3 SECTION I - INTRODUCTION The Metropolitan Washington Airports Authority (the Authority) is responsible for the operation, maintenance and repair of Ronald Reagan Washington National Airport ( DCA ). The Airport is located in Arlington County, Virginia herein after referred to as the "job site (Appendix A). The Airport served over 19.7 million passengers in The contract that will be awarded by this solicitation is intended to provide for comprehensive Integrated Pest Management Services at Ronald Reagan Washington National Airport. The term of this contract is intended to consist of a two (2) year base period with three (3) one (1) year Options. Attachment 01 Statement of Work Page 3

4 SECTION II - SUMMARY OF WORK The contractor shall furnish all supervision, labor, materials, tools, supplies, equipment, transportation and applicable licenses and permits necessary to perform quality Integrated Pest Management (IPM) services at Ronald Reagan Washington National Airport. IPM services shall be performed in a manner that will ensure the health and general well being of both the public and airport personnel. The job site consists of 601 acres of which there are approximately 5.1 million square feet of interior facilities. The primary objective of the IPM program is to achieve long term, environmentally sound pest control through the use of a wide variety of technological and management practices. These practices include inspection/surveillance, identification, exclusion, trapping, communication, sanitation, biological and mechanical means of control, and where appropriate, application of pesticides as well as recommendations for structural and procedural modifications intended to eliminate the food, water and shelter available to pests. The contract that will be awarded by this solicitation is intended to provide for comprehensive IPM Services between the hours of 7:00 AM through 3:30 PM Monday through Friday with 24 hour emergency call back services 365 days a year at Ronald Reagan Washington National Airport. The contract shall also require performance of supplemental services on an as needed and reimbursable basis. Any item(s) of work, inspections, parts and service listed in this statement of work (SOW) shall not be construed as limiting the contractor to those items but rather as minimum requirements. 5 SECTION III - DEFINITIONS ACCEPTANCE - The act of an authorized representative of the Authority by which the Authority assumes for itself, or as an agent of another, ownership of existing and identified supplies, or approves specific services, as partial or complete performance of the contract. AIRPORT Shall refer to Ronald Reagan Washington National Airport. AOA - Aircraft Operation Area - The portion of the Airport used or intended to be used for landing, takeoff or surface maneuvering of aircraft. This is a security area requiring security badging. Workers in this area are required to obtain and display an AOA photo ID credential. Drivers in this area are required to obtain an Aerodrome Vehicle Operator's Permit. ATCT Air Traffic Control Tower. AUTHORITY - The Metropolitan Washington Airports Authority AUTHORITY WORK HOURS - The hours of 6:00 AM through 4:30 PM EST/DST, Monday through Friday, excluding weekends and holidays. CALL ORDER Contains a description of the Services, cost estimate, and schedule required from the contractor for any work under Supplemental Services. All Supplemental Services require a COTR signed Call Order. CLEAN The absence of dirt, litter, debris, dust, surface marks, fingerprints, spills, oils, gum, grime, film, stains, streaks, spots, blemishes, chemical residue, and/or any other foreign matter or chemical residue that can be removed without permanently damaging the underlying surface. CMMS - Computerized Maintenance Management System is used to schedule and generate work orders for all maintenance and repair activities performed for each piece of equipment covered under this Contract. CORRECTION Elimination of a Deficiency COTR Contracting Officers Technical Representative (COTR). DCA - Ronald Reagan Washington National Airport DUTY HOURS - The contractor shall provide services during the hours of 7:00 AM through 3:30 PM, Monday through Friday to fulfill the requirements of SOW. EMERGENCY SERVICE Contractor response to a reported rodent (live or dead) and/or any pest that has the potential to cause injury to humans. FEDERAL AVIATION ADMINISTRATION (FAA) - The federal branch of the government responsible for the regulations and procedures related to air transportation. GROUNDS - Includes land, parking lots, roadways, walks, bridges, airfields etc. at the Airport. HCS - Hazardous Communication Standard also known as HAZCON. Attachment 01 Statement of Work Page 5

6 INTEGRATED PEST MANAGEMENT (IPM) - A multifaceted approach to preventing and solving pest problems by integrating education, inspection, identification, sanitation, exclusion, communication, biological and mechanical means of control, and where appropriate, specific pesticide application. JOB SITE - The area within the Authority s property lines for DCA or portions of such area, which are defined within the SOW. LITTER - Debris, waste paper, rags, dust, dirt, beverage containers, trash etc. MA DCA, Engineering and Maintenance Department, Maintenance Engineering Division MSDS - Material Safety Data Sheet METROPOLITAN WASHINGTON AIRPORTS AUTHORITY (the Authority) - The public body responsible for the operation and management of both Washington Dulles International Airport (IAD) and Ronald Reagan Washington National Airport (DCA). OSHA - U. S. Occupational Safety and Health Administration. The Federal Government agency responsible for providing the rules and regulations on safety and health requirements in the work place. PRIMARY TERMINAL OPERATING HOURS - The Primary Terminal Operating Hours are 6:00 AM through 11:00 PM EST/DST, daily 365 days a year (includes weekend and holidays). Please note Terminals are open to the public 24 hours a day, 365 days a year. QUALITY CONTROL PROGRAM - A method used by the contractor to assure that quality Services are provided to satisfy the contract requirements. QUALITY ASSURANCE - A means by which the Authority is able to confirm that the quantity and quality of Services received conformed to contract requirements. These methods/procedures are not intended to aid the contractor in the performance of the contract requirements and shall not be a substitute for contract or quality control. SOW Statement of Work STATE - The Commonwealth of Virginia WORK CONTROL DESK Unit where contractor shall check-in and checkout when arriving or departing the Job Site. 7 SECTION IV - BASE SERVICES 01 DESCRIPTION OF SERVICES The contractor shall perform comprehensive Integrated Pest Management (IPM) services at all locations listed on the price schedule and as shown on Appendix A (with the exception of leased Food and Beverage space) in accordance with the Schedule of Services described in Appendix B. The contractor shall perform these services daily Monday through Friday 7AM through 3:30 PM with 24 hour call-back response 24/7/365. The contractor shall determine if pests are existent, perform necessary treatment and/or make recommendations to eliminate or control pests. 02 DESCRIPTION OF PESTS A. The contractor s IPM Program shall address abatement of the following pests: 2. Indoor and outdoor populations of cockroaches, mice, moles, voles, rats, ants, fleas, ticks, mites, spiders, silverfish and other insects, arachnids, and arthropods. 3. Indoor and outdoor populations winged stinging insects including nests. 4. Individuals of all excluded pest populations that are incidental invaders inside the specified buildings, including winged termite swarmers emerging indoors. 5. Mosquitoes 6. Midges B. Populations of the following pests are excluded from this contract: 1. Birds, bats, cats, dogs and snakes. 2. Termites 03 PERFORMANCE REQUIREMENTS The contractor s IPM Program shall use safe, effective, environmentally sound methods including biological/genetic/cultural control, mechanical/physical control, and where necessary, the judicious use of least hazardous pesticides. All services shall conform to the requirements specified herein. A. Insect Control 1. The contractor shall use non-pesticide methods of control wherever possible. Trapping devices, rather than pesticide sprays, shall the standard method for indoor fly control. 2. As a general rule, the contractor shall apply all insecticides as crack and crevice treatments only, defined in this contract as treatments in which the formulated insecticide is not visible to a bystander during or after the application process. 3. Application of insecticides to exposed surfaces or as space sprays (fogging) shall be restricted to exceptional circumstances where no alternative measures are practical. No surface application or space spray shall be made while tenant personnel are present. The contractor shall take all necessary precautions to ensure tenant and employee safety, and all necessary steps to ensure the containment of the pesticide to the site of application. 4. Bait formulations shall be the standard pesticide technology for cockroach and ant control, with alternate formulations restricted to unique situations where baits are not practical. 8 5. Sticky traps shall be used to guide and evaluate indoor insect control efforts wherever necessary. 6. A once yearly mosquito control treatment to help prevent the West Nile Virus is to be utilized. To accomplish this, the contractor shall place Altosid briquettes (150 day wet) are to be placed into approximately 300 drains airport wide as scheduled by the COTR. B. Use of Pesticide 1. The application of all pesticides shall adhere to all federal, state and local laws and regulations, including all applicable Environmental Protection Agency (EPA), Occupational Safety and Health Administration (OSHA), state/local regulatory guidance on pesticide storage, disposal and applications. 2. Pesticides shall be applied according to the methods, rates and precautions on the manufacturer s label. 3. Pesticide application shall be according to need and not by schedule. As a general rule, application of pesticides in any inside or outside area shall not occur unless visual sighting, inspection or monitoring devices indicate the presence of pests in that specific area. 4. When pesticide use is necessary, the contractor shall employ the least hazardous material, most precise application technique, and minimum quantity of pesticide necessary to achieve control. 5. Pesticides shall only be applied by personnel with a Commercial Pesticide Applicator Certificate or License. 6. The contractor shall not store any pesticide product on the job site. 7. The contractor shall obtain the approval of the COTR prior to any application of pesticide liquid, aerosol, or dust to exposed surfaces, or any space spray treatment. The contractor shall take all necessary precautions to ensure tenant and employee safety, and all necessary steps to ensure the containment of the pesticide to the site of application. Other than crack and crevice treatments, no liquid, aerosol, or dust applications shall be made while tenant personnel are present. C. Rodent Control 1. Indoor trapping As a general rule, rodent control inside buildings shall be accomplished with trapping devices only. All such devices shall be concealed out of the general view and in protected areas so as not to be affected by routine cleaning and other operations. The contractor shall check all trapping devices for rodents daily, and shall dispose of the rodents in an appropriate manner. 2. Use of Rodenticides The contractor shall use rodenticides in circumstances when rodenticides are deemed essential for adequate rodent control inside buildings. All rodenticides, regardless of packaging, shall be placed either in locations not accessible to children, pets, wildlife and domestic animals, and in EPA-approved tamper-resistant bait boxes. As a general rule, rodenticide application outside Attachment 01 Statement of Work Page 8

9 buildings shall emphasize the direct treatment of rodent burrows wherever feasible. Contractor shall be responsible for the dispose of dead rodents and shall do so in an appropriate manner. On occasion treatment of storm and/or sanitary drains may be required, this will be accomplished using appropriate methods for such treatment. 3. Use of Bait Boxes All bait boxes shall be maintained in accordance with EPA regulations, with an emphasis on the safety of non-targeted organisms. The contractor shall adhere to the following: a. All bait boxes shall be placed out of the general view, in locations where it will not be disturbed by routine operations. b. The lids of all bait boxes shall be securely locked or fastened shut. c. All bait boxes shall be securely attached or anchored to floor, ground, wall, or other immovable surface, so that the box cannot be easily picked up or moved. d. Bait shall always be secured in the feeding chamber of the box and never placed in the runway or entryways of the box. e. All bait boxes shall be labeled on the inside with the contractor s business name, phone number and address, and dated by the contractor s technician at the time of installation and each servicing. f. The contractor shall install and maintain bait boxes wherever necessary inside and/or outside of buildings for rodent control including, but not limited to, the vicinity of dumpsters, roll-off containers and trash compactors around the A, B and C Terminals. There are approximately forty five (45) dumpsters, roll offs and compactors at DCA. 4. Exclusion Services a. The contractor shall be responsible for exclusion services of potential rodent access points less than 1 inch in diameter within buildings. Exclusion services for holes/openings larger than 1 inch shall be accomplished under supplemental services. b. The contractor s primary exclusion work shall include copper mesh and expanding foam; sealant however, other methods may be used with the COTR s approval. Exclusion work shall be performed in a manner that does not leave an unsightly appearance. 5. Loading Docks The contractor shall provide a scheduled pest control inspection and treatment monthly from April through November during the hours of 11 p.m. to 3 a.m. This work with be performed in coordination with the Authority s monthly loading dock cleanings. 04 INTEGRATED PEST MANAGEMENT PLAN (IPM) The contractor s IPM plan shall address the following: A. Methods for inspection, monitoring and detection. Attachment 01 Statement of Work Page 9

10 The contractor shall describe methods and procedures to be used for identifying sites of pest harborage and access, and for making objective assessments of pest population levels throughout the term of the contract. B. Materials and Equipment for Service The contractor shall submit the current labels and Material Safety Data Sheets (MSDS) for all pesticides to be used, and brand names of pesticide application equipment, rodent bait boxes, insect and rodent trapping devices, pest monitoring devices, pest detection equipment and any other pest control devices or equipment that may be used to provide service. The Authority s approval of the submittal does not relieve the contractor of its responsibility to comply with the requirements of the contract documents. Attachment 01 Statement of Work Page 10

11 01 DESCRIPTION OF SERVICES SECTION V - SUPPLEMENTAL SERVICES The Authority may, during the term of this Contract, request that the contractor perform supplemental services which are outside the requirements of the Base Contract, i.e., special pest control services and technical consulting services. 02 CONTRACT SERVICES CALL ORDER A. The COTR will provide the contractor with a Contract Services Call Order (Appendix C) which includes a description of the work that is required. The contractor shall then provide the COTR a detailed cost and time estimate, which includes an itemized breakdown for labor, parts and materials as well as a schedule with critical milestones for completing the requested supplemental service. If and when the contractor s proposal is accepted, it then becomes part of the Call Order package and the COTR will authorize the contractor to proceed by signing the Call Order. The Call Order becomes binding when the contractor signs the Call Order. B. Labor rates included on the pricing schedule for the contract shall be used in preparing supplemental services estimates. Unless otherwise directed by the Authority, the contractor shall provide the Authority an accurate written estimate of the cost and time for the contractor to complete each of the tasks requested by the Authority. The contractor shall not proceed with any of the work described in such call orders until written authorization has been received from the COTR. C. The contractor shall be reimbursed for the labor and materials to complete such tasks in accordance with the provision of Section XIII of this SOW entitled "Method of Payment". D. The Authority shall incur no obligation for out of scope work that is not authorized in advance, in writing. 03 TECHNICAL CONSULTING SERVICES The contractor may be requested to perform technical consulting services such as: A. Analyze historical pest activity data and provide trending reports. B. Develop and present pest control presentations to upper level Authority management. The contractor shall prepare and provide all visual aids necessary to support the presentations. These visual aids shall include handouts, overhead transparencies, and Power Point presentations. 04 EXCLUSION SERVICES A. The contractor shall seal small holes/openings less than 1 inch in diameter under Base services. Openings greater than 1 inch in diameter the contractor shall request approval from the COTR and request a contract call order before proceeding with the work. 05 DOOR SWEEPS A. The contractor may be requested to provide and install broom type door sweeps 36 to 48 wide on doors with a gap greater than ¼ inch. Attachment 01 Statement of Work Page 11

12 01 CONTRACTOR'S PERSONNEL SECTION VI - GENERAL REQUIREMENTS A. For the purpose of this contract, the contractor's Personnel shall mean the contractor's employees (including but not limited to supervisors, managers, administrator, and technicians) and subcontractor(s) who are on the job site to fulfill the requests of the Statement of Work. B. The contractor shall have a licensed pest control manager assigned to support this contract. Persons applying pesticides must possess a current Virginia Department of Agriculture and Consumer Services Commercial Pesticide Applicator Certificate/License. The contractor will be responsible to ensure that the licenses/certificates and training of contractor personnel are kept current. C. At all times while on the job site, to fulfill the requirements of this Statement of Work (whether on or off duty), the contractor's employees shall conduct themselves in an orderly and safe manner. While on the job site, the employees shall not fight, engage in horseplay, be under the influence of alcohol and/or drugs, bring or consume alcohol and/or drugs, gamble, solicit, steal or commit any other crimes. The Authority may request the contractor to immediately and permanently remove from the job site of any employee engaging in acts that violate this section of the Statement of Work. D. The contractor s employees shall wear company uniforms comprised of a shirt with company identification logo and full-length pants at all times while performing work at the airport. Contractor employees not wearing the required uniform will not be permitted to perform work. E. At a minimum, the contractor shall have three individuals SIDA badged and certified to perform services at the airport, one acting as a regular service representative and the other acting as an alternate. F. Contractor personnel shall be certified to operate Authority provided and/or contractor rented man lifts necessary for the performance of IPM services. 02 QUALITY CONTROL PROGRAM A. The contractor shall implement an effective quality control program. This program shall insure the contractor fulfills all the requirements of this SOW. This program shall include but not be limited to including all elements of the quality control program described in the Technical Proposal that the contractor submitted in response to the Authority's solicitation for this contract. B. This program shall also include but not be limited to the following: 1. A proactive management system based on using quality control inspections as a means of monitoring work performance to ensure services and documentation are being provided in accordance with the contract documents. 2. Description of how inspections, scheduled and unscheduled, are to be conducted. 3. Documentation, such as inspection forms and corrective action forms that record inspections and recommended corrective action. C. At all times during the contract term the contractor shall provide no less than the level of quality described in this SOW. Attachment 01 Statement of Work Page 12

13 03 RESPONSE TIME A. The contractor shall be available, when requested by the Authority, to respond to and remedy all emergency pest related issues at the Airport 24 hours, 365 days a year for the term of the contract. This service shall be provided as part of Base Services and shall not be an additional cost. B. Contractor shall respond to all requests for service with 30 minutes during duty hours and within two hours outside of duty hours. C. Response time is defined as from the time the contractor receives the call from the Authority to the time the contractor arrives at the area requiring service. 04 CONTRACTOR CHECK-IN/CHECK-OUT Upon arrival to the site, the contractor shall immediately call the Work Control Desk and check-in, then notify the COTR that he is on site. The contractor will review the pest sighting log located at the Authority s Work Order Desk. At the conclusion of each work day the contractor shall document responses to the pest sightings reported in the pest sighting log before checking-out with the Work Control Desk. 05 DUTY HOURS Regular duty hours are defined as 7:00 am through 3:30 pm Monday Friday, excluding Federal holidays. If an area requires an after hour pest control treatment in order to mitigate disruption of operations, such as an Airline Club, the contractor shall perform this treatment at no additional cost to the Authority HOUR EMERGENCY CALL BACKS A. The contractor shall provide a 24x7x365 dispatch desk with a single point of contact for all 24-hour call back requests for service. A person, not voice mail, shall answer calls placed to the dispatch desk. Dispatch desk personnel shall be responsible to log and forward basic information about calls including party calling, caller s contact information, accurate description of the problem or request, extent of the problem. The phone number to the dispatch desk shall be provided to the COTR on the day of contract award. B. The contractor shall respond to all requests for service and corrective action 24 hours a day, 365 days of the year. The contractor shall be responsible for the first three service calls per calendar month under Base Services; after three service calls per month the contractor shall request a contract call order for the emergency call back. 07 COMMUNICATION AND COORDINATION A. The contractor shall maintain an effective communication and coordination policy with the Authority utilizing , telephones, faxes, pagers, etc. to ensure the Authority is kept abreast of current pest control status for the term of the contract. B. The contractor shall provide, at its own expense, mobile phone and electronic pagers and digital cameras to its personnel performing services at DCA. The contractor shall also provide facsimile, telephone and pager numbers by which the Authority can contact individuals who have the responsibility and authority for implementing all the requirements of the contract. 14 08 MEETINGS The contractor s representative shall attend meetings as required by the Authority to coordinate, evaluate and discuss issues and performance of the work under this contract. 09 ACCIDENTS The Contractor shall be responsible for promptly notifying the COTR and Airport Police of any accidents arising from the performance of this Contract involving bodily injury to workers, building occupants, visitors, or other persons. The COTR will provide information necessary concerning whom to contact and the specific form of the follow-up written notice. 10 DELIVERY OF SUPPLIES The Contractor shall schedule its own supply deliveries and the supply deliveries of its vendors and Subcontractors to coincide with the loading dock operating hours. 11 SECURITY PROCEDURES A. The contractor shall not permit any employee to have keys for access to locked rooms until it has been determined that permitting such person(s) to have such access shall not be contrary to the Authority s interest, and that the individual(s) is authorized to be admitted in accordance with applicable security orders, rules, regulations and instructions as determined by Authority. B. The contractor shall secure and safeguard all keys, key cards, and any other entry devices and codes provided by the Authority. The contractor shall maintain a record of the key numbers issued to its employees. These prohibitions and requirements shall also be applicable to all individuals with regard to access, removal, and/or possession of any information, confidential data, materials, supplies, or equipment. The contractor shall not duplicate and shall not allow any such issued items to be duplicated or removed from the job site. All keys and other entry devices used by the contractor s employees in the performance of the work shall be returned to the Authority when the contract expires. C. The contractor shall safeguard all the identification cards, issued its employees and subcontractors by the Authority to fulfill the requirements of this SOW. The contractor shall ensure these cards are visibly displayed by the respective individual at all times while employed on site at the Airport to fulfill this requirement. D. The contractor shall immediately report to the Authority all keys issued to it by the Authority that are lost or stolen. The contractor shall be responsible for all loss, damages and expenses that the Authority incurs as a result of the contractor s loss of Authority keys. These costs include the expense of changing all locks to which the lost keys provided access. The cost of changing locks or keys to the building rooms or areas accessible by the lost or stolen keys will be deducted from the contractor s invoice to the Authority for the services performed under the contract. E. The contractor shall ensure that, under no circumstances any of its employees shall enter an area not authorized for access by the COTR for the contractor. F. The Authority will not issue keys for sensitive security areas. Instead, the Authority will require the contractor s employees to be accompanied at all times in this area by either Authority employees or the contractor s own employees who have authorized access to the area. 15 G. The contractor, its subcontractors, and all its employees shall be subject to, and shall at all times, conform with any and all rules, regulations, policies, and procedure pertaining to security at the airport. Any violations of the rules, regulations, policies, and procedures may be cause for immediate termination. H. All contractor employees performing work at the Airports shall have in their position a valid security badge. The contractor shall be responsible for, at its own expense, obtaining the proper security clearance, fingerprinting, training, badges and custom seal required to access the restricted areas of the airport including the Air Operations Area (AOA), Security Identification Display Area (SIDA), Customs and Immigration. Identification badges issued by the Authority must be visibly worn at all times while in the SIDA. I. The contractor shall be responsible for, at its own expense, compliance with the requirements and procedures to obtain approval of any motor vehicle to operate in the Air Operations Area (AOA). J. The Contractor s employees, including new hires, must be legal to work in the United States. The Contractor shall confirm citizenship of all foreign-born employees and alien numbers (Green Card), if not US citizen. 12 SAFETY A. The contractor and each of his employees shall comply with all applicable OSHA and Authority rules and practices, including directives issued by the Airport Manager, Airport Operations, MWAA Police and Fire Departments, Federal Aviation Administration, and Authority Divisions while on the job site. B. The contractor shall provide and ensure that all personnel at the work site wear the safety devices/apparel described below when in areas designated by the Authority. Approved back support and protective devices Eye protection Approved Hearing Protection Approved hand protection Other safety devices/apparel when conditions warrant C. The contractor shall furnish documentation as directed by the COTR of the completion of the approved safety training of equipment operators and other personnel. The safety training shall comply with all OSHA standards and a sample program shall be submitted to the COTR. D. The Authority reserves the right to inspect all areas for safety violations at its discretion, direct the contractor to make immediate improvement of necessary conditions and/or procedures, and/or stop the work if other hazards are deemed to exist. E. In the event that the Authority should elect to stop work because of any type of existing safety hazards after the contractor has been notified and provided ample time to correct, the contractor shall bear all costs for eliminating the hazard(s) and shall not be granted compensation for the work stoppage. The contractor shall pay all additional expenses. F. The operation of the contractor s vehicles or private vehicles by the contractor s employees on or about the property shall conform to posted regulations and safe driving practices. Aisles, passageways, alleyways, entrances or exits to fire protection equipment must be kept unobstructed at all times. Attachment 01 Statement of Work Page 15

16 G. The contractor shall be responsible for initiating, maintaining and supervising all safety precautions and programs in connection with the performance of the contract. The contractor shall take all necessary precautions for safety of, and shall provide reasonable protection to prevent damage, injury or loss to persons, properties, equipment and vehicles. H. Damage caused by the contractor to any properties shall be repaired or replace to the satisfaction of the Authority at the expense of the contractor. The Authority, at its sole direction, may elect to repair or replace the damaged property, and deduct such costs from monies due the contractor. I. The contractor shall submit its own detailed safety and protection plan/program that shall comply with all safety, environmental protection, property protection and health provisions of the contract. J. Prior to use of any products or materials, the contractor shall provide the following submittals for review and approval by the COTR. Contractor shall furnish three copies of each submittal. 1. Manufacturer s product data and literature 2. Manufacturer s installation recommendations 3. Samples, if required by the COTR 4. Material Safety Data Sheets (MSDS) 13 FIRE PREVENTION AND PROTECTION A. Fire prevention and protection at Authority facilities property is essential. The Authority shall provide limited fire prevention equipment within the facilities. The availability of fire protection equipment provided by the Authority shall not limit the contractor s responsibility or liability for maintaining a reliable fire prevention and protection program for its employees and the property serviced. B. The contractor shall be knowledgeable of and provide adequate and appropriate training for all employees in the proper method of reporting a fire. All pertinent information regarding fire-reporting procedures may be obtained from the COTR. 14 SMOKE FREE ENVIRONMENT The Authority s facilities are smoke free. The contractor and its employees shall adhere to the rules and regulations in regard to this facilities maintenance of a smoke free environment. 15 LOST AND FOUND PROPERTY The contractor shall turn in to the Authority Police Department all property found on the property of Ronald Reagan Washington National Airport and Washington Dulles International Airport immediately, any violations or disregard of the rules, regulations and/or policies may be cause for immediate termination. 16 DISPOSAL OF DEAD PESTS The contractor shall be responsible for the removal and disposal of all dead pests on the job site of the type that are covered under this contract. Contractor shall dispose of dead pest in an appropriate manner. 17 WORK ASSIGNMENT PROCEDURES A. Each morning the Pest Control contractor shall review the daily Trouble call log and ensure that all pest related issues are scheduled for service or follow up inspection that day. 17 B. The Pest Control contractor shall respond to all service requests immediately upon notification by the Work Order Desk. The Pest Control contractor shall document the contact person s (name) if applicably and type of service-performed to complete the Work Order once the Work Order has been assigned. C. The Pest Control contractor shall visit the Authority Work Order Desk three (3) times per day during the normal work week (Monday Friday) for the purpose of picking-up work orders that may been issued. This shall occur in the morning, again around the noon timeframe and again in the afternoon around 3 PM. D. The Pest Control contractor shall close out all work orders responded to on a daily basis. 18 01 BASELINE INSPECTION AND REPORT SECTION VII DOCUMENTATION AND REPORTING Within thirty (30) calendar days after the effective date of the contract, the contractor shall conduct a thorough, initial inspection of the job site and provide a detailed site specific report to the COTR. This report shall identify all pest activity noted along with the location, type and extent of infestation. The contractor shall also recommend improvements to existing structural, sanitary and/or managerial practices that are contributing to the existence of pest activity. 02 THE AUTHORITY S COMPUTERIZED MAINTENANCE MANAGEMENT SYSTEM (CMMS) A. The contractor shall use for the term of this contract an Authority provided computerized maintenance management system (CMMS) to schedule and generate work orders for all inspections and treatment activities performed for each location covered under this Contract. The Authority will retain a management role over the system. B. The contractor shall use for the term of this contract the Authority provided handheld computers as an extension of the CMMS. The contractor shall access and enter data on Work Orders on the handheld computers. C. The contractor shall generate work orders for all service calls and service call backs. Upon completion of work the contractor shall be responsible for closing out the work order by inputting all relevant information data in the CMMS that relates to work performed by the contractor. This information data shall include, but not be limited to; asset number, name of technician(s), date of service, duration of work performance, specific service accomplished, labor, date completed and any comments necessary to explain corrective action or work performed. D. The Authority will provide the contractor five (5) business days prior to the end of each month, a CMMS generated Work Order Status Report that details all incomplete and completed work orders generated by the contractor during the month. At a minimum the report will contain; work order number, PM type/service required, account code and origination date and completion date. E. If access to the CMMS program is not available from the Authority, the contractor shall meet this requirement by providing the required information on paper copies of the work orders, which will be provided by the Authority. F. The Authority will provide the necessary training to the contractor on the proper use of the CMMS program. 03 DAILY REPORT A. The contractor shall send an to the COTR at the beginning of each shift communicating information on the contractor s planned work for that particular shift. B. The contractor shall submit to the COTR, via , a daily pest control inspection and treatment report at the conclusion of each workday. The contractor shall list on this report all areas that were to be inspected that day as per the Schedule of Services (Appendix B) as well as report on all issues identified per area and the corrective actions taken by the contractor. The daily report shall include time and date stamped pictures depicting all relevant information of areas that were inspected. Attachment 01 Statement of Work Page 18

19 04 RODENT ACTIVITY LOG The contractor shall maintain a log on the Authority s intranet (Livelink) which documents all reported mice and rat activity throughout the airport. The contractor s proposed format for this log shall be provided to the COTR for his review no later than 5 business days after award of the contract. The COTR shall have final approval rights of the format. After approval, the log shall be updated daily by the contractor. Attachment 01 Statement of Work Page 19

20 SECTION VIII - SPECIAL REQUIREMENTS 01 POWER EQUIPMENT The contractor shall never leave power equipment unattended without disconnecting them from their power source. All electrical cords shall be properly sized for the job and placed away from vehicular or pedestrian traffic. All connections between the extension cords and relayed equipment (e.g., tools, machine, or additional extension cords) shall be tightly fastened with no exposed electrical contacts. All extension cords shall have, and use, a proper electrical grounding plug. Power tools and/or extension cords used in damp areas shall be plugged into a ground fault circuit interrupter (GFCI) switches to immediately shutdown when a short to ground is detected. 02 REGULATORY AND ENVIRONMENTAL PROVISIONS A. General The contractor (including its on the job site employees and subcontractors) shall comply with all applicable Federal, state, local, and Authority regulatory, code and procedural requirements. This shall include but not be limited to the contractor complying with the following Authority requirements: The Authority's 1. Construction Safety Manual 2. Airport Advisories 3. Authority and Airport Orders and Instructions 4. DCA Security, Traffic and Parking Requirements 5. Safety Procedures including: lockout/tag out, confined space entry, and hazardous materials. The contractor shall report all regulatory infractions that are incurred by the contractor while fulfilling the requirements of this Statement of Work to the Authority and COTR in accordance with Authority regulations and orders. The contractor shall also report such infractions to appropriate governmental agencies as required by Federal, state and local laws and regulations. B. Asbestos Containing Materials/Lead Based Paint Facilities constructed prior to 1981 should be presumed to have both asbestos containing materials (ACM) and paint containing lead in their construction. Therefore, prior to undertaking any activities that could disturb these materials the contractor shall obtain written approval from the Authority through the COTR prior to proceeding with such activities. C. Air Quality The contractor shall use on the job sites only chemicals products which do not exceed the volatile organic chemical (VOC) limitations rule(s) published by the U.S. Environmental Protection Agency (EPA). 21 D. Hazardous Materials 1. Compliance with Laws The contractor shall comply with all laws relating to hazardous materials on the job sites or related to the contractor's activities at the job sites. The contractor shall not manage or use hazardous materials at the job site except as reasonably necessary to accomplish the Statement of Work. The contractor shall not dispose or treat of any hazardous materials on the job sites or surrounding lands or waters. The contractor shall immediately provide to the COTR a written list of hazardous materials intended to be used at the job site, and the approximate quantities to be used prior to entering into the Contract. 2. The Contractor's Responsibility for Environmental Costs and Damages The contractor's hazardous materials shall be the sole responsibility of the contractor and the contractor shall be solely liable for and responsible for, without limitation, at the contractor's sole cost and expense: a. Corrective Action of the contractor's hazardous materials as directed by any governmental agency, as required by any law, or as necessary to prevent or eliminate any nuisance, trespass, waste or diminution in the value of the job sites or as necessary to avoid any impairment of the Authority's ability to use the job sites for Airport purposes upon expiration or termination of this Contract. b. Damages for injury or death to persons, or injury to property, the job sites and surrounding lands and waters arising out of the contractor's hazardous materials. c. Claims resulting therefrom. d. Fines, costs, fees, assessments, taxes, penalties, demands, orders, directives or any other requirements imposed in any manner by any governmental agency asserting jurisdiction, or under any law with respect to the Contractor's hazardous materials. e. Costs and expenditures for Corrective Action required as to the contractor's hazardous materials. f. Damages, costs and expenditures for injury to natural resources resulting from the contractor's hazardous materials as required by applicable law; g. Compliance with laws regarding the generation, use, storage, transportation, treatment, management or disposal of the contractor's hazardous materials; and, h. Any other liability related to the contractor's hazardous materials. While the Authority is not required to incur any costs, fees (including attorney, consultant and expert witness fees) or expenses for environmental compliance, or Corrective Action relating to the contractor's hazardous materials, should the Authority incur any such costs, expenses or fees due to the contractor's non-performance of its obligations under this Contract, the contractor shall within 30 days of demand reimburse the Authority for said costs, expenses or fees. 22 3. Contractor's Indemnification of the Authority In addition to any other indemnities in this Contract, the contractor shall defend, indemnify, release and hold harmless the Authority, its officers, agents and employees, successors and assigns from any and all responsibilities, damages, claims, penalties, orders, decrees, fines, liabilities, costs, expenditures, attorney's fees, litigation expenses and court costs relating to the contractor's hazardous materials liabilities and responsibilities. 4. Scope of Responsibilities The job sites, conditions, covenants, and indemnities by the contractor in this provision shall apply without limitation to the contractor's successors, assigns, assignees, and guarantors of the Contract. Further, with respect to each of the promises, conditions, covenants and indemnities in this section, the contractor assumes responsibility to the Authority for the acts or omissions of the contractor's employees, agents, assignees, successors, shareholders, subsidiaries, contractors or subcontractors (whether or not such acts or omissions are negligent, intentional, willful or unlawful) in any way relating to the contractor's hazardous materials, or environmental compliance with respect to the contractor's hazardous materials. Each of the promises and indemnities in this provision apply to any discharges of hazardous materials at the job sites (or emanating from the job sites) by the contractor, and to any assessment, testing, investigation, remediation and/or cleanup with respect to the contractor's hazardous materials, whether occurring before or after the contractor vacates the job sites. The promises and indemnities by the contractor are continuing and survive termination of the Contract. 5. Testing and Assessment by Authority 6. Other At the Authority's sole discretion, during reasonable business hours, the Authority or its representatives or consultants, may enter upon the job sites and make any tests, measurements, investigations or assessment the Authority deems necessary in order to determine the presence of hazardous materials or to evaluate contractor's compliance with this agreement. Nothing herein requires the Authority to conduct any such testing, measurement, investigation or assessment. The Authority shall give the contractor a minimum of five (5) days written notice prior to conducting any such tests, investigations or assessment except no such notice is required under urgent or emergency conditions. If any of the contractor's hazardous materials are detected requiring Corrective Action other than monitoring under this provision, or if any material violation of any law or the requirements of this provision are found by the consultant, the fees and expenses of said consultant shall be paid by the contractor on demand by the Authority. This is in addition to the contractor's obligation to conduct all required Corrective Action of any of the contractor's hazardous material releases or suspected releases at the contractor's sole cost as provided herein. All hazardous and/or carcinogenic materials transported or generated on to either job site by the contractor must be properly disposed off the Airport site by the contractor in accordance with applicable Federal, state and local laws and regulations and at no cost to the Authority. The contractor shall provide the COTR with complete, legible copies of all regulatory notices, violations notices, citations, etc. received by the contractor that pertain directly or indirectly to its fulfillment of this Statement of Work. 23 The contractor shall provide the COTR with documentation on hazardous materials or wastes that are accumulated, handled, generated, or disposed of by the contractor's operations. The documentation shall demonstrate the adequacy of the handling and disposal operations used by the contractor and will demonstrate that the contractor s activities will not result in contamination of Airport property. This documentation shall be provided upon request during periodic environmental inspections of the contractor's premises by the Authority. The contractor shall immediately provide copies of all such correspondence to the COTR on all correspondence with regulatory agencies concerning the contractors compliance with environmental regulations. If the contractor generates hazardous waste in an amount that makes it subject to State and Federal hazardous waste requirements, the contractor shall apply for a Hazardous Waste Generator Identification Number. Hazardous waste shall be transported off the Airport using the contractor's Hazardous Waste Generator Identification Number documented on a complete and properly signed Uniform Hazardous Waste Manifest. The contractor shall be required to submit an Annual Hazardous Waste Report to the State of Virginia Department of Environmental Quality. The contractor shall be responsible for developing a Resource and Conservation Act Contingency (RCRA) Plan if the amount of hazardous waste generated places it into a category that requires a plan. The contractor shall be responsible for notification and reporting required under SARA, Title III regulations. E. Spill Contingency Plan Neither domestic drains, nor storm drains on the job sites shall be used to dispose of gasoline, paint, thinners, hydraulic fluid, solvents, concentrated cleaning agents, pesticides or other hazardous material. The contractor shall implement on the job sites (for the entire period of performance of this Statement of Work) a written Hazardous Waste Spill Control and Containment Plan listing materials used, spill prevention procedures, containment equipment and procedures to be used in the event of spill, personnel protective equipment requirements, notification procedures, site redemption procedures, and personnel training procedures in accordance with regulations. The contractor shall provide the COTR a copy of this plan five (5) working days after the award of the contract. In the event of a spill, the Contractor shall notify the Airport Fire Department at (703) The contractor shall be responsible for all cleanups, site remediation and disposal costs including hazardous waste response teams that may be required at the site. All procedures shall be in accordance with applicable Federal, state and local environmental and OSHA regulations. Hazardous materials that are temporary, stored on site during normal working hours, shall be placed in containment devices that are capable of containing 110 percent of the volume of the substance in the event of a spill. The contractor shall initiate a training program for its employees and subcontractors on the proper disposal of hazardous materials such as gasoline, paint thinners, hydraulic fluid, solvents, pesticides etc. Attachment 01 Statement of Work Page 23
