3 PAGE 3. Executive Director Mr. John Ware reported on the following: 1. OCOG Update: The elimination of OCOG funding for career college students has created a number of financial issues for students and schools. Notwithstanding the funding gap issue for students, the elimination of OCOG funds has created a significant potential issue for schools that are required to meet the federal funding ratios. We have discussed these funding issues with a number of schools and will be participating in a th workshop on October 14 sponsored by the Ohio Association of Career Colleges and Schools to discuss the requirements. 2. Web Site Update: The Board s new web site should be operational within th next week. The new web site will conform to the State s new IT standards and will give the Board the capability to develop more interactive applications for collecting and disseminating information. th 3. Annual Board: On September 11, we distributed the forms that will be used to gather data for the Fiscal Year 2009 Annual Report. All schools are required to submit their reports th by October 7 and in the next month we will begin compiling the data to be used in the Board s Annual Report. We hope to have this year s Annual Report finalized by the end of the calendar year. 4. Director Training: We will be holding our second director training seminar for this year th on October 8 at the State Library of Ohio. Approximately school directors are expected to attend. 4 PAGE 4. PUBLIC COMMENT There was no Public Comment. OLD BUSINESS 1. Executive Director Mr. John Ware reported the Administrative Rule Review Update. (10-053)Dr. Jerome Brockway moved that the Board adopt the following order: WHEREAS this Board previously approved changes to the following rule: Miscellaneous Fees and; WHEREAS a public hearing on the rule changes was held on July 29, 2009 and the rules were subject to review of the Joint Committee on Agency Rule Review whose jurisdiction over the rules ended on or about August 28, THEREFORE BE IT RESOLVED THAT: This Board formally adopts the rule changes as filed with an effective date of October 1, BE IT FURTHER RESOLVED that the Executive Director of this Board is directed to notify all registered schools and the directors thereof, of this Board s order. Mr. Kenneth Miller seconded. 4 Ayes - 0 Nays. Motion carried. (10-054)Mr. Charles Kramer moved to rescind motion # which was approved at the January 28, 2009 Board Meeting. Miami-Jacobs Career College - Ontario Update: This school was presented to the Board at the January 28, 2009 Board Meeting (motion #09-139) pending receipt of approved consultant report/site visit, completion of facilities compliance statement, and subject to nursing and cosmetology board approval. A letter sent to school 2/4/09. Ms. Jennifer Yarnell called 6/17/09. Stated school had lost their lease and would submit a change of location. On 9/15/00, Ms. Darlene Waite ed Mr. John Ware stating that they are no longer going to open this school at this time. This motion needs to be rescinded by the Board.

5 PAGE 5. (10-055)Mr. Kenneth Miller moved to rescind motion # (only the AAS in Respiratory Therapy program part of the motion) which was approved at the July 29, 2009 Board Meeting. Tri-State College Update: This school was presented to the Board at the July 29, 2009 Board Meeting (motion #10-023) subject to respiratory board approval and accreditation by the commission on accreditation for respiratory care. Letter received 9/10/09 from school stating that they are not going forward with accreditation until This motion for the AAS in Respiratory Therapy program only needs to be rescinded by the Board. (10-056)Mr. Kenneth Miller moved that the Board amend resolution # adopted at the July 29, 2009 Board Meeting and extend the suspension of the revocation of the certificate of registration of the Ohio Academy of Holistic Health until November 30, 2009 in consideration of the ongoing change of ownership proceedings. NEW BUSINESS (10-057)Mr. Charles Kramer recommended that the State Board of Career Colleges and Schools ADOPT the following resolution: WHEREAS the following schools have applied for renewal of their certificate of registration and program authorization with this Board: Meadowmark School of Business Software Medicore Ohio Model and Talent Management Ohio American Health Care; and WHEREAS the aforementioned schools have failed to submit required fees for renewal of their certificate of registration and program authorization; and WHEREAS this constitutes a violation of sections and of the Ohio Revised Code and section of the Ohio Administrative Code. THEREFORE BE IT RESOLVED THAT: RESOLVED, that the Executive Director of this Board, be, and he hereby is, directed to notify these schools and the owners thereof, that this Board is initiating formal disciplinary action pursuant to Ohio Revised Code Section and in accordance with Ohio Revised Code Chapter 119 for the aforementioned violations.
