3 COMMUNITY REINVESTMENT ACT PERFORMANCE EVALUATION INSTITUTION'S CRA RATING: This institution is rated Satisfactory. The major factors supporting this rating include: The bank s loan-to-deposit ratio is considered reasonable in relation to demand for credit in the bank s assessment area when taking into account the institution s recent entry in the market. While a majority of the bank s small business loans were originated outside the institution s assessment area, the bank s level of lending is considered responsive to the area s credit needs. Lending to businesses of different sizes is considered reasonable using various proxies for demand. While the bank s lack of lending to small businesses located in low-income census tracts is considered reasonable, the lack of lending in moderateincome tracts is considered poor using various proxies for demand. There have been no complaints regarding the bank s CRA performance. SCOPE OF EXAMITION Based on the number and dollar amount of loans originated during the preceding year, small business loans were identified as the primary credit product extended by the bank. Accordingly, this product line was considered in the evaluation and includes 50 small business loans extended during calendar years 2005 and DESCRIPTION OF INSTITUTION Virginia Heritage Bank is a de novo institution that commenced operations on November 21, 2005, and operates two branch offices in Fairfax County, Virginia. As of September 30, 2006, the bank reported assets of $41.5 million, of which 36.5% were loans. Various deposit and loan products are available through the institution, including loans for business, residential mortgage, and consumer purposes. The loan portfolio as of September 30, 2006, was comprised of 28.7% oneto four-family real estate secured, 40.3% commercial real estate and farm, 30.1% commercial and agriculture, and.9% consumer. The bank is currently focusing on commercial loans as its primary credit product. This is the first CRA evaluation of the institution. DESCRIPTION OF FAIRFAX COUNTY ASSESSMENT AREA The institution's assessment area encompasses all of Fairfax County and Fairfax City, Virginia, and is located within the Washington-Arlington-Alexandria DC-VA-MD- WV Metropolitan Statistical Area (MSA). According to the 2000 census data, the assessment area contains 170 census tracts, of which one is low-income, 13 are moderate-income, 58 are middle-income, and 97 are upper-income. One census tract in the assessment area does not have an income level designation. The area has a 1
4 population of 991,247 and a median housing value of $221,316. The owner-occupancy rate for the market is 69.2%, which exceeds both the MSA and the commonwealth levels of 58.8% and 63.3%, respectively. Within the assessment area, 3% of the families are living below the poverty level. This is below both the MSA and commonwealth poverty rates of 5.6% and 7%, respectively. The 2006 median family income for the MSA is $88,200. As of June 30, 2006, Virginia Heritage Bank maintained less than a.1% deposit market share in the assessment area. 5 While the assessment area is considered a bedroom community for the metropolitan Washington, D.C. area, both Fairfax County and the City of Fairfax, Virginia, have become self supporting communities. The local economies consist of a variety of businesses and include large corporations, small service firms, national trade associations and thriving retail stores. As of December 2006, the unemployment rates for Fairfax County, Fairfax City, and the Commonwealth of Virginia were 1.9%, 2.2%, and 2.7%, respectively. The December 2006 jobless rate for the Washington-Arlington- Alexandria DC-VA-MD-WV MSA is 2.9%. A local economic development official was contacted to further assist in evaluating the bank s CRA performance. The individual indicated that area financial institutions appear to be meeting the credit needs of the community. CONCLUSIONS WITH RESPECT TO PERFORMANCE CRITERIA: Loan-To-Deposit Ratio A bank s loan-to-deposit ratio is one measure of its lending relative to its capacity. The bank s loan-to-deposit ratio as of September 30, 2006, is 52.8% and averaged 50.7% for the four-quarter period also ending September 30, In comparison, the quarterly average loan-to-deposit ratios for all banks headquartered in metropolitan areas of Virginia and of similar asset size to Virginia Heritage Bank ranged from 66.2% to 79.5% for the same time period. Typical of a de novo institution, the bank s loanto-deposit ratio has been steadily increasing since its loan-to-deposit ratio of 23.5% reported for the quarter ending on December 31, Overall, the bank s loan-todeposit ratio is considered reasonable given the institution s size, branch locations, financial capacity, and the length of time in operation. As a result, a slightly higher percentage of small business loans were originated outside the institution s assessment area. Of the 50 small business loans reviewed, 48% of the total loans and 54.1% of the dollar amount of such loans were provided to businesses within the assessment area. Given the institution s recent entry in the market and its emphasis on increasing its loan portfolio, the institution s level of lending within its assessment area is considered responsive to community credit needs. 3
6 Lending to Borrowers of Different s and To Businesses of Different Sizes To evaluate the bank s lending penetration, the small business loans extended within the assessment area were analyzed. Area demographics, business loan aggregate data, and Dun & Bradstreet (D&B) information are used as proxies for demand. Aggregate business lending data includes all reporting institutions that originated such loans within the bank s assessment area during 2005 as required by the CRA. Virginia Heritage Bank is not subject to CRA reporting requirements; consequently, the bank s commercial lending activity is not included within the aggregate information. Discussion of the bank s performance is provided below. According to aggregate small business data, at least 44.6% of all small business loans reported within the market area were to businesses having annual revenues of $1 million or less. The remaining loans were extended to businesses having annual revenues in excess of $1 million, or revenue data was not reported. As indicated in the table above, 58.3% of the bank s loans were to entities with revenues of $1 million or less. Additionally, 79.6% of the dollar amount of the loans extended were to businesses with revenues under $1 million and 87.5% of the 24 loans extended were for loans of $1 million or less. When compared to area demographics and aggregate data, the bank s level of small business lending is considered reasonable. Geographic Distribution of Loans The geographic distribution of the small business loans originated by the bank within its assessment area is reflected below. Area demographics, small business aggregate data, and D&B business information are used as proxies for demand. A review of D&B data indicates that only.1% and 4.6% of the area s businesses are located in low- and moderate-income tracts, respectively. Furthermore, according to the 2005 aggregate loan data, less than.1% and 4.2% of loans extended in the market were to businesses located in low- and moderate-income tracts, respectively. Based on the few lending opportunities in the 4
7 low-income census tracts, the bank s lack of lending in such areas is not considered unreasonable. While recognizing the institution s recent entry in the market and the small number of loans available for analysis, the bank s current lack of lending in moderate-income areas is nonetheless considered poor. Fair Lending Or Other Illegal Credit Practices Review No credit practices inconsistent with the substantive provisions of the fair housing and fair lending laws and regulations were identified. Adequate policies, procedures and training programs have been developed to support nondiscrimination in lending activities. 5
