1 The Laws On Keeping Pigs In the 50 States Of The U.S.A And the Federal laws from Washington D.C In some States Pigs are called Hogs, in the States that use the term Hog I will use the term, Hog. Some states use the Federal law with some additions in these States I will give their additional Laws, and add refer to federal law, which in it self does not have a lot of laws on pigs making it easier for the big companies to flout them. The federal laws also cover the disposal of the pig manure. In the case of pigs being kept in boxes to feed their young and to fatten them up, some states ban it, other states are trying to bring in legislation to ban the cruel practice but are finding it hard due to the lobbying of the major companies. I will say which states still practice it and which one don t. I will also add any laws on keeping pigs as pets if they apply. All the information has been gathered from : U.S.A.GOV 50states.com globalcomputing.com ALABAMA : Alabama has no specific laws governing the keeping of Hogs, the only law they have is about breeding hogs to fight dogs and allowing hogs to fight dogs. If a person is caught doing this they have the hogs and dogs taken of them. There is no laws governing the keeping of pigs as pets ALASKA : Has no laws of its own and purely follows the Federal Laws governing the keeping of pigs. There is also no laws governing the keeping of pigs as pets ARIZONA : There is no laws in place for keeping hogs in place, you don t need a licence and again they just follow federal laws on the welfare of Hogs, you will see from the federal laws that there is not a lot to go with. They also have organised pig and dog fights which the whole family go to, the dog is the winner when it bites the Hogs face off or the Hog wins if it gores the dog on its tusks. There is no laws governing the keeping of pigs as pets. ARKANSAS : Has no laws in place for keeping Hogs, the only law they have is.if one of your Hogs break a fence and go onto some ones property you have to pay them recompense if it happens a second time you have to pay double and should it happen a third time the owner of the land has the right to shoot the animal. There is no laws governing the keeping of pigs as pets. CALIFORNIA : Has not got any laws in place for keeping hogs, but you must have a licence if you intend to bring in any Hogs from outside the state. They are also in the process of passing a law to ban crate farming,this is where the sow is in a crate and has no room to move just enough to feed her young, the male is kept in the crate so it does not use up any energy, therefore it fattens faster. If you have a pet pig you cannot take it in and out of the state, to stop the spread of swine cholera.
2 COLORADO : Has No specific laws on keeping hogs, but they have rules on the disposal of slurry, which is causing a major pollution problem, and is seeping into some of the rivers. They require hog farmers to monitor water wells and conduct soil testing to make sure no contamination is occurring. They are also cover lagoons of waste to minimize the severe odour and if there is a spillage they have to pay for the clean up, not the tax payers. This is because most of the pig farms as with the rest of the USA is corporate pig farmers who have massive barns producing a enormous amount of slurry, there are very little small time pig farmers in North America, it is mostly huge corporations that run the pig industry. You do not need any permission to keep a pig as a pet. CONNECTICUT : You have to pay for an inspector to examine your premises $15 to see if they are suitable and you have to have a livestock licence $190 which is renewable every year. No checks are carried out after the initial examination. You also have to dispose of the slurry, so it does not cause any contamination. There is no regulations on keeping a pig as a pet. DELAWARE : You have to require a permit the cost of depends on how many Hogs you will have. You are not allowed to feed your Hogs raw garbage and all of the Hogs must have a tattoo in their ear to show where they came from, if they don t have a tattoo they will not be allowed to be taken to the slaughterhouse. You need to have a permit for any pet pig. FLORIDA : You need a permit to run a Hog Farm, you also need a permit to feed food waste to the hogs, the food waste has to be cooked before it is fed to the hogs, you also need a permit to transport the hogs. If the hogs are for your own consumption you do not have to cook the food waste. You need a permit for a pet pig. GEORGIA : You have to have a permit to the more Hogs you keep will depend on the type of permit you need, if you have under 300 you do not need a permit. You also have to follow strict waste guidelines where the lagoons storing the slurry should be a certain distance apart and well away from any habitation, also the waste must be checked to make sure it is not entering any streams or rivers, the rules on welfare of the hogs is the same as the rest of the states who all use government rules.(the reason for this will be plain to see when you read the federal law from Washington)You need a permit for a pet pig HAWAII : You don t need any permits to farm pigs, but the major problem with hog farming is feral pigs getting in to the fields with the farmed pigs and breeding and passing on diseases. The other problem with farming pigs is that many houses in Hawaii have covenant with them where the owner can veto any neighbours from having any kind of livestock. you do not need any permit to have a pet pig. IDAHO : You do not need a permit unless you have over a 1000 Hogs, due to water rights, as the water is shared by many different farms and industries. The welfare laws are
3 the same as the Federal laws. There is believed to be 33,000 hogs on 100 farms in the state. You do not need a permit to have a pig as a pet. ILLINOIS : You do not have to pay for a permit but you must register your premises in case of any outbreak of animal disease. You are not allowed by law to feed the hogs food waste even if it is re-cooked. You must have planning permission for all slurry lagoons which will be tested to see if they leak, the more hogs you have the further back from any water is set down in law and you should seek advice before putting any hogs on the land. The state of Illinois uses the federal laws for Hogs and allow crates. You need a permit for any pig which is foreign i.e. a Vietnamese Pot Belly Pig. INDIANA : Follows the federal laws for Hog Farming, they do not even protect hogs from animal fighting in their State laws, they protect cockerels, dogs, bears but not hogs. You do not need a licence to keep a pet pig. IOWA : Follows the Federal laws For pigs, and have not added of there own even though they have numerous laws for cows, sheep and chickens they have added none for pigs this is a general theme with the states. KANSAS : Uses the Federal laws, as the federal laws suit them for pigs just like most states. You have to have medical certificate to keep a pet pig. KENTUCKY : The feeding of garbage is illegal, and the rest of their laws are the same as the Federal laws, You must have a permit if you wanted to keep a pet pig LOUISIANA : There are no extra laws apart from the federal ones, you do not need to make new ones, as far as I can see it is the same as the other States as it is easier to follow their laws than to make their own laws. MAINE : They don t have any extra laws they just use federal law. There is no special law fow keeping a pg as a pet. MARYLAND : They use federal laws on the farming of pigs, they have laws on pollution for pig slurry. Most of the state use Federal law this will be come apparent when you read the federal laws and why most states just stick with them. There is no special laws needed for keeping pets. MASSACHUSETTS : Has laws covering the disposal of pig slurry it must be done in an environmental way if not the owner can be fined. They use the federal laws for the animal welfare. They have the strictest wildlife licence for pets. You can have a pet as a pig as long as it is an exotic breed and it is neutered you can not keep local Hogs or Boars as pets. MICHIGAN : They have no special laws and have recently uplifted a ban on importing hogs, due to a lot of hogs escaping from captivity local landowners are allowed to shoot them if they are on their land. Anti pollution laws are used to make sure hogs are not kept too near water. You can have a pig as a pet without a licence. MINNESOTA : They have a ban against Cooperate pig farming due to the high scale of pig waste that was seeping into the water system. You must have a permit to pig
4 farm and they follow the Federal Humane laws. You do not need a specal permit to keep a pig as a pet. MISSISSIPPI : There is no special permits or laws on keeping hogs, the majority of hogs are bred in crates, they use federal laws for the wellbeing of the animals. You don t need a permit to keep a pig as a pet MISSOURI ; You do not need any permits for the keeping of Hogs, they follow the Federal law. You also don t need a permit too keep a pig as a pet. MONTANA : The state follows the Federal laws on keeping hogs, but you must dispose of the slurry in an ethical way. You need a special Licence to keep a pig as a pet. NEBRASKA : If you intend to keep over a 1000 hogs you need a permit. You must also make sure that all slurry lagoons are covered to keep the smell down. You do not need a permit to keep a pig as a pet. NEVADA : You need a licence to keep hogs the more hogs you keep the higher the price, there is very few independent hog farmers most of the farms are run on a big scale by big companies who use crates for the pigs the welfare laws are the same as the Federal Laws. You have to hold a permit to have a pig as a pet. NEW HAMPSHIRE : You have to apply for a permit to farm hogs and they must be kept away from running water. The slurry lagoons must be a certain distance apart and will be checked on a regular basis to show that they conform with environmental laws. The hogs welfare laws are the same as the federal laws. You need a permit to keep a pig as a pet. NEW JERSEY : You must obtain a permit to farm pigs. you must have the barns well separated and away from any built up areas and you must have adequate lagoons. Again there is no laws for the welfare of the hogs, they just follow federal law. You need a permit to have a pig as a pet. NEW MEXICO ; You do not need any permits to farm hogs, the laws for the welfare of the hogs are just the federal ones. You don t need a permit to keep a pig as a pet NEW YORK : If you keep over a 1000 Hogs you must have a special licence and you will be accountable for any damage, the way big companies get around this is by having barns of less than a 1000 in different fields. The welfare and transportation laws are the same as the federal laws. You have to have a permit to keep a pig as a pet. NORTH CAROLINA : You do not need any kind of permit to keep hogs and the welfare and transportation laws are governed by Federal law. You must have a permit to keep a pig as a pet. NORTH DAKOTA : You do not need any licence and there is no specific laws covering the keeping of hogs except for the Federal Law.ypu do not need a permit to keep a pig as a pet, OHIO : You do not need any special permit to keep hogs and the welfare and transportation laws are just the federal laws. No permit is needed to keep a pig as a pet.
5 OKLAHOMA : There is no laws on keeping hogs but you must follow environmental laws when disposing of the slurry, it can not be dumped anywhere that it can seep into the water system.again Federal laws cover the well being and the transportation of the hogs. You need to have an exotic animal licence. OREGON : There is no special laws on keeping hogs, just the Federal laws on welfare and transport. You don t need a permit to have a pig as a pet. PENNSYLVANIA : You need a permit to keep hogs and you are responsible for any leakage or spillage of slurry and you must pay for the damage, You need a permit to keep a pig as a pet. RHODE ISLAND : You must have a permit to keep hogs and you must have all their ears tattooed with numbers to show where they came from, the welfare and transportation are covered by Federal Law. You need a special permit to keep a pig as a pet. SOUTH CAROLINA : You do not need any permit to keep hogs and the laws on welfare and transportation are covered by Federal Law. You don t need a permit to have a pet pig. SOUTH DAKOTA : There is no laws on keeping hogs except for the laws on welfare and transportation which are covered by Federal Law, You do not need a special permit to keep a pig as a pet. TENNESSEE : There is no special laws on keeping hogs, except for the federal laws for the welfare and transportation of hogs, you need a permit to keep a pig as a pet. TEXAS : You have to have a permit for keeping hogs and make sure you dispose of the slurry, you cannot feed them left over food scraps again the welfare and transportation Laws are covered by Federal law, You need a permit to keep a pig as a pet. UTAH ; There is no laws on keeping hogs just the Federal laws on welfare and transportation. You need a permit to keep a pet pig VERMONT : There is no state laws on keeping hogs, they follow the Federal government Federal Laws on welfare and transportation. You must have a permit to keep a pet pig. VIRGINIA : you must have a permit to keep hogs you also have to build your barns well away from running water and you cannot allow the hogs to drink from it. You must supply them with drinking water that does not seep into any rivers or streams. You must make sure that the slurry is taken care of. The welfare and the transportation are covered by federal law. You must have a permit for a pig if you are keeping it as a pet and you must make sure it does not come in to contact with ant farmed hogs. WASHINGTON : You must have a licence and you are responsible by law to have you re her checked for disease every year you must also not let the herd mix with wild Boar known as European boars or Razorbbacks, welfare and transportation are covered ay Federal Law, you are also responsible for the disposal of slurry, You need a permit to have a pig as a pet
6 WEST VIRGINIA : There is no state laws governing hogs, only ones on pollution you are responsible for the disposal of the slurry and illegal activity can result in a big fine or even Jail. The welfare and transportation are covered by Federal law. You must have a permit to have a pig as a pet WISCONSIN : You do not need any state permits the only state laws cover the disposal of slurry, which is the sole responsibility of the owner. Welfare and Transportation are covered by Federal Law. You must have a permit to keep a pig as a pet. WYOMING : There is no state laws on keeping hogs and the welfare and transport is covered by Federal law ON THE NEXT PAGE IS THE FEDERAL LAWS FROM WASHINGTON THE DISTRICT OF COLUMBIA
7 WASHINGTON THE DISTRICT OF COLUMBIA FEDERAL LAW The laws on pig faming are very vague, when the government past animal welfare and transportation bills they did not include pigs, nobody knows why. It means that pigs can be kept in a truck without the truck stopping and letting them out to exercise, sometimes this is up to 2 days, they are crammed in with no space to move and end up getting covered in excrement a lot of the pigs arrive at the slaughterhouse with broken legs and in a lot of distress.they do not get a big enough charge to render them helpless so they feel it when their throats are cut they are left for 5 mins before they are dropped into a steaming vat of hot water, some on lookers have commented that they have seen pigs trying to get out. Also the government didn t ban gestation crates where the pigs are kept and just grow fat and the sows feed their young from them, the practice is banned in the E.U. Some states are trying to change the law so is the humane society as you can see from the clipping. No new animal welfare laws in USA 11 May 2007 US Congress members showed an inclination towards pig and cattle growers this week, at a hearing in the process towards the 2007 farm bill. Efforts by animal rights campaigners to include enhanced livestock care standards in the bill thus were frustrated. Chairman of the House subcommittee on livestock, dairy and poultry, Leonard Boswell, said that it was 'evident that livestock producers are vigorously addressing animal welfare issues'. Representatives Prior to that, several producer representatives had urged the House Agriculture Committee not to include specific animal welfare regulations in the bill. For the pig industry, the National Pork Producers Council (NPPC) had already emphasised the fact that it is the pig producers themselves who know what is best for their animals. The Humane Society of the US (HSUS) had called for legislation that would ban pork produced with intensive confinement of pigs - and similar laws for other 'inhumane' industrial practices.
