6 COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN AND CHILD SEXUAL ABUSE IN SOUTH ASIA 1.1 INTRODUCTION This report has been prepared for the Second World Congress against Commercial Sexal Exploitation of Children, to be held in Yokohama, December A draft report was prepared for and circlated at the Soth Asia Consltation for the Second World Congress against Commercial Sexal Exploitation of Children, Dhaka 4-6 November Based on feed-back provided dring the Consltation, the report has been finalised for the Yokohama Congress. The three-day Soth Asia Consltation was co-hosted by the Government of the People s Repblic of Bangladesh and UNICEF. Prior to the Consltation, a one-day preparatory workshop was organised for children and yong adlts from the region. The approximately 140 delegates to the Consltation inclded senior government officials from seven contries, 25 children and yong adlts, and representatives of international agencies, NGOs and NGO networks and campaigns. The children and yong adlts were selected on the basis of their active work for at least one year as partners with NGOs and in collaboration with other children against child sexal exploitation and abse in Soth Asia. The Soth Asia Consltation was designed to assess and reaffirm government commitments and to discss lessons learned since the First World Congress against Commercial Sexal Exploitation of Children, held in Stockholm in Agst As participants in the Stockholm Congress, Bangladesh, India, Nepal, Pakistan and Sri Lanka all adopted the Stockholm Agenda for Action. The Soth Asia Consltation provided an opportnity to reinforce partnerships with media, civil society and governments to address sexal exploitation of children and child sexal abse. A major achievement of the Consltation was the active participation of children and yong adlts from throghot Soth Asia in all aspects of the meeting. The Soth Asia Strategy adopted at the Consltation will be presented at the Second World Congress against Commercial Sexal Exploitation of Children. The First World Congress against commercial sexal exploitation of children was the clmination of a global mobilisation against the commercial sexal exploitation of children that began in 1994 when the End Child Prostittion, Child Pornography and Trafficking of Children for Sexal Prposes (ECPAT) Campaign proposed holding a World Congress. Delegates from 122 governments, Inter-Governmental Organisations and Non-Governmental Organisations attended the Congress. The participating governments nanimosly adopted the Stockholm Declaration and Agenda for Action, affirming their commitment to a global partnership against the commercial sexal exploitation of children. The Stockholm Agenda for Action calls for all governments to pt in place strategies and mechanisms to end Commercial Sexal Exploitation of Children by the year Under the Agenda for Action, governments committed themselves to adopt national agendas/plans of action and to develop implementing and monitoring mechanisms or focal points so that 7

7 data bases cold be established. This instrment also called for integrated measres to conter the commercial sexal exploitation of children based on measres of co-operation/coordination, prevention, protection, recovery and reintegration, and child participation. While contries in Soth Asia have made some progress towards developing their National Plans of Action, this report will show that mch remains to be done. Frthering this process is the nderlying rationale for the p-coming Yokohama Congress. At the Soth Asia Consltation progress on the Stockholm Agenda for Action was reviewed, major obstacles and strengths in flfilling the Stockholm commitments were identified and the next phase of action planned. 1.2 FRAMEWORK AND DEFINITIONS A child is defined in the UN Convention on the Rights of the Child (CRC) as a person nder the age of 18. This incldes infancy, early childhood, middle childhood and adolescence. While all states in Soth Asia have ratified the CRC, the concept of childhood is often defined in relation to pberty or socio-cltral contexts. Girls and boys, from an early age, are often forced to fnction as adlts. For example, for many girls in Soth Asia the search for a hsband starts arond the onset of menstration and may reslt in marriage before menarche. 1 Considerable ambigity is also reflected in laws concerning the definition of a child. The legal definition of child may differ among contries, and even within contries for different prposes, and between boys and girls. According to the CRC, all children have the right to be protected from sexal exploitation. However, the child s evolving capacities shold also be taken into accont. Adolescents, yoths, and yong people are grops having other rights; for example in relation to migration, age of sexal consent and child work in non-hazardos labor. (Contry-wise information on Definition of a Child according to different laws within the region is presented in Annexre 4). INTERNATIONAL INSTRUMENTS ADDRESSING CHILD SEXUAL EXPLOITATION AND ABUSE Child sexal exploitation and abse have been recognised at the international level throgh varios instrments sch as the Convention on the Rights of the Child (1990) (CRC) and its Optional Protocol on the Sale of Children, Child Prostittion and Child Pornography ; the Convention on the Elimination of All Forms of Discrimination against Women (1981) (CEDAW); the UN Convention against Transnational Organized Crime with a special protocol to Prevent, Sppress and Pnish Trafficking in persons, especially women and children (2000); the ILO Convention 182 (1999), recognising child prostittion and child pornography as one of the worst forms of child labor. These international instrments offer varios definitions of sexal exploitation of children, inclding trafficking, and of child sexal abse (see Annexre 1). Many of the international instrments post-stockholm present a wider nderstanding of child sexal abse and sexal exploitation and are therefore a step forward in addressing these isses more holistically (for stats of ratification, see Annexre 2). 8

8 The UN has defined child sexal abse as contacts or interactions between a child and an older or more knowledgeable child or adlt (a stranger, sibling or person in a position of athority, sch as a parent or caretaker) when the child is being sed as an object of gratification for an older child s or adlt s sexal needs. These contacts or interactions are carried ot against the child sing force, trickery, bribes, threats or pressre. 2 Child sexal abse refers to a range of activities: toching and fondling a child s genitals, with or withot penetration, forcible intercorse with penetration of child s vagina or ans by a penis or other object (rape and sodomy respectively), regardless of ejaclation. 3 It incldes exposing children to adlt sexal activity or pornographic movies and photographs; making lewd comments abot the child s body; having children pose, ndress or perform in a sexal fashion on film or in person; and to peeping into bathrooms or bedrooms to spy on a child (voyerism). 4 The Declaration from the First World Congress against Commercial Sexal Exploitation of Children defines commercial sexal exploitation as sexal abse by the adlt and remneration in cash or kind to the child or a third person or persons. The child is treated as a sexal object and as a commercial object. The commercial sexal exploitation of children constittes a form of coercion and violence against children, amonts to forced labor and a contemporary form of slavery. The UNICEF definition frther links child sexal abse to sexal exploitation: Child sexal abse becomes sexal exploitation when a second party benefits throgh a profit or throgh a qid pro qo throgh sexal activity involving a child. This may inclde prostittion, brothel and street-based sexal exploitation, trafficking for sexal prposes and child pornography. 5 While recognising that there will still be debate abot varios definitions, for the prpose of this report, child sexal abse is nderstood as taking place both within and otside the family and incldes both physical RELEVANT ARTICLES FROM THE UN CONVENTION ON THE RIGHTS OF THE CHILD, adopted by all Soth Asian nations Article 34: States Parties ndertake to protect the child from all forms of sexal exploitation and sexal abse. For these prposes States Parties shall in particlar take all appropriate national, bilateral and mltilateral measres to prevent: a) The indcement or coercion of a child to engage in any nlawfl sexal activity; b) The exploitative se of children in prostittion or other nlawfl sexal practices; c) The exploitative se of children in pornographic performances and materials. Article 35: States Parties shall take all appropriate national, bilateral and mltilateral measres to prevent the abdction of, the sale or traffic in children for any prpose or in any form. Article 36: States Parties shall protect the child against all other forms of exploitation prejdicial to any aspects of the child s welfare. 9

9 contact and non-contact (sch as in the case of voyerism). As sexal abse is nderstood in this report, no commercial transaction takes place. In contrast, commercial sexal exploitation of children is nderstood as involving a transaction, throgh a qid pro qo and/or a perceived qid pro qo. Commercial sexal exploitation of children commonly refers to sing a child for sexal prposes in exchange for cash or in-kind favors between the client/cstomer and an intermediary or agent who profits from sch trade in children. Those who profit inclde a wide range of persons, inclding parents, family members, and procrers/agents, commnity members, largely men, bt also women. 6 They may be operating individally or as part of a syndicate. Commercial sexal exploitation incldes prostittion, sex torism and child pornography. Althogh the main theme at the Second World Congress in Yokohama is Commercial Sexal Exploitation of Children (CSEC), the Soth Asia Consltation and the Soth Asia Strategy also consider child sexal abse. In Soth Asia, child sexal abse within and otside the home, among all social and economic grops, is a critical concern; growing evidence sggests that child sexal abse is more prevalent than child sexal exploitation. While it is clear that the factors that contribte to the sexal exploitation of children are many and diverse, and may differ depending on the society or contry into which the child is born, one casal sitation is common to children across the globe: children who are sexally absed by someone in their own family or circle of friends are extremely vlnerable to sexal exploitation as well otside the family or later in life. In contries from the United Kingdom to Soth America, srveys among adlt prostittes have shown that many entered commercial sex after being absed at home. A small-scale stdy in Bangladesh indicates the same. 7 Sometimes, sexal abse by a parent or relative drives yong people ot of the family home and onto the streets, where the need to srvive makes them vlnerable to pimps, traffickers, drg peddlers and other maniplation. 8 Gender discrimination and the sbordination of women and girls have been referred to as a fndamental case of commercial sexal exploitation. 9. Any long-term strategy for combating commercial sexal exploitation of children therefore reqires addressing all forms of gender-based violence, inclding sexal abse. Gender ineqality is widely prevalent in Soth Asia. Girls and women in Soth Asia face harsh discrimination that compromises their right to srvival, growth, development, protection and participation. Girls in many parts of Soth Asia lack eqal access to edcation with boys, so the region is home to the largest gender gap in edcation levels in the world. Soth Asia is also the only region in the world where men otnmber women. An estimated 79 million women are missing throgh discrimination, neglect and violence. 10 Gender based violence is common given the patriarchal strctres in the region. This is illstrated in emerging statistics on female infanticide, honor killing, acid and dowry deaths and nmeros other forms of violence against girls and women. Sexal violence is directly linked to increased vlnerability amongst girls and women to sexally transmited infections (STIs) inclding HIV/AIDS. 11 Genderbased violence tends to increase in refgee sitations More than 26 million refgees, asylmseekers and internally displaced persons are registered world-wide and millions more are nregistered. Flly 50% are girls and women. 10

10 Discrimination of women and girls is also reflected in male control over female sexality and, to some extent, the legitimisation of prostittion of yong girls and women. 12 Deep rooted ineqality in strctres and systems within families and commnities, perpetated by cltral norms and practices, are factors to consider in combating commercial sexal exploitation of children in Soth Asia. There are also indications that individals who are sexally absed dring childhood may become absers themselves as adlts. 13 While more information is needed to make sch a conclsion with certainty, this report will for these reasons address both commercial sexal exploitation of children and child sexal abse. Trafficking of women and children is often considered as interchangeable with sexal exploitation. However, while the two are certainly inter-linked, as trafficking often leads to commercial sexal exploitation, trafficking shold be recognised as a process involving other forms of exploitation, forced labor or services, slavery or practices similar to slavery, servitde or the removal or organs

11 SITUATION ANALYSIS In Soth Asia, commercial sexal exploitation of children and child sexal abse are some of the least explored forms of child abse. Lack of sond methodologies and indicators to condct comprehensive research and to compile qantitative data often associated with isse of abse, exploitation and neglect, limits the availability of systematic qantitative and qalitative data. Inadeqate and ineffective legal provisions and the absence of monitoring systems also impede data collection. It has been pointed ot that in Soth Asia talking precisely abot sexal abse is not cstomary even among psychiatrists. The very lack of direct and clear langage to discss child sexal abse makes diagnosis and treatment problematic. 15 This also impedes data and information collection. While most available estimates for commercial sexal exploitation of children and child trafficking in many of the Soth Asian contries are otdated, varios national stdies make clear that the problems of commercial sexal exploitation of children and child sexal abse are widespread, and are acqiring alarming proportions. 16 Nmeros smallscale stdies, newspaper reports and case stdies from several contries provide insight into the natre and gravity of this problem. Commercial sexal exploitation of children and child sexal abse in Soth Asia very often have ndertones of gender discrimination against females. Girls are at greater risk of commercial sexal exploitation than boys becase they face doble discrimination and vlnerability, sffering on accont of their gender as well as their socio-economic stats. Sexal abse and exploitation have been fond amongst the most prevalent forms of violence that affect girls throghot childhood and adolescence. 17 However, boys are also clearly at risk of commercial sexal exploitation and sexal abse. 2.1 COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN Child prostittion, sale and trafficking of children for sexal prposes and child pornography, involving both boys and girls, are closely linked. Child prostittion is freqently combined with the prodction of pictres, videos and other sexally explicit visal material involving children. The estimated nmber of children in prostittion in Soth Asia varies. Figres for children engaged in prostittion in India s metropolitan cities range from 270,000 to 400, In Nepal, the problem of child prostittion is believed to be spreading all over the contry, predominantly in rban areas and along highways. One srvey estimated that 800 girls are engaged as sex workers in the Kathmand valley alone. 19 Prostittion of boys is known in Pakistan, althogh figres are hard to obtain. A stdy has reported that children are lred into sex work by making them dependent on drgs. The practice of bringing boys to cinema halls where x-rated films are being screened has also been reported. 20 Commercial sexal exploitation of boys has also been reported in Bombay. 21 To date, commercial sexal exploitation of children has not been identified as a problem in Bhtan and Maldives. 12

12 The growth of sex-torism for child sex absers, inclding pedophiles 22, has been increasingly noted in Sri Lanka, India, and Nepal, catering primarily to demand from foreign torists. The majority of child sex absers are non-pedophiles, bt are often reglar sers of commercial sex workers who by children for sex as part of the mainstream sex trade. 23 In Sri Lanka, the problem of child prostittion, primarily among boys, is highly visible in beach resort areas. Their ages generally range from eight to 15 years. These yong male sex workers are sally school dropots, working for little money while nrtring the dream of qick and easy money. 24 Nevertheless, in relation to sex-torism examples from Sri Lanka show that local child sex absers often ot-nmber the torists by many thosands. 25 The potential danger of child sexal exploitation shold not be overlooked in the Maldives since torism is the contry s largest indstry. The risk is, however, minimal as torists generally stay in resorts hotels bilt on ninhabited islands. Althogh child sex workers have not so far been officially reported in the Maldives, nofficial reports do exist of forced prostittion and drg related jvenile prostittion. While commercial sexal exploitation often incldes elements of force, it shold also be recognised that children have also been fond willingly engaging in sex related work for profit, althogh the distinction between volntary and forced is difficlt to make. Yonger street boys in Bombay and Calctta are reported to form steady relationships with older boys for protection from other bllies and gradally accept sex as part of the relationship. 26 Most children who are sexally exploited seem to be girls between 13 and 18 years old, and the average age of the children involved is falling. Certain categories of children are particlarly vlnerable to sexal exploitation becase of their socio-economic stats. These inclde boys and girls of nderprivileged and marginalised religios and ethnic minorities or caste grops. Refgee children, street children, children of sex workers, children in commnities where tradition or cstom psh them into sexal exploitation, children in instittional care, or in work places - especially in domestic labor - are considered particlarly at risk of varios forms of sexal exploitation. Also, migrant labor, bonded child labor, children affected by disaster and involntary displacement, children in sitations of armed conflict and child soldiers have been fond to be at risk of sexal exploitation and abse. Redced access to reprodctive health services, and edcation abot sch services, increases the vlnerability of adolescents in particlar. 27 Stdies also show that women with disabilities are two to three times more likely to be victims of physical and sexal abse than women with no disabilities. 28 The same is likely to apply to girls. In Nepal, cltral forms of prostittion among Badi and Deki commnities still prevail in some parts of the contry, where girls are forced into sex work as a socially accepted means of srvival. Men in the Badi commnity commonly involve their wives and daghters in commercial sex work to spport the family. It is reported that 35 to 40% of Badi women involved in prostittion are nder the age of 15. In India, several grops sch as the Nats, Rajnats and Bhart in Uttar Pradesh, Rajasthan, and Madhya Pradesh, are examples of castes and tribes that practice cltral forms of prostittion. 29 Prostittion with religios sanctity also exists in India and Nepal. For example, in Soth India and some parts of Maharashtra, it 13

13 is practised according to traditions like Devadasi, Jogin, Matamma. Also known as temple prostittion, these traditions allow sexal exploitation of yong girls by the temple priests in the name of dedicating sch girls to the deities. These religios forms of prostittion have completely degenerated and serve as a sorce that spplies girls to brothels in major cities like Bombay. In fact, many Devadasis and Jogins are today fond in the Kamathipra red light area in Bombay. The UN Special Rapporter on Violence against Women points ot in her 2000 report that trafficking in girls and women appears to have become a thriving indstry in the contries of Soth Asia. While hard data are not available regarding the nmber trafficked for commercial sexal exploitation, NGO activists in Bangladesh estimate that 10,000-15,000 girls and women are trafficked across the border to India each year. Similarly, an estimated 5,000 to 10,000 girls from Nepal are trafficked to India per year. While forced prostittion remains the primary goal for traffickers of women and girls into India, child trafficking occrs in the region for many prposes, inclding varios types of legal and illegal work, as domestic servants, and bonded laborers. 30 Many boys from Bangladesh, India, Nepal and Pakistan are sent to the United Arab Emirates to serve as camel jockeys. Yong girls from certain rral districts of India, Nepal and Bangladesh are trafficked for marriage and then sold into prostittion. Similarly, girls from India are also trafficked to Glf states. 31 Children are trafficked for entertainment as a part of dancing and theatre troops sch as jatra and natanki in India, or for circses from Nepal to India. Girls from the sb-continent are also reported to be trafficked as dancing girls to Dbai. While not all of these children are sbjected to exploitative and absive sitations, some have been fond to be sexally absed and vlnerable to being frther trafficked. Trafficking cannot be seen ot of the context of migration. Evidence sggest that traffickers often merge with the general poplation moving across open borders, and that traffickers freqently exploit the desire on the part of girls and women to migrate to escape poverty and discrimination at home. Therefore, while fewer victims are being kidnapped or abdcted, an overwhelming majority are trafficked throgh deception and false promises. They are therefore active participants in their own trafficking, at least at the beginning where the process incldes recritment and transportation. This dimension adds to the difficlty of developing methodologies to ascertain the actal nmber of trafficked persons and of creating effective interventions against the phenomenon. 32 While the open borders between many Soth Asian contries allow large movements of poplations, imposing more stringent immigration and border srveillance does not seem to be the soltion; the problem of trafficking most likely wold go frther ndergrond and become even more profitable. Very little data exists on child pornography in Soth Asia. Some cases have been noted in India (Goa and Mmbai) of which a few have also been taken to the cort of law. In Sri Lanka, reports on cases of child pornography freqently appear in the press. 33 Several NGOs across the region have been demanding the introdction of extra-territorial legislation whereby criminals responsible for child pornography and the prodction of pornographic material 14

14 involving children can be pnished in the contry of their origin for crimes committed in another contry. The fast growing IT sector has also led to promotion of child pornography on the Internet. Contries like India, Pakistan and Nepal have been discssing this phenomenon and there have been demands by parents and NGOs to introdce filtering devices on the Internet that deny access to pornographic sites CHILD SEXUAL ABUSE 2.2 While child sexal abse cts across caste, class, ethnicity and location, street/homeless children and working children, particlarly domestic workers and poor children, have been identified as experiencing an especially high risk of sexal abse. 35 Newspapers freqently report sexal abse in schools and at work places, within instittions sch as prisons and remand homes, on the streets and other pblic spaces. 36 Homosexal rape of yonger street boys has been reported in Mmbai, Delhi and Calctta. Being tramatised by their first experience, they are often threatened into acqiescing sbseqently. Moreover, the children sbjected to this sexal violence have little or no access to information, conselling and services for the prevention of STIs inclding HIV/AIDS. With respect to sexal abse, it appears that no age is safe. In some cases sexal abse has been reported on girls as yong as a few months old, and data indicates that the age grop 10 to 15 years is the most vlnerable grop of children to sexal abse. 37 In Bangladesh, child sexal abse has been recognised among children employed as domestic workers. A stdy by the NGO Breaking the Silence fond that 13% of the victims had been absed by an employer s son. In India, as in other contries, most victims of sexal abse were more often than not raped or absed by family members, close friends and relatives. Figres from Delhi from 1994 show that nearly two ot of three rape victims were children. 38 In Nepal, dring 1995 and 1996, a local newspaper reported a nmber of rape cases in which the majority of the victims were nder 16 years. 39 While girls in general face a greater risk of being sexally absed, boys are also at risk. A small scale stdy in Pakistan claims that 35% of child victims of sexal assalt were boys. 40 Althogh sexal exploitation of children has not been recognised in the Maldives, cases of child sexal abse are being increasingly reported to the Government s Unit for the Rights of the Child CAUSES OF COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN Many factors, both modern and traditional, are commonly cited for commercial sexal exploitation of children and trafficking, inclding trafficking for sexal prposes. Globalisation is a stimls since it involves increased trade across national borders, greater mobility of capital and workers, increased rbanisation, and the incorporation of sbsistence commnities into the market economy. Globalisation has also led to the growth of torism, the expansion of international organised crime, the profitability of trafficking and the conseqent commodification of children s bodies. Large profits lead to the well-known nexs between prostittion mafias, law enforcement agencies and others. Family members are sometimes also involved in the trafficking of children as a means of earning money. Commnities along many borders also profit from trafficking by providing meals, shelter and other spport services. 15

15 Frthermore, that border officials sometimes seek personal financial benefits ot of trafficking is no secret. Poros borders between some contries in the region allow for extensive trafficking and sexal exploitation of children and women. According to a March 1994 Sindh Police Report, borders in Soth Asia are generally poros, where some borders remain entirely ncontrolled. 42 In particlar, the poros India-Bangladesh and open India-Nepal borders are known for trafficking in women and children. Bangladeshi women and children are trafficked to India throgh the bordering districts: Satkhira, Jessore, Jhenidah, Meherpr, Rajshahi, Nawabganj, Joyprhat (sending rote in Bangladesh). Indo-Bangla international border at Khojadanga in the North 24 Parganas in West Bengal is the receiving area in India. The trafficking from Nepal largely takes place throgh the adjoining border districts of Bihar and West Bengal, from where they make entry into other places in India. The Nepal-U.P. border is also another easy entry point. 43 In Bhtan, a task force has been created by the local police to crb the increase of commercial sex workers, particlarly in the border town of Phntsholing where the poros borders between India and Bhtan have allowed for typical sex indstry clientele to seep throgh, while those selling tend to take their trade ot as well. 44 HIV/AIDS in Soth Asia Available epidemiological indicates that globally 50% of HIV infection is among yong people below 25 years of age. 45 In most contries in the region, HIV infection is now concentrated in certain grops sch sex workers and intravenos drg sers. 48% of adolescent sex workers in Pne, India are HIV positive. Infection rates among sex workers in Nepal have soared in recent years from 2% in 1996 to 20% in The average age of sex workers in Nepal is years % of adolescent sex workers are infected with HIV/AIDS in Pne, India. 47 In general, information levels on HIV/AIDS are still low. According to NFHS II, ( ), in India only for ot of ten married women and only 18 % of illiterate women have ever heard of AIDS; 86 % of married girls in Bangladesh between years of age still don t know how to protect themselves from infection. 48 There is limited access to information and services for yong people and more so for marginalised poplations sch as sex workers and street children. The se of condoms for safe sex is very limited. UNAIDS reports that the fear of HIV seems to be prompting some men to seek ot yong girls as partners whom they believe are less likely to be infected, ths leading to larger demand for them by brothel owners. Men who fear acqiring HIV may nonetheless be infected themselves withot knowing it; in trn they infect their yong partners. (Over 90% of those infected in the developing contries are not aware of their stats. 49 ) In addition, some men believe that engaging in sexal intercorse with a virgin offers a cre for AIDS. 50 In brief, the interplay of biological, cltral and economic factors makes yong girls who are sexally exploited particlarly vlnerable to the sexal transmission of HIV. Individal factors leading to child sexal exploitation inclde family breakdown, migration of mothers and single parent hoseholds. Family disptes and domestic violence leading to abse at home, being in sbstitte or instittional care, drg addiction and family histories of sexal exploitation are additional contribting factors. 16

16 Social discrimination against women has also been mentioned as a factor responsible for women leaving home. Lack of access to inheritance, land and employment, and the practice of polygamy make women easy prey for traffickers who exploit their desire to migrate. Child marriage and nilateral divorce also increase the vlnerability of women and girls to the whims of male partners. 51 Child marriage exists in India, Pakistan, Nepal and Bangladesh. Reports reveal marriage of girls of 10 years old or even yonger. The age of marriage has traditionally been determined by the concept of childhood, which across the region was generally seen as a period of life that ended as soon as children attained pberty. Not only does early marriage add to the brden of girls, it also leads to sexal abse. Non-registration of marriages is another serios problem that allows child marriages to contine. In Soth Asia, increasingly violent ethnic and armed conflict accompanied by persistent and widespread poverty are factors making children more vlnerable to sexal exploitation. Clearly, poverty is not the single largest factor contribting to commercial sexal of children. It mst be remembered that while poverty is an nderlying case for commercial sexal exploitation of children in Soth Asia, which interacts with the making of profit from the circmstances of the poor, it cannot be an excse for it and mst be contered throgh positive advocacy and proactive measres. 52 Althogh the notion has received little systematic attention, it has been sggested that in areas of conflict where families have lost a male hosehold head, girls lacking a father to protect them may be more vlnerable to sexal exploitation and rape. 53 National stdies have shown that girls growing p in brothels are very likely to follow in their mother s footsteps. Alternative means of living is rarely an option as sex workers and their children are not accepted by the rest of society and children often face difficlties being admitted in schools. 54 With no schooling and often low self-esteem, breaking the vicios circle of second-generational prostittion is qite difficlt. Limited access to niversal qality edcation and hence lack of life skills, economic secrity and social protection increases children s vlnerability to commercial sexal exploitation and child sexal abse. In Soth Asia, while some progress in edcation can be noted, enrolment and retention rate in parts of the region, especially for girls, are far from satisfactory. In addition, the qality of primary edcation is so poor in mch of Soth Asia that little is being learned. Lack of birth registration de to the absence of enforcement systems, limited awareness and cmbersome procedres in mch of Soth Asia has mltiple implications. Children whose existence is not legalised lack a clear nationality and official identity of age and location, and are ths more vlnerable to being sold and trafficked. Non-registration of births cases problems in determining victims ages, depriving them of government-adopted child protection measres. In addition, Soth Asia is host for a large nmber of nrecognised refgees. Whatever factors may be the factors responsible for commercial sexal exploitation of children and child sexal abse, adeqate attention mst be paid to the adverse impact of commercial sexal exploitation and sexal abse on the very life and dignity of children who fall prey to them. 17

17 2.4 LONG-TERM IMPACTS ON BOYS AND GIRLS Conditions of prostittion in many Soth Asian contries resemble slavery. Girls are held in brothels against their will; they are tortred, degraded, beaten and forced into sbmission throgh deprivation of food and water. 55 Sexal abse and exploitation of children reslts in physical injries sch as brises, nwanted pregnancies and infections in the vagina and ans. Sexal abse and exploitation also sbjects children to mental and psychological trama as well as exposing them to social ostracism and a ftre of violence and poverty. The notion of personhood of children and women is severely nderminded throgh sexal abse and exploitation. The psychological and emotional impacts inclde depression, fear, mental distrbances, sleeping problem and low self-esteem. 56 The trama the children experience renders them frther ssceptible to drg abse, with adlt traffickers and other child sex exploiters encoraging drg se and addiction in order to gain more control over the children. Child victims may become both physically and emotionally dependent on their absers. The loss of an affirmative sense of self is a serios mental health impact that is often obscred in the processes and procedres involved in recovery and reintegration of the victims. 57 Moreover, repatriation, rehabilitation and re-integration of children who have experienced commercial sexal exploitation into families and homes is often difficlt becase of the stigma attached to sch children, especially girls. Some families wold rather disown their daghters, or have them dead, than have a tainted girl in the family, one with no ftre possibility of marriage or social acceptance. Commnity-based rehabilitation is the most sstainable way of ensring rehabilitation and reintegration of the victims of sexal abse and exploitation. However, this may be viable only if accompanied by trama therapy for the victims and conselling for the family and commnity. Sstained programmes for commnity sensitisation and all possible attempts to bring abot an attitdinal change are imperative for effective and sccessfl commnity based rehabilitation.bring abot an attitdinal change are imperative for effective and sccessfl commnity based rehabilitation. 2.5 LEGAL FRAMEWORK AND LAW ENFORCEMENT By ratifying the UN Convention on the Rights of the Child, all contries of Soth Asia have become accontable to their citizens, inclding children, and to the international commnity, to respect, protect, promote and flfil child rights. They mst take deliberate action to ensre the progressive flfilment of rights and the transparent assessment of progress. Most contries in Soth Asia have compiled laws relating to children, bt governments have adopted a piecemeal approach to making them conform to the CRC. Althogh the CRC has to some extent inflenced fresh legislation, few child rights laws appear to have been enacted or amended specifically in response to it. 18

18 Who Perpetrates Sexal Abse and Trafficking? Child sexal abse may come from within or otside the family. Often the abse is perpetrated by someone familiar to and trsted by the child. Absers are sally men, bt are sometimes boys and can also be women. Family members can inclde immediate relations, other relatives and family friends. Schoolteachers, caretakers, neighbors, commnity members, religios leaders and local politicians, are also common absers, althogh abse can also be perpetrated by complete strangers. Factors referred to as nderlying child sexal abse inclde notions of sexality and masclinity, gender-discrimination and power relations. Failre to nderstand the needs of a child and notions of childhood are also discssed in the context of addressing child sexal perpetrators. Targeting child sexal abse also reqires an nderstanding of perpetration as strctred arond dimensions of sexal fantasy, sexal norms and sexal demands/needs. The trafficking of children is carried ot by individals or organised crime syndicates throgh employment agents, local criminals with connivance and assistance from corrpt officials, inclding local police, border police, officials on dty at the airport, passport officials and so on. The main approach to legal reform has been to reglate the system in which violations occr by taking an increasingly hard line against the perpetrators. Governments have generally avoided enacting laws that reglate behavior within the private domain, based on the common assmption that families, immediate or extended, flfil their obligations to children s rights to the best of their abilities. How to address child sexal abse within the family remains a challenge. While measres have been taken to ensre children improved protection from abse and exploitation, existing laws reqire re-examination and reformlation to cover the wide range of offences now being witnessed. In addition, ineffective enforcement and jdicial procedes are factors exacerbating the problem of child sexal exploitation and abse, as is the silent collsion of the larger society s general nwillingness to acknowledge or protest this atrocity. Also, few consider the social, economic, cltral and religios environment that sometimes overrides the law and leaves children, especially girls, at great risk. For example, despite a legal minimm age for marriage, cstom may dictate that girl children can nonetheless be married before reaching that age. The gap in law and law enforcement is a common problem across the region. While it has been raised at varios platforms and acknowledged by the governments, serios effort is reqired to address it withot any frther delay. 19

19 AFTER STOCKHOLM TOWARDS YOKOHOMA Commitments to address commercial forms of sexal exploitation of children were made in 1996 at the first World Congress in Stockholm by adopting the Stockholm Agenda for Action. As participants in the Stockholm Congress, Bangladesh, India, Nepal, Pakistan and Sri Lanka all adopted the Agenda for Action. The Agenda provides a checklist of essential actions that range from criminalising adlt exploiters to non-penalisation of child victims and increased protection of children throgh more effective law enforcement. Other integrated measres to prevent commercial sexal exploitation of children inclde more access to edcation, commnity mobilisation and anti-poverty programmes, recovery and reintegration of child victims and participation of and partnership with children against the phenomenon. The following provides an overview of interventions made by Soth Asian contries after the Stockholm Congress. 3.1 NATIONAL PLANS OF ACTION (NPA) In Nepal, a National Plan of Action (NPA) to Combat Trafficking in Women and Children for Commercial Sexal Exploitation was prepared in co-ordination with ILO/IPEC in The Cabinet formally approved it in The NPA incldes policy, research and instittional development. Recently, with spport from ILO/IPEC, it was reviewed throgh a consltative process which inclded children. India adopted a NPA to Combat Trafficking and Commercial Sexal Exploitation of Women and Children in Salient featres of the NPA inclde awareness generation and social mobilisation, health care services, edcation and child care, hosing, shelter and civic amenities, economic empowerment, legal reforms and law enforcement, resce and rehabilitation, instittional machinery, and methodology for translating action points into action. 58 Pakistan adopted a NPA to Combat the Worst Forms of Child Labor in 1999, and a Plan of Action against Sexal Exploitation and Abse of Children has been drafted. While the draft NPA is ready for approval by the Cabinet, the process of consltation with the civil society is still contining. 59 The draft NPA was prepared by a Core Grop of experts. A two-day national consltation was organised to discss and provide inpt to the draft NPA. As drafted, the NPA focses on improved qality of life for all children in a jst, hman and child-friendly society. It has three distinct components of prevention, protection, recovery and reintegration implemented throgh a participatory approach. 60 In Bangladesh a Core Grop was established in 2001 consisting of NGOs, INGOs and UN agencies, headed by a senior official from the Ministry of Women and Children Affairs. The task of the Core Grop and its sbsidiary sb national Technical and Child Consltation grops are to create a national policy that addresses both sexal abse and exploitation 20

20 (inclding trafficking) of children and to identify good practices to combat sexal abse and exploitation of children. A participatory process led to the development of a National Plan of Action to Combat Sexal Abse and Exploitation of Children, inclding trafficking. In addition to being a prodct of a diverse grop inclding NGOs, INGOs, UN and government representatives, it has soght to ensre the inpt of divisional and district level officials and NGO representatives dring three sb national meetings. A separate process involved children s inpt in the National Plan of Action. It was ndertaken to ensre that their views were solicited and incorporated in an interactive, yet non-threatening way. Facilitators with extensive experience working with children and promoting children s rights designed the methodology and led the eight consltations held with children. 61 In Sri Lanka, the National Child Protection Athority (NCPA) has developed a draft Plan of Action for combating child trafficking with the assistance of ILO/IPEC in However, there is no Plan of Action specifically to combat commercial sexal exploitation of children. Implementing the Plans of Action remains a challenge in many contries and reqires concerted political will and allocation of adeqate resorces. Developing a clear work plan specifying how the NPA will become operational is essential. A work plan will also help in terms of improving co-ordination, identifying gap areas in services or information and in relation to on-going monitoring and evalation. The development of an NPA has in some cases involved coalition bilding and co-operation between government agencies, civil society and to some extent children s grops. It can be arged that this has led to better information sharing and raised awareness of child sexal exploitation and abse in the respective contries. Most Soth Asian contries have yet to establish national focal points with effective data bases against commercial sexal exploitation of children. In Sri Lanka, however, a Presidential Task Force was set p in December 1997 to plan interventions and programmes on the specific topic of child abse. One recommendation of the Task force was to establish a National Child Protection Athority (NCPA). Created as an Act of Parliament in Janary 1999, it is fnctioning directly nder the President as the focal point against child sexal exploitation and abse. Some of the NCPA fnctions are to advise the government on national policy and measres regarding prevention and treatment of child abse, co-ordination with and assistance to the torist indstry to prevent child abse related to commercial sex networks, consltation and co-ordination with relevant ministries, local athorities, pblic and private sector organisations, and recommending measres to prevent child abse and protect victims. The NCPA is establishing a database with the assistance of UNICEF. Withot adeqate knowledge and effective data bases in all contries on the extent, forms, cases and impacts of commercial sexal exploitation of children and child sexal abse, planning for action and carrying ot necessary interventions contines to be difficlt. 21
