1 All short sales are processed on Equator.com. Agents must be registered for short sales to be assigned to them. Required Document Checklist must be complete (all documents uploaded into Equator and labeled correctly.) for short sale review to be processed. Seller: Financial analysis forms see attached Hardship affidavit (see attached) AND Hardship letter please detail when hardship started, what caused the hardship and approximate monetary impact. Most recent 2 paystubs for each borrower OR profit and loss statement for previous 90 days (three full months) if self employed. Most recent 2 bank statements for every account: savings, checking and investments. Most recent 2 federal tax returns (2009 & 2010) Print out of the MLS listing 2nd lien statement or payoff demand letter (if applicable). The 2 nd lien short sale approval letter will be needed upon 2 nd lien approval. Signed third party authorization form naming specific individuals that GMAC is authorized to speak with about your account. Agent: Executed contract/ short sale addendum/ executed counter if applicable. Agent AND broker license numbers must be on contract or addendum. Current, signed list agreement. Estimated HUD1- (Please include the settlement company s name on the HUD, addresses of buyers and sellers.) Pre-qualification letter OR verification of funds (bank statements) for Cash buyers. If requesting seller concessions for a financed buyer: please provide Buyers Good Faith Estimate of buyer s closing costs (provided by lender) or buyer s side of the Hud1. Please note that bills are required if there is a request for these items to be paid: delinquent HOA dues; delinquent property taxes; delinquent utilities/ water/ sewer/ trash that are on title. Sales are AS IS; however, if repairs are requested as a special exception, at least 2 estimates are required. Name affidavit signed by buyer/seller and both agents as applicable. Name affidavit automatically generates in Equator when you submit the offer. Earnest money receipt from escrow, upon short sale approval. If this is a HAFA short sale: A blank ARASS doc package will be sent to you, for the sellers to fill out completely and sign. The must be check marked appropriately. ALL HAFA SALES CONTRACTS MUST HAVE AN ADDENDUM SIGNED BY BUYER/SELLER WITH THIS SPECIFIC VERBIAGE CUT AND PASTED IN: "Seller and Buyer each represent that the sale is an "arm's length" transaction and the Seller and Buyer are unrelated to each other by family, marriage or commercial enterprise. The buyer agrees not to sell the property within 90 days of closing of this sale." Please ensure the seller check marks the appropriate boxes on the Dodd-Frank and Primary residency certification forms and send back as one PDF package with the HAFA addendum attached.
