THIS CONTRACT WILL NOT BE CONSIDERED TO BE IN EFFECT UNTIL THE DEPOSIT IS RECEIVED AND SIGNED by both the agent/performer and the OHTM. POLICIES AND RULES GOVERNING USE OF THE HASKELL OPERA HOUSE THEATRE The use of the facilities of the Haskell Opera House is a privilege granted by the Haskell Board of Trustees which can be revoked at the sole discretion of the Haskell Board, or the Opera House Theatre Manager, hereinafter known as the OHTM, at any time. a. The facilities included in the scope of the contract are: the main stage, dressing rooms, and public areas of the Opera House only, and exclude the use of all other areas of the Theatre/Library Building including, but not limited to the Haskell Free Library, its offices, and the Reading Room unless otherwise arranged. b. Application for the use of all the Lessor s premises must be made on the Lease or Rental Contract. The contract must be fully completed, signed and the OHTM, must receive the entire rental fee at the time of signing the contract. All persons executing the contract must be over twenty-one (21) years of age. c. A list of performers and staff/personnel is to be submitted with the contract. d. Permission to one applicant, or for one purpose of event, is NOT transferable, except by the written consent of the Haskell Board and/or the OHTM. f. The Lessee is solely responsible for the behavior of all performers and personnel authorized in their assigned areas. ALL participants MUST wear identifying name tags. g. All fire laws must be obeyed. Flammable materials and open flame of any kind is expressly and strictly prohibited in or around the facility at any time. h. There is NO SMOKING ALLOWED in the facility. Anyone smoking in the building may cause revocation of the Lessee s privileges for future use of the facility. Fire doors and hallways cannot be blocked for any reason.

2 i. Illegal drugs, controlled substances and/or alcoholic beverages are not to be brought to the Haskell Opera House at any time. j. At the time of the executed Lease or Rental Contract, the Lessee shall name an individual agent of choice to be responsible for the Lessee s company and their personnel. Said agent shall accompany an opera house representative or security personnel on a walkthrough of the facility to determine condition of areas of the building to be used. A punch list will be reviewed with and signed by the Lessee and the Opera House agent stating any irregularities in the condition of the facility. Any alterations or damages caused during the Lessee s scheduled event not preexisting during said walkthrough will be sole financial responsibility of the Lessee. Repair and replacement costs will be provided by the Lessor upon request of the Lessee. k. It should be noted and conveyed to all performers, their staff, and their patrons, that the Haskell Opera House is the only facility of its kind in the world that sits in two countries. First time visitors and old friends of the Haskell Opera House must be aware that the border between Canada and the United States that runs through our building is real and it is enforced. Visitors from Canada must park their cars on the Church Street side of the building or report to US Customs via Cordeau St. and Dufferin/Main St. Visitors from the United States must park in our parking lot, on Caswell Ave. or another Derby Line street. It is expected that all visitors will return to their country of origin. Law enforcement authorities have recently increased their presence in the vicinity of the Haskell and visitors found to be in violation of border crossing rules are subject to detention and potential fines up to $5,000. The Lessor is NOT RESPONSIBLE for any persons being held by the authorities. For information about crossing the border into the United States, please refer to this website: FACILITY USE At least one month in advance, the Technical Director of the Lessee must submit all technical needs to the Haskell Opera House Technical Director, hereinafter known as the OHTD. BACKSTAGE includes two dressing rooms, a greenroom (that also may be used as a dressing room). Restrooms are exterior to the back stage, so they must be judiciously used during performances. Following a performance, these areas must be restored to their original state. BUILDING AND PAINTING SETS must be arranged with the Haskell OHTM. The stage (bathrooms and dressing rooms, if used for such) must be restored to their original condition. Failure to do so will result in at $250 cleaning fee. ANTIQUE SETS may be used only with prior authorization from the Haskell Board of Directors and the OHTM. An additional $150 will be assessed for the use of such. PROSCENIUM ROLL DROP is used only twice a year, at the beginning and the end of the season. Due to this rule, the fact that the stage is fully seen must be taken into consideration. SCENIC ITEMS AND EQUIPMENT brought into the facility, including set pieces, draperies, properties, costumes, additional electrical and sound equipment used for the event, must be struck

3 and loaded immediately after the last performance unless previously agreed upon in writing with the OHTM. The Lessee is responsible for covering any expenses incurred by the Lessor to restore the theatre, upper and lower levels, dressing rooms, lighting equipment, and tech communication system (if used), to their condition prior to the Lessee s rental. SCENIC PIECES AND PROPS are to be stored in such a manner as not to interfere with any Haskell Opera House function or in defiance of any regulations set forth by fire codes in both the US and Canada. Anything left behind by the Lessee will be considered unwanted and handled accordingly. Should the Lessee wish to leave items at the Haskell Opera House to be picked up at another time, a storage fee of $50 per day will be imposed on the Lessee. Special Effects Equipment The placement of special effects equipment must be approved by the OHTM or the OHTD. This includes, but is not limited to: fog machines, snow machines, confetti machines, and special lighting effects. No pyrotechnical equipment is allowed due to fire regulations. SUPPLIES must be provided by the Lessee, including all needed hardware, tools, gaffer s tape,. needed. The Lessor does not supply any of these items for performers use. SCREWING AND NAILING NO SCREWING OR NAILING INTO THE STAGE FLOOR OR WALLS IS PERMITTED. THE UTMOST CARE IS TO BE GIVEN TO THE HISTORIC PROSCENIUM. Any chips or damage to the plasterwork will be assessed by a Conservator and the Lessee must pay restoration charges. THEATRE CURTAINS Adjustment of Curtains is only to be done by the Lessor s staff or an approved Lessee technician. WIRES AND CABLES All additional cabling and wiring for lights and sound must run along the floor of the stage or house and taped in all appropriate areas to maintain safety of the technicians, actors, performers, speakers, and audience members. Prior approval is required. ONLY GAFFERS TAPE (not duct or masking tape), PROVIDED BY THE LESSEE IS PERMITTED FOR WIRES ON THE FLOOR. Wire and cable layouts must be approved by the OHTM or the OHTD prior to the performance. THIS IS A FIRE CODE REQUIREMENT. AUDIO EQUIPMENT The Haskell does not have a sound system. Should you bring in your own equipment, you must clear placement of on-stage speakers with the OHTM before set-up. Any use of on-stage speakers must be cleared with the OHTM before set-up. VIDEO RECORDING Video cameras are allowed only with prior approval by and arrangements with the OHTM. There will be NO EXCEPTIONS. TECHNICAL COMMUNICATION Use of the Haskell s technical communication system, with four wireless headsets, must be arranged in advance. A security deposit of $50 will be charged for the use of the system. This deposit will be refunded if no damage to the equipment has been assessed. If there is damage, the Lessee will be responsible for any repair costs above $50. SPIKE TAPE/LIGHTS If you spike the floor, you must remove the tape immediately after the performance. If you adjust and gel the lights, they must be returned to their original positions, with gels removed, at the end of the event. Due to rising costs of gels, all performers are hereby

4 required to provide their own gels for lighting instruments. Gel frames will continue to be supplied by the Lessor. The follow spot is the property of QNEK Productions and its use must be approved in writing. If you re-plug the dimmers, you must put them back as you found them. If you adjust the stage curtains (including cycs, back curtain, teasers, legs, pin rail system) Failure to comply with the above rules will result in a charge of $25 per hour to the OHTD for restoration. Use of the piano or antique sets/drops without written permission will result in a $100 fine. This is a new policy and will be STRICTLY ENFORCED. USE OF PIANOS Pianos shall not be moved or used without prior arrangement with the OHTM. Tuning of pianos is the responsibility of the performer. The official piano tuner for the Haskell is John Young john@youngspiano.com Due to his tight schedule, he must be contacted well in advance of the event. HASKELL HOUSE MANAGER the Haskell House Manager (HHM) is primarily responsible for the audience, ushers, and sellers. However, the HHM also has the authority to enforce any infringement of the contract in any part of the facility in the absence of the OHTM. ADDITIONAL TECHNICAL AND FRONT-OF-HOUSE SUPPORT may be necessary as determined by the OHTM and the OHTD or may be made available upon request of the Lessee, at an additional cost. Additional Security may also be necessary as determined by the OHTM. USHERS You are requested to provide your own ushers as the Haskell can no longer guarantee this service. Four (4) ushers will be required to be at the Opera House one (1) hour before performance to receive instructions from the Haskell House Manager. Please forward your usher s name to us as soon as possible. Should you decide not to use the balcony for seating, you will need to provide two (2) ushers. SEATING The Lessee reserves the rights to the exclusive use of the auditorium for the appropriated amount of time. If reserving specific or numbered seats, the Lessee is responsible for notifying a printer/agency concerning their seats. Should the Haskell provide ushers, the Lessor will allow seats for Haskell ushers plus one guest each, for a total of eight (8) at no charge, if available. Two complimentary seats will be given to the Haskell for discretionary use. CONCESSIONS No food or drink is allowed in the auditorium. No concessions will be sold by the Lessee at any performance without prior approval by the OHTM. The Lessor has first priority in selling any concessions prior to the event or during intermission, including but not limited to Haskell memorabilia, soda, candy, souvenirs, postcards, etc. All profits from these sales go to the Lessor. RECEPTIONS The Haskell Library Reading Room may be rented for receptions for $30 per hour. Arrangements should be made through the Haskell Librarian, Nancy Rumery. INTELLECTUAL PROPERTY The Lessee is solely responsible for obtaining the rights to perform, display or otherwise use any copyrighted materials including but not limited to text, live music recorded music, images, choreography or specific stage directions. BOX OFFICE The Box Office is to be manned by Haskell Opera House personnel ONLY, unless prior arrangement has been made, in writing, with the OHTM. PUBLICITY INFORMATION

5 POSTERS The Lessee is responsible for the design and printing of posters.* The Lessor will no longer be providing this service. The Lessee will provide four posters or flyers one month in advance of the performance for placement in the marquee and on the bulletin boards of the Haskell Free Library and Opera House. The Lessee shall not affix any materials to the building directly. Failure to comply with this procedure will lead to ALL publicity materials being removed from the building. Materials must be submitted to the OHTM for approval. All other placements of posters/flyers are up to the Lessee. All posters, flyers and any other publicity must include the Haskell Website, We are trying to drive all information seekers to the website. Performers are encouraged to register and provide some brief information to list their shows on Matchbook.org in order to better publicize them in the New England area. TICKETS The Lessee is responsible for the design and printing of tickets.* The Lessor will no longer be providing this service. However, in order to keep all Opera House tickets uniform, we ask that they be the size of a business card. Tickets should clearly state the name of the performer, group, or event; the date and time; and the ticket price in U.S. and Canadian funds. Samples are available upon request. Tickets may be reserved via telephone: Haskell U.S. box office, Canadian box office, TICKETS WILL NO LONGER BE SOLD AT THE HASKELL FREE LIBRARY. *Should you need anyone to create a poster or ticket design, we recommend the official publications designer for the Haskell, Susan-Lynn Johns atwhimseyworksvt@gmail.com. The Lessee will notify the OHTM of all Ticket Venues. Patrons paying by check should make checks payable to OTHER FEES AND INCURRED EXPENSES INSURANCE The Lessee must present proof of insurance to the Lessor. If the Lessee fails to provide proof of insurance or to purchase insurance, the Lessee will be required to sign the Haskell Hold Harmless Agreement and provide a deposit of $50 that is refundable if there is no damage. The Lessor disclaims all liability for any personal injuries incurred during the tenure of the rental by the Lessee. The Lessee applying for use of the Lessor s facilities agrees to assume full responsibility for damages to property and all personal injuries, and to fully compensate for all damages and injuries incurred. The Lessee agrees to be solely responsible for any damages occurring as a result of the Lessee or the Lessee s agents, and to reimburse the latter for any repair costs. PARKING LOT This lease does not convey any use of the Lessor s parking lot. Due to emergency and liability issues, use of said parking lot is restricted to staff and performers. All others may use the lot at their own risk. Parking is not permitted on Caswell Avenue. Additional parking is available on Main Street, Derby Line and in the Community National Bank parking lot, when available. The Lessee must

6 make every effort to convey this information to the Lessee s staff and clientele. The Lessor reserves the right to tow vehicles improperly parked. Notwithstanding the above parking injunction, the Lessee shall have the right to use the area for Load-in and Load-out during the agreed to date of performance. TICKETS WILL NO LONGER BE SOLD AT THE HASKELL FREE LIBRARY. BUILDING AND GROUNDS The Lessee agrees to comply with the Lessor s policy regulating the use of the Lessor s building and grounds, to comply with all requirements set forth in the Lessor s rates and conditions stated in this contract. It is also agreed that the Lessor shall not be liable for any property damage or personal injuries WHATSOEVER occurring from or connected with the granting of use of any Haskell facilities. LOAD-IN/OUT AND ELEVATOR USAGE A special key must be used to hold the elevator door in the open position while loading and unloading. Do not block the door instead of using this key. Any large equipment must be carried up the three flights of stairs with great care so as to not damage the stairs, walls, or ceilings, which are quite low in places. The Lessee is advised to pay special attention to the elevator weight limit. If unsure of the weight of your equipment, err on the side of lightness. Should anything happen to the elevator while you are loading or unloading, you will be billed for any subsequent repairs and/or overtime for Haskell maintenance or security personnel. FEES AND REQUIRED EXPENSES The Lessee is obligated to pay the rental fee of $375 in advance along with a signed contract This basic fee covers up to four (4) hours in the Theatre prior to the performance. In addition to the rent, the Haskell will receive 10% of the gate unless otherwise negotiated. CANCELLATION POLICY If a producer cancels more than three (3) months before the scheduled event, the producer will receive a full refund less $50 service charge. There is NO REFUND for events cancelled within three (3) months or less of the event. The Lessor has the option of cancelling a contract if all required fees are not received from the Lessee thirty (30) days prior to the event. Those fees that have been paid, are NON- REFUNDABLE. There is also a security deposit of $50 for use of the technical communication system. This amount is REFUNDABLE if no damage to the equipment has been assessed. The expense list below explains the breakdown of funds. A consultation with the OHTM will determine what services performers/renters need. In the event of any delay by the Lessee that leads to an extension of time beyond the time period agreed upon in the contract, the Lessee agrees to pay an additional fee. This fee is not prorated. Stage Hands $25 h PAYMENT INFORMATION All payments for rental of the Haskell Opera House must be made in check, cashier s check, or cash in US or Canadian funds, depending on current exchange rates. Forms of payment DO NOT include credit cards. Checks should be made payable to the Haskell Opera House. Fundraising It should be known that in order to raise money for the Opera House, the Lessor: rents seat cushions for 50 prior to the performance (The Opera House seats are not padded.) Personnel provided by the Lessor. sells raffle tickets for a 50/50 prize before the show and during intermission; half goes to the winner and half to the Haskell. sells a book about the history of the area written by Board member Matthew Farfan. All receipts go to the Haskell. announces the Adopt-a-Seat Project from the stage during the House Manager s welcome and announcements.
