2 2 Invitation for Tender Offers Shri Saibaba Sansthan Trust, Shirdi(hereinafter referred to as SSST) invites sealed tender offers (Technical bid and Commercial bid) from eligible, reputed Service Providers to enter into a rate contract for Supply, Installation, integration & Commissioning of 10 MBPS (1:1) Internet lease line to be provisioned at Shri Saibaba Sansthan Trust, Shirdi as per Terms and Conditions of the tender document. This link will be a backup link for Saitech Project implemented by the Sansthan for Online Services for its devotees which include generating Online Darshan Passes, Room Reservations & Other online services at the portal The portal has around visitors per day which increases to about 1 lakhs per day in the festive season. This itself implies the importance of the internet link. 2

Introduction Shri Saibaba Sansthan Trust, Shirdi, is the Governing and Administrative body of Shri Saibaba's Samadhi Temple and all others temples in these premises, and devoted towards development of Shirdi village. Shri Saibaba Sansthan Trust, Shirdi, is the authorized body to control and manage the day-to-day activities at the Shri Saibaba Samadhi Temple. It also provides various facilities like accommodation, Food (at economical rates), refreshments, and lots more. The Sansthan Trust also runs Kanya Shala (Girls School) and English Medium School, Hospital, Blood Bank, Industrial Training Institute (I. T. I.), Drinking Water supply, etc. Sansthan wants to implement the best I.T. systems to improve efficiency and effectiveness of management and increase the services to devotees with more facilitation. The scope of Saitech Project includes providing total IT & Telecomm solution with Hardware, Networking infrastructure & equipment, licenced software, printer, UPS & other equipment s. Sansthan has implemented the Saitech Project which includes ERP based 37 application modules. Sansthan provides Online Services for its devotees which include generating Online Darshan Passes, Room Reservations & Other online services at the portal The portal has around visitors per day which increases to about 1 lakhs per day in the festive season. Pre-Qualifying Document shall consist of following Photocopy of document showing ISP License No. (with date) and A/ B category ISP along with a copy of the License agreement for the provision of Internet Service issued by Government of India to be enclosed Earnest Money of Rs.11,500 in the form of Bank Draft (any nationalized bank) in favor of The Executive Officer, Shri Saibaba Sansthan Trust, Shirdi. Copy of latest Income tax returns with audited balance sheet. Name of the organizations where such projects have already been implemented. Certificates from earlier clients for successful implementation of Leased lines Internet access. Address, Contact Person, Phone, Tele Fax/ of the organization. C. TERMS AND CONDITIONS OF THE TENDER Tenderer should be a category A /B Internet Service Providers as certified by TRAI. The tenderer company must have requisite infrastructure and resources to successfully execute the order/ project and provide services in Shri Saibaba Sansthan Trust, Shirdi and should have a valid ISP license from Government of India. The individual signing the tender or other document, in connection with the tender must certify as to whether he or she has signed as A Sole proprietor of the firm or constituted attorney of such sole proprietor. A partner of the firm, if it be partnership, in which case he must have authority to refer to arbitration disputes concerning the business partnership either by virtue of the partnership agreement or a power of attorney. In the alternative all the partners should sign the tender. Constituted attorney of the firm, if it is a company. The connectivity should be on wired (OFC) network or wireless network of a licensed basic telecom service provider to the locations as specified or required. This link should be of 10 Mbps capacity with scope of further increasing it. It should be a premium uncompressed Internet leased line, to be terminated on a Ethernet port with an uptime of 99.5%. The tenderer would ensure that the local loop provisioning, if required does not violate regulations as laid by Government of India/TRAI in respect of such links/networks. All the licensing requirements for compliance with such regulations will be responsibility of the Tenderer at his own cost. ISP should bear financial RS. 5000/day for any delay in installation due to non-availability of approvals and violations if any. 5

Eligible Tenderers The bidding is open to all qualified Tenderers who fully meet the following qualifying requirements (The required documents in proof of the below eligibility should be enclosed in the pre-qualification bid) :- The ISP should have a 24x7 contact number of the respective Technical Support executive. The SSST reserves the right to carry out the capability assessment of the tenderers and the SSST s decision shall be final in this regard. E. DELIVERY PERIOD & INSTALLATION The delivery period of the said tasks should be adhered to as will be mentioned in the Award of Contract. Tenderer should quote the minimum and maximum period he will take to install the link. The supply shall actually be deemed to have been complete on the actual date of installation. F. EARNEST MONEY DEPOSIT Tenderer shall deposit Earnest money of Rs. 11,500/- in the form of Bank Draft of any nationalized bank only in favor of The Executive Officer, Shri Saibaba Sansthan Trust, Shirdi, payable at Shirdi. SSSTS will not pay any interest on the EMD amount G. SCHEDULE OF PAYMENT Bandwidth Charges: Bandwidth Charges (of 3 Months) are payable after completion of the quarterly period. The ISP will raise the bills after Completion of the period. If requested, an advance amount for the quarter may be given to the ISP if a performance bank guarantee is submitted after successful bidding. Hardware Charges: Any Hardware if required for commissioning of this link, will be provided and maintained by the Tenderer at its own cost. H. UPTIME OBLIGATIONS The Tenderer will maintain the Equipment & Services for efficient running at all times during the contract period. However, average uptime during a quarter should not be less than 99.95%.. The total uptime calculations are based on total year uptime minus downtime minutes. 6

Documents prepared by the ISP to be the Property of the SSST All plans, drawings, specifications, designs and other documents prepared by the ISP in the execution of the contract shall become and remain the property of the SSST, and before termination or expiration of this contract, the ISP shall deliver all such documents to the SSST under the contract along with the detailed inventory thereof. J. Confidentiality: The ISP or sub-contractor(s) and their personnel shall not, either during the term or after expiration of this contract, disclose any proprietary or confidential information relating to the services, contract or the SSST s business or operations without the prior written consent of the SSST. K. Force Majeure: Notwithstanding the provisions of the tender, the ISP shall not be liable for forfeiture of its performance security, liquidated damages or termination for default, if and to the extent that, its delay in performance are other failure to perform its obligations under the contract in the result of an event of Force Majeure. For purposes of this Clause, Force Majeure means an event beyond the control of the ISP and not involving the ISP and not involving the ISP s fault or negligence and not foreseeable. Such events may include, but are not restricted to, acts of the SSST either in its sovereign or contractual capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight embargoes If a Force Majeure situation arises, the ISP shall promptly notify the SSST in writing of such conditions and the cause thereof. Unless otherwise directed by the SSST in writing, the ISP shall continue to perform its obligations under the contract as far as reasonably practical, and shall seek all reasonable alternative means for performance not prevented by the Force Majeure event. The SSST may terminate this contract, by giving a written notice of minimum 30 days to the ISP, if as a result of Force Majeure, the ISP being unable to perform a material portion of the services for a period of more than 60 days. L. Responsibilities under the contract: The short-listed ISP would be responsible for the following during the period of contract: Provision of Internet Bandwidth connectivity at Shri Saibaba Sansthan Trust, Shirdi. All repairs and maintenance of the equipment installed for the provisioning of services. 7

8 8 Demonstration of the uplink and downlink from your gateway located to the department as and when required. Providing MRTG reporting of the Internet Connectivity port on the Internet. The Internet Bandwidth should be on 1:1 full duplex basis, with an uptime of 99.95%.uptime availability will be calculated on a monthly basis. The total uptime calculations based on total year uptime minutes minus downtime minutes. Penalty for downtime would be calculated at 5 times the cost price of bandwidth. M. Rejection & Return of Tender SSSTS reserves the right to reject any or part of Tender without assigning any reason. SSSTS also reserves the right at its sole discretion, not to award any order under the Tender called. SSSTS will not pay any interest on the EMD amount. If the Bidder gives wrong information in his Tender, SSSTS reserves the right to reject such bid at any stage or to cancel the Contract, if awarded, and forfeit the Earnest Money. Bids from agents without proper authentication from the manufacturers shall be treated as non-responsive. 8
