1 TERMS AND CONDITIONS OF THE SECOND EDITION OF THE "MADRID FASHION FILM FESTIVAL- MFFF ONE.-ORGANISING ENTITY, GEOGRAPHICAL SCOPE, TIME PERIOD AND PARTICIPANTS. The Company Enri Mür Management, S.L. with Tax Identification Number: B and registered office at: Calle Santa Clara, 3, 2º dcha Madrid (Hereinafter, the Organiser), announces the following contest and declares the registration period for original audiovisual films (Fashion Film) open. The festival is directed to all creators, directors, producers and distributors from any country, as well as national and international companies and media outlets, and individuals who wish to participate, and access the website to enter and in this manner participate in the contest by uploading videos under the conditions set forth below. In the event that an individual submits an entry to the contest, they must be of legal age or have and provide the relevant authorisation from their legal guardians if they are minors. SECOND.- PURPOSE The purpose of this contest is to bring to the public's attention a widespread trend within the world of imaging, fashion and advertising: "Fashion Film", as well as recognise the Spanish sector and all of its participants, thereby demonstrating to advertising agencies and advertisers the possibilities offered by these new mediums and internet consumption habits. In addition, we would like to showcase international trends of the fashion industry.
2 THREE.- PRIZES The prizes of this contest are presented in the following manner: - Best Fashion Film: prize for the best international Fashion Film. - Special Jury Award Best National Fashion Film: prize for the best national Fashion Film. - Best Script: prize for the best script. - Best branded Fashion Film: prize for the best fashion film by a brand. - Best Photography: prize for the best photography. - Best Art Direction: prize for the best artistic direction. - Best Fashion Film by a new talent: prize for the best Fashion film by a new talent. The prizes will be awarded by a multidisciplinary and independent Jury comprised of professionals from the fashion, advertising and imaging world which will be made public prior to the gala and who will award the prizes described through a vote. Once the jury is formed, its composition will be announced at the Organiser could replace those jurors who for any reason find themselves unable to accomplish their job. The Jury will choose the winners of the contest through a simple majority of the votes cast. Likewise, the Jury will also choose one runner up for each category in the event that the winners may not be awarded with the prize. The Festival reserves the right to increase and modify the number of prizes during the course of the call to participate. The Festival organiser considers that this will not be detrimental to the contestants under any circumstances; rather it will have a positive effect. In the same manner, the Festival reserves the right to increase, although not significantly, the films selected in the event of a tie in the voting.
3 The Fashion Films selected by the organisation for the contest will be shown on the festival website and on its social media, as well as during the festival. They may also be shown in other media, which cover the festival as well as in the festival blog. FOUR.- HOW THE CONTEST WORKS 1.- REGISTRATION STAGE: In the event that an individual submits an entry to the contest, they must be of legal age or have and provide the relevant authorisation from their legal guardians if they are minors. The entrant must go to the website and apply to enter by filling out the entry form and attaching a public or private link to a video on YouTube, Vimeo, etc. In the event that the video is private, the entrant must provide a password. Each entrant may enter as many Fashion Films as they deem appropriate. Entry will not be finalised until the fee is paid (EUR 50 administration fees inlcuded for Professionals and EUR 10 for New Talents). The aforementioned fee will be used in full for the selection, copying, distribution and viewing of the films by a multidisciplinary jury established by the Festival organisation. With the Submission cost (Professional and New Talents) is possible to submit until 4 Fashion Films. For submit more than that number the contestant should formalize another submission (with the correspondent cost). In the event that the video does not meet the terms and conditions in the opinion of the Organiser, it will be left out of the selection process. The Organiser reserves the right to extend the entry period, prior announcement via their website or social media.
4 2.- SELECTION STAGE: The official selection of the contest will be notified on the Media Partner's and the Festival's website ( as well as on all online media or platforms which collaborate with the dissemination of the festival. The Organiser will get in touch with the participants of the selected fashion films for provide the following documentation: - Video in Full HD (1920x1080) or HD (1280x720). - Four still images/photos extracted from the fashion film (minimum size 800 PX high, with a resolution of 300 DPI) for promotional purposes, or authorise the organisation of the Festival to take screenshots of the film. - All of the credits for the film. - Contact information for the participant (name and surname or company name, address, telephone number) - Biography of the director (100 words maximum) and synopsis of the film (100 words maximum). - Fashion Film Screening Authorization Form (facilitated by the organization) 3.- FASHION FILM REQUIREMENTS The technical requirements of the material are the following: - Fashion Films may be submitted with a minimum length of 60 seconds, with no maximum length limitation. - If the Fashion Film contains dialogue or text in a language that is not Spanish nor English, the exhibition copy should be subtitled either in Spanish or English. - The Fashion Film may be signed and produced by one individual, legal entity or cooperative of creators.
5 - Fashion Films that have already competed previously in other festivals can be submitted. But no Fashion Films already presented in the 1st and 2nd edition of Madrid Fashion Film Festival. - The entrant must have legal possession of all of the rights and grant them to MadridFFF under the conditions set forth below. The material sent by the entrant should be of its own authorship, and the Organiser is not responsible for any claim which may be presented by third parties for such reason. - The video must be recorded in Full HD (1920x1080) or HD (1280x720). The artistic requirements of the material submitted by the participant are the following: - The material, uploaded in compliance with these terms and conditions, shall be authorised for dissemination on the website and through any media chosen by the Organiser, which, taking into the account the contents of these terms and conditions, will approve its dissemination. - The theme of the content of the Fashion Film will be optional but it must be clearly related to the fashion world and its imagery, or be commissioned by a fashion or beauty brand or magazine, in addition to being aesthetically well-presented and artistically and carefully directed. - Besides, the submission must comply with the content restrictions and terms in the used video platform s terms. Fashion Films may not contain pornographic material, content that threats to any entity, place or group. I could not violate any applicable laws. Also it must not infringe any third party s intellectual property rights or infringe any third party s privacy rights, including any musical recording or composition, unless you have a license to use such work or such work is in the public domain.
6 The films may be entered into two categories. A) PROFESSIONAL AWARDS: professional contest: artists who are professional photographers or video creators having performed paid work for editorial groups, media outlets or commercial brands and have been able to hold individual exhibits in art galleries. B) NEW TALENT AWARDS: contest for new artists who do not periodically publish in media outlets, students or self-taught video creators outside the professional or commercial market. The Organiser will send a dual invitation to all those selected to attend the event, which will be held in Madrid. The Organiser is not forced to provide accommodation or travel arrangements for gala participants. Attendance must be confirmed in writing in the time frame established by the Festival in order to attend. In the event that the participant does not do so, it will lose the right to attend the gala and award ceremony. FIVE.- NOTIFYING THE WINNERS The Organiser will notify the participating winners that they have won, through the address they participated with in the contest and, subsequently, their name will be published on the website. The awards will be presented in the place and on the date established by the Organiser. For the stated reasons, the winners must verify their identity by presenting their identification credentials, as well as ratifying the documentation that the Organiser sends them for such purposes with respect to the truthfulness of the material with which it has participated in this contest. In the event that the foregoing cannot be certified, the award winner could not or did not want to accept the prize, renounced the prize or it was impossible to locate
7 them in a maximum period of five calendar days from the date of the first notification, the award will be given to the runner-up who is designated by the Jury for such purpose, and following procedures identical to those mentioned in the above paragraphs, until the three winners of the contest have been designated. SIX.- FRAUD In the event that the Organiser or any entity which is professionally associated with the contest detects any irregularity or suspects that a participant is impeding the ordinary progress of the contest, illegally altering their entry, participating or using material which is not authored by them, or in which their image does not appear, by means of any technical or computer procedure in order to falsify their participation, their entry may be unilaterally eliminated. In this respect, it is important to add that the Organisation has put the necessary technological support into place in order to detect any fraudulent, irregular or criminal act intended to alter the entry with the objective of winning the prize illegally. Therefore, the Organiser reserves the right to eliminate any participant from the register who demonstrates or who is suspected of acting irregularly in the aforementioned sense. Likewise, in the event that a complaint is received regarding a video exhibited, the Organiser may, once it has been analysed, proceed to remove it. SEVEN.- CONSULTING THE TERMS AND CONDITIONS The participants may consult the instructions and rules of this contest on the website. EIGHT.- AWARDING THE PRIZES The prizes will be awarded by the Organiser in the place and on the date communicated previously, provided that the winners have observed the requirements contained in these terms and conditions.
8 NINE.- DISQUALIFICATION OF PARTICIPANTS AND UNAWARDED PRIZES The Organiser reserves the possibility to declare the prizes unawarded in the event that the quality of the material presented by the participants does not meet the minimal requirements or, where applicable, does not meet the parameters of Condition Four. TEN.- PARTICIPATION INSTRUCTIONS The participants in this contest must follow the instructions provided by the Jury or the Organiser, where applicable. ELEVEN.- CHANGE OF PRIZES The prizes which are the object of this contest may under no circumstances be changed, altered or paid in cash at the request of the winner(s). TWELVE.- AUTHORISATION TO USE THE NAME, IMAGE AND RIGHTS THERETO The winners, and in the event that they are minors, their parents, guardians or legal representatives, authorise the Organiser to use for information and advertising purposes the name and image of the participants in the winning videos, as well as to grant to the Organiser, all of the copyrights of the texts, images and material created to participate in this contest. Such copyrights include, but are not limited to, setting, reproduction distribution, public dissemination and transformation. The Organiser may request said authorisation in writing from the parents, guardians or legal representatives of winners who are minors. The selected grant all the rights to exhibit, exploit and publicly disseminate their films to the MadridFFF organisation and its partners to be shown in the film archive, the award ceremony, the MadridFFF party, the MadridFFF website, social media and any other medium which is available to the festival organiser to contribute to its promotion. The selected grant all the rights to exhibit their films in other Fashion Films Festivals representing the reel of MadridFFF, for a year.
9 Those selected grant, for one year, the aforementioned rights for their dissemination in audiovisual communication media and press as selected entrants or winners of the Madrid FFF The selected grant the division rights to their films to create promotional reels for the festival which may be shown for the entire year and unlimited for a maximum of 20 seconds of each film. Those selected grant the exhibition, distribution and public dissemination rights of the images included in their entry, for the sole purpose of the festival using them for dissemination. Likewise, they authorise the festival to extract images from their films for the same purposes. The copyright of the images of the models or works of art which appear in the films submitted must be held by the contestant and this is understood upon entering the film in the contest. MadridFFF is not liable for any subsequent consequence which arises therefrom, rather the entrant is responsible for their management. The Festival understands that the intellectual property rights and the copyrights belong to the contestant entering the film in the contest, who grants the rights expressed in these festival terms and conditions. The festival organiser is not liable for any subsequent consequence which arises therefrom. The festival organiser is not responsible for the possible subsequent use of the material exhibited outside the online media of the Festival. The festival organiser may use the material as part of the history of that presented, produced or exhibited in the first edition of Madrid FFF, with an unlimited use of a maximum of 20 seconds of each film.
10 THIRTEEN.- ACCEPTANCE OF THE TERMS AND CONDITIONS Participation and entry in this contest entails the full acceptance of these terms and conditions, as well as the criteria of the Jury and Organiser in the resolution of any conflict which may arise from the interpretation thereof. The Festival organiser reserves the right to amend, change or modify these terms and conditions, and if applicable inform the candidates entered of the changes thereto in advance. The terms and conditions are governed and interpreted in accordance with Spanish laws and the resolution of any matter related to their validity or interpretation, or compliance or non-compliance of either of the parties therewith, will be the responsibility of the Courts and Tribunals of the city of Madrid, both parties expressly waiving any other jurisdiction which might correspond to them. The participant will not include in the videos sent to the Organiser in the context of the contest any personal data of third parties (including image and voice), unless they have their express consent. FOURTEEN.- CLAIM The period for making claims regarding this contest ends after 90 days have elapsed from the date the contest period ends. FIFTEEN.- PERSONAL DATA PROCESSING In compliance with that established in Organic Law 15/1999 of 13 December on Personal Data Protection and in Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we hereby inform you that voluntarily sending personal data (including ) to participate in this contest, entails their incorporation into MADRID FASHION FILM FESTIVAL's file, under the ownership of ENRI MÜR MANAGEMENT S.L. and the participant's consent for the Organiser to process the aforementioned automated data for advertising purposes. In particular, they will be processed and used for the purpose of processing the entries and
11 informing participants of new contests or news closely related to the Festival, as well as how to comply with the legal obligations. Under no circumstances will they be transferred to third parties and participants may exercise their rights to access, rectification, cancellation and opposition by writing to the MadridFFF organiser at the address indicated, providing a photocopy of their National Identification Document or its equivalent, and indicating the right which they would like to exercise. The participant's data will be used by the Organiser to communicate with them in the future, as well as to manage their participation in this contest. If you do not want the data processed for the purposes included in this paragraph, we ask that you not participate in the contest. The participant will have the right to access their data, oppose the processing thereof, as well as request they be modified or cancelled simply by requesting it at the registered offices of the Organiser at calle Sombrerería, 5 Bajo, Madrid The participant declares and guarantees that all the personal data provided to the Organiser for the purpose of participating in the contest are truthful and correspond to them. The participant will not include in the videos sent to the Organiser in the context of the contest any personal data of third parties (including image and voice), unless they have their express consent. SEVENTEEN.- LIABILITY The Organiser is not responsible for any possible loss, damage, theft, delay or any other circumstance attributable to a third party or to the internet which could affect participation in this contest.
