2 176 Tomb It May Concern: Save Our Cemeteries Tour Guide Training Manual Myths and Stories Is there any truth to the stories that fences and gates in New Orleans cemeteries were installed to keep evil spirits and ghosts away from the graves? This question comes up from time to time, as a result of popular legends or stories. The answer is, of course, NO. Decorative gates and fences made of ironwork were added to tomb designs for the same reason they were added to buildings: to be decorative and to embellish the tomb s design. There is no connection between gates and fences and the effort to keep away ghosts or evil spirits. Is it true that the Superdome was built on top of an old cemetery? No, the Girod Street Cemetery was located between Girod, Cypress, St. Paul (now South Liberty), and Perrilliat Streets. So the cemetery was actually located closer to the Superdome s parking garage and the former New Orleans Centre shopping mall. When the cemetery was deconsecrated in 1957, remains were moved to Hope Mausoleum, Section K, and Providence Memorial Park. Is it true that a tomb cannot be opened until a year-and-a-day after a previous burial? The year-and-a-day between tomb openings is a tradition probably established among sextons of cemeteries. In addition, French mourning customs of the 19th century specified a window mourn for a year and a day after the death of a spouse. However, Billy Henry, a funeral director, researched this topic and found no legal precedent for this common practice. The closest legal link was the fact that person s estate is subject to claims up to a year after death so that a day after that ends, remains may be moved and another burial take place. Each cemetery can make its own rules, and today some limit the number of multiple uses in a tomb as well as when a tomb can be opened for another burial. Tomb Tablets and Inscriptions Why do some tombs have only last names on them, with no names of individuals listed on them? This is a popular way to establish a family tomb, by using the family s original last name on the tomb s plaque. Comprehensive records are usually kept on exactly which individuals are buried in the tomb. In situations where only the last name is indicated, the family perhaps elected not to list every individual buried in the tomb, if the tomb was used for multiple burials. In older cemeteries, the original closure tablet may have been lost or stolen, and the family decided not to have a new tablet inscribed with the older information. Why do some tombs have more than one plaque or tablet on them? When the original plaque becomes filled with the names of those buried in the tomb, an additional plaque is ordered to accommodate the additional burials. In this situation, the old plaque (or the new plaque) may be placed on the side of the tomb to feature the additional names. In some instances, when the large plaque becomes filled with names, smaller plaques are placed on the front or sides of the tomb.
3 Appendix A: Frequently Asked Questions 177 Present-day Burial Procedures and Costs What would happen if a family experienced multiples deaths at the same time, but the family only had two burial vaults? In this situation, a funeral director could offer the family several options. The various family members could have a regular visitation and funeral services, as well as a grave site service at the cemetery. Then following these services, coffins could be placed in the available family vaults, and the other coffins could be stored in temporary storage crypts at the cemetery, or the additional coffins could be transferred to a cemetery that had temporary space available. Following the cemetery s specific rules of how long between burials in a single vault, the family tomb would be opened, and the other family members would be interred in their family tomb. The family would be notified of the transfer. Another option for the family faced with this situation would be cremation of the additional bodies, with the remains being placed in the family tomb. Historically, a wall vault could be rented for a year or until the family tomb could once again be accessed. What does a typical two vault family tomb cost? The answer to this question varies widely, depending on the cemetery, availability of plots, and the type of tomb selected. Plots in our cemeteries are marketed much like lots for houses, with factors such as size, location, and availability affecting their pricing. In some of the cemeteries, a new two vault tomb s cost can easily approach or exceed $60,000 and an elaborate multi-vault mausoleum can exceed $500,000. While this may seem expensive, it is important to remember that the tomb will accommodate many burials over generations, making it a wise investment over time, avoiding the need for single plot purchases when a death occurs. What does it cost to be buried in a New Orleans cemetery? Historically, costs of a lot was $25 and the sexton charged $3 to dig a grave or $1 to attend a corpse to the grave according to vestry records from Christ Church who operated the Girod Street Cemetery. Currently, for burial in a city cemetery, the following fee schedule have been outlined in the Code of the City of New Orleans: For opening and closing vaults $150 - $200 For opening and closing vaults for infant burials $50 Internment of cremated remains $50 Are burials conducted in-ground today? Yes, many cemeteries offer single burial plots for burial in ground, with a simple marker, much like the rest of the United States. Modern pumping stations allow for this practice. However, the multiple burial above-ground system still remains the most popular, and traditional, mode of burial.

These plaques indicate that the owners of the tomb have paid a fee to the cemetery owner to maintain the tomb. Essentially, this obligates the cemetery owner to maintain the tomb to a certain degree from the time the contract was signed for maintenance and when the fee was collected. This amount varies, according to the size and the type of the tomb, as well as the factors related to the tomb s maintenance. The City does not currently offer any kind of perpetual care or maintenance plans for their cemeteries. Can people still buy tombs and cemetery plots today? Sort of. For city cemeteries, instead of purchasing a plot, a person purchases a servitude right of use of space. Basically, a servitude is a private right to use the property owned by another, and it can be passed down to successors under the right circumstances. The servitude gives the person the ability to construct a tomb and bury within that structure, and it must be renewed every 10 years. If someone does not renew his servitude, the City has the right to assume ownership, which includes relocating any interments and altering or demolishing any existing structures. Before the City can obtain ownership, though, they must follow a specified procedure of notification and announcement. The right of servitude only applies to those transactions occurring after January 1, For those that already hold title to their property, they do not need to have, or worry about, the servitude right of use. Laws How fast must a body be buried, following death? According the Code of the City of New Orleans, Section , something must happen to the body within 24 hours of death during the summer and 36 hours during the winter whether it s burial, embalming, or cremation. If the cause of death is linked to a contagious or infectious disease, the Department of Health may require an earlier burial. What other laws should I be aware of regarding cemeteries? According the Code of the City of New Orleans, Section 38-12, any person entering a cemetery and damaging the trees and plantings or using profane language or selling refreshments shall receive the same punishment as those found guilty of desecrating a grave, which punishments are outlined in Section of the City Code. Also, it is considered unlawful for any person to play any radio, phonograph, or any other soundproducing instrument in any commercial establishment located within 1,000 feet of the outer boundary of a cemetery between 9 am and 6 pm, according to Section

According to Section of the City Code, desecration is the: 1) Unauthorized opening of a tomb, vault, or the like, with the intent to remove the body or any item interred with the body 2) Intentional or criminally negligent damage of any grave, tomb, or mausoleum erected for the dead 3) The theft or taking of any artifact or object from a tomb without the consent of the owner, including by fraudulent conduct 4) Being in illegal possession of an object or artifact stolen from a tomb 5) Encouraging others to steal any artifact or object from a tomb Desecration can also be considered institutional vandalism, which means the defacing, destruction, or otherwise damaging of certain types of property, including cemeteries. The state defines desecration in a similar manner in Section 14:225. What are the punishments for desecration and institutional vandalism? Desecration carries the punishment of a fine of at least $300, but not more than $500, or imprisonment of at least 30 days by not more than 60 days, or both. Or a punishment of at least 30 days but not more than 90 days of community service, which may include performing maintenance services at a cemetery. Institutional vandalism carries a punishment of a fine of $500 and six months imprisonment. Financial restitution for the resulting damages may also be required. The state carries a much more detailed punishment for institutional vandalism. In Section , the punishment is as follows: For damages valued at less than $500: Up to $500 fine or six months imprisonment or both For damages valued at more than $500 but less than $50,000: Up to $1,000 fine or a two-year sentence (with or without hard labor) or both For damages valued at more than $50,000: Up to $10,000 fine or a ten-year sentence (with or without hard labor) or both Can a cemetery owner sell an abandoned tomb or plot? Legally, he can. According to state law 8:308, a cemetery authority can declare a space abandoned after following a detailed set of requirements and notifications, and then re-sell the property. However, most operators have been reluctant to take advantage of this law. Do you have to be embalmed? Wouldn t embalming delay the decomposition process or perhaps produce a mummy? Bodies are embalmed in New Orleans as they are in the rest of the United States. Embalming is set by law in most places, for health and sanitation reasons. However, if the casket is not opened for public viewing during the wake, and if the body is entombed within a certain time frame, embalming can be avoided. The process of embalming only preserves the body for a short period of time, and the tissue subsequently begins normal decomposition. A mummy is the result of the confluence of certain conditions, the occurrence of which is very rare, particularly in New Orleans.
6 180 Tomb It May Concern: Save Our Cemeteries Tour Guide Training Manual Tomb Preservation Why are some tombs in very good condition, while others are in a state of disrepair? A tomb in good condition indicates that the family is still alive and maintaining the tomb. The family may have invested in a maintenance contract with the cemetery operator. Tombs that are in a neglected state may not have any descendants to maintain the tomb, relatives have moved out of the area, or the family can no longer maintain the tomb. New Orleans weather adversely affects the conditions of the tomb, if it is not properly maintained. Efforts to allow the resale of abandoned or neglected tombs have been slow to take effect, and have been met with some resistance. An 1850s law states a family can be fined $50 for not maintaining a family-owned tomb, but that law has not been routinely enforced. How much does a restoration cost? A typical tomb restoration costs approximately $3,500 to $6,000, depending on the size of the tomb, the extent of deterioration, the amount of materials required for replication and replacement, and other factors. A smaller tomb would cost significantly less, while a larger tomb, such as a society tomb, would be a much higher figure. Other Questions Tourists Love When is the next jazz funeral? This question will inevitably be asked by a visitor who has spent way too much time at Disneyworld or Colonial Williamsburg. Obviously, we do not know when a jazz funeral will take place, given they occur in conjunction with a death. Your best bet to find out when one may be taking place or even a second line parade is probably the Backstreet Cultural Museum ( ). Sometimes WWOZ ( or ) has that information, as well. Occasionally, it is also included in the obituary. What is the difference between St. Louis Cemetery No. 1 and Lafayette Cemetery No. 1? In other words, why should I visit both? While the burial practices and customs are the same for both cemeteries, there are several distinctions that make each cemetery special. St. Louis Cemetery No. 1 is the city s oldest extant cemetery, consecrated in the late 1700 s. It has no planned layout, and some say it is a maze to negotiate. It is owned and operated by the Archdiocese of New Orleans, and the majority of the burials are those of the original Catholic Creole families of New Orleans. It features humble step-top brick tombs that only contain a single burial to elaborate society tombs to wall vaults with segmented arches resembling brick ovens. Iron work in crosses, gates, and fences dominate, as well as monuments and statues or imported stone. In 2002, SOC completed a large-scale preservation project on Alley 9L, allowing the visitor to get a glimpse of what the cemetery would have looked like in the nineteenth century, when tombs were maintained with their original limewash finishes.
7 Appendix A: Frequently Asked Questions 181 Lafayette Cemetery No. 1 was established in 1833 after the Louisiana Purchase and the French City became American, actually a primary destination for many immigrants. It is a planned layout in a cruciform, or cross, pattern with trees. It is owned and operated by the City of New Orleans, one of seven such cemeteries. It has burials of immigrants from 21 different countries and 27 states with many Irish and German families. There is no religious discrimination in its burial plan, making it the City s oldest non-denominational cemetery. It has copings, but no low, step-top single burial tombs. The wall vaults are post-and-lintel construction of brick and slate with a marble façade. Simple stone crosses and statues dominate, with limited examples of ironwork. Wouldn t above ground burials cause offensive cemetery odors? Yes. Bodies buried above ground vaults are exposed to high temperatures and humidity, thus starting the decomposition process very quickly, resulting in the offensive odors. A popular method to mask these bad odors was pouring lime over the bodies and planting sweet smelling plants and trees, such as sweet olive, in cemeteries. Don t you find tourist visits to your local cemeteries disrespectful? Our cemeteries, burial practices, and attitude towards death are unusual in the United States, thus tourists are very interested in seeing the cemeteries. Burial is another concept of respectful celebration in New Orleans, and exhibits another level in our burial customs transforming a mortal death into a new spiritual reality. We always respect families when they are visiting tomb sites, and we avoid that area of the cemetery when burial services are being conducted. What do the SOC plaques on tombs in Lafayette Cemetery No. 1 mean? The plaques were placed on tombs that SOC stabilized or tried to prevent further decay under the demolition-by-neglect law. At one time, SOC thought they could save all the decaying tombs; however, this proved to be unfeasible and cost prohibitive. Unfortunately, plaques are on tombs that families have allowed to deteriorate, and SOC cannot act without the family s consent. Such efforts and finances are now targeting tombs with the most need and historical significance. Why weren t bodies cremated? While cremation would seem like a perfect solution to the limited space problem found in New Orleans, it is important to remember that New Orleans remains a predominately Catholic city in attitude and culture. The Catholic Church only recently supported cremation by noting that the ashes produced from a Catholic cremation were considered sacred and the ashes must be interred accordingly. Where is Louis Armstrong buried? Flushing Cemetery, Queens County, New York, Plot: Section 9 as is his wife Lucille. Although his stone marker has his birth date as July 4, 1900, it was later discovered that Louis Armstrong was actually born on August 4, 1901, at Charity Hospital, New Orleans, Louisiana. On his 100th birthday, the city of New Orleans renamed its airport the Louis Armstrong International.
