2 1.INTRODUCTION 1-1. Purpose. This Encrypted (NDVD) management guide gives operating procedures for the Navy Entertainment Movie Program NDVD format, the cognizant manager of which is Navy Motion Picture Service (NMPS) Navy Motion Picture Service. Navy Motion Picture Service (NMPS) (N923A) is part of the Fleet and Family Readiness (FFR) branch of the Commander, Naval Installations Command (CNIC), and is the designated authority for operation of the Navy Entertainment Movie Program (NAVEMPROG). NMPS has been serving the fleet since 1928 and currently supplies motion picture entertainment on encrypted DVD s (NDVD s) to commands afloat and ashore worldwide Navy Entertainment Movie Program. The local program manager is responsible for the successful operation of this popular, high profile entertainment program and is an integral part of the Navy s effort to maintain and improve the morale of military personnel and their families around the world The operative Navy instruction governing this program is CNICINST , Chapter 14 titled Navy Motion Picture Service and any other guidance provided by N923A. You should be familiar with its contents and requirements and maintain a copy either in your turnover folder and your command's Moral Welfare and Recreation (MWR) or administrative files. Copies of the instruction may be obtained from NMPS or from the MWR website at Questions about this program should be directed to NMPS and the NDVD Program Manager listed in section CONTRACTUAL AND COPYRIGHT REGULATIONS 2-1. All movies distributed by NMPS are protected under U.S. Copyright Law and SECNAVINST They may not be duplicated, edited or loaned out for private use. Use of NMPS NDVD s in quarters on a standalone player is "private use" and is not authorized Movies obtained from retail outlets and/or electronic means via internet access grant licenses for private use only. Those movies are restricted to in-quarters use and must not be shown publicly. Exhibition or shipboard broadcast via SITE-TV of movies 2

3 in any format other than in formats issued by NMPS is prohibited Neither the U.S. Government nor the Department of the Navy owns any of the programming distributed by NMPS. The movies are leased from their respective copyright owners, usually movie studios. These licensing agreements are formal contracts, which give the Navy certain narrowly defined rights to distribute and exhibit such programming in carefully specified locations, to specific groups of individuals, and for public exhibition only NMPS is the sole authorized source of entertainment movies shown on SITE-TV, CASI or in public settings where eligible patrons gather to watch. Aboard ship, no movies other than those provided by NMPS or Armed Forces Radio & Television Service (AFRTS) will be shown on SITE-CCTV or CASI systems. At shore installations only NMPS movies may be shown at any public setting such as Base Theaters, Liberty, Recreation, Community, Child and Youth, and Teen centers All personnel eligible to use MWR facilities are authorized to watch NMPS movies NMPS movies may be exhibited at any time. There are no conflicts with local TV broadcast programming. Only NMPS provided movies may be exhibited. Rented or purchased movies are not authorized and may NOT be exhibited Violations of federal copyright regulations and/or contracts between the Navy and the movie studios may jeopardize the entire NAVEMPROG and result in civil, criminal, and/or Uniform Code of Military Justice (UCMJ) penalties Charging admission for NDVD exhibitions, ashore or afloat, is prohibited. Sale of food and beverage at these movie showings is authorized as long as it is not a requirement for viewing. 3. ESTABLISHING AND DIS-ESTABLISHING MOVIE SERVICE 3-1. Establishing Service. A written request to establish or restore motion picture service must be submitted, through command channels, to NMPS at least 60 days in advance of the desired starting date and include the following information: - Ship name and hull # (Afloat) Facility and base name (Ashore) - Shipping address 3

4 - UIC Number - Point of Contact. (POC assigned responsibility for the movies) - Commercial and DSN phone and fax numbers - address of POC To obtain NDVD players, afloat commands should contact Afloat Media Services (AMS). Shore locations should contact NMPS. Contact information for AMS and NMPS is located in Section Disestablishing Service: Requests to discontinue movie support should be processed through command channels and NMPS at least 90 days in advance of the closure date Afloat units should contact AMS to determine what to do with onboard NDVD players For shore locations discontinuing service, all NDVD players provided by NMPS must be returned via insured traceable means at least 60 days prior to closure. Accounts will not be closed until all NDVD players are received United States Navy and Medical Sealift Command ships should contact the nearest AMS location to schedule removal of NDVD players installed in SITE-TV For United States Coast Guard and National Oceanic and Atmospheric Administration commands, all NDVD players provided by NMPS must be returned via insured traceable means at least 60 days prior to closure Purchased players may be reassigned to other locations within the owning service branch but can only be used in a location approved by both the service headquarters and NMPS Suspending Service: To suspend NDVD service for any reason contact NMPS at least 60 days in advance. This will allow sufficient time for in route shipments to arrive and for us to adjust our shipping schedule. NMPS will hold your monthly shipments until notified that you are ready to receive them It is best to remove your NDVD movie library and store it in a secure location. Do not return the NDVD movies to NMPS. NDVD players provided by NMPS must be secured in a locked and guarded location separate from the NDVD movies or returned to NMPS. NMPS 4

5 will hold the players for you and restore them upon notification of overhaul completion. Contact NMPS to discuss. 4. MOVIE DISTRIBUTION 4-1. Negotiation and procurement of motion pictures is the function of NMPS, and NMPS is the sole authorized source for programming shown aboard ships. Procurement of movies from any other source is prohibited. Only NMPS personnel are authorized to contact the movie distribution companies. Contact NMPS if you have questions NMPS gains access to movies about 1-2 months before films are available to the general public through retail outlets and/or electronic media, although this can vary earlier or later, depending on the movie studio's marketing and release strategies. The products of all film companies are available to NMPS and the best of these are selected. Movies are shipped monthly as they become available Movies are licensed for a term of 4 years. All movies provided by NMPS are encrypted and will play only on an encrypted NDVD player. Each disc is marked with an expiration date. After the expiration date, the disc can be destroyed and discarded. Please do not return expired discs to NMPS Movies are shipped monthly, 16 in a box, to accounts in good standing. Commands should receive one box each month. Contact NMPS if a shipment does not arrive. To see a list of what movies are scheduled or have been shipped, please use the NMPS website Upon receipt of a shipment, verify that the address NMPS is using is accurate and that each DVD listed on the enclosed packing slip is actually in the box. Notify NMPS of any discrepancies. If NDVD s are damaged or missing we will replace them upon request Fill out the packing slip with the info requested and a copy to NMPS. We use this info to update our database, confirm your receipt and quickly resolve problems when they occur. Keep the original in your turnover folder as a record of receipt. 5

6 5. NAVY MOTION PICTURE SERVICE MOVIE SELECTION CRITERIA 5-1. Movies are chosen based on their overall entertainment value to our primary audience, the adult men and women of the fleet All films rated by the Classification and Rating Administration (CARA) of the Motion Picture Association of America (MPAA) are eligible for consideration and release by NMPS NMPS does not censor movies. All movies are procured in the original uncut and complete theatrical versions. We do not lease edited-for-television or airline programming Commands may choose not to show a specific movie, but may not delete or edit any part of a movie chosen for exhibition. If a movie is deemed to be potentially controversial, NMPS recommends having the commanding officer preview the film before exhibition. 6. THE MOTION PICTURE ASSOCIATION OF AMERICA AUDIENCE SUITABILITY MOVIE RATINGS SYSTEM 6-1. The movie ratings system is a voluntary system, established on 1 November 1968, sponsored by the Motion Picture Association of America (MPAA) and the National Association of Theater Owners, to provide parents with advance information on films and enable them to make judgments on movies they want to see. The ratings do not indicate if a movie is "good" or "bad". The system is not intended to approve, disapprove or censor any film; it merely assigns a rating for guidance, leaving the decision-making to you A specially designed committee of parents, called the Film Rating Board of the Classification and Rating Administration (CARA), assigns the ratings. As a group they view each film, and after discussion and vote, they make an educated estimate as to which rating American parents would consider most appropriate for that film. NMPS strongly encourages adherence to the CARA ratings system and local review of each movie for suitability The current MPAA movie ratings are as follows: a. G: All Ages Permitted. Signifies that the film contains nothing most parents will consider offensive for even their youngest children to see or hear. Nudity, sex scenes, and scenes of drug use are absent; violence is minimal; snippets of dialogue 6

7 may go beyond polite conversation but do not go beyond common every-day expressions. b. PG: Parental Guidance Suggested. Some Material May Not Be Suitable For Children. Signifies that the film may contain some material parents might not like their young children exposed to. Materials that will clearly need to be examined before children are allowed to attend. Explicit sex and drug use scenes are absent; nudity, if present, is seen only briefly; horror and violence do not exceed moderate levels. c. PG-13: Parents Strongly Cautioned; Some Material May Be Inappropriate For Children Under 13. Signifies that the film may be inappropriate for pre-teens. Parents should be especially careful about letting their younger children attend. Rough or persistent violence is absent; sexually oriented nudity is generally absent; some scenes of drug use may be seen; some use of one of the harsher sexually derived words may be heard. d. R: Under 17 Requires Accompanying Parent or Adult Guardian (Age Varies In Some Jurisdictions). Signifies that the rating board has concluded that the film may contain some adult material. Parents are urged to learn more about the film before taking their children to see it. An R may be assigned due to, among other things, a film's use of language, theme, violence, sensuality, or its portrayal of drug use. e. NC-17: No One Under 17 Admitted (Age Varies In Some Jurisdictions). Signifies that the rating board believes that most American parents would feel that the film is patently adult and that children under age 17 should not be admitted. The film may contain explicit sex scenes, an accumulation of sexually oriented language, and/or scenes of excessive violence. The NC-17 designation does not, however, signify that the rated film is obscene or pornographic in terms of sex, language or violence. The NC-17 rating is not exactly the same as an X rating; NC-17 is the new name for the old X rating -- but unlike the X, NC-17 is a registered trademark and cannot be self-applied. 7. PROGRAMMING 7-1. NMPS procures most of the major motion pictures released in the U.S. We augment these with older classic titles. We welcome suggestions for titles. If a title is purchased, it is purchased for all. 7

8 7-2. When programming, consider the time of day and anticipated viewing audience when deciding on appropriate movies to play. Schedule repeat exhibitions during different times of the day and days of the week so that personnel on all watches can get the chance to see the new movies. Avoid showing all the new movies as soon as they arrive, you'll quickly run out of new programming. Instead, pace your schedule to intersperse new films with older ones throughout the month so each week you'll have new movies to play Schedule Big Name titles at prime viewing times, and round out the schedule with lesser movies of various themes and genres for optimum program diversity and appeal NMPS supplies only theatrical movies, those you would go to see at your local theater. Sports, news and television programs are supplied by AFRTS. Training programs come from Navy Education Training Centers (NETCs). We do not provide music videos or CD s Inventories are not required in the NDVD program. NMPS recommends that commands create their own spreadsheet or database to track movies. The list of available titles on our website can be exported as an excel spreadsheet. 8. ENCRYPTED DVD HANDLING 8-1. Each NDVD provided has the title, program number, rating, runtime and expiration date printed on it. Additional info such as the cast and synopsis can be found on the NMPS Website. Web address located in section NDVD s are provided in a thin, plastic DVD case to protect them from damage during transit and storage. Feel free to use whatever storage system works best in your environment It is recommended that you test recently received NDVD s for playback quality before first broadcast. Defective or damaged NDVD s will be replaced upon request. Do not return damaged NDVD s to NMPS. Mark as damaged or cut in half and discard NMPS recommends that sites tailor the size of their movie library to the use it gets and available storage. You decide how big a library to maintain. There is no requirement to hold NDVD s until expiration. If storage space is at a premium or titles are 8

9 not being used, simply cut them in half and discard. There is no requirement to notify NMPS. It is however recommended that this action be noted on your movie spreadsheet When you receive a new box, verify that the address we are using is the current one. Notify NMPS of any changes that need to be made. This will help prevent delays and costly returns. 9. ENCRYPTED DVD SECURITY 9-1. Positive control of your movie library should be maintained. Even though the movies NMPS provides are encrypted and will not play on commercial machines, loss of a movie degrades the quality of your program by making that title unavailable for others 9-2. NMPS movie shipments are sent via United States Postal Service Media Mail. Shipments of movies should never be left unattended or unsecured Movies are a valuable and highly sought after commodity on the worldwide film piracy market. Be aware that though all NMPS movies are encrypted a thief may not know this. If they are stolen or illegal copies are made, the movie studios and NMPS can trace the origins of those copies back to the original source Piracy is a major concern for the studios that provide movies to NMPS well before commercial release. Strict control of your NDVD players should minimize this risk. Attempts to duplicate NMPS provided movies WILL result in immediate termination of support and prosecution under Federal and UCMJ regulations Lost Movies: If you suspect a movie is missing, conduct a physical inventory of your entire movie library. Check that the movie was not left in a player. Search all areas where movies are used and stored. Notify your chain of command NMPS will not suspend or terminate support for the loss of an NDVD movie. The loss will simply prevent your shipmates from enjoying it. Regular local inventories and a good SOP on movie use is recommended Private use of NMPS NDVD movies in quarters is prohibited. If a higher authority demands to use a movie in an unauthorized location, advise the individual of the strict regulations against 9

10 private use of NMPS movies; show them BUPERSINST and this guide. Both are available on the NMPS section of the MWR website. Violation of this instruction puts your program and the entire Navy in violation of U.S. copyright law. Violations can cause your program to be terminated or suspended. 10. ENCRYPTED DVD PLAYER MANAGEMENT The key to providing movie support almost concurrent with commercial release is the NDVD player. It is therefore critical that they be installed in a controlled location or secured when not in use. They may not be checked out for private use NDVD players must be treated as controlled equipment and inventoried on a periodic basis. A unique serial number can be found on the front of each player. Please add your players to whatever inventory control system is used by your command Loss of a player can jeopardize the entire movie program and must be reported to NMPS immediately. Contact NMPS as soon as the loss is confirmed for additional instructions. Failure to do so can result in termination of program support (Shore) Damaged NDVD players will be repaired or replaced by NMPS if the players were provided by NMPS. Contact NMPS via with a description of the problem, the serial number of the player and your contact info and we will send you further instructions (Afloat) Damaged NDVD players installed in SITE-TV will be repaired by AMS. Contact AMS for repair/return instructions If you receive a low battery warning, do not attempt to replace the batteries in the NDVD player. Removing the battery will cause the player to lose its encryption program and the player will no longer function, even if you put the batteries back in. The player will then have to be returned. Contact NMPS if you get a Low Battery warning on your player and we will provide a battery replacement kit. 10
