2 Trade in Goods Provisions of the CARIFORUM-EC EPA on trade in goods are contained in Chapter 1. Provisions apply to all goods originating in the EC party and in any CARIFORUM State. Originating means qualifying under the Rules of Origin in Protocol 1 of the agreement. The Rules of Origin to be reviewed within

3 Customs Duties Customs duty - include any duty or charge of any kind, including any form of surtax or surcharge, imposed in connection with the importation or exportation of goods. Customs duties does not include : Internal taxes or charges in excess of what is imposed on domestic products; Antidumping, countervailing and safeguard measures; Cost of services rendered.

4 Export Taxes Customs duties on exports not applicable to goods originating in CARIFORUM States and imported into the EC and vice versa. CARIFORUM States with customs duties on exports will eliminate these within three years of signature of the agreement.

5 Customs Duties on Imports Originating in CARIFORUM states Products originating in the CARIFORUM States shall be imported into the EC free of customs duties, except for the products indicated, and under the conditions defined in Annex 2.

6 Summary of Annex 2 EC customs duties shall be eliminated on all products of Chapters 1 to 97 of the HS except products of chapter 93. EC customs duties on rice, except rice in husk, originating in CARIFORUM States shall be eliminated from 1 January A tariff quota at zero duty of 187, 000 tonnes of rice shall be opened for 2008 and 250, 000 tonnes for 2009.

7 Summary of Annex 2 EC customs duties on sugar originating in a CARIFORUM State shall be eliminated from 1 October The provisions of the Sugar Protocol (contained in the Cotonou Agreement) shall remain applicable until 30 September A tariff rate quota at zero duty of 60, 000 tonnes of sugar shall be opened for the 2008/2009 marketing year, in addition to the allocations made under the Sugar Protocol.

8 Customs duties on Imports Originating in the EC Products originating in the EC and imported into the CARIFORUM States shall not be subject to customs duties higher than those indicated in Annex 3 of the Agreement. Products originating in the EC and imported into CARIFORUM shall be exempted from all customs duties other than those products listed in Annex 3.

11 Products for immediate elimination of customs duties Products for which the customs duty is already zero. Nuisance tariffs between zero and 5 per cent. Some other products which CARIFORUM States agreed to eliminate customs duties immediately upon implementation of the agreement.

12 CARIFORUM Market Access Conditions Elimination of customs duties will begin 3 years after signature of the agreement. Duties and charges, other than the import duties in Annex 3, may be applied up to 10 years after signature of the Agreement. A phased reduction of these duties and charges must begin 7 years after signature of the agreement. Fiscal reforms, with support from the EC, to take place over the period before duties and charges are eliminated.

13 Market Access Conditions Moratorium of 10 years for CARIFORUM States before customs duties are eliminated on motor vehicles. Moratorium of 10 years for Haiti only before customs duties are eliminated on some petroleum products. Schedule of customs duty reduction or elimination may be reviewed in case of difficulties.

14 Special and Differential Treatment In light of the development needs of Haiti, Guyana and the Less Developed Countries of CARICOM, the Parties to the EPA may decide to modify the level of customs duties stipulated in Annex 3, which may be applied to a product originating in the EC Party when imported into the CARIFORUM States.

15 Most Favoured Nation Clause The EC shall accord to CARIFORUM States any more favourable treatment resulting from the EC becoming a party to a free trade agreement with third parties after the signature of the EPA. CARIFORUM States or any signatory CARIFORUM State shall give the EC any more favourable treatment resulting from a free trade agreement with any major trading economy after the signature of the EPA.

16 MFN Clause A major trading economy means : Any developed country. Any country or territory whose share of world merchandise exports is above 1 per cent in the year before the entry into force of the free trade agreement entered into between the CARIFORUM State/States and the that country or territory. Any group of countries whose share of world merchandise trade is above 1.5 percent in the year before entry into force of the free trade agreement.

18 Regional Preference Clause Any more favourable treatment and advantage that may be granted under the Agreement by any CARIFORUM State to the EC shall also be enjoyed by each Signatory CARIFORUM State. More favourable treatment/advantage shall apply immediately upon signature of the Agreement with respect to zero rated products.

19 Regional Preference Clause Any more favourable treatment and advantage shall apply one year after the date of signature between CARIFORUM States which are More Developed Countries of CARICOM and the Dominican Republic. Any more favourable treatment and advantage shall apply two years after the date of signature, between the Less Developed Countries and the Dominican Republic. For Haiti the period is 5 years.
