PROSECUTING ATTORNEY S REPORT KYLE CHRISTOPHER Mr. Christopher gave the following report: For the month of December 2014, the overall license activity case load was 633, up from 617 in November of 2014, and up from 416 in December There were 461 cases currently in Legal to be reviewed, 11 cases set for probable cause, 31 cases where probable cause had been found/administrative complaints filed, 1 settlement stipulation approved, 1 informal hearings requested, 0 cases awaiting outside action, 23 cases ready for default, 42 formal hearings requested, 6 cases referred to DOAH, 1 case in settlement negotiations, 0 cases pending board date, 35 cases set for board presentation, 21 cases awaiting final orders, 0 cases under appeal and 0 cases had been re-opened. For the month of December 2014, 117 cases were closed. With nothing further to report the board voted unanimously to approve this report. ATTORNEY GENERAL S REPORT Douglas Dolan AMERICAN TENNIS COURTS INC PETITION FOR DECLARATORY STATEMENT Representative(s) from American Tennis Courts Inc. was present. Mr. Dolan presented this case stating American Tennis Courts Inc. filed a petition for a declaratory statement on October 20, The petition was noticed in the Florida Administrative Register on October 28, Mr. Dolan noted the petition seeks the Board s interpretation as to what Class Codes they should have for a Florida s Contractor s License. Mr. Dolan asked the Board to consider whether or not the petition meets the criteria for a declaratory statement, and to dismiss or answer as appropriate. After discussion, the Board voted the petitioner had standing. After further discussion, the petitioner withdrew his declaratory statement. LEONARDO AMPIE REQUEST FOR INFORMAL HEARING Mr. Ampie was present. Mr. Dolan presented this case stating Mr. Ampie s application FOR A Certified Mechanical Contractor s license was denied at the September 2014 meeting of the Board for failure to demonstrate required experienced, as required by Rule ,Florida Statutes, and Rule 61G , Florida Administrative Code. The Notice of Intent to Deny was filed in October of Mr. Ampie timely requested board reconsideration. Page 8 of 18

9 After discussion, the Board voted to vacate the previous denial and approve the application for a downgrade to a Certified Class A air conditioning license. MARK BIEBIGHAUSER PETITION FOR DECLARATORY STATEMENT Mr. Biebighauser was not present. Mr. Dolan presented this case stating Mr. Biebighauser filed a petition for a declaratory statement on October 15, The petition was noticed in the Florida Administrative Register on October 21, Mr. Dolan noted the petition seeks the Board to request a classification for Prestress/Precast Concrete Panel Erection in order for them to apply for a license with the. Mr. Dolan asked the Board to consider whether or not the petition meets the criteria for a declaratory statement, and to dismiss or answer as appropriate. After discussion, the Board voted to decline to answer due to lack of standing. BROWARD COUNTY BORA PETITION FOR DECLARATORY STATEMENT Representatives from Broward County BORA were present. Mr. Dolan presented this case stating the Broward County BORA filed a petition for a declaratory statement on October 15, The petition was noticed in the Florida Administrative Register on October 21, Mr. Dolan noted the petition seeks the Board s interpretation as to whether a Mechanical Contractor or Class A or B Air Conditioning Contractor can install, remove or replace the Air-Conditioning control wiring used to shut down air conditioning equipment by duct detectors in systems that are controlled by a Fire Control Panel. Mr. Dolan asked the Board to consider whether or not the petition meets the criteria for a declaratory statement, and to dismiss or answer as appropriate. After discussion, the Board voted the petitioner had standing. After further discussion, the Board voted that either a Mechanical, Class A or B Air Conditioning Contractor can install, remove or replace the Air-Conditioning control wiring used to shut down air conditioning equipment by duct detectors in systems that are controlled by a Fire Control Panel LEWIN CAMPBELL REQUEST FOR INFORMAL HEARING Mr. Campbell was present with counsel Mr. Dolan presented this case stating Mr. Campbell s application for a Certified Roofing Contractor s license was denied at the September 2014 meeting of the Board for failure to demonstrate the required experience, as required by Rule , Florida Statutes, and Rule 61G , Florida Administrative Code. Mr. Dolan presented this case stating Ms. Clayton s application to qualify an additional business was denied at the October 2014 meeting of the Board for failure to demonstrate financial stability, and responsibility, as required by , Florida Statute, and Rule 61G , Florida Administrative Code. The Notice of Intent to Deny was filed in October of Ms. Clayton timely requested board reconsideration. After discussion, the Board voted to vacate the previous denial and approve the application. FRANCISCO DALMAU REQUEST FOR INFORMAL HEARING Mr. Dalmau was present. Mr. Dolan presented this case stating Mr. Dalmau s application to qualify an additional business was denied at the October 2014 meeting of the Board for lack of experience as required by , Florida Statutes, and Rule 61G , Florida Administrative Code. The Notice of Intent to Deny was filed in October of Mr. Dalmau timely requested board reconsideration. After discussion, the Board voted to vacate the previous denial and approve the application. DIVERSIFIED CONVEYORS INC. PETITION FOR DECLARATORY STATEMENT Representatives from Diversified Conveyors Inc. were not present or represented by counsel. Mr. Dolan presented this case stating Diversified Conveyors Inc. filed a petition for a declaratory statement on October 27, The petition was noticed in the Florida Administrative Register on November 24, Mr. Dolan noted the petition seeks the Board s clarification of the Contractor License Statute confirming the category of Contractor License required for Conveyor System Installation or confirming that Diversified Conveyors, Inc. is not required to obtain a Contractor s License with the State of Florida. Mr. Dolan asked the board to consider whether or not the petition meets the criteria for a declaratory statement, and to dismiss or answer as appropriate. After discussion, the Board voted to deny the petition for declaratory statement due to lack of standing. CHARLES JOSEPH REQUEST FOR INFORMAL HEARING Mr. Joseph was not present Mr. Dolan presented this case stating Mr. Joseph s application to qualify an additional business entity was denied at the August 2014 meeting of the board for failure to demonstrate the required experience, as required by , Florida Statutes, and Rule 61G , Florida Administrative Code. The Notice of Intent to Deny was filed in July of Mr. Kennedy timely requested board reconsideration. After discussion, the Board voted to vacate previous denial and approve contingent upon providing satisfaction of lien and proof of bond. PHILIP MATHEWS REQUEST FOR INFORMAL HEARING Mr. Mathews was present. Mr. Dolan presented this case stating that Mr. Mathews application for a Certified Class B Air Conditioning Contractor s License was denied at the October 2014 meeting of the Board for failure to demonstrate the required experience, pursuant to , Florida Statute, as required by Rule 61G , Florida Administrative Code. RAINIER RODRIGUEZ REQUEST FOR INFORMAL HEARING Mr. Rodriguez was present. Mr. Dolan presented this case stating that Mr. Rodriguez s application for certified Class B Air Conditioning license was denied at the September 2014 meeting of the Board for failure to demonstrate the required experience, pursuant to section , Florida Statutes, and Rule 61G , Florida Administrative Code. The Notice of Intent to Deny was filed in October Mr. Rodriguez timely requested board reconsideration. After discussion, the Board voted to uphold the denial and after further discussion deny the application due to lack of experience. RICHARD SASTO REQUEST FOR INFORMAL HEARING Mr. Sasto was present with counsel. Mr. Dolan presented this case stating that Mr. Sasto s application for a change of status for a Certified Plumbing Contractor s license was denied at the May 2014 meeting of the Board due to lack of supervision pursuant to section , Florida Statues. Mr. Sasto timely requested board reconsideration After discussion, the Board voted to vacate the previous denial and approve the application. STEEL FABRICATORS LLC PETITION FOR DECLARATORY STATEMENT Representatives from Steel Fabricators LLC were present. Mr. Dolan presented this case stating the Steel Fabricators LLC filed a petition for a declaratory statement on December 8, The petition was noticed in the Florida Administrative Register on December 18, Mr. Dolan noted the petition seeks the Board s interpretation as to whether a license is required to perform structural steel and architecturally exposed structural steel work in Florida. After discussion, the Board voted the petitioner had standing. After further discussion the Board voted to decline to answer due to pending litigation.
