2 Introduction The goods tariff (hereinafter: tariffs) are valid for consignments transported on the basis of contracts of carriage made according to the conditions of MMV Zrt Business Regulations of Goods Traffic, within the railway network of the Hungarian Republic. The Tariffs are available at the headquarters of MMV Zrt (1035 Budapest, Kerék u. 80.) as well as its website. Tariffs include: Chapter 1: Tariff conditions Chapter 2: Additional Charges Chapter 1 Tariff Conditions MMV Zrt. determines tariffs based on the charges for the use of railway infrastructure determined in the Network Business Regulations (HÜSZ) and further costs of tasks and services relating to carriage. With regard to the fact that MMV Zrt calculates carriage charges individually, which is based on the cost of hauling of trains under given conditions, in order to receive an accurate calculation of charges it is indispensable to indicate the tasks to be performed at the stations of dispatch and destination. (It is recommended to fill in and forward the Price Quotation Form to be found on the website: 1. Classification of Goods A list of goods and their NHM number is to be found under Harmonized List of Goods (Appendix 1). 2. Weight of Goods The weight of goods is the weight determined by MMV, in lieu of which it is the weight documented in the consignment note by the consigner (declared weight). The weight of goods is to include the material, tools, cover used for packaging, the loading equipment used for safe carriage of goods, the loading tackle, container and platform not belonging to the. 3. Weight of goods for calculation of carriage charges In case the carriage charges are to be determined based on the weight of goods, the charging weight is based on the weight in the carriage document or declaration of weight given in kilograms. In case it is determined in the contract that the train is to carry a minimal amount of goods or other specified amount of goods, charging is to be based on that. 2

Application of Conditions Valid for Domestic Traffic: MMV Zrt applies conditions valid for domestic traffic in case the dispatch and destination stations of the consignment are within the railway network of the Hungarian Republic. 5. Application of Conditions Valid for International Traffic: Conditions valid for international traffic are to be applied in cases of export, import and transit traffic. 6. Train Loaded and/or empty s that cannot be divided or carried by hauling equipment. 7. Determining train charges: MMV Zrt determines train charges individually upon requests for price quotation, taking into consideration the following: 7.1. Particulars of the train: - the number of carried s, - the status of s (ownership), - the class of the s (NHM number), - the gross weight of the train - the length of the train Hauling costs: - method of hauling, (diesel, electric) - type of hauling vehicle (expected power of the engine) - parameters of the railway line (ascent and descent conditions, capacity) - hauling energy input Technical inspection, brake test Charges of railway services needed for carriage: Railway services of MÁV Zrt. - Minimum charge: - charge of providing route (Ft/train), - traffic charge, traffic charge by railway category (Ft/trainkm). 3

4 - Charge of station use: (Ft/train) - dispatch station, - interim station, - border and junction stations, - destination station. - Charge of use of destination station for freight s (Ft/). - Charge of shunting and delivery shunting on public railways (Ft/). - Charge of shunting and delivery shunting on railway company railways (Ft/). - Charge of use of catenary system (Ft/electric trainkm). - Charge of acceptance of train. MÁV Zrt. determines traffic and station use charges according to three categories of railway zones and stations; categorization of zones and station can be found in the appendix of HÜSZ Railway services of GySEV Rt. - charge of providing route (Ft/train), - traffic charge, (Ft/trainkm + Ft/tonnagekm). - charge of use of station according to the three categories of HÜSZ (Ft/stop). - shunting charge (Ft/trainhandling + Ft/delivered ). 8. Main Unit of Carriage Charge - train charge (Ft/train or EUR/train) - charge according to the total weight of goods (Ft/tonne, EUR/tonne) 9. Calculation of Carriage Charges Carriage charge given in tonne is to be determined on the basis of the charging weight. 10. Cost of MMV Zrt services MMV Zrt includes the service charges in the individually requested quotation, taking into consideration all circumstances of carriage. 11. Currency of Tariffs All tariffs have been determined in forint (HUF) and euro (EUR). Conversion of charges into the currency of payment is according to the official exchange rates issued by the Hungarian National Bank valid at the time of execution and performance of services. 4

5 12. Value Added Tax The charges do not contain VAT. 13. Authority Fees, Costs In accordance with the regulations of the effective provisions, MMV Zrt. has the right to charge the taxes and authority fees determined in those provisions to the person liable to pay. The determined taxes and other authority fees are to be rounded according to the instructions of the relevant legal regulations. 14. Control Weighing MÁV Railway has the right to check the weight of the consignment during carriage. If the allowed axleload of the railway is exceeded by 5%, control weighing charges will be imposed. MMV Zrt. has the right to impose the charges of control weighing and all costs of terminating the excess axleload to the consigner. 15. Validity The conditions of tariff are valid for all consignments unless otherwise determined by the conditions of a separate agreement. 5
