2 -:n:0/0/0:jet/mfc LRS0-0 0 SYNOPSIS: Under existing law, a person is guilty of trafficking in controlled substance analogues if he or she knowingly sells, manufactures, delivers, or brings into this state or more grams of the controlled substance. This bill would increase the requisite weight for trafficking in controlled substance analogues to grams. Under existing law, certain named chemical compounds of synthetic cannabinoid and other controlled substance analogues are included in Schedule I of the controlled substances list. Possession, distribution, and trafficking of these compounds is unlawful, and violations are subject to the existing criminal penalties for distribution and possession. This bill would include additional synthetic controlled substances and analogues to Schedule I. Amendment of the Constitution of Alabama of 0, now appearing as Section.0 of the Page
3 0 Official Recompilation of the Constitution of Alabama of 0, as amended, prohibits a general law whose purpose or effect would be to require a new or increased expenditure of local funds from becoming effective with regard to a local governmental entity without enactment by a / vote unless: it comes within one of a number of specified exceptions; it is approved by the affected entity; or the Legislature appropriates funds, or provides a local source of revenue, to the entity for the purpose. The purpose or effect of this bill would be to require a new or increased expenditure of local funds within the meaning of the amendment. However, the bill does not require approval of a local governmental entity or enactment by a / vote to become effective because it comes within one of the specified exceptions contained in the amendment. 0 A BILL TO BE ENTITLED AN ACT Relating to Schedule I controlled substances; to amend Sections A-- and 0--, Code of Alabama, to increase the requisite weight for trafficking in controlled substance analogues; to include additional synthetic Page
4 0 0 controlled substances and analogues to the Schedule I controlled substances list; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Amendment of the Constitution of Alabama of 0, now appearing as Section.0 of the Official Recompilation of the Constitution of Alabama of 0, as amended. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section. This act shall be known and may be cited as Landon's Law. Section. Sections A-- and 0--, Code of Alabama, are amended to read as follows: " A--. "Except as authorized in Chapter, Title 0: "() Any person who knowingly sells, manufactures, delivers, or brings into this state, or who is knowingly in actual or constructive possession of, in excess of one kilo or. pounds of any part of the plant of the genus Cannabis, whether growing or not, the seeds thereof, the resin extracted from any part of the plant, and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or resin including the completely defoliated mature stalks of the plant, fiber produced from the stalks, oil, or cake, or the completely sterilized samples of seeds of the plant which are incapable of germination is guilty of a felony, which felony shall be known as "trafficking in cannabis." 5 0 0 of tetrahydrocannabinols including, but not limited to, all synthetic or naturally produced samples of tetrahydrocannabinols which contain more than percent by weight of tetrahydrocannabinols and which do not contain plant material exhibiting the external morphological features of the plant cannabis. If the quantity of cannabis involved: "a. Is in excess of one kilo or. pounds, but less than 00 pounds, the person shall be sentenced to a mandatory minimum term of imprisonment of three calendar years and to pay a fine of twenty-five thousand dollars ($,000). "b. Is 00 pounds or more, but less than 00 pounds, the person shall be sentenced to a mandatory minimum term of imprisonment of five calendar years and to pay a fine of fifty thousand dollars ($0,000). Is grams or more but less than 00 grams, the person shall be sentenced to a mandatory minimum term of imprisonment of three calendar years and to pay a fine of fifty thousand dollars ($0,000). "b. Is 00 grams or more, but less than one kilo, the person shall be sentenced to a mandatory minimum term of imprisonment of five calendar years and to pay a fine of one hundred thousand dollars ($00,000). Is grams or more, but less than 00 grams, the person shall be sentenced to a mandatory minimum term of imprisonment of three calendar years and to pay a fine of fifty thousand dollars ($0,000). "b. Is 00 grams or more, but less than kilo, the person shall be sentenced to a mandatory minimum term of imprisonment of 0 calendar years and to pay a fine of one hundred thousand dollars ($00,000). "c. 15 0 0 "() The felonies of "trafficking in cannabis," "trafficking in cocaine," "trafficking in illegal drugs," "trafficking in amphetamine," "trafficking in methamphetamine," and "trafficking in synthetic controlled substance analogs substances" as defined in subdivisions () through (), above, shall be treated as Class A felonies for purposes of Title A, including sentencing under Section A--. Provided, however, that the sentence of imprisonment for a defendant with one or more prior felony convictions who violates subdivisions () through () of this section shall be the sentence provided therein, or the sentence provided under Section A--, whichever is greater. Provided further, that the fine for a defendant with one or more prior felony convictions who violates subdivisions () through () of this section shall be the fine provided therein, or the fine provided under Section A--, whichever is greater. "() Notwithstanding any provision of law to the contrary, any person who has possession of a firearm during the commission of any act proscribed by this section shall be punished by a term of imprisonment of five calendar years which shall be in addition to, and not in lieu of, the punishment otherwise provided, and a fine of twenty-five thousand dollars ($,000); the court shall not suspend the five-year additional sentence of the person or give the person a probationary sentence. " 0--. "(a) The Legislature finds the following: Page
16 0 0 "() New synthetic substances are being created which are not controlled under the provisions of existing state law but which have a potential for abuse similar to or greater than that for substances controlled under existing state law. These new synthetic substances are called "controlled substance analogs," "synthetic controlled substances or synthetic controlled substance analogues" and can be designed to produce a desired pharmacological effect and to evade the controlling statutory provisions. Controlled Synthetic controlled substance analogs substances or synthetic controlled substance analogues are being manufactured, distributed, possessed, and used as substitutes for controlled substances. "() The hazards attributable to the traffic in and use of a synthetic controlled substance analogs or synthetic controlled substance analogues are increased because their unregulated manufacture produces variations in purity and concentration. "() Many new synthetic substances are untested, and it cannot be immediately determined whether they have useful medical or chemical purposes. "() The uncontrolled importation, manufacture, distribution, possession, or use of controlled substance analogs analogues has a substantial and detrimental impact on the health and safety of the people of this state. There is a need for a speedy determination of their proper classification under existing law. It is therefore necessary to identify and classify new substances that have a potential for abuse, so that they can be controlled in the same manner as other substances controlled under existing state law.
