John Butson (Senior International Technical Expert-Enviromarket) Mr. Emre Akgun (Auditor Freelance) Mrs.Petek Egerci (Junior Engineer) Mr. Norman Sheridan is a senior legal expert, who has experience on ECEL and TEL regarding environmental issues. Within the scope of the project Mr. Sheridan provided assistance to Ekodenge during the development of the format for the Information System, and during the preparation of summaries of relevant directives and other ECEL for inclusion in the Information System. The Partnership Agreement signed between Mr. Norman Sheridan and Ekodenge is given at Annex 1.4. Mr. Erdem Evren is a local legal expert who supports the project team at national environmental laws regarding the project. He has monitored studies regarding TEL inventory, regulation analyses and has given support for DSIP preparation of EoLV. The Partnership Agreement signed between Mr. Erdem Evren and Ekodenge is given at Annex 1.6. Mr. John Butson is a senior international expert, whoes Partnership Agreement regarding project activities has been issued under Task 7, is given at Annex 1.5. His contribution to project will start in Mr. Emre Akgun is the internal auditor as mentioned as a must at Article 27. The Partnership Agreement regarding project activities is given at Annex 1.9. 8 Mrs. Petek Egerci, junior engineer from Hacettepe University has supported the Team by collecting related documents and carrying out analysis studies. Partnership Agreement regarding project activities is given at Annex 1.7. Meetings: Meeting No: 001 / 2004 ( ): The studies on draft partnership agreement prepared by Ekodenge was discussed. The fiscal and administrative articles for the implementation of the project was negotiated, and the duty definitions were determined. Meeting No: 002 / 2005 ( ): The draft partnership agreement with KOSGEB and determination of related fundamental principles for the implementation of the project was negotiated. The personnel would represent KOSGEB during project activities was determined. Meeting No: 003 / 2005 ( ): The personnel who would represent OSTIM during project activities was determined. The articles of the partnership agreement and programming pilot studies that will be executed at OSTIM was evaluated.. Meeting No: 004 / 2005 ( ): Legal Consultancy Department of MoEF was conversed with, in order to obtain EC Directives related with EC Environmental Legislation whose translations will be covered and published by IS. It was decided to inform MoEF about the project developments. Meeting No: 005 / 2005 ( ): The duties of project parties were issued in detail. SAP rules that have to be complied were negotiated once again by discussing on the work program. The work program and assignments were finalized. Meeting No: 006 / 2005 ( ): The project was introduced to TOBB. The issues such as provision of project integration with other EU projects and hosting of the IS by KOSGEB were assessed. It was decided to make cooperation with TOBB when it is needed to get opinions from industrialists. Bilateral linking of TOBB s site being prepared by national sources about permit and license procedures for investment processes of industrialists and project web site were discussed for the announcement of the project. Meeting No: 007/ 2005 ( ): Project integration with other implemented EU projects; determination of activities which will be prepared for assisting industrialists during the EU Environmental Approximation, and when required, the assistance of TOBB to OSTIM and KOSGEB were discussed. In order to render the portal accessible and usable, it was decided to converse it with industrialists located at OSTIM. Also, giving pre-training to industrialists and testing of portal information when it is needed, were decided. Meeting No: 008 / 2005 ( ): Is the first evaluation meeting among partners (see photos at Annex 13). A general information about the project was given. The work program for the project partners was prepared. The strategies for the following October 2005 Hacettepe University 5

9 activities were developed and progress of the project was evaluated. The project manager made a project presentation to informed the partners. A file (Annex 4) including a CD, that contains information about the activities carried out since the beginning of the project and a leaflet which was printed by KOSGEB was submitted to project partners at the meeting. The content was evaluated, and it was determined that the project activities were ahead of the estimated time schedule of the work program. Besides technical matters of the project, fiscal and project management issues were discussed and submission of monthly payrolls with an official letter, within a week after preparation of payrolls to Technopark by all partners was decided. KOSGEB suggested giving preference to preparation of approximation strategy of EoLV as a sample DSIP in order to be able to explain the SMEs the EU approximation process, as soon as possible. KOSGEB suggested using television broadcast to announce the project. Particular attention was also given to the following issues and following decisions were made at the meeting: Minutes of meetings will be recorded by Ekodenge and will be delivered to project partners by . Partners meetings will be held on bimonthly and the next meeting will be held on o5.o5,2005. Announcement of meetings will be carried out not by official correspondences but by electronic mail (electronic communication list). Meeting No: 009 / 2005 ( ): Preparation of draft project web page, draft IS and the format of the project web page for determination of the software development methodology were discussed. It was decided that the components in this site, such as legislation groups and guidance information etc. would be put into IS. Also: Consultation with KOSGEB on determined sectors covered by IS and also negotiation with State Institute of Statistics on selection of sector codes were discussed. Related institutions such as TKSD, MoEF, and TOBB will be linked to web site of the project. The necessity of taking permission from TOBB and the project web site link that will be hosted on TOBB web site (after finalization of the project web site) were the other issues discussed at the meeting. Preparation of guidelines, which will be covered by web site, related with all sectors and ISO was discussed. Preparation of software development methodology by IT group and preparation of a guide document covers all interfaces (that will be used) and system properties were decided. Meeting No: 010 / 2005 ( ): IT group gave information about all topics mentioned in SRS (Annex 8) and interfaces that will be formed for IS, user properties and system structure format, and data for finalization of the project web page were discussed. IT group and project manager will hold a meeting related with web page October 2005 Hacettepe University 6

10 and then final form of the web page will be decided. SRS is decided to be discussed in detailed at the second partners meeting. Meeting No: 011 / 2005 ( ): Industrial sectors that will be covered within the scope of the project were discussed. Sectors determined within the scope of project are food, leather and textile, wood/furniture, pulp and paper, chemicals, cement and lime, metal, and machinery. It was decided to get opinion of KOSGEB about these industrial sectors. Meeting No: 012 / 2005 ( ): Industrial sectors to be covered within the scope of project was discussed and making use of NACE codes during selection of these sectors was decided. KOSGEB proposed to converse with industrialists in order to learn their requests and expectations from the project. This proposed issue was discussed and it was decided to converse with industrialists from automotive sector in the following weeks. SRS was discussed (Annex 8). For the portal that will be prepared within the scope of project, issues like getting information about KOSGEB Portal and preparing an integrated portal to KOSGEB were discussed. It was decided to hold a related meeting and determine the necessities for portal preparation and server establishment. Meeting No: 013 / 2005 ( ): The progress of project was evaluated. The necessity of delivering Inventory of TE and holding meetings with related institutions besides MoEF and TOBB were discussed. It was decided that IT group of Ekodenge would hold a meeting about project web site in order to make it linked to KOSGEB site. Studies to help industrialists in order to make them understand environmental regulations and applications of EMAS and ISO (management systems), and training of industrialists located at OSTIM with prepared instructions about EMAS and ISO were discussed. It was mentioned that during the project activities for IS regulations, within the sectoral basis, related with solid waste management, water quality, air quality, and industrial pollution control were studied. The progress regarding example web pages to be prepared for hazardous waste management in chemicals sector was assessed and decided to be finalized and presented to the partners in the next partners meeting. Meeting No: 014 / 2005 ( ): The project manager submitted a CD (Annex 5) covering a summary document of implemented activities of the project, the Inventory of TEL and a document of Environmental Directives of EU to the legal consultancy of MoIT. The ministry explained their willingness about involving and participating in the project studies. Meeting No: 015 / 2005 ( ): The project manager submitted a CD (Annex 5) covering a summary document of implemented activities of the project, the Inventory of TEL and a document of Environmental Directives of EU to the MoH, General Directorate of Basic Health Services. During this meeting the ministry expressed willingness about involving and participating in the project studies and proposed cooperation to prepare license permits (by taking into consideration the new October 2005 Hacettepe University 7

11 Municipal Law), which will be applied to industrialists within the scope of Law on Unhygienic Establishments. Studies about this issue will be started next month. Meeting No: 016 / 2005 ( ): Technopark, OSTIM and Ekodenge exchanged views about preparation, edition and delivery of booklet (Annex 6), which represents the project to industrialists and covers information about TEL and environmental management systems. Meeting No: 017 / 2005 ( ): The IT group of Ekodenge conversed with KOSGEB about IS, software necessities and project web page that will be hosted by the KOSGEB site. Publication of the project web page from the following address was decided. Meeting No: 018 / 2005 ( ): The project manager explained the progress of the project and submitted a CD covering an example web demo (Annex 7.1) for hazardous waste and waste oil management in chemicals sector to the General Directorate of Environmental Management, MoEF, and received comments. In order to evaluate the implemented activities of the project by MoEF, it was suggested to form a working group. Meeting No: 019 / 2005 ( ): Second partners meeting (see photos at Annex 13). The progress since the last partners meeting (meeting no. 008) was explained. It was decided to change the date of 3 rd Partners Meeting, which was planned to be held on July, to since 1 st Progress Report will be submitted on Prepared project web page was presented and it was indicated that the web page of the project will be hosted by KOSGEB server. A web demonstration (Annex 7.1), taking hazardous waste and waste oil management in chemicals sector as an example, was presented by Ekodenge and SRS was discussed (Annex 8). Discussions made about difficulties faced with legislation during defining the category of industrialists in accordance with Regulation on Control of Industrial Air Pollution. For the announcement of the project it was decided to make a speech to Baskent TV, which will introduce the project, as a first step. During the meeting it was indicated that the IS should enable easy access for information and would present comprehensible and fast information to industrialists. Meeting No: 020 / 2005 ( ): The meeting was held with participation of OSTIM, Ekodenge, and Technopark. Before the publishing of booklets (mentioned at meeting no. 16), which will be used for informing industrialists, final decision about format and content of booklets was given. Meeting No: 021 / 2005 ( ): The project manager conversed with legal consultancy of MoEF and explained the details of the project. At the meeting the necessity and benefit of the project (for MoEF) was explained and mentioned about a probable cooperation. It was indicated that MoEF would inform opinions by official correspondence. October 2005 Hacettepe University 8

12 Meeting No: 022 / 2005 ( ): For the announcement of the project, the television program was held within the scope of meeting. A speech to Baskent TV was made with the participation of Prof. Dr. Selcuk Gecim (Dean of Hacettepe University Engineering Faculty), Mrs. Ayse Yıldırım (OSTIM OIZ) and Dr. Zeynep Yontem (Project Manager) in order to promote the project to the industrialists. (Annex 14) Meeting No: 023 / 2005 ( ): Third evaluation meeting among project partners. This meeting was held before submission of first progress report. Due to this reason general scope of meeting was presentation of progress report to all project partners and taking their comments and suggestions on it. General information about the progress report was given at the meeting. The project manager made a presentation in order to inform partners about progress report (Annex 10.2). Besides technical matters of the project, fiscal issues were also discussed; especially VAT Exemption of goods and services to be purchased within the scope of the project was the main issue that was concentrated on during the meeting. The project partners were informed about correspondence made between Ministry of Finance (MoF) and Hacettepe University Technopark about VAT Exemption, the uncertainty regarding VAT was mentioned but also positive approach of MoF on giving Ekodenge an exemption certificate was specified by the project manager. Regarding reporting, submission dates of coming reports were discussed. It was stated that the report submission dates were written wrong by mistake. The situation was explained to the project partners and it was decided to correct this mistake by proposing an amended schedule for the report submission dates and following dates were determined for submission of the reports; for interim report, for 2 nd progress report, for 3 rd progress report and for final report. As a conclusion date of Fourth Evaluation Meeting was decided as September 8 th. Meeting No: 024 / 2005 ( ): The meeting was held with the participation of Hacettepe Technopark, Ekodenge and KOSGEB. Sustainability of the project was discussed. Meeting No: 025 / 2005 ( ): The meeting was held with the participation of representatives of KOSGEB, Hacettepe University and the project manager. Main issue of the meeting was the evaluation letter received from European Community. Opinions and recommendations delivered from evaluation letter were mentioned to KOSGEB representatives. The contribution of KOSGEB to project activities was also discussed. As it is known some of the main tasks of the project are analysis of legislation, literature survey and data collection. Literature survey and data collection regarding important sectors related with KOSGEB and analysis of legislation were determined as KOSGEB s contribution. Work sharing on above mentioned issues was determined within the scope of the meeting. As a conclusion analysis study on food & automotive sectors October 2005 Hacettepe University 9

13 and literature survey on mentioned issues will be carried out by KOSGEB. EoLV was the other issue which was concentrated on. Meeting No: 026 / 2005 ( ): Fourth evaluation meeting among project partners. Although the date of evaluation meeting was decided as September 8 th, it was postponed due to collide with an important exhibit in Istanbul (CEBIT Istanbul). Within the scope of the meeting; progress gained since the last partners meeting (meeting no.23) was explained. The main issue discussed during the meeting was the evaluation letter of 1 st Progress Report. The issues identified through evaluation letter were discussed one by one. IT group gave information about progress on information system. Meeting No: 027 / 2005 ( ): The meeting was held with the participation of MoEF, Hacettepe Technopark, Hacettepe University, Ekodenge and the representative of automotive sector (leading automotive companies such as Mercedes-Benz A.Ş., Iveco, Automotive Distributors Association and Automotive Manufacturers Association). The scope of the meeting was End of Life Vehicles directive DSIP. MoEF explained the current situation of approximation studies regarding EoLV, it was stated that a working group on EoLV was established with the participation of above mentioned automotive sector representatives and also information was given on implemented studies about EoLV by working group. Project manager stated the importance of DSIP that would be prepared within the scope of project. It was stated that preparation of approximation strategy of EoLV as a sample DSIP in order to be able to explain the SME s the EU approximation process and also stated that DSIP that would be prepared within the scope of this project would resolve the conflicts between parties. As a conclusion, decisions on project integration with other implemented studies on EoLV, preparation of DSIP, and corporation with MoEF & representatives of leading automotive representatives were taken and the date of other meeting with automotive sector was determined as October 12th. Meeting No: 028 / 2005 ( ): The meeting was held with the participation of KOSGEB, Ekodenge and Mr. Norman Sheridan who is senior international legal expert of the project. 70 EU directives relevant with SME and environment were introduced. Sustainability of the project was the main issue conversed within the framework of the project. KOSGEB suggested establishing an environmental centre for supplying the sustainability of the project. Meeting No: 029 / 2005 ( ): The meeting was held at MoEF with the participation of Ekodenge, Hacettepe University and Mr. Norman Sheridan. The project manager gave information to deputy undersecretary of MoEF about SME project. Mr. Norman Sheridan also explained the importance of the project with giving information on SME s and related practices implemented in Europe. October 2005 Hacettepe University 10

14 Meeting No: 030 / 2005 ( ): The meeting was held at Automotive Manufacturers Association in Istanbul. Information regarding DSIP preparation was given to Automotive Manufacturers Association by the project manager, also DSIP format and outline of formerly prepared DSIP examples were given through (Annex 12). Automotive Manufacturers Association made a presentation regarding EoLV draft regulation, which was prepared as a result of their studies. Within the scope of draft regulation some gaps regarding the chapter namely producer responsibility were recognized. With the draft regulation it is probable to face difficulties in establishment of a connection between automotive manufacturers and scrap dealers. Regarding this circumstance the importance and necessity of preparing a detailed situation report was stated. Mr. Kemal Kurusakız who is an environmental expert in Waste Management Department of MoEF was informed about studies and CD (Annex 12) comprising information about EoLV was given. Meeting No: 031 / 2005 ( ): The Meeting was held at HU Engineering Faculty with the participation of air quality management department of MoEF. The project was introduced and project information was given by the project manager. Information regarding implemented studies during preparation of web demo was also mentioned. The department is very content about demo regarding air quality and they want to participate in project activities. Holding meetings with sub-divisions of the air quality management department (noise prevention, pollution control etc.) of MoEF and carrying out detailed studies were decided within the scope of the meeting. Meeting No: 032 / 2005 ( ): The meeting was held at Ekodenge with IS group. 16 16/02/2005: UoT, as a reply to correspondence No. 005, informed Technopark that VAT cannot be an eligible cost within the scope of the project for purchase of equipments and services. They mentioned that a Framework Agreement covering other EU grants is under negotiation at the Grand National Assembly of Turkey and VAT exemption may be considered only after this agreement is approved. Note: Even though the Framework Agreement has been signed on 26/02/2005 and the relevant decision is issued in Official Journal No , there is no relevant circular or communiqué has been adopted yet. Therefore, it is understood that at the moment there is no possibility of refund. After a consultation with an authority from the MoF, General Directorate of Incomes, VAT Unit, it was learned that refund will be possible retrospectively from 2000 once the circular, which is draft at the moment, is adopted. 23/02/2005: KOSGEB sent the names of the experts to be allocated for the project to the Deanship of HU Engineering Faculty, and also informed that Technopark Central Manager Mr. Metin Karaçay has been assigned as coordinator. KOSGEB also stated that the Partnership Agreement should not be signed bilaterally between Technopark and each partner but by all partners. 25/02/2005, No. 010, 011, 012, 013: Technopark sent an invitation to all partners for the meeting which was going to be held on 03/03/2005 and attached a CD (Annex 4) to the invitation letter including basic information about the project, contact information of personnel charged within the project according to the Partnership Agreement, the time schedule, an introduction of the project both in English and Turkish, and Standard Administrative Provisions both in English and Turkish. 11/04/2005, No. 014: Technopark sent the decisions taken on meeting No. 008 to MoEF, General Directorate of Environmental Management, Waste Management Unit, and requested their collaboration for initiation of studies regarding preparation of Directive Specific Implementation Plan of EoLV since it has to be transposed at the beginning of /04/2005, No. 015, 016, 017, 018, and 019: Technopark sent an official letter and a CD (Annex 5) to MoEF, MoIT, the MoH, TOBB, MoLSS informed them about priorities of legislation and EU directives to be detailed in the scope of the project was given and asked for opinions and suggestions of Ministries. 05/05/2005, No. 020: Technopark sent to General Directorate of Environmental Management of MoEF, information about what had been done hitherto in the project scope involving the inventory of TEL, environmental management booklet preparation for OSTIM industrialists (Annex 6), and the web demonstration taking Hazardous Waste Management in Chemicals Sector (Annex 7.1) as a sample for the IS. It is informed that the meeting that will be held on 12/10/2005 with the representatives of related departments of MoEF will be for the purpose of monitoring mentioned web demo. Project partners were informed about evaluation results, opinions and suggestions related with progress report. 28/09/2005, No. 034: Fax to MoEF to ask an appointment with Deputy Undersecretary of MoEF in order to introduce SME s project. 19 30/09/2005: Astrale GEIE s electronic mail regarding Turkey visit for auditing. 1.3 Progress during the Reporting Period After completion of the preliminary consultations, the Partnership Agreement mentioned in Article 4 of LIFE SAP (Standard Administrative Provisions) is signed between partners, HU, Technopark, KOSGEB, OSTIM and Ekodenge (01/03/2005). The project activities regarding tasks have been started immediately. Tasks covered under the project have been started on time, First milestone, Start up-data Collection and Review of Current Legislation, has almost been reached as well. The project team was mobilized and the project was announced by KOSGEB. All current legal information about TEL and ECEL was reviewed, the list of documents to be collected in relation to TEL was prepared, and Inventory of TEL was prepared and updated with in the period covered by interim report. Studies regarding task 2, 3, 4 and 6 have been implemented as have been planned. The second milestone Collection, Selection and Preparation of Documents covering collection of all data about TEL and ECEL, which was determined to be covered by the IS in Task 1 that will be used for future tasks has been implemented by the project partners. An example web demonstration on water and air, EIA and waste sector including hazardous waste, medical waste, household waste, waste oil, packaging waste, demolition waste, was prepared within the framework of third milestone, Formatting of Data for IS Development (Annex7.2). The pilot study was implemented at OSTIM to carry out training about industrialists responsibilities on environmental legislation as part of fourth milestone, Completion of the Information System. Fifth milestone, Preparation of Approximation Strategy of End of Life Vehicles Directive (EoLV) as a sample, which was planned to be started up at January 2006, has started before its scheduled time. Meetings regarding this task were held. Regarding sixth milestone, Provision of Supplementary Information by IS, provision of supplementary information was started, during the period covered by this report studies regarding information collection has been implemented, information about EC Fund management was collected. Task 1 Start-up Data Collection and Review of Current Legislation Following studies regarding Task 1; 1.1 The establishment of the project office, launching of an electronic communication list, and a project web page for dissemination of project results. The Partnership Agreement (Annex 1.3) mentioned in Article 4 of LIFE Standard Administrative Provisions (hereafter SAP) is signed between partners, Hacettepe October 2005 Hacettepe University 16

20 University (hereafter HU), Hacettepe University Technopark Inc. (hereafter Technopark), KOSGEB Small and Medium Industry Development Organization (hereafter KOSGEB), OSTIM Organized Industrial Zone (hereafter OSTIM) and Ekodenge Environmental Engineering and Consultancy Ltd (hereafter Ekodenge) (01/03/2005). In order to carry out studies related with the project, Ekodenge rented an office (see photos at Annex 13) at Technopark and signed a Rental Contract (Annex 1.8) with Technopark valid from 01/01/2005. Studies related with the project are implemented in a existing Technopark office until the new office will be completed. Start-up meetings were held with the participation of all project partners. Fundamental principles and methods regarding the project were clarified at the meetings. Mentioned information and presented documents at meeting no 008 is given at Annex 3. An electronic communication list was launched, it was announced and it is in use since February. The web page for the dissemination of project results was prepared. At the beginning project web page was hosted on the following address; then the address was changed to its final location Preparation of a Project Introduction File and announcement of Project Introduction by KOSGEB via a leaflet and via publishing by Project introduction file and a leaflet used for project announcement and introduction were prepared (Annex 3). Information regarding the project was started to be publicized under the project web page ( which is being hosted by KOSGEB server. A link to Eurlex data base on EU legislation was provided. Translation study regarding legislation that has priority was started up. In order to obtain EU legislation that is already translated into Turkish, the official letters are sent to MoEF and the Under Secretariat for EU affairs. Unfortunately there was not any responses received. Due to this reason a link to the official versions of translated EU directives did not exist. Turkish version of web page is available and translation study for the English version of web page was started up. The leaflet and project information CD was distributed to other relevant institutions. The Legislation with priority, which would be detailed during the project, was determined according to the following issues: National Environmental Action Plan, 5 Year National Development Plan ( ), National Program for the Adoption of Acquis, Preliminary National Development Plan, An Integrated Environmental Approximation Strategy for Turkish Republic Project 1.3 Analysis of Turkish Environmental Legislation (T E L), for preparation of inventory. Studies for determining and collection of documents in relation to TEL were carried out. Inventory of TEL was prepared and presented by a CD in a file (Annex 3) to all project partners at the meeting no The CD involves English translation of the inventory. The Inventory of TEL involves legal documents, which are listed according October 2005 Hacettepe University 17

21 to OJ numbers and also covers all amendments. The status of legislation is followed up and new ones are added into this inventory and it was updated. The project was started to be publicized under the project web page ( which is being hosted by KOSGEB server. One of the main objectives of this project is to establish the Environmental Legislation Database for Turkish SMEs as an information management system in order to render the environmental information accessible by industrialists. After finalization of the project mentioned inventory and texts of legislation covered by inventory will be published through our information system. In this way access to the legislative texts via internet will be easier for industrialists. Inventory and legislation texts will be publicized under the following project web page; Related links will be provided through project web page. Also, if it is requested, a link will be provided in the web site of MoEF in order to render it accessible to Inventory. All relevant sectoral legislation, international agreements, laws, ministerial orders, regulations, communiqués, circulars were gathered and listed. We have most of the legislation, covered by inventory, existing in digital form. Some of older legislation needs to be updated, because of having former publication dates, and they also need to be checked for finding out lacking legislation. Within this framework, new and lacking legislation is gathered and transformed into digital form (Annex 15). Also, list of status of transposition of relevant EC directives is compiled. Since some communiqués were not published by Official Journal, all unpublished communiqués were taken from MoEF, Legal Consultancy Department at the meeting (Meeting no 004) held on 26/01/2005. Due to EU negotiation period, Turkey faces a rapid legal change. According to National Plan, especially transposition studies related with environmental legislation have to be finalized until the end of Therefore this task will be implemented until the finalization of the project. With the negotiations with MoIT, Legal Consultancy Department on 21/04/ 2005 (meeting no 014) and MoH on 26/01/2005 (meeting no 015) the project was introduced and project information was given to the Ministries, whoes opinions and suggestions were taken. At the negotiations mentioned Ministries stated their desires to be involved in the project. As mentioned before in the first progress report; related ministries were informed about project by sending a CD (Annex 5) involving Inventory of Turkish Environmental Legislation; European Union Environmental Acquision; List of Transposition Status of EU Directives; Turkish translation of EU Directives having priority, and their opinions and suggestions regarding the project was asked (Annex 2).
