3 Profssor Kiran C Murphy Prsidnt Prsidnt s Statmnt I am plasd to submit, in accordanc with Sction 6 of th Mdical Practitionrs Act 7 (MPA), th Annual Rport of th Mdical Council for th yar ndd 3st Dcmbr. Th commncmnt of Part of th Mdical Practitionr s Act 7 in May provids a statutory framwork for doctors to maintain thir profssional comptnc. For th majority of doctors, this is th formalisation in law of a procss with which thy ar alrady voluntarily ngagd. It is a vry important milston for th profssion and for patints and will hlp maintain and build trust btwn patints and doctors. Patints can now b crtain that thir doctor is maintaining an appropriat lvl of knowldg and skills and ths profssional comptnc schms will hlp nsur that patints ar gtting th bst possibl car. Th Council s Statmnt of Stratgy 3, approvd in July, outlins th Mdical Council s vision, mission and valus in addition to our stratgic objctivs for th nxt thr yars. Th ovrall objctiv of th Mdical Council is to protct th public by promoting and bttr nsuring high standards of profssional conduct and profssional ducation, training and comptnc among rgistrd mdical practitionrs. In a contmporary socity, thr ar incrasd xpctations from th public and incrasd accountability of doctors. W aim to b a progrssiv, fitforpurpos organisation which continually looks to improv th way in which w work to mt ths xpctations. Th Statmnt givs stratgic dirction to th Council ovr th nxt thr yars to furthr promot patint safty and furthr nhanc th trust of th public in th mdical profssion. Th Council s nw CEO Carolin Spillan took offic at th nd of Sptmbr and has implmntd invaluabl changs to our businss procsss and procdurs. In particular, sh ld th dvlopmnt of th Mdical Council s first formal businss plan, providing a clar framwork which nabls Council and th Excutiv to ralis our stratgic objctivs. In w hav workd to communicat in mor comprhnsiv ways with th public, th mdical profssion and othr stakholdrs. Our first vidocast on Mdical Ethics was producd in Sptmbr faturing Dr Dirdr Maddn, Chair of th Ethics Working Group, in which sh taks viwrs through th 7th dition of th Guid to Profssional Conduct and Ethics for Rgistrd Mdical Practitionrs. W ar committd to sharing information with patints about thir rights and about th rsponsibilitis of doctors. This form of communication is a nw dvlopmnt for th Council and w hop it will provid clarity on ths issus to a widr audinc. saw an incras in th numbr of public inquiris, from 4 in 9 to 4 in. Th majority of inquiris undr th MPA 7 ar now hld in public and this incras can b attributd to th ris in public awarnss and knowldg of Mdical Council procdurs. Th Mdical Council is kn to ducat th public of thir rights and th profssion of thir obligations in thir mdical practic and will continu to rviw and rdvlop our publications on an ongoing basis. This has bn a vry busy and challnging yar and I would lik to thank ach mmbr of th Council for thir ddication and xprtis. Following th rsignation of Profssor Paul Finucan, Dr John McAdoo, was nominatd to join th Mdical Council and is du to tak his plac as a mmbr of Council in th Nw Yar. I am vry gratful to Paul for his outstanding work as Chair of th Profssional Comptnc Schms Working Group which laid th foundations for th stablishmnt of profssional comptnc schms prior to May. In particular h ovrsaw th dvlopmnt of Part Ruls and Associatd Standards which undrpin th opration of ths schms. I would lik to acknowldg our clos working rlationships with th Dpartmnt of Halth and Childrn, th Halth Srvic Excutiv Mdical Education and Training Division and th Forum of Postgraduat Training Bodis. 4 Ms Carolin Spillan Chif Excutiv Officr Chif Excutiv Officr s Rviw was a yar of immns chang for th Mdical Council, as th dlivry of numrous improvmnts in work practics stramlind our procsss and brought thm in lin with bst practic among mdical rgulators in othr jurisdictions. Our stratgy for 3 was approvd in July, and it will provid a platform from which w will agr and dvlop our work ovr th nxt thr yars. Th stratgy documnt was th bluprint which ld to th cration of a dtaild businss plan for th scond half of, and subsqunt businss plans will outlin initiativs dsignd to mt our stratgic objctivs. As our formost duty is to protct th public, it is imprativ that our procsss ar transparnt and that all of our stakholdrs hav confidnc in th work w undrtak. Th publication of our stratgy and businss plans will highlight masurabl targts against which w will bnchmark our progrss ovr th coming yars. Th commncmnt of Part of th Mdical Practitionrs Act in May bgan an intnsiv consultation and ngagmnt procss surrounding nw statutory rquirmnts for th maintnanc of profssional comptnc. Within a yar of th commncmnt of th Act, all practising doctors will b lgally obligd to maintain thir profssional comptnc by nrolling in profssional comptnc schms and following rquirmnts st by th Mdical Council. A significant body of work was undrtakn in th scond half of to communicat with doctors about ths nw obligations, whil simultanously dvloping ruls and standards and planning for prformanc assssmnt structurs. I d lik to thank th many individuals and organisations who gnrously gav thir tim to b part of th consultation procss. Fdback from th public, doctors, training bodis and a rang of stakholdrs has mad an immns contribution to th procss. It is hartning that at th nd of, a survy found that 96% of doctors wr confidnt thy will mt thir statutory rquirmnts to maintain profssional comptnc. Council and staff will build on this work, to nsur that all ncssary systms ar in plac for th launch of schms in May. On of our ky stratgic objctivs is to nsur that clar standards for mdical conduct and thics ar st and monitord. In ight domains of good profssional practic wr dvisd and incorporatd into th curriculum at mdical schools in Irland. Thy offr a clar guid for all doctors and ncapsulat th cor principls and valus which ar ky to nhancing patint safty. Thy can b viwd on our wbsit, and provid a clar summary for both doctors and patints of th standards xpctd. Much work was don in to ngag with th public, th profssion and othr stakholdrs. A customr srvic audit was undrtakn and its rsults will b valuatd in to furthr improv our procsss. It is important that th public ar ncouragd to highlight any prcivd shortfall in th standard of car thy rciv whil th profssion ar confidnt in th transparncy and fairnss of Council s procsss. W hav workd collaborativly throughout to nsur our rol within th widr halth systm supports and complmnts th work of othr organisations. I would lik to particularly thank th Ministr for Halth and Childrn, Officials in th Dpartmnt of Halth and Childrn, our collagus in th 3 Postgraduat Training Bodis, th Halth Srvics Excutiv and th many patint rprsntativ bodis for working closly with us in. 5 Th Rol and Functions of th Mdical Council Th objctiv of th Mdical Council is to protct th public by promoting and bttr nsuring high standards of profssional conduct and profssional ducation, training and comptnc among rgistrd mdical practitionrs. Establishd by th Mdical Practitionrs Act 978 (updatd in 7), th principal functions of th Mdical Council ar to: Establish and maintain th rgistr of mdical practitionrs Approv and rviw programms of ducation and training ncssary for th purposs of rgistration and continud rgistration Spcify and rviw th standards rquird for th maintnanc of th profssional comptnc of rgistrd mdical practitionrs Spcify standards of practic for rgistrd mdical practitionrs including providing guidanc on all mattrs rlatd to profssional conduct and thics Conduct disciplinary procdurs Mission Statmnt: Protcting th public by promoting and nsuring th highst profssional standards amongst doctors Th Mdical Practitionrs Act 7 has confrrd th Mdical Council with an incrasd numbr of statutory functions that allows Council to xrcis this rol in a mor comprhnsiv mannr. Th abov principal functions, in addition to th incrasd rsponsibilitis for stablishing standards for undrgraduat ducation and postgraduat training of doctors, provids a stabl mandat for achiving Councils mission statmnt. 6 Mdical Council Th Council has a mmbrship of 5 including both lctd and appointd mmbrs. Undr th provisions of th Mdical Practitionrs Act 7 th Council is comprisd of 3 nonmdical mmbrs and mdical mmbrs rprsnting a rang of mdical spcialtis, taching bodis, mmbrs of th public and stakholdrs, all of whos appointmnts hav bn approvd by th Ministr for Halth and Childrn. 7 Mdical Council Excutiv Th Mdical Council staff work in th svn divisions of th Excutiv. Each division is ld by a Had of Sction, who rports to th Chif Excutiv Officr. Th Chif Excutiv Officr is appointd to manag and coordinat th administration and businss of th Council and to prform any othr functions that may b dlgatd by th Council. 8 FINANCE Th function of th Financ Sction is to manag th financs of th Mdical Council in a prudnt and fficint mannr and to nsur that th Council fulfils its lgislativ rquirmnts and applis bst practic to th govrnanc of its affairs. Th Had of Financ is also rsponsibl for ovrsing th Human Rsourcs function. An xtrnal HR Consultant works in conjunction with th Managmnt tam to provid HR advic and support. A ddicatd snior mmbr of staff manags th administration of HR activitis within th Mdical Council. Financrlatd Committs and Working Groups: Audit Committ (AC) Th Mdical Council has an Audit committ which is rsponsibl for providing a framwork for accountability; for xamining and rviwing all systms and mthods of control both financial and othrwis including risk analysis and risk managmnt; and for nsuring th Mdical Council is complying with all aspcts of th law, rlvant rgulations and good practic. Th xtrnal auditor mts priodically with th Committ to brif thm on th outcom of th xtrnal audit. Th Mdical Council s intrnal auditor Mazars conducts annual rviws of intrnal financial controls. Corporat Govrnanc Working Group (CGWG) Th Corporat Govrnanc Working Group rports to th Audit Committ. Th rol of th Corporat Govrnanc Working Group is to nsur th Mdical Council complis with all aspcts of th law, rlvant rgulations and good practic in rlation to corporat govrnanc. Summary of HR Activitis and Initiativs in Computrisd HR Systm Th onlin HR systm to facilitat mor ffctiv data managmnt is now fully functional and it is intndd to furthr customis this systm during. Th systm allows both staff and managrs to rviw an mploy s rcord rgarding attndanc, lav tc. Training Staff undrtook training in th following aras during : IT including th NICS platform, th HR systm, th updatd vrsion of Microsoft Offic. This is an ongoing procss. Halth and Safty all staff undrtook a numbr of Halth and Safty training programms including Fir Drill and Occupational First Aid during. Managmnt Training an inhous managmnt dvlopmnt programm for all Snior Excutiv Officrs was dsignd. Dlivry of th programm commncd in Sptmbr. Individual profssional dvlopmnt programms a numbr of staff undrtook prsonal and profssional dvlopmnt initiativs supportd by th Council during. Staff Handbook Th staff handbook was introducd in its currnt format in 7 and is rgularly rviwd and updatd in lin with changs in lgislation and HR practic. Wllbing Initiativ A wllbing initiativ for staff, ld by th Snior Excutiv Officr group, was succssfully launchd in 9 and du to th positiv fdback it rcivd is ongoing. EAP Programm An ongoing Councilsponsord EAP programm for staff is providd by VHI. Prmannt Halth Insuranc Covr Th Mdical Council is oprating a PHI schm aimd at public srvants and a numbr of staff mmbrs hav joind this schm. Rmunration Working Group (RWG) Th Rmunration Working Group rports to th Audit Committ. 10 EDUCATION AND TRAINING Th Education and Training Sction support th Council s functions in stting and monitoring standards in undrgraduat, intrn and postgraduat ducation and training in Irland. This includs accrditation of undrgraduat and postgraduat programms and bodis; dtrmining which spcialtis should b rcognisd; producing critria and guidlins on a rang of ducation and training issus (including thical standards and bhaviour for mdical studnts, curriculum issus and contnt and th awarding of qualifications). Its monitoring functions includ th inspction of univrsitis, mdical schools, and clinical training sits, both hospital and communitybasd. Th Sction also administrs th PrRgistration Examination Systm (PRES). Basic Mdical Qualification Working Group (BMQWG) Th purpos of th Basic Mdical Qualification Working Group is to, undr th dirction of th Profssional Dvlopmnt Committ, st standards in rspct of organisations providing courss and facilitis for th provision of basic mdical ducation and training of mdical studnts. Intrn Working Group (IWG) On th rcommndation of th Intrn Working Group, th Intrn Training SubCommitt was formd on 3rd Jun. It has continud th procss of dvloping standards and critria for granting a Crtificat of Exprinc including a targtd consultation procss with th major stakholdrs ngagd in intrn training in Irland. Th Postgraduat Training Working Group (PGWG) Th Postgraduat Training Working Group is primarily rsponsibl for providing guidanc to th Council, through th Profssional Dvlopmnt Committ on th standards of spcialist mdical ducation and training. Clinical Training Sits Working Group (CTSWG) Th rol of th Clinical Training Sits Working Group is to advis and mak rcommndations to th Profssional Dvlopmnt Committ in rspct of th standards ncssary for clinical training sits. Education and Trainingrlatd Committs and Working Groups that mt during Profssional Dvlopmnt Committ (PDC) Th Profssional Dvlopmnt Committ is rsponsibl for th implmntation of Council s policy for mdical ducation in Irland. Th PDC strivs to nsur th quality of mdical ducation and training by stablishing national standards and guidlins and thn assssing thir dlivry by univrsitis and mdical schools, postgraduat training bodis and clinical training sits. Ethics Working Group (EWG) Th Ethics Working Group givs guidanc to th profssion on all mattrs rlating to profssional conduct and bhaviour and has continud to progrss furthr work on thical issus which rquir additional considration in collaboration with othr rlvant stakholdrs. Monitoring Working Group (MWG) Th Monitoring Working Group s primary function is to monitor a practitionr s complianc with conditions attachd to thir rgistration following sanction by th Mdical Council. Prliminary Procdings Committ (PPC) Th Prliminary Procdings Committ was stablishd pursuant to sction of th Mdical Practitionrs Act 7 to giv initial considration to complaints against rgistrd mdical practitionrs. Th nw Guid is a substantial but comprhnsiv documnt, which dals with vry aspct of rgistration, from application, to maintaining rgistration, to withdrawing or bing rmovd from th Rgistr and rstoring a doctor s nam to th Rgistr. Th Guid also provids information for mployrs and is availabl to download from th Council s wbsit. A qustionnair will b dvlopd as part of th Council s Communication Stratgy in.
