2 Main Goals of the Study To contribute to the development and implementation of the European Cloud Computing Strategy through: The quali-quantitative analysis of the current and expected demand for cloud computing in Europe; The analysis of the main barriers to take up of cloud computing by industry and consumers, focusing on the main policy and regulatory issues affecting demand; The production of recommendations for European policies and regulatory framework updates in order to accelerate the take up of cloud computing. 10 Barriers remaining in the No Intervention Scenario Regulatory Barriers Legal Jurisdiction and data location: no clarifying regulation, continuing uncertainty Security and Data protection: no harmonized regulation across the EU, no clear rules (or certification) of cloud vendors Trustworthiness: no vendors certification or other provisions helping users to select trustworthy service providers Market Regulation Data access and Portability: no guarantees for users because of lack of standardization, interoperability, overall market rules Market Conditions Local support, local language, slow Internet connections, demand for tax incentives to adopt: concern expected to lessen in time IDC May-12 10

11 Recommended Actions and Discussion points I Regulatory Framework Harmonize the regulatory framework across the EU for data protection, privacy protection But will it be possible to reconcile 27 Data protection approaches? Clarify uncertainties about data jurisdiction: the EU cannot leave cloud vendors and users alone in the globalized scenario Fostering EU-wide standardization and interoperability of cloud and cloud services how to deal with the current fragmented standard scenario? Data Portability : to what extent should it be guaranteed and/or supported by norms? May-12 11

12 Recommended Actions and Discussion points II Market conditions Develop conditions to insure cloud vendors accountability by Providing clear rules about liability and accountability about security breaches and compliance with relevant regulation Develop standardized contracts Options: security certifications of vendors, certifications for the government sector...self-certification or quality labels? Developing the business case for clouds is probably more relevant than it appears May-12 12

13 Recommended Actions and Discussion points III Tax incentives: is there a need to provide any? Switching from capital to service expenditure is discouraged by current fiscal rules particularly in the public sector. How relevant is this problem and should the EC do something about it? Should the cloud strategy refer to or contribute to the development of broadband infrastructures and regional infrastructures in order to improve connectivity? SMEs and Clouds Should the EC foresee specific incentives for SMEs to adopt cloud? Of which kind? May-12 13
