4 Contractual Conditions and Challenges The HSL Zuid Contract (PPP) covers the infrastructure. The State is the Contracting & Developing Party, ProRail has been involved at a later time. In parallel there is a contract between the State and the High Speed Alliance (HSA), today NS-Highspeed, for the rolling stock. The TSI definition of trackside assembly defines a larger scope than what has been contracted to Infraspeed. Additional need to clarify the Real Configuration Tests (RCT) and the Safety Qualification Tests (SQT) etc. The HSL Zuid contract is mainly a functional contract. Technical specifications and details have been clarified after the contract had been signed. Originally the contract only required ETCS Level 2. Due to the very strict performance regime Infraspeed decided to additionally implement ETCS Level 1 as fallback level. 4
5 Baseline, Rules and Regulations ETCS and high-speed lines require dedicated operating rules. At the beginning of the project, operational procedures and rule books for ETCS and operation above 160 km/h were not available. Operational scenarios had to be created. Originally Unisig TSI was ordered. During the project, it had to be changed to and finally after CoA to (2.2.2 plus selected CRs, Subset 108) OBU definition received as a baseline to determine the impact on the infrastructure. Compliance with the rolling stock according to the definitions set up by the corridor countries. 5
6 Planning Challenges The HSL Zuid is the first border crossing ETCS project (first application of the TSI for border crossing, also for the Notified Bodies). Need to efficiently synchronise processes and all involved parties. The stations (Schipol airport, Rotterdam, Breda) are not included in the project. The connections were located at in total five heavily traffic-loaded areas (RAS). Possessions had to be required and managed. The main challenge has been timing rather than the technical changes update had to be squeezed into the customer s time frame with the target of producing no or little impact on the overall program executed by the State/HSA. Dependencies between rolling stock and infrastructure activities (access to site, compliance, test programme) had to be considered. 6
7 Border Crossing Challenges Unisig TSI as well as did not define the - hand-over at a technical border between two countries in enough detail. However, the ETCS L2-L2 border crossing at 300 km/h was a contractual requirement in both contracts. Several proposals had been made (e. g. wait until 2.3.0, Gateway, L1-L1 300 km/h connection as an interim solution). The States decided for the Gateway. During the past period of having no real - link across the border, the seamless L2-L1 solution was an auxiliary measure, which can be regarded as a best-practice example for preventing trains being stopped until the real - connection can be provided. Consequently, ETCS L1 is a useful measure to keep the performance and availability level high in case of a non-available ETCS L2. 7
8 Approval, Conformity, EC Declaration Whenever decisions are made in favour of a new technology, it is recommended also to consider the changes for operating staff. This applies to rules as well as to the approval process, especially in the case of the ERTMS process of reaching the position to release the EC Declaration of Conformity. The European process of achieving conformity and authorisation is not always and everywhere commonly seen and partly depends on interpretation. Contractual needs, standard definitions and reality may conflict with each other. Example: EC declarations are not defined for interim versions but might be needed for operational purposes. Way out: pragmatic and commonly target-oriented approach of all parties involved (customer, supplier, notified body, safety assessor, etc.). 8
