Assistant Director September October 1995 Bureau of Competition Federal Trade Commission Mr. Horoschak was responsible for developing and implementing the FTC s antitrust enforcement program governing the health care industry during a period of unprecedented change in that industry. Major accomplishments included:
4 Page 4 Successful litigation of FTC v. University Health, Inc., 938 F.2d 1206 (11th Cir. 1991), and FTC v. Columbia Hospital Corp., No FTM-CIV-23D (M.D. Fla., preliminary injunction issued May 21, 1993), in which proposed hospital mergers were enjoined. Development and expansion of the Statements of Enforcement Policy and Analytical Principles Relating to Health Care and Antitrust which were jointly issued by the U.S. Department of Justice and Federal Trade Commission. Issuance of 24 advisory opinions on provider joint ventures and networks, business coalition activities, and professional self-regulation. Prior to taking charge of the health care program, Mr. Horoschak held a variety of positions with the FTC between 1984 and 1989, including Assistant General Counsel for the Commission and Acting Executive Assistant (Chief of Staff) and Attorney-Advisor for the Chairman of the Commission.
