6 TAXI MOTOR VEHICLE INSURANCE PRODUCT DISCLOSURE STATEMENT About the SRS Taxi Motor Vehicle Insurance Product Disclosure Statement and Policy This Product Disclosure Statement (PDS) is designed to help you understand the SRS Taxi Motor Vehicle Insurance Policy and to provide you w ith sufficient information to enable you to make an informed choice about w hether to buy this insurance. It sets out some important information about the SRS Taxi Motor Vehicle Insurance Policy, including its features, benefits and costs. Please read it carefully together w ith the SRS Taxi Motor Vehicle Insurance Policy Wording w hich attaches to and forms part of this PDS and contains full details of the coverage, the exclusions and the terms and conditions applying to this insurance. Preparation Date of this PDS: 20 March 2014 About SRS This PDS and the SRS Taxi Motor Vehicle Insurance Policy are issued by SRS Underw riting Agency Pty Ltd ABN AFSL as coverholder and agent on behalf of certain Underw riters at Lloyd s of London, and as agent on behalf of Berkley Insurance Company. Details of the Lloyd s syndicate numbers and the proportions of this insurance for w hich each of the Underw riters and Berkley Insurance Company are liable may be obtained from SRS. You should direct all of your correspondence to SRS through your insurance broker as he or she is your agent for this insurance. Definitions Defined terms are used in this PDS and throughout the Policy. The definitions are set out at page 7 of this PDS and the SRS Taxi Motor Vehicle Insurance Policy Wording. Policy Features and Benefits The follow ing information is a summary of Policy features and benefits. You should refer to the Policy Wording and Your Policy Schedule for complete details of the coverage and the Exclusions and Conditions w hich apply. The SRS Taxi Motor Vehicle insurance Policy has tw o types of cover available Comprehensive and Third Party Cover. Comprehensive cover provides cover under Sections 1 and 2 for loss or damage to Your Vehicle and third party property and death or bodily injury. Third Party Cover provides cover under Section 2 only for third party property and death or bodily injury. Section 1 Your Vehicle Cover Your Vehicle Cover provides cover up to the Sum Insured for loss or damage to Your Vehicle due to Accident, fire, hail, flood, storm, earthquake, theft, attempted theft, or malicious damage occurring during the Period of Insurance. Additional Benefits available under Section 1.1 are: reasonable costs of tow ing to the nearest repairer or place of safety, in addition to the Sum Insured. reasonable costs of debris removal from the scene of the Accident, in addition to the Sum Insured. demurrage if Your Vehicle is off the road for more than 3 w orking days: refund of any recoveries w here available w hen you are not at fault; up to $250 per day/$1,500 for any one claim in addition to the Sum Insured w hen you are not at fault and w hen you are at fault or partly at fault. Your contribution for general marine average and salvage charges if Your Vehicle is being transported by sea betw een places w ithin Australia, up to the Sum Insured. cover under Section 1.1 applies to a substitute vehicle under Your legal custody or control. up to $1,000 in addition to the Sum Insured, tow ard the reasonable costs You incur for traffic control w here debris forming part of Your vehicle is causing an obstruction. Section 2 Third Party Cover Third Party Cover provides cover up to the Sum Insured for: Section 2.1 Your legal liability to pay for loss or damage to the property of other persons w hich results from an Accident occurring during the Period of Insurance and arises out of the use of Your Vehicle. 7 Section 2.2 Your legal liability for death or bodily injury to others w hich results from an Accident occurring during the Period of Insurance and arises out of the use of Your Vehicle. This is supplementary cover and is subject to the limitations set out under Section 2.2 of Your Policy Wording. Additional Benefit: Cover under Section 2 applies to a substitute vehicle under Your legal custody or control. Exclusions apply to both Sections 1 and 2 and these are set out on pages 10 to 12 of this PDS and Policy Wording. Policy Conditions Coverage under Sections 1 and 2 is subject to the Claims Conditions and General Conditions set out in the Policy Wording. Claims Conditions explain w hat You must do if it becomes likely that You w ill make a claim. They set out: Your obligations in the event of Accident, theft or malicious damage. claims notification procedures. Your claim responsibilities. Our rights and responsibilities in relation to handling Your claims. depreciation and contribution requirements. Your obligation to pay the Excess and the types of Excess payable. Your obligation to obtain our authorisation before carrying out repairs. Our entitlements in respect of salvage. Our entitlements in the event of Total Loss. General Conditions explain: Your obligation to give w ritten notice of any material alteration to the risk. Your obligation to obtain your driving history record w ithin 14 days of a request from Us. Your obligation to use due diligence and take all reasonable measures to maintain all Vehicles and Accessories in sound efficient w orking condition and to comply w ith all statutory obligations, regulations and by-law s. how GST affects Your Policy and Your obligation to inform Us as to Your Input Tax Credit entitlements. Our entitlements to inspect and examine any Vehicle. that Your Policy only protects Your interests and such other interests as are notified to and accepted by Us. Our maximum liability is the relevant Sum Insured as show n in Your Policy Schedule or any sub-limit show n in Your Policy Wording. Your obligations in respect to payment of premium by the due date for cover to be available to You. Your rights and obligations in respect of Policy cancellation and Ours. Policy Costs The premium is calculated taking into account certain factors including: w hether you choose Comprehensive cover or Third Party cover. the number and type of Vehicles You insure. Sums Insured. Your claim and loss history. the Excess You choose. The premium also includes amounts payable in respect of government taxes and charges such as stamp duty and GST. Excess When you make a claim, an Excess applies. The Standard Excess is stated in Your Policy Schedule. An Age and Inexperience Excess may also apply as set out in the Claims Conditions of Your Policy Wording. Cooling-off Period If, for any reason, You decide that You do not require the Policy, and no claim has been made under the Policy, you have the right to cancel and return the Policy to Us w ithin 14 days, w hich starts on the earlier of: The date you received confirmation of the Policy; or The end of the fifth day after the Policy w as issued to you. If You cancel w ithin this 14 day period, We w ill refund the premium You have paid unless You have made a claim. Your Duty of Disclosure Under the Insurance Contracts Act 1984 ( the Act ), You have a Duty of Disclosure. The Act requires that before a Policy is entered into, You must give Us certain information We need to decide w hether to insure You and anyone else to be insured under the Policy and on w hat terms. Your Duty of Disclosure is different, depending upon w hether this is a new Policy or not. New Busi ness What you must tell us When answ ering Our questions, You must be honest and You have a duty under law to tell Us everything You know, and w hich a reasonable person in the circumstances, w ould include in answ er to the question. We w ill use the answ ers in deciding w hether to insure You and anyone else to be insured under the policy, and on w hat terms. Taxi Motor Vehicles Insurance PDS and Policy Wording V0314 Page 5

8 Who needs to tell us It is important that You understand You are answ ering Our questions in this w ay for yourself and anyone else w hom you w ant to be covered by the Policy. If you do not tell us If You do not answ er Our questions in this w ay, We may reduce or refuse to pay a claim, or cancel the policy. If You answ er Our questions fraudulently, We may refuse to pay a claim and treat the Policy as never having w orked. Renewals, variations, extensions and reinstatements Once the Policy is entered into and is no longer new business, then Your duty to Us changes. Before You renew, vary, extend or reinstate your insurance, You have a duty to disclose to Us every matter that You know, or could reasonably be expected to know, is relevant to Our decision w hether to accept the risk of the insurance and, if so, on w hat terms. Your duty how ever does not require disclosure of matter: that diminishes the risk to be undertaken by Us; that is of common know ledge; that We know or, in the ordinary course of Our business, ought to know ; as to w hich compliance w ith Your duty is w aived by Us. Non-disclosure If You fail to comply w ith Your Duty of Disclosure, We may be entitled to reduce Our liability under the contract in respect of a claim or may cancel the contract. If Your non-disclosure is fraudulent, We may also have the option of avoiding the contract from its beginning. Complaints Handling If you are dissatisfied w ith this Policy, a decision SRS makes, SRS service, the service of others SRS appoints, or a claim settlement, SRS has an internal dispute resolution process to assist You. For further information, ask for a copy of the SRS Complaints and Disputes Resolution Policy or visit w w w.srs.com.au. Privacy Statement SRS handles your personal information w ith care and in accordance w ith the Privacy Act 1988 and the Australian Privacy Principles. SRS collects personal information about you to provide you w ith insurance and insurance related services. SRS may disclose your personal information to third parties for the purposes described in our Privacy Policy, including related entities, insurers, reinsurers, agents and service providers, some of w hom may be located in the United Kingdom. By asking us to provide you w ith insurance and insurance related services, you consent to the collection, use and disclosure (including overseas disclosure) of your personal information for the purposes described in our Privacy Policy. Where you provide personal information about others, you represent to us that you have made them aw are of that disclosure and of our Privacy Policy and that you have obtained their consent. If you do not consent to provide us w ith the personal information that w e request, or w ithdraw your consent to the use and disclosure of your personal information at any stage, w e may not be able to offer you the products or provide the services that you seek. For information about how to access and or correct the personal information w e hold about you or if you have any concerns or complaints, ask us for a copy of our Privacy Policy or visit General Insurance Code of Practice SRS and Lloyd s of London proudly support the General Insurance Code of Practice. The purpose of the Code is to raise standards of practice and service in the general insurance industry. A copy of the Code can be obtained from w w w.codeofpractice.com.au, or from SRS upon request. Australian Terrorism Insurance Act 2003 Notice The Underw riters have treated this Insurance (or part of it) as an Insurance to w hich the Australia Terrorism Insurance Act 2003 (ATIA) applies. ATIA and the supporting regulations made under the Act deem cover into certain policies and provide that the Terrorism exclusion to w hich this Insurance is subject shall not apply to any eligible terrorism loss as defined in ATIA. Any coverage established by ATIA is only in respect of any eligible terrorism loss resulting from a terrorist act w hich is a declared terrorist incident as defined in ATIA. The Terrorism exclusion to w hich this Insurance is subject applies in full force and effect to any other loss and any act or event that is not a declared terrorist incident. All other terms, conditions, insured coverage and exclusions of this Insurance including applicable limits and deductibles remain unchanged. If any or all of the Underw riters have reinsured this Insurance w ith the Australian Reinsurance Pool Corporation, then any such Underw riters w ill not be liable for any amounts for w hich they are not responsible under the terms of ATIA due to the application of a reduction percentage as defined in ATIA w hich results in a cap on the Underw riter s liability for payment for eligible terrorism losses. 9 Taxi Motor Vehicle Insurance Policy Wording Definitions The follow ing terms have specific meanings: Market Value Sum Insured Accessories Taxi Equipment Accident Driver s Licence Excess Interim Cover Period of Insurance Policy Policy Schedule Proposal Total Loss The value We determine as being the reasonable amount of money it w ould cost to buy or sell a Vehicle of the same make, model and condition that Your Vehicle w as in at the date of its loss or damage. We w ill seek independent advice concerning this value. The Sum(s) Insured specified in Your Policy Schedule. Taxi Equipment and any items listed in the Schedule, other than portable equipment or apparatus, w hich is Your property and w hich is permanently attached and fitted to Your Vehicle for the business use of the Vehicle. Taxi meter, LP gas tank including fittings, taxi roof sign and all signage, w hich is permanently fixed to the Vehicle for the business use of the Vehicle. An unexpected and unintended event, other than fire, theft, hail, flood, earthquake or malicious damage. A statutorily issued current and valid licence to drive a particular type of Vehicle at a particular time and w ithin a particular geographical area. Is the first amount w hich You pay w hen You claim, for loss, damage or liability w hich is covered by Your Policy. The Excess is applied each time You make a claim. Insurance cover We may provide to You until We issue the Certificate of Insurance. The period of Interim Cover is included in the Period of Insurance set out in Your Policy Schedule. The period of time during w hich We provide cover under this Policy. It is set out in Your Policy Schedule. The policy of insurance w hich includes this Policy Wording, Your Policy Schedule, and the Proposal. The Schedule and Certificate of Insurance and attachments to them, w hich are most relevant to the cover provided, at the time of a loss, and w hich w ere issued to You by SRS on behalf of Us. The w ritten proposal made by You, in application for this insurance, w hich We use w ith other information to determine w hether to provide You w ith a Policy, and if so, its terms. A Vehicle is regarded as being a Total Loss w hen it is stolen and not recovered w ithin thirty days from the date the theft w as reported to the police, or it is damaged or destroyed and We consider the cost of repairing Your Vehicle is greater than the Sum Insured or Market Value, w hichever is the lesser, less the Excess and salvage value of the damaged Vehicle. SRS SRS Underw riting Agency Pty Ltd ABN AFSL Vehicle We/Our/Ours/Us You/Your/Yours The motor vehicle or trailer as described in Your Policy Schedule and includes Accessories. Insurers and / or Underw riters as show n in Your Policy Schedule. The person(s) named as the Insured in Your Policy Schedule or other persons specifically covered by Your Policy. 10 Our Agreement After You have paid or agreed to pay the premium, including Endorsement premiums, We w ill insure You against loss, damage or liability as provided by Your Policy from an event w hich occurs during the Period of Insurance. Your Policy sets out Our Agreement w ith You. Your Cover Your Policy Schedule nominates the cover w hich applies. Comprehensive When Your Policy Schedule nominates this cover, the follow ing Policy Sections apply: (a) Section 1 Your Vehicle Cover; and Section 2 Third Party Cover. Third Party When Your Policy Schedule nominates this cover, (a) Section 1 Your Vehicle Cover does not apply. Only Section 2 Third party Cover applies. Section 1. Your Vehicle Cover 1.1. Loss or Damage If during the Period of Insurance Your Vehicle incurs loss or damage due to: Accident; fire, hail, flood, storm or earthquake; theft or attempted theft; or malicious damage, We w ill at Our option: (a) Pay the amount of Our liability for the reasonable cost of repairing or replacing Your Vehicle; or Repair or replace Your Vehicle. With either option Our liability w ill not exceed the Sum Insured less any applicable deductions and any noted Accessories that You w ish to retain. Unless specifically noted on Your Policy Schedule, Accessories w ill be limited to $1,000 per item and $3,000 per claim. If any new or secondhand part or Accessory necessary for repair of Your Vehicle is not available in Australia at the time of repair, We w ill pay, at Our option, up to the latest listed Australian price of the manufacturer or distributor for that part or Accessory Additional Benefits The follow ing additional benefits are available under Section 1.1, provided the amount payable by Us under that Section exceeds the relevant Excess/s w hich apply Costs of Towing If Your Vehicle cannot be driven as a result of an event giving rise to a claim included under Section 1.1, We w ill pay the reasonable cost of removing it to the nearest repairer or place of safety, or to any other place approved by Us. The amount payable is in addition to the Sum Insured Debris Removal Where as a result of an event giving rise to a claim included under Section 1.1 debris forming part of Your Vehicle needs to be removed from the scene of an Accident, We w ill pay for these reasonable costs, in addition to the Sum Insured Demurrage Notw ithstanding Exclusion 3.23 Loss of Use, if Your Vehicle is off the road for more than 3 w orking days: (a) (c) and We have deemed You to be not at fault, We w ill refund to You any recoveries that We make on Your behalf for lost income / shifts incurred w hilst Your vehicle is of the road. You must provide Us w ith evidence of the lost income/ shifts; or and We have deemed You to be not at fault and We have deemed recovery to be impossible or impracticable, We w ill pay you up to $250 per day. We w ill only pay for any loss of income/shifts incurred from the 4 th day of Your Vehicle being off the road. This cover is limited to $1,500 for any one claim and is in addition to the Sum Insured; or and We have deemed You to be at fault or partly at fault, We w ill pay You up to $250 per day. We w ill only pay for any loss of income/shifts incurred from the 4th day of Your Vehicle being off the road. This cover is limited to $1,500 for any one claim and is in addition to the Sum Insured. We or SRS w ill decide, w ithin 60 days from the date of Your Vehicle being off the road as the result of an event covered under Section 1.1, if a claim is unrecoverable or if it is not practical to pursue recovery. 11 Marine Average If Your Vehicle is being transported by sea betw een places w ithin Australia during the Period of Insurance, We w ill pay Your contribution for general average and salvage charges w here such maritime conditions apply, w hether or not Your Vehicle suffers loss or damage under Section 1.1. The maximum amount We w ill pay is the Sum Insured for Your Vehicle w hich is being transported Substitute Vehicle Cover under Section 1.1 applies to any substitute vehicle of similar type, w hich is under Your legal custody or control and does not belong to You, w hilst it is being used as a replacement vehicle in substitution for Your Vehicle nominated in Your Policy Schedule. The Cover applying to the substitute vehicle is limited to the cover applying to Your Vehicle. Cover only applies w hen: (a) You can prove to Our satisfaction that Your Vehicle w as not drivable due to damage resulting from loss or damage as covered by this Policy or mechanical or electrical breakdow n; and The ow ner of the substitute motor vehicle is not entitled to cover in respect to loss, damage or liability under any other Policy; and (c) No more than one substitute vehicle is insured at any one time in respect of each of Your Vehicles w hich are not driveable Traffic Management Costs Where as the result of an event giving rise to a claim included under Section 1.1, debris forming part of Your Vehicle is causing an obstruction and the police require the use of a traffic management and control company w hich is licensed and accredited in the state to direct and control traffic follow ing an accident, We w ill pay up to $1,000, in addition to the Sum Insured, tow ard the reasonable costs You incur for such traffic control. Section 2. Third Party Cover 2.1. Legal Liability We w ill cover You for Your legal liability to pay for loss or damage to third party property w hich results from an Accident occurring during the Period of Insurance and arises out of : the use of Your Vehicle; the direct and immediate operation of the loading or unloading of Your Vehicle from and to directly beside Your Vehicle; goods or parts being carried by or falling from Your Vehicle; or any authorised passenger in or on, or getting into or out of Your Vehicle Under Section 2.1 We include the resulting costs by or on behalf of a public authority for the cleaning up and removal of a contained escape. The maximum amount We w ill pay for these costs for public authorities is $250, Third Party Death or Bodily Injury Supplementary Cover We w ill cover any legal liability incurred by You for death or bodily injury to others w hich results from an Accident occurring during the Period of Insurance and arises out of the use of Your Vehicle. How ever, We w ill not pay: (a) (c) (d) (e) if You are entitled to be partially or w holly compensated by any statutory compulsory insurance or other insurance or fund, or accident compensation scheme; or any amount w hich is below the excess or deductible amount of any statutory compulsory insurance or other insurance or fund, or accident compensation scheme; or for any amount in excess of that recoverable under any such statutory insurance or other insurance or fund or accident compensation scheme; or for any claim for w hich You w ould have been partially or w holly compensated, but for Your failure to insure or register Your Vehicle or lodge a claim in accordance w ith a requirement of any statutory compulsory insurance or other insurance or fund, or accident compensation scheme, or comply w ith any other term or condition; or liability for or arising out of death or bodily injury including loss of consortium to any: person driving or in charge of Your Vehicle; or of Your employees, partners or co directors, or family members, or persons w ith w hom You ordinarily reside; or person if Your Vehicle is registered in the Northern Territory of Australia; or arising from any industrial aw ard, employment agreement or similar agreement or determination Additional Benefits The follow ing additional benefit is available under Section 2.1 and 2.2, Substitute Vehicle Cover under Section 2 applies to any substitute vehicle of similar type, w hich is under Your legal custody Taxi Motor Vehicles Insurance PDS and Policy Wording V0314 Page 9

12 or control and does not belong to You, w hilst it is being used as a replacement vehicle in substitution for Your Vehicle nominated in Your Policy Schedule. The Cover applying to the substitute vehicle is limited to the cover applying to Your Vehicle. Cover only applies w hen: (a) You can prove to Our satisfaction that Your Vehicle w as not drivable due to damage resulting from loss or damage as covered by this Policy or mechanical or electrical breakdow n; and The ow ner of the substitute motor vehicle is not entitled to cover in respect to loss, damage or liability under any other Policy; and (c) No more than one substitute vehicle is insured at any one time in respect of each of Your Vehicles w hich are not driveable. Section 3. Exclusions We w ill not pay for any loss, damage or liability, if: 3.1. Approved Fuel Systems Your Vehicle is fitted w ith a fuel system that does not comply w ith the relevant Australian Standard and the loss arises directly or indirectly from or is caused by such fuel system Australia Your Vehicle is outside Australia, except w hen Your Vehicle is in transit by sea or air betw een places w ithin Australia Dangerous Goods You have not complied w ith the requirements and procedures of the Australian Code for the Transport of Dangerous Goods by Road or Rail including any other statute relating to or in respect of the transportation, storage, compatibility, labelling, or packaging of dangerous goods or any other relevant legislative or regulatory requirements Driving Under the Influence (a) The event causing an Accident, loss or liability occurred w hile Your Vehicle w as being driven by any person impaired by, or under the influence of any drug or alcohol, or by any person w ith a percentage of drug or alcohol in their breath or blood in excess of that permitted by law or regulation; and/or Follow ing an event causing an Accident, loss or liability the driver of Your Vehicle refused to submit to any of the necessary tests to determine the percentage of drug or alcohol in the breath, blood or urine. How ever, if You can prove that You could not reasonably have know n that the driver of Your Vehicle, being a driver other than You, w as impaired by or under the influence of any drug or alcohol, We w ill indemnify You but not the driver of Your Vehicle Experiments Your Vehicle w as used in connection w ith the motor trade for experiment, test, trial or demonstration Illegal Purpose Your Vehicle w as used for any illegal purpose or used illegally w ith Your know ledge or consent Motor Sports Events Your Vehicle w as being used in connection w ith a race, trial, contest or sports event Other Agreements Liability is accepted by You because You have entered into any agreement w ithout our w ritten permission, unless Your entering into that agreement did not prejudice Our rights 3.9. Theft Your Vehicle is stolen by a person comprising You, or a person to w hom the Vehicle is security on a loan or to w hom leased or w ho has a financial interest over the Vehicle or w here the theft relates to a debt, such as contractual payments or w ages and the like, ow ed or allegedly ow ed to them Tests The loss, damage or liability occurred w hile Your Vehicle w as being tested, other than in connection w ith service or repair by a person w ho is qualified to carry out the service or repair or w ho is acting under the supervision of such a person Unlicensed Drivers and Underage Drivers (a) Your Vehicle is driven by You or by any person w ith Your consent w ho does not hold a current and valid Driver s Licence; or Your vehicle is being driven by or is in the control of any person under 21 years of age Unregistered Vehicles Your Vehicle w as unregistered at the time of the event giving rise to the loss, damage or liability Un-roadworthy Vehicles Your Vehicle w as operated w hile in an un-roadw orthy or unsafe condition w hich w ould be normally and reasonably detected by You and this condition contributed to the event giving rise to the loss, damage or liability War Risks Loss, damage or liability is directly or indirectly occasioned by, happening through or in consequence of w ar, invasion, acts of foreign enemies, hostilities (w hether w ar be declared or not), civil w ar, rebellion, revolution, insurrection, military or usurped pow er or confiscation or nationalisation or requisition or destruction of or damage to property by or under the order of any government or public or local authority. Furthermore, We w ill not pay for: Due Observance Loss, damage or liability if You fail to comply w ith any provision of Your Policy. We may refuse to pay a claim, but in any event Our rights w ill be subject to the law Fines, Penalties, Punitive Damages Any fines, penalties, or aggravated, exemplary or punitive damages Intentional Damage Loss or damage intentionally caused by You, or any other person acting w ith Your express or implied consent Loss of Use Any type of loss incurred because Your Vehicle could not or cannot be used or its performance is below expectations or a usual level of performance Mechanical, Structural, Electrical or Computer Failure Mechanical, structural, electrical or computer failures, malfunctions or non-performance No more than the Sum Insured In respect of any number of claims in total arising out of any one event, any more than the Sum Insured stated in Your Policy Schedule or any amounts otherw ise specified in Your Policy Nuclear w aste/nuclear material/radioactive substance/explosives (a) loss or destruction of or damage to any property w hatsoever or any loss or expense w hatsoever resulting or arising therefrom or any consequential loss, or any legal liability of w hatsoever nature, directly or indirectly caused by or contributed to by or arising from: (i) (ii) ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear w aste from the combustion of nuclear fuel. the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof Pre-existing Damage The costs of repairing pre-existing damage or the costs of fixing faulty repairs Property in Your Custody Loss of use of or arising out of, from or for loss or damage to property, other than property listed in Your Policy Schedule, belonging to or in the care, custody or control of You. This shall not limit Section 2 cover from applying to damage to motor vehicles belonging to employees or visitors located w ithin Your car park or the immediate vicinity of Your car park on property ow ned or operated by You Property Carried for Reward Loss, damage or liability arising directly or indirectly out of or to any property being carried for rew ard. Safeguard of Vehicle Further loss or damage to a Vehicle, unless reasonable steps w ere taken to protect or safeguard this Vehicle follow ing the initial event Terrorism (a) Loss, damage, cost or expense of w hatsoever nature directly or indirectly caused by, resulting from or in connection w ith any act of terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss; or Loss, damage, cost or expense of w hatsoever nature directly or indirectly caused by, resulting from or in connection w ith any action taken in controlling, preventing, suppressing or in any w ay relating to any act of terrorism. For the purpose of this exclusion an act of terrorism means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, w hether acting alone or on behalf of or in connection w ith any organisation(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear. If We allege that by reason of this exclusion, any loss, damage, cost or expense is not covered by this insurance, the burden of proving the contrary shall be upon You. In the event any portion of this exclusion is found to be invalid or unenforceable, the remainder shall remain in full force and effect Tyres or Wheel Rims Damage to tyres or w heel rims caused by the application of brakes, road punctures, cuts or bursts or shredding of tread Voluntary Loss You voluntarily or otherw ise parting w ith the title to, or possession of Your Vehicle, w hether or not induced to do so by a fraudulent scheme, trick, device or false pretence Wear and Tear Loss or damage attributable to vermin, insects, inherent vice, latent defect, w ear, tear, gradual deterioration, developing flaw s, contamination, rust, oxidation, corrosion, depreciation, mould or rot. Section 4. Claims Conditions These Conditions apply to all Sections of Your Policy 4.1. Accident, Theft and Malicious Damage Your Obligations (a) In the event of an Accident, you must obtain the other driver s name, address, vehicle details, the name of their insurance company and any other relevant details such as telephone numbers of other drivers, w itnesses, passengers, and Driver s Licence details of the other drivers, and other vehicle make, model and registration details, and details of ow ners of other property. In the event of theft and/or malicious damage, You must notify the police as soon as possible after You become aw are of the theft of or from or malicious damage to Your Vehicle. We w ill require details of the name of the police officer, police station and event number they give to this notification Claim Notification Procedures If an event occurs w hich may result in a claim under this Policy, You must w ithout delay forw ard to Us: (a) Full details in w riting; and Any letters, notices or court documents received in connection w ith a claim or any potential claim, We do not pay for any costs or amounts, w hich are attributable to delays in Your advising Us of any event, third party matters or demands for payment Your Claim Responsibilities You, or anyone on Your behalf must: (a) (c) (d) not make any admission, offer, promise, payment or indemnity, w hich w ould prejudice Our rights at law, w ithout Our w ritten consent to the contrary; use due diligence in doing everything reasonably possible to avoid or diminish any loss, damage or liability; use Your best endeavours to preserve anything w hich might prove useful by w ay of evidence in connection w ith any claim; not carry out any repairs or alterations, other than those of a necessary and temporary nature, w ithout Our w ritten consent; Taxi Motor Vehicles Insurance PDS and Policy Wording V0314 Page 12

Under these circumstances We w ill pay Our liability for any loss or damage caused as a result of the theft; give us notice in w riting as soon as possible of every occurrence, claim, w rit, summons, proceedings, intended prosecution and inquest, together w ith all information in relation to them in respect of w hich liability under Your Policy may arise, or on the receipt of w ritten notice from any third party that it is their intention to make a claim against You; give to Us all information and assistance We require in the prosecution, defence or settlement of any claim; allow Us, at Our discretion, to take over and conduct in Your name, the defence or settlement of any claim; notify us of any other insurance that also provides cover for any claim or part thereof under Your Policy; pay any contribution on the cost of repairs or parts as directed by Us; and allow Us to pay to a nominated Interested Party any amounts of Your claim settlement w hich You ow e to them Our Claim Rights and Responsibilities (a) If You have agreed not to seek compensation from another person w ho is liable to compensate You for any loss, damage or liability w hich is covered by this Policy, We w ill not cover You under this Policy for that loss, damage or liability. (c) (d) (e) (f) (g) We may at Our option take over and conduct in Your name, the defence, settlement or management of any repair or third party action against You. We may at Our option at any time pay to You, in respect of a claim the Sum Insured, Market value or any other amount w hich is the limit of Our liability. Upon such payment We shall relinquish conduct or control of and be under no further liability under Your Policy in connection w ith such claim or claims except for costs, charges and expenses in respect of the period prior to the date of such payment covered by Your Policy (w hether or not pursuant to an order made subsequently) or incurred by Us w ith Our w ritten consent prior to the date of such payment. If We agree to pay any claim under Your Policy, then regardless of w hether or not actual payment has been made, We shall immediately be subrogated to any rights contractual or otherw ise w hich You may have in connection w ith that claim. We w ill tell You, w hen, how and to w hom the Excess should be paid. We w ill deduct any unpaid Excesses payable before paying any claim amount Depreciation and Contribution You may have to pay a proportion of the cost of repairing or replacing parts, w hich are affected by w ear and tear or rust and corrosion. These parts include tyres, engines, agreed Accessories, paintw ork, bodyw ork, batteries, trims or radiators and others not listed. The amount You have to pay is dependent upon the amount of w ear these parts have w hen the damage or Accident occurs Excess You are required to contribute an Excess or Excesses tow ards each claim made under Your Policy. The amount of the Standard Excess and any other Excess w hich applies, is show n in Your Policy Schedule, on Endorsements w hich apply to Your Policy or elsew here in this Policy Wording. The total Excess amount is to be paid as directed by Us Standard Excess This is the amount, w hich applies to each Vehicle as show n in Your Policy Schedule Age and Inexperience Excess (a) For drivers aged 21 to 24 or if they are over 21 years and w ith less than 2 years practical driving experience in Australia as at the time of an Accident the Age and Inexperience Excess is $750. The length of driving experience is a continuous period during w hich the driver has held a Driver s Licence to drive the Vehicle and is exclusive of any time during w hich a learners licence or permit applied. (c) Any relevant Age and Inexperience Excess shall be added to the Standard Excess. The Age and Inexperience Excess amount does not apply on a claim for w indscreen only damage 4.5. Repairs (a) You may appoint a repairer of Your choice, but We reserve the right to invite, accept, adjust or decline estimates or to arrange for the removal of Your Vehicle to other repairers. You or Your repairer must obtain Our w ritten agreement to commence repairs before We w ill accept responsibility for their cost. You agree to make Your Vehicle available for inspection by Us at a time convenient to Us. Repairs must not commence until We have inspected the Vehicle. 16 (c) We reserve the right to seek additional quotations prior to repairs being effected Salvage In the event of a Total Loss of Your Vehicle the salvage at Our option becomes Our property, alternatively at Our option We may deduct the value of the salvage from any claim settlement. If We elect not to take possession of Your Vehicle, You cannot abandon Your responsibilities for it Total Loss In the event of a Total Loss of any item or Vehicle listed in Your Policy Schedule the remaining premium for that item or Vehicle shall be retained by Us w ithout any refund to You and the item or Vehicle removed from the Policy Schedule. Section 5. General Conditions These Conditions apply to all Sections of Your Policy Alteration of Risk You agree to give w ritten notice to Us, as soon as is reasonably practicable of any fact or event w hich materially affects the risk insured by Your Policy, including but not limited to changes to the use of Your Vehicle, modifications, performance enhancements or other changes to the physical condition of Your Vehicle, or changes to Your interest in any Vehicle covered by this Policy. In such circumstances, We reserve Our rights to vary Your Policy Driving History Record You must w ithin fourteen (14) days of a request from Us obtain from the relevant statutory traffic authority a record of traffic offences for w hich You or Your drivers have been reported, charged or convicted and all endorsements, suspensions or cancellations of a Driver s Licence Due Diligence and Reasonable Precautions At Your ow n expense You shall take all reasonable precautions and use all due diligence to prevent or minimise bodily injury and loss of or damage to Vehicles and shall take all reasonable measures to maintain all Vehicles and Accessories in sound efficient w orking condition and comply w ith all statutory obligations, regulations and bylaw s imposed by any public authority for the safety of persons or property GST (a) The premium includes an amount for GST. Our liability to indemnify You under Your Policy is calculated less any Input Tax Credit to w hich You are entitled for any relevant Acquisition, or to w hich You w ould have been entitled had You made a relevant Acquisition. You must inform Us of the extent to w hich You are entitled to an Input Tax Credit for that GST amount each time that You notify a claim under Your Policy, and any GST liability arising from Your provision of incorrect advice is payable by You. GST, Input Tax Credit and Acquisition have the same meaning as given to those w ords in a New Tax System (Goods and Services Tax ) Act 1999 and related legislation and amendments Inspection Our representatives and agents shall at all reasonable times have the right to inspect and examine any Vehicle insured under Your Policy Other Interests and Joint Insureds Your Policy only protects Your interests and such other interests including financiers, ow ners, and lessors as are notified to and accepted by Us at the time Your Policy Schedule is issued by Us or thereafter by Us in w riting. No interest in Your Policy may be transferred w ithout Our w ritten consent and all persons entitled to benefit under Your Policy shall be bound by the terms and conditions of Your Policy and Our rights at law. A claim lodged by any one of the persons named as the Insured in Your Policy is considered to be a claim by all of You Limit of Liability (a) We w ill pay no more than the relevant Sum Insured show n in Your Policy Schedule (or any sub-limit show n in this Policy Wording) for any number of claims arising out of any one event. Such payment shall include, w ithin the Sum Insured, the costs and expense incurred by You or on Your behalf in defense of any claim for w hich indemnity is provided by Us and We have confirmed Our offer to pay for such costs in w riting to You Payment of Premium and Due Dates We w ill advise You of the total amount You have to pay and w hen this payment is due to Us. You must pay this full amount by the due date for this Policy cover to be available to You. If You pay Us after the due date, We can reject Your payment to Us and the Policy w ill lapse. 17 5.9. Policy Cancellation (a) You may cancel Your Policy at any time by giving Us a w ritten notice signed by You. Policy cancellation is effective from the date and time nominated by You or 4pm on the day on w hich Your cancellation notice has been received by Us, w hichever is the later. In the event of Your cancellation, We may retain 20% of the unexpired premium as a cancellation fee. We may cancel Your Policy only w hen the law allow s Us to do so. We w ill do this by giving You a w ritten notice. After cancellation by Us, We w ill be entitled to retain the premium for the period during w hich Your Policy has been in force and You shall be entitled to a refund of the unexpired premium Policy Interpretation (a) Paragraph titles in Your Policy are for descriptive purposes only and do not form part of Your Policy for the purposes of its construction or interpretation In Your Policy, the singular includes the plural and vice versa. 22 1. Important Information (a) This Policy This Policy is an important document and should be kept in a safe place. Please read this Policy, and any attachments w e provide to you, so that you understand the insurance provided by this Policy. This insurance is 100% underw ritten by certain Underw riters at Lloyd s of London. SRS, as Coverholder and agent of Lloyd s Underw riters, has the authority to bind this Policy on Underw riters behalf. Your Duty of Disclosure Before you enter into a contract of general insurance w ith an insurer, you have a duty, under the Insurance Contracts Act 1984, to disclose to the insurer every matter that you know, or could reasonably be expected to know, is relevant to the insurer s decision w hether to accept the risk of the insurance and, if so, on w hat terms. You have the same duty to disclose those matters to the insurer before you renew, extend, vary or reinstate a contract of general insurance. Your duty how ever does not require disclosure of matter: that diminishes the risk to be undertaken by the insurer; that is of common know ledge; that your insurer know s or, in the ordinary course of his business, ought to know ; as to w hich compliance w ith your duty is w aived by the insurer. (c) (d) Non-disclosure If you fail to comply w ith your duty of disclosure, the insurer may be entitled to reduce his liability under the contract in respect of a claim or may cancel the contract. If your non-disclosure is fraudulent, the insurer may also have the option of avoiding the contract from its beginning. Goods and Services Tax The amount payable by you for this Policy includes an amount for GST. The Sum Insured and other limits of insurance cover show n in the Policy documentation are GST inclusive. When w e pay a claim, your GST status w ill determine the amount w e pay. If you are Not registered for GST, the amount w e pay is the Sum Insured or the other Policy limits being inclusive of GST Registered for GST, the amount w e pay is the Sum Insured or the other Policy Limits less any Input Tax Credit (ITC) to w hich you are entitled or w ould be entitled if you made a relevant acquisition. This ITC may be claimable w ithin your BAS. You must advise us of your ABN Number and Taxable Percentage. Any GST liability arising from your incorrect advice is payable by you. Where the settlement of a claim is less than the Sum Insured or the other Policy limits, w e w ill only pay the GST (less your ITC credit) applicable to settlement. This means that if these amounts are not sufficient to cover your loss, w e w ill only pay the GST relating to our settlement of the claim. We w ill pay the claim by reference to the GST exclusive amount of any supply made by any business of yours w hich is relevant to the claim. GST, ITC, Business Activity Statement (BAS) and Acquisition have the same meaning as given to those w ords in a New Tax System (Goods and Services Tax) Act 1999 and related legislation and amendments. Taxable Percentage is your entitlement to an Input Tax Credit on your amount payable as a percentage of the total GST on that amount. (e) Privacy SRS handles your personal information w ith care and in accordance w ith the Privacy Act 1988 and the Australian Privacy Principles. SRS collects personal information about you to provide you w ith insurance and insurance related services. SRS may disclose your personal information to third parties for the purposes described in our Privacy Policy, including related entities, insurers, reinsurers, agents and service providers, some of w hom may be located in the United Kingdom. By asking us to provide you w ith insurance and insurance related services, you consent to the collection, use and disclosure (including overseas disclosure) of your personal information for the purposes described in our Privacy Policy. Where you provide personal information about others, you represent to us that you have made them aw are of that disclosure and of our Privacy Policy and that you have obtained their consent.
