Statement of the Issue Should the Commission approve the route through the Fond du Lac Reservation? Introduction and Background On December 29, 2008, an Order of the Commission issued a Pipeline Routing Permit to Enbridge Energy, Limited Partnership and Enbridge Pipelines (Southern Lights) L.L.C. for the following projects: A. The Alberta Clipper project, a 36-inch outside diameter, high-pressure (1,313 pounds per square inch gauge) buried pipeline and associated facilities, with capacity to transport an average of 450,000 barrels of crude oil per day from Hardisty, Alberta to Enbridge s tank farm and terminal in Superior, Wisconsin. The Alberta Clipper pipeline will be buried underground and primarily within and adjacent to Enbridge s existing rights-of-way in the Minnesota counties of Kittson, Marshall, Pennington, Red Lake, Polk, Clearwater, Beltrami, Hubbard, Cass, Itasca, Aitkin, St. Louis and Carlton. B. The Southern Lights Diluent project, a 20-inch outside diameter, high pressure (1,334 psig) buried pipeline and associated facilities, with capacity to transmit 180,000 barrels per day of diluent from refineries near Chicago, Illinois, to Enbridge s facilities at Clearbrook, Minnesota, where they would flow into an existing pipeline to Alberta. The Southern Lights Diluent pipeline will be buried primarily within and adjacent to Enbridge s existing rights-of-way in the Minnesota counties of Carlton, St. Louis, Aitkin, Itasca, Cass, Hubbard, Beltrami, and Clearwater. These pipeline routes are shown on Attachment 1 in the Commissioner s packet. However, the Commission in its Order refrains from issuing a permit with respect to the route between Mileposts and on Enbridge s initial preferred route pending negotiations by the parties. The Commission Order directed Enbridge and the Fond du Lac Band to resume negotiations regarding the route of the proposed pipelines between Milepost and , and to report on their progress toward reaching an agreement within 30 days of the date of the Commission s Order. 2

4 On February 13, 2009, Enbridge filed a status report on negotiations, suggesting that the parties had reached an impasse. On February 26, 2009, the Band filed a response to Enbridge s status report. The Band also filed a request for reconsideration of the Commission s December 29, 2008, Order to correct a statement regarding the Band s authority over non-tribal lands. On March 10, 2009 Office of Energy Security (OES) Energy Facility Permitting (EFP) staff filed a letter reaffirming its support of and recommendation of the Revised Preferred Route across the Fond du Lac Reservation. This recommendation was supported by the Fond du Lac Band of Chippewa Indians and the Minnesota Department of Natural Resources. In a March 27, 2009, Commission Order, the Commission again deferred designating a route for the Alberta Clipper and Southern Lights Diluent pipelines between Milepost and until after the United States Department of Interior issues its Environmental Impact Statement. Enbridge and the Band continued to negotiate and in a letter dated March 30, 3009, from Enbridge and the Band to Burl Harr, the parties indicated that terms were reached between the Fond du Lac Band and Enbridge regarding the Alberta Clipper and Southern Lights Pipeline Route that now allows (the Projects ) to proceed along Enbridge s existing pipeline route through the Band s Reservation in northern Minnesota. The March 30, 2009, letter also states as follows: The Band and Enbridge jointly submit this letter to inform all state and federal agencies involved in the permitting for the Projects that both the Band and Enbridge now prefer the existing route through the Reservation (to-date denominated the Fond du Lac Alternative ) for siting the Projects. The Band and Enbridge jointly ask that all agencies issue permits for the existing Reservation corridor as opposed to the proposed new route around the Reservation (to date denominated the Preferred Route ). The Band and Enbridge agree that the Reservation route is environmentally-preferable to the Preferred Route or any other alternative route that may be proposed or under consideration by the permitting agencies. As there is no remaining financial dispute between the parties, the Reservation route is now practicable and feasible and the Band and Enbridge request that the permitting agencies authorize the construction of the Projects within the existing Enbridge corridor on the Reservation. While the Band and Enbridge s financial terms are confidential, the relevant features of the Parties agreement for purposes of permitting are as follows: 1. The Band will deliver to Enbridge valid and enforceable easements for Enbridge s four existing pipelines and the proposed two additional pipelines and appurtenances in and adjacent to the existing right-of-way corridor through the Reservation for a period of 20 years in exchange for certain considerations. 3

5 2. The Band will not participate in any opposition to the Projects, but may comment on environmental or other matters directly affecting the Band or its Reservation. 3. The Band and Enbridge will cooperate and assist one another in timely requesting and obtaining all required consents and approvals for construction of the Projects through the Reservation from the Bureau of Indian Affairs and other agencies. Both parties are aware of the relevant timelines for environmental and cultural review, and are committed to full cooperation with all state and federal agencies. DOC EFP Staff Analysis and Comments The pipeline route before the Commission is comprised of Enbridge s original route as modified between Mileposts through which crosses the Fond du Lac Reservation and is shown in Attachment 2 of the Commissioner s packet on aerial photos 325 through 357. The same route photos were provided in Attachment 11, filed with the OES EFP Comments and Recommendations in November 2008, and identified as Appendix E to the proposed Pipeline Routing Permit. Aside from the Fond du Lac Route Alternative (as the around-the-reservation alternative has been called in this proceeding), which is a distinct route alternative that by-passes the Band s Reservation (see Attachment 1 in the Commissioner s packet. For detailed air photos see Attachment 7 to OES EFP Comments and Recommendations filed in November 2008) no other routing options were proposed between Mileposts through In determining the route of a proposed pipeline, the Commission shall consider the characteristics, the potential impacts, and methods to minimize or mitigate the potential impacts of all proposed routes so that it may select a route that minimizes human and environmental impacts. In selecting a route for designation and issuance of a pipeline routing permit, the Commission shall consider the impact of the pipeline and associated facilities on each criterion. Each of these criteria was addressed separately, by supporting supplemental findings (see OES EFP Comments and Recommendations, Supplemental Findings 2 through 88, dated November 2008, and the Commission s Supplemental Findings 2 through 88). The Criteria for Pipeline Route Selection in Minn. Rule , subd. 3. A-J. must be uniformly applied to the entire route and/or route segments considered by the Commission in its route designation determination. In its November 19, 2008, Comments and Recommendations, OES offered supplemental findings and conclusions which were adopted by the Commission in its December 29, 2009, Order. However, at that time the Commission did not adopt the following supplemental findings and conclusion (See pages 89 and 90 of EFP staff Comments and Recommendations submitted November 19, 2008) which were again re-submitted by OES EFP staff in its March 10, 2009, letter to the Commission, and numbered as follows: [Supplemental Finding] 89. The Fond du Lac alternative is a 100 percent green field route while the Proposed Route is adjacent to existing rights of way for its entire length. [Ex. 117 Supplemental Filing to the Fond du Lac Route Alternative] 4

6 90. Most of the 21.4 miles of the Fond du Lac Route Alternative goes through county or state forest. [Ex. 117 Supplemental Filing to the Fond du Lac Route Alternative] 91. The Fond du Lac alternative opens up a significant new corridor through large tracts of undisturbed native communities, including Sites of High Biodiversity Significance. [DNR April 21, 2008 letter to ALJ] 92. The Fond du Lac Route Alternative crosses more waterbodies than the Revised Preferred Route and affects an additional 23,859 feet of NWI-mapped wetlands including at least five stands that are designated as ecologically important lowland conifers. [Ex. 117 Supplemental Filing to the Fond du Lac Route Alternative; DNR April 21, 2008 letter to ALJ] 93. Construction of two large-diameter pipelines through this area will permanently alter these communities, fragment large areas, and open the area to invasive species. Existing forested area would be replaced with an unnatural grassy habitat. Wildlife habitat and timber production will be impacted. [DNR April 21, 2008 letter to ALJ] [Supplemental Conclusion] 1. The Fond du Lac Route Alternative has more negative impacts when assessed according to the tenfactor test under Minn. R than the Proposed Route. The Commission did not adopt the OES EFP supplemental findings and conclusion, but adopted language withholding designation of a route between Milepost and on Enbridge s initial preferred route, pending further negotiations by the parties. Because the Band and Enbridge have agreed on the general location of the Alberta Clipper and Southern Lights Diluent pipelines, which will generally be within, along or adjacent to Enbridge s existing right-of-way, EFP staff is again recommending Commission adoption of OES EFP staff supplemental findings (89 through 93 and Supplemental Conclusion 1). OES EFP staff continues to believe that the route through the Fond du Lac Reservation is supported by the record and best meets the criteria in Minn. Rule , Subd 3. A. through J. The Band and Enbridge also now share that belief. Based upon the information in the record of this proceeding and upon the agreement between the Band and Enbridge, OES EFP believes that the Commission can designate the route that proceeds along Enbridge s existing pipeline route between Mileposts and through the Band s Reservation in northern Minnesota and as depicted in aerial photo sheets 325 through 357 (see Attachment II, in the Commissioner s packet). These aerial photos were submitted by OES EFP staff as Attachment 11 to the OES EFP staff Comments and Recommendations filed in November

7 OES EFP staff also believes that the terms and conditions of the pipeline routing permit issued with the Commission Order on December 29, 2009, should apply to the designated route across the Band s Reservation between Mileposts and as shown in aerial photo sheets 325 through 357. Commission Decision Options 1. OES EFP Staff Supplemental Findings of Fact and Conclusions A. Adopt OES EFP Staff supplemental findings 89 through 93 and Supplemental Conclusion 1. B. Amend and adopt the Supplemental Findings and Conclusion as deemed appropriate. C. Deny route designation through the Fond du Lac Reservation. D. Make some other decision deemed more appropriate. 2. Route Designation A. Designate as the preferred route the route segment between Mileposts and along Enbridge s existing rights-of-way across the Fond du Lac Reservation as shown in Attachment 11 (aerial photo sheets 325 through 357) filed with the OES Comments and Recommendations submitted in November 2008 and also referred to in the pipeline routing permit as Appendix E. To assist the Commission those same photos (sheets 325 through 357) illustrating the route segment boundaries are included as Attachment 2 in the Commissioner s packet. B. Designate a different route as identified by the Commission. C. Make some other decision deemed more appropriate. 3. Permit Issuance A. Amend the December 20, 2008 Commission Order to apply the terms and conditions of the pipeline routing permit issued pursuant to that Order to the designated route segment across the Band s Reservation between Mileposts and as shown in Attachment 11 (aerial photo sheets 325 through 357) filed with the OES Comments and Recommendations submitted in November 2008 and also referred to in the pipeline routing permit as Appendix E. To assist the Commission those same photos (sheets 325 through 357) illustrating the route segment boundaries are included as Attachment 2 in the Commissioner s packet B. Amend and adopt the Pipeline Routing Permit as deemed appropriate. C. Take some other action deemed more appropriate. OES EFP Staff recommendations: Staff recommends options 1.A., 2.A., and 3.A. 6
