1 WESTbus GmbH and Blaguss Reisen GmbH fares, Standard Business Terms and access conditions pursuant to Regulation (EU) No 181/2011 applicable to the WESTBUS product (Valid from 01/12/ Last amended on 03/05/2016) The male form of personal pronouns has been used for purposes of better readability. These terms and conditions apply to both women and men in equal measure. I. Preamble In conjunction with its two owners, BLAGUSS Reisen GmbH (concession holder) and Rail Holding AG, WESTbus GmbH (WESTbus) is establishing a new long-distance public transit network. II. All fares indicated below are applicable per person, apply to one single trip in one direction and reflect applicable VAT. Picture identification is required at the bus when purchasing a child or senior ticket. A. Scheduled service/routes 1. The route Vienna Bratislava, Vienna Budapest, Vienna Prague, Vienna Trieste (via Graz),Vienna Venice, Vienna Zagreb, Vienna Berlin, Vienna Munich, Vienna Frankfurt (via Regensburg, Nürnberg and Würzburg) are operated with our partner FlixbusMobility GmbH. The route Klagenfurt Ljubljana is operated with our partner AlpeAdria Line. When making an online reservation, you will be re-directed to our partners` website. 4 C. Reduced fares 1. WESTbus - Sparstraße 1. General terms A "non-cancellable" promotional fare is applicable to all WESTbus routes and combo tickets with WESTbahn on selected routes and reservation dates. 2. Allocations None 3. Sales Sales in the online shop at and at the WESTbus partner sales outlets. 4. Applicability period Travel period: from 01/01/2016, may be purchased starting 01/12/ Bus routes This promotion applies to the routes Vienna-Klagenfurt, Linz-Graz, Linz-Prague and partial or transfer travel along these routes; also applies to the combo-lines with WESTbahn and WESTbus to Graz and Prague. 6. 5 2. Active Ticket 1. General terms Persons from the age of 60 travel for between Monday and Thursday on the routes indicated below. A photo ID must be presented upon ticket check. 2. Allocations None 3. Sales Sales in the online shop at at our partner sales outlets and directly in the bus. 4. Applicability period This promotion applies until further notice. 5. Bus routes This offer applies to the routes Vienna - Klagenfurt, Linz - Graz, Linz - Prague as well as transfer connections on these routes. 6. Price The price for a one-way ticket is Seat reservation A seat is automatically guaranteed when buying tickets on-line or at one of our partner sales outlets. Travel is not guaranteed when purchasing a ticket directly on the bus. 8. Partners No partners 9. Cancellation and reimbursement On-line purchases may be cancelled up to 12 hours prior to departure at no charge at The ticket price will be refunded. The cancellation fee is 100% of the ticket price after this period. The same periods apply to tickets purchased at one of our partner sales outlets - Cancellation is only possible via the respective sales outlet. 3. Combo Ticket WESTbus - WESTbahn 1. General terms The combo ticket entitles the holder to one trip with WESTbahn and WESTbus on selected routes at reduced prices. 2. Allocations None 3. Sales Sales in the on-line shop at and at the WESTbus partner sales outlets. 4. Applicability period This promotion applies from 24/08/2015 until further notice. The ticket is routespecific for the bus portion. The WESTbahn ticket may be used on the same day, at any departure time. A print-out of the ticket must be presented to a WESTsteward and will be collected by the steward for purposes of documentation. The WESTbahn standard business terms apply for travel with WESTbahn and may be viewed at 5. Price Prices are indicated per person for one-way travel: Amstetten Graz, Salzburg Graz, Attnang-Puchheim Graz, Wels Graz: Amstetten Prague, Attnang-Puchheim Prague, Wels Prague: St. Pölten Prague, Salzburg Prague: Combo tickets of the Sparstraße are available form 12,-. 7. Seat reservation Automatic seat reservation at WESTbus. Seat reservations are possible for the WESTbahn for an extra charge at 8. Partners WESTbahn 9. Tickets of the Sparstraße cannot be cancelled or rebooked. D. Other products 1. Vouchers: Vouchers will no longer be offered from 15/07/2014 and may no longer be redeemed online. The price of vouchers that have already been purchased may be refunded in our customer care centre at westbus@blaguss.com.

7 III. Standard Business Terms A. Ticket sales, Data protection Sales channels are shown in the route description. A print-out of the ticket or an image of the ticket on a smart phone/tablet (applies to WESTbus routes) must be shown upon ticket check. A print-out of the ticket can not be wrinkled or folded where the bar code is located. When purchasing a ticket online, personal data related to the order is processed in accordance with the provisions of the Data Protection Act, as amended. WESTbus may engage third parties to conduct data processing services. In particular, customer data may be transmitted to third parties for use for purposes of processing an order, conducting payment transactions and collecting outstanding amounts. Available payment methods are indicated online in the ticket sales system. In the case of abuse, false information, insufficient funds or a blocked credit card, WESTbus reserves the right to preclude a passenger from making an online purchase. B. Carriage, Ticket validity 1. Carriage: The general terms of carriage for bus and coach transport (available at Regulation (EU) No 181/2011 (available at as well as the terms of carriage and standard business terms of the respective carrier - as indicated under Point A "Scheduled service/routes" apply. We expressly note that carriage on lines 7-14 (see Point II A) is provided pursuant to the terms of carriage and standard business terms of the respective carrier; these may vary from the WESTbus terms of carriage and standard business terms. You can find these on the homepage of the respective carrier. Please note that an absolute prohibition on smoking and alcohol is enforced on all WESTbus buses and those of our partners. 2. Unaccompanied children under the age of 7 can only travel if accompanied by an adult. /adolescents aged 7 to 15 can travel either accompanied by an adult or with express written permission including the name, address and telephone number of the parent or guardian stating that they consent to the respective trip. This confirmation must be attached to a copy of the passport of the legal representative of the minor.

8 Adolescents between the ages of 15. and18 require only a written declaration of permission from a parent or guardian. In other countries, the laws of the destination country for the protection of children apply. Detailed information on this topic can be obtained from the embassy or consulate of the respective country. 3. Carriage of animals The transporting of pets is not permitted. Guide dogs and companion dogs accompanying a handicapped passenger as well as small pets up to a maximum of 5 kg are exempt. These must be kept in suitable transport boxes, on the lap or stowed in the foot space under the passenger s own seat. The same rule as for the free hand bag allowance applies. We expressly note that the carriage of animals on our partner lines (see Point II A) is governed by the terms of carriage and standard business terms of the respective partner, which may vary from the WESTbus standard business terms. They can be found on the homepage of the respective partner company. 4. Luggage Carry-on luggage: Carry-on luggage includes every object that the passenger may stow above or below the seat, carry on his or her lap or hold in the hand without impeding, bothering or endangering other passengers (e.g. purses, laptops). One carry-on item is permitted per person. Carry-ons are transported at the passenger's own risk. If a coach is especially full, carry-ons may also be stowed in the luggage compartment. Luggage: Luggage includes every piece of luggage beyond carry-on luggage. A maximum of 2 pieces of luggage (max. 85 x 65 x 45 cm; max. weight: 25 kg) is permitted per person. A fee of 2.00 is imposed for the second piece of luggage. Other luggage/bulky items: Surf boards, skis, bicycles, including foldable bicycles, fragile or valuable items, music instruments etc. may not be transported. In exceptional cases and on a space available basis, the bus driver may decide prior to departure to transport bulky items. However, transport cannot be guaranteed. If foldable, baby carriages may be transported as luggage. We expressly note that the carriage of baggage our partner lines (see Point II A) is governed by the terms of carriage and standard business terms of the respective partner, which may vary from the WESTbus standard business terms. They can be found on the homepage of the respective partner company. 5. Ticket validity Tickets purchased via and our partner sales outlets are valid until the reserved time of departure; they lapse thereafter. Tickets are only valid for the route indicated on the ticket.

9 C. Refund, Cancellation, Changes 1. Refund Passengers who miss their departure are not entitled to a refund of the ticket price. Refunds of ticket prices are possible within 14 days of the expiration of a ticket's validity date if it was not possible to travel with luggage on a travel leg for which the ticket was redeemed or as provided in Point D (1b) (overbooking and cancellation). The ticket price is refunded within 14 days after submission of a written refund request. In circumstances covered by Point D (2), the ticket price is refunded in full for parts of the trip not provided as well as for parts of the already provided if the trip was futile. Documentation of futility of the trip must be attached to the request for refund. Holders of annual network cards will receive a refund of a fixed amount of for the entire trip. Passengers consent in principle to refunds in the form of a voucher. If desired, cash refunds may be provided as well. 2. Cancellation On-line reservations at standard fares Individual standard fare tickets purchased on-line at may be cancelled up to 24 hours before departure (for ticket purchases by 30/11/2015) and up to 12 hours prior to departure (for ticket sales from 01/12/2015) for no charge at The ticket price will be refunded. The cancellation fee is 100% of the ticket price after this period. Partner sales outlets Changes and cancellations for tickets purchased via our partner sales outlets may be made up to 24 hours before departure (for ticket purchases by 30/11/2015) and up to 12 hours prior to departure (for ticket sales from 01/12/2015) for no charge at the respective sales outlet. On-line reservations using a promotional code Promotional tickets with time restrictions and that have been redeemed using a promotional code may not be cancelled. Sparstraße Sparstraße tickets may not be cancelled. Partner lines: The terms of the respective carrier apply to refunds, cancellations and changes on our partner Lines (see Point II A). 1. Ticket changes WESTbus tickets may not be changed.

10 D. Passenger rights in the case of cancellation or delay 1. Overbooking or cancellation The passenger has the options described below in the case of overbooking or if the carrier must reasonably presume that the departure of scheduled service from a bus station / bus stop will be cancelled or is delayed by more the 120 minutes: a. Continuation of travel or travel via a different route to the destination as soon as possible on comparable terms as those set out in the contract of carriage. b. Refund of the ticket price and, if applicable, return travel to the place of departure free of charge as provided in the contract of carriage. 2. Breakdowns If a bus breaks down during a trip, the carrier must provide the passenger either a. continued travel with a different bus to the destination, b. transportation to a waiting point or bus station where he can wait for a next available busto continue hisjourney. 3. Exceptions Point E only applies to passengers who have made a reservation for the bus. E. Assistance 1. In the case of accidents In the case of accidents in which itself is involved, WESTbus will provide reasonable and practical assistance in the form of accommodations, food and drink, transportation and the performance of first aid. In no case does providing assistance constitute an acknowledgement of liability. Lodging for passengers is limited to per night and for a maximum of two nights. 2. In the case of cancellations or delays in departure Assistance in the case of cancellations or delays in departure are based on Art. 21 in conjunction with Art. 23 (2) Regulation (EU) No 181/2011. Lodging for passengers is limited to per night and for a maximum of two nights. F. Liability Liability on the part of WESTbus is governed by the terms of the Railway and Motor Car Liability Act, as amended, the general terms of carriage for bus and coach transport and Regulation (EU) No 181/2011. In the case of death or bodily injury, liability is limited to 220, per passenger; liability is limited to 1, per piece of luggage in the event of damage or loss. WESTbus assumes no liability for on-time arrival or the ability to reach connecting travel opportunities if applicable. A refund of the ticket price in the event of late arrival or the failure to reach connecting travel opportunities is expressly excluded. This does not apply to combo tickets or transfer lines offered by WESTbus.

11 G. Jurisdiction, Choice of law The exclusive place of jurisdiction for all disputes related to carriage is the court in Vienna with subjectmatter jurisdiction. The parties are deemed to have agreed to the application of Austrian law. 12 IV. Access conditions for the transportation disabled persons or persons with reduced mobility WESTbus and its partner carriers endeavour at all times to offer discrimination-free access for all customers to the means of carriage. Regulation (EU) No 181/2011, in particular the provisions regarding assistance, has been implemented by WESTbus and its partner carriers in order to enable customers with reduced mobility to travel by bus. However, we must note that the construction of buses only permits the transportation of wheelchairs to a limited extent (Art. 10 (1) alt. b Regulation (EU) No 181/2011). Barrier-free buses: Buses on the following routes are accessible for persons with a disability or reduced mobility and, in each case, offer space for one wheelchair for persons with reduced mobility: Vienna Klagenfurt (via St. Michael) Klagenfurt - Vienna (via St. Michael) Linz Graz (with the exception of Sunday departures at 2:05pm) Graz - Linz (with the exception of Sunday departures at 6:05pm) Reserving a wheelchair space: Persons with reduced mobility require a valid ticket for travel. A reservation for a wheelchair space may be made at no charge via our customer care centre at westbus@blaguss.com. Transportation is not guaranteed without a seat reservation. Accompanying persons: The disabled person's disability identification document must include the comment "The holder of this identification document requires an accompanying person". The accompanying person travels free of charge in such cases. This ticket may be obtained from our customer care centre or directly on the bus (depending on availability). Proof of authorization must be voluntarily shown to the bus driver on the bus.
