1 Rules of Conduct and Conditions of Use Environmental Research Station Schneefernerhaus (hereinafter referred to as UFS) N.B. This English translation of the UFS Rules of Conduct and Conditions of Use is provided for information purposes only. In the event of conflict, the German text shall be considered to be the authentic text. 1 Acceptance of the Rules of Conduct and Conditions of Use 1. These Rules of Conduct and Conditions of Use form an integral part of the Nutzungsvereinbarung (Agreement of Use). 2. The user shall accept the Rules of Conduct and Conditions of Use as binding for himself/herself and his/her personnel. The user shall pay compensation for all damage to the UFS which arises as a result of a breach or a non-observance of these Rules of Conduct and Conditions of Use, in particular as a result of a concealment of facts. 2 General Regulations 1. Instructions issued by the staff of the UFS shall be adhered to. Whilst performing activities in the UFS, personnel of the user shall remain personnel of the user with all their respective rights and obligations. However, with regard to all safety issues, the UFS technical director or his/her deputy, shall be authorised to issue instructions to personnel of the user. This provision does not relieve the personnel s superior from his/her responsibility vis-à-vis his/her personnel. 2. Access to the UFS and its outside areas is strictly prohibited to unauthorised persons. Rules of Conduct and Conditions of Use (version of ) Page 1 of 6
2 3. Staff of the UFS are normally present from 08:00 to 16:00 on Mondays to Fridays (with the exception of Bavarian public holidays). If a user intends to be in the UFS outside of these times, this has to be notified in writing to (e.g. by ) and approved by the UFS technical director or his/her deputy. 4. All users and visitors shall sign themselves into the attendance list in the entrance hall of the UFS; upon leaving the UFS, they shall sign themselves out. In the case of larger guided groups of visitors, the group leader shall be responsible for ensuring that the correct number of participants is registered in - and later signed out from - the attendance list 5. Smoking is strictly prohibited throughout the entire premises of the UFS, including the outside areas. 6. Animals are not allowed in the building without prior approval of with the UFS management. 7. Children and babies may only be brought to the UFS at the risk of the accompanying adult. 8. The user shall use the rented areas only for the contractually agreed purposes. Noise control regulations and environmental regulations shall be observed. The user shall respect the stringent requirements of the atmospheric environmental research at the UFS (in particular, the guarantee of clean air in the labs and the guarantee of disruption-free conditions on the experiment decks). The other users and their experiments shall, in particular, not be affected by emissions (e.g. gases, vapours, odours, smoke); see also 2 of the Nutzungsvereinbarung in this respect. In cases of any contravention of this provision, it shall be the user who is held responsible and liable, also with regard to third parties. 9. General safety and order are to be respected at all times. The rented areas, the communal facilities, the conference area, the overnight facilities and the self-catering kitchen shall be treated with the appropriate care and shall be left clean after use. 3 10. Each user shall tolerate the presence of equipment in his/her rented areas which is necessary for other users or the UFS. The UFS commits itself to install such equipment in a manner which, as far as possible, minimises any disruption. 11. The user shall not place or store any items outside the areas rented by the user. Even if the UFS has exceptionally granted permission for items to be located elsewhere, the user shall nevertheless be held responsible and liable for any resulting damage which may occur. No work may be conducted by the user outside his/her rented areas. 3 Due diligence of the user The user shall: 1. keep the floor dry and maintain the floor in such condition that no damage occurs; 2. avoid any damage to the supply systems, electrical systems and other building installations, avoid blockages of the drainage systems and report any disruption immediately to the staff of the UFS; 3. keep doors and windows closed when absent, during bad weather, during strong winds and during the night; 4. be economical with the use of electricity, lighting, warm and cold water, and the heating and cooling installations for air conditioning in the labs and instrument cooling; 5. adhere to the currently valid waste disposal regulations of Garmisch-Partenkirchen; 6. empty the rubbish bins located in the rented areas in good time and dispose of the waste in the appropriate waste-separation containers; 7. adhere to the special provisions for the use of lifts, water heaters and any other building installations; 8. adhere to any signs posted by the UFS; 9. avoid excessive ventilation of rooms during the heating period (1 October to 30 April). When temperatures fall below zero, the radiator valves shall not be set on kalt. Rules of Conduct and Conditions of Use (version of ) Page 3 of 6
4 4 Use of Internet & 1. Private use of internet and is not permitted. 2. Access data is logged at various points. In particular, access statistics are gathered when the firewall is passed. This data is compiled for technical reasons only and serves to maintain security within the UFS network. 3. The IT infrastructure of the UFS shall only be used in a legally correct manner. Attention is explicitly drawn to the fact that, in particular, the following behaviour is in accordance with the relevant legal provisions (Strafgesetzbuch StGB) punishable under law: the acquisition of other persons passwords and the non-authorised surveillance of data ( 202 a STGB) non-authorised modification, deletion, suppression or disabling of data ( 303 a StGB) computer sabotage ( 303 b StGB) and computer fraud ( 263 a StGB) the distribution of propaganda material from unconstitutional organisations ( 86 StGB) or with racist content ( 131 StGB) the distribution of pornography in the internet ( 184 Abs. 3 StGB) the download or possession of documents containing child pornography ( 184 Abs. 5 StGB) defamation of character, e.g. libel and slander ( 185 ff StGB). 5 Keys 1. The building is accessible by key. The UFS shall provide each user with a set of keys when the rented area is handed over. If any key is lost, this shall be reported immediately to the UFS. The user shall cover the entire cost of issuing replacement keys or if deemed necessary for security reasons the entire cost of replacement locks. 5 2. On termination of the Nutzungsvereinbarung (Agreement of Use), the user shall immediately return the keys provided to him. Any additional keys which have been prepared shall also be handed over to the UFS. Any keys which have been returned early will, if required, be re-issued at no extra cost. 3. In the event that the user moves out either permanently or temporarily before termination of the Nutzungsvereinbarung (Agreement of Use), the keys shall be surrendered to the UFS or to an authorised agent. This applies even if items have been left in the rented areas, the number or nature of the remaining items making the intention to vacate the rented area for a longer period of time clear. In such a situation, the UFS shall be entitled to re-acquire the rented area before it has been definitively vacated. 6 Public Image 1. The user shall commit himself/herself, in particular vis-à-vis the press and the general public, to contribute to maintaining and enhancing the public image of the UFS. 7 Safety 1. Fire prevention: All fires, accidents or other emergencies shall be immediately notified to the staff of the UFS and immediate action shall be taken in accordance with the escape and rescue plans which are displayed in each area. All general, technical and official regulations, in particular the regulations of the building supervisory board, the fire insurance and the fire brigade, shall be adhered to. Fire extinguishers and the corresponding signs shall not be covered or otherwise rendered inoperative. 2. Escape routes: The escape routes and escape doors are marked and shall be kept clear at all times. The markings shall not be removed, obscured or defaced. 3. 6 During the skiing season, the ski-lift operator (Bayerische Zugspitz Bahn - BZB) may perform unannounced avalanche detonation on the slopes above the UFS at any time between the hours of 18:00 and 09:30. Moreover, under certain circumstances, the local council in Garmisch-Partenkirchen may order that the UFS be sealed off; in such cases, avalanche detonation may be performed at any time (i.e. also during daylight hours) without prior warning. The user shall therefore ensure that his/her personnel follow all instructions of the general management of the UFS with regard to any access restrictions to the outside areas and decks imposed by the management of the UFS and that his/her personnel enquire with the general management of the UFS about any restrictions or dangers before attempting to access the outside areas and decks. The user shall immediately follow all safety provisions issued by the staff of the UFS in relation to avalanche detonation. If, as a result of avalanche detonation, damage occurs to the UFS or to any equipment, instruments or research activities located therein or thereon, or if any ongoing series of measurements or experiments are disrupted, the UFS shall not be held responsible, provided that no reproach of gross negligence or malintent can be levelled against the UFS with respect to their duty to inform. 4. Hazardous materials: Hazardous materials shall be transported, stored, secured, handled and disposed of in accordance with the appropriate regulations. All of the corresponding official regulatory provisions shall be observed and adhered to by the user. 5. Safety Instructions: Every person staying overnight in the UFS shall undergo an obligatory safety instruction briefing by the general management before their first overnight stay.
