4 Form 807 AGREEMENT TO HIRE AN APPRENTICE / TRAINEE EMPLOYMENT AGREEMENT BETWEEN (the) Plumbing, Electrical, Electronic and Refrigeration Vocational Education, Employment and Training Incorporated referred to hereafter as PEER VEET AND (Hereafter referred to as the Host Employer) PART A PLACEMENT CONDITIONS OF APPRENTICE/TRAINEE 1. CONTRACT OF TRAINING 1.1 Apprentices/Trainees supplied by PEER VEET to Host Employers are employed under a Contract of Training under the Training and Skills Development Act 2003, as amended. The Apprentice/Trainee will remain an employee of PEER VEET and nothing contained in this agreement will be construed so as to constitute a transfer of employment or assignment of the contract to the Host Employer. 2. PERIOD OF PLACEMENT 2.1 This agreement shall commence on the first day of placement of the Apprentice/Trainee and be for any period of successive Apprentice/Trainee placement unless otherwise agreed between the Host Employer and PEER VEET. 2.2 The Host Employer may terminate the placement of the Apprentice/Trainee with a minimum of one weeks notice from the date of notification to PEER VEET. 2.3 In the event of any dispute or disagreement arising between PEER VEET and the Host Employer, either may give notice in writing stating the nature of the dispute and after expiration of seven days from the date of service of notice, the matter (unless resolved) shall be referred to a mutually agreed arbitrator. The decision shall be final and binding upon both parties. 3. TRAINING 3.1 On-the-job training The Host Employer shall provide On-the-job Training to the Apprentice/Trainee in accordance with the relevant Industry Competency Standards. The Host Employer is to notify PEER VEET of areas of trade training which the company provides. The Host Employer shall provide adequate supervision for the Apprentice/Trainee in accordance with the relevant award. Form 807 Issue Date: 12 January Review Date: 12 January 2011

5 3.1.2 The Host Employer must not assign and/or sub-contract the PEER VEET Apprentice/ Trainee to any other employer without written permission from PEER VEET. (PEER VEET is the only party that can determine this requirement.) 3.2 Off-the-job training PEER VEET will provide the Host Employer with the following as applicable to the Apprentice/Trainee. Off the job Training Schedule Off the job Assessment Results Notification of additional training as required The Host Employer shall release the Apprentice/Trainee to attend compulsory off-the-job training at an accredited training institution as and when required. Host Employers cannot alter an Apprentice s/trainees training schedule without prior approval from PEER VEET. When an Apprentice/Trainee is required to complete off-the-job training by correspondence lessons, the Host Employer shall allow the Apprentice/Trainee up to four hours per assignment in normal working hours. PEER VEET shall be responsible for all costs incurred for such absences The Host Employer is to encourage the Apprentice/Trainee to ensure all correspondence assignments are completed and forwarded to the relevant training centre in accordance with the Apprentice s/trainee s training timetable Additional training courses available to the Apprentice/Trainee will be advised by PEER VEET to the Host Employer. 4. WORKPLACE ASSESSMENTS 4.1 Probationary Assessment The progress of Apprentices/Trainees will be monitored during the probationary period to determine whether or not the Apprentice/Trainee has the aptitude and desire to continue employment in his/her trade. The Probationary Period is three months for an Apprentice and one-month for a Trainee, from the commencement of the Contract of Training. 4.2 Site Visits On a two-monthly basis, in conjunction with the Host Employer, PEER VEET s Recruitment & Training Coordinator will conduct progressive Site Visits (Workplace Assessments) to Apprentices/Trainees. The visits are to assess general conduct and performance, determine future training needs, ensure relative competencies are being achieved and provide any support or counselling if required PEER VEET will notify the Host Employer of any areas of concern in regard to the Apprentice s/trainee s performance and/or skills acquisition The Host Employer will provide all assistance which PEER VEET may reasonably request in relation to the compilation of periodic reports and Workplace Assessment on the Apprentice s/trainee s progress and performance. The Host Employer shall also complete and return the PEER VEET Apprentice/Trainee work performance report at the completion of the placement period. 6 5. APPRENTICE PROFILING 5.1 Under the current National Training Packages there is a requirement in some vocations for apprentices to complete weekly profiling sheets. The Profiling System is a compulsory part of the Contract of Training in order to ensure that apprentices achieve competency in areas of the industry as specified on the Profiling Sheets. 5.2 The Apprentice is required to complete the sheet daily and it is to be submitted to the training provider weekly. The Profiling Sheet must have verification by the immediate qualified tradesperson. 5.3 The Host Employer agrees to assist PEER VEET with complying with the requirements of the Profiling System. 5.4 PEER VEET may (by negotiation with the Host Employer) rotate the Apprentice s/trainee s work placement to ensure all relevant competencies are achieved. PART B ADMINISTRATION 6. PAYROLL & ALLOWANCES 6.1 Awards PEER VEET Apprentices/Trainees are respondent to the following industrial awards: 6.2 Plumbing & Roof Plumbing Plumbing Trades (Southern States) Construction Agreement Electrical, Data Communications, Refrigeration & Air Conditioning & Traineeship Vocations National Electrical Electronic & Communications Contracting Industry Award 1998 South Australia. It is a condition of the PEER VEET Enterprise Bargaining Agreement (EBA) that PEER VEET s Apprentices placed with Host Employers who have a current certified EBA that provides better wages and conditions than the PEER VEET s EBA, then those Apprentices shall be afforded those same wages and conditions. In respect of the Apprentice weekly rate of pay (in accordance with the relevant award or enterprise agreement) Host Employers may not make cash in hand payments in lieu of award or enterprise agreement entitlement. Such breaches of the Industrial Relations Act 1988 can lead to prosecution. 6.4 Wages, Overtime and Allowances PEER VEET will make payment to the Apprentice/Trainee of wages, travelling allowance, overtime and any other allowances due (site, travel, dirt, shift etc), as per the submitted timesheets. NOTE: Apprentices are entitled to the full rate of allowances. 7 Annual Leave and Leave Loading Public Holidays Off-the-job Training Attendance Worker s Compensation Levy & Claims Management Superannuation Income Tax Long Service Leave (if applicable) Group Certificates Payslips 6.5 Sick Leave The Apprentice/Trainee is entitled to sick leave in accordance with the relevant award. PEER VEET must be notified of absences and the Host Employer must be notified prior to normal commencement time. Apprentices/Trainees must also provide PEER VEET with a medical certificate for any absences due to sickness. 6.6 Annual Leave The Apprentice/Trainee must apply to the Host Employer at least four weeks in advance (in normal circumstances) and also notify PEER VEET of leave arrangements by filling out a PEER VEET leave application form. Annual leave will not be granted to Apprentices/Trainees during off the job training attendance. The Host Employer will notify PEER VEET as early as possible if they intend to close business for annual holidays to allow time for the Apprentice/Trainee to be placed with another company if necessary. It is a policy of PEER VEET that Apprentices take 20 days of annual leave before the anniversary of the next year. Host Employers must release Apprentices/Trainees to allow them to take annual leave accruals prior to their anniversary. Host Employers may be charged additional costs if they fail to release any Apprentices/Trainees for annual leave. 7. HOST EMPLOYER ACCOUNTS 7.1 Payment of Accounts PEER VEET will provide the Host Employer weekly invoices and a monthly statement detailing the monies due to allow for the full recovery of an amount that shall include wages paid, overtime, site allowances, any other award or EA conditions plus an amount to cover on costs. Payment terms of the account are within 7 days of receipt of such invoices/statement via a Direct Debit System. In the event that the Host Employer defaults on any monies due within the said period, PEER VEET may at its absolute discretion, immediately withdraw the Apprentice/ Trainee, take legal action to recover the full amount owing and charge interest on overdue accounts at current bank overdraft rates. SUBSIDIES PEER VEET as the employer specified in the Contract of Training retain the right to claim any administrative or employment incentive subsidies in respect to the employment of the Apprentice/Trainee from any source. From time to time PEER VEET may have access to training wages subsidies, for example from the Construction Industry Training Fund through the Construction Industry Training Board. These subsidies will be passed on to an eligible Host Employer as they are made available to offset the cost involved for the time the trainer (tradesperson) spends in training the Apprentice/Trainee. The Host Employer must, in order to qualify for any available subsidy; Ensure all Apprentice/Trainee weekly timesheets are lodged with PEER VEET by the close of business one (1) working day prior to PEER VEET s nominated pay week (currently COB each Tuesday), to which the time sheets refer Meet the Payment of Accounts conditions. 9. INSURANCE 9.1 Workers Compensation All Apprentices/Trainees employed by PEER VEET are insured for WorkCover by PEER VEET. The Host Employer MUST advise PEER VEET immediately of any near miss incident, workplace injury or workers compensation claim that has occurred to the Apprentice/Trainee during their placement with the Host Employer, regardless of whether any time has been lost. PEER VEET is responsible for the administration of any workers compensation claim. 9.2 Public Liability The Host Employer will maintain public liability insurance for a minimum of Five Million Dollars ($5M) against any loss, damage or injury to any third party caused by the Apprentice/Trainee in the course of work done while the Apprentice/Trainee is placed with the Host Employer and hereby indemnifies PEER VEET in respect of any such liability. A copy of the current certificate of insurance, including the expiry date, shall be provided to PEER VEET. Note: Host Employer, please attach evidence of your current liability insurance policy, to this document. PART C OCCUPATIONAL HEALTH, SAFETY & WELFARE, EQUAL OPPORTUNITY & AFFIRMATIVE ACTION 10. OCCUPATIONAL HEALTH, SAFETY AND WELFARE PEER VEET will ensure the Apprentice/Trainee has completed an off job workplace employee induction program, and has been instructed in and is aware of their obligations in regard to Occupational Health, Safety and Welfare compliance. The Apprentice/Trainee will be provided with a copy of PEER VEET s Apprentice Information and Safety Manual for ongoing reference. Form 807 Issue Date: 12 January Review Date: 12 January 2011

9 PEER VEET will supply each Apprentice/Trainee with safety clothing and equipment. These items which are in accordance with Australian Standard AS 2210, include trousers and shirts, bluey jacket, safety footwear, clear and tinted safety glasses, gloves, earplugs, dust mask, hard had, sun hat, sun screen and safety bag to contain all such items. However, should the supplied equipment not be applicable for a particular task or environment, the Host Employer must, at no cost, provide the Apprentice/Trainee adequate personal protective clothing and equipment and training to protect them against any hazards associated with the particular task or environment. All items of personal protective equipment that has been supplied by the Host Employer or PEER VEET must meet the relevant Australian Standards, be in good working order and be of correct fit to the individual required to use such protective equipment. In accordance with the relevant sections of the Occupational Health, Safety and Welfare Act and the Occupational Health, Safety and Welfare Regulations (as amended), the Host Employer shall as a minimum: provide and maintain a safe work environment, safe plant and substances and safe systems of work such that, so far as is reasonably practicable, PEER VEET Apprentices/Trainees are not exposed to hazards within their workplaces and are safe from injury and risks to their health; provide such information, instruction, and training to, and supervision of, PEER VEET Apprentices/Trainees as is reasonably necessary to ensure that they are not exposed to hazards and risks and do not create workplace hazards and risks for others. ensure, so far as is reasonably practicable that the use, handling, cleaning, maintenance, transportation, storage, processing and disposal of plant, equipment and substances in the workplace are carried out in a manner such that PEER VEET Apprentices/Trainees are not exposed to hazards and risks in the workplace. 11. OCCUPATIONAL HEALTH & SAFETY AGREEMENT BETWEEN PEER VEET & HOST EMPLOYER 11.1 For the purposes of the OHSW Act 1986, an Apprentice/Trainee, who is engaged by a Host Employer to perform work for the Host Employer, is deemed to be employed by the Host Employer. However, the Host Employer s duties under this Act, in relation to them, extend only to matters over which the Host Employer has control or would have control but for some agreement to the contrary between the Host Employer and the Apprentice/Trainee or PEER VEET Accordingly, the Host Employer has specific responsibilities and obligations to the Apprentice/Trainee under the OHSW Act In particular the Host Employer has a Duty of Care to the Apprentice/Trainee as delineated by Section 19 of the OHSW Act (Copy attached, see part D, pages 13 & 14 of this agreement). It should be acknowledged by the Host Employer that in the event of an injury to a PEER VEET Apprentice/Trainee, PEER VEET bears the Workers Compensation liability associated with this injury. However, in the event of Host Employer negligence resulting in injury to a PEER VEET Apprentice/Trainee the Host Employer may be liable for breaches of the OHSW Act and Regulations, which may result in convictions and fines. Enforcement of the OHSW Act and Regulations is the responsibility of the SafeWork SA Inspectors (Department of Premier and Cabinet) not PEER VEET. 10 11.3 It is a requirement of this agreement that the Host Employer will meet its obligations under the OHSW Act, the OHSW Regulations and any relevant approved Codes of Practice In particular it is a requirement of this agreement that the Host Employer will: (1) Do all things reasonably practicable to eliminate hazards and control risks to health and safety in the workplace; (2) Notify PEER VEET of any fundamental changes to the workplace, work practices or procedures, plant equipment, materials or substances that may put the health and safety of Apprentices/Trainees at risk; (3) Provide Apprentices/Trainees with appropriate supervision consistent with the risks to health and safety associated with the work performed; (4) Provide Apprentices/Trainees with appropriate information, instruction and training to enable them to safely carry out their job; (5) Provide evidence of and conduct a formal induction process, that includes OHSW, when the Apprentice/Trainee commences work with the Host Employer (also, individual site inductions may be required and need to vary dependant on the identified hazards and risks at each worksite) It is also a requirement of this agreement that the Host Employer will: (1) Provide PEER VEET authorised staff with access to the worksite (when permissible) where PEER VEET Apprentices/Trainees are performing work; (2) Support the right of PEER VEET to monitor the health and safety of Apprentices/ Trainees whilst working with the Host Employer; (3) Accept representation, by PEER VEET Field Officers (Recruitment and Training Coordinators) or PEER VEET nominated personnel, in relation to the health and safety of PEER VEET Apprentices/Trainees; (4) Verbally inform and provide a documented accident report to PEER VEET or their representative of any accidents, incidents or injury occurrences involving PEER VEET Apprentices/Trainees within 24 hours (where practicable); (5) Provide appropriate First Aid to PEER VEET Apprentices/Trainees in the event of an injury occurring in the workplace; (6) In the event of a hazard being reported or an incident or injury occurring to a PEER VEET Apprentices/Trainees, permit PEER VEET personnel to conduct an investigation to determine contributing factors and remedial actions; (7) Assist PEER VEET rehabilitate an injured Apprentice/Trainee back into the workplace where the injury occurred (where practicable); (8) Liaise with PEER VEET personnel with respect to the implementation of appropriate control mechanisms in order to prevent a recurrence of incidents or injuries; (9) As soon as practicable report to PEER VEET, that they have notified the Department of Administrative and Information Services (Workplace Services), of any Dangerous Occurrences and/or Default, Improvement, or Prohibition Notices that have been issued to / placed on the Host Employer. 11 12. EQUAL OPPORTUNITY AND AFFIRMATIVE ACTION PEER VEET has a firm commitment to the aims and objectives of both state and Federal Equal Opportunity and Affirmative Action Legislation. There is legislation in place that prohibits discrimination on various grounds against people seeking employment and those already employed. Any purposeful infringement(s) of the Acts referred to above may lead to the termination of this Employment Agreement and the immediate withdrawal of the Apprentice/Trainee. PART D OHS&W LEGISLATION Direct quote from the Occupational Health, Safety and Welfare Act 1986 Part 3 General Provisions Relating to Occupational Health, Safety and Welfare Duties of employers Section 19. (1) An employer shall, in respect of each employee employed or engaged by the employer, ensure so far as is reasonably practicable that the employee is, while at work, safe from injury and risks to health and, in particular (a) shall provide and maintain so far as is reasonably practicable (i) (ii) (iii) a safe working environment; safe systems of work; plant and substances in a safe condition; and (b) (c) shall provide adequate facilities of a prescribed kind for the welfare of employees at any workplace that is under the control and management of the employer; and shall provide such information, instruction, training and supervision as are reasonably necessary to ensure that each employee is safe from injury and risks to health. * * * * * * * * * * (3) Without derogating from the operation of subsection (1), an employer shall so far as is reasonably practicable: (a) Monitor the health and welfare of the employer's employees in their employment with the employer, insofar as that monitoring is relevant to the prevention of work-related injuries; and (b) Keep information and records relating to work-related injuries suffered by employees in their employment with the employer and retain that information and those records for such period as may be prescribed; and (c) Provide information to the employer's employees (in such languages as are appropriate) in relation to health, safety and welfare in the workplace (including the names of persons to whom the employees may make inquiries and complaints about matters affecting occupational health, safety or welfare); and Form 807 Issue Date: 12 January Review Date: 12 January 2011

12 (d) Ensure that any employee who is to undertake work of a hazardous nature not previously performed by the employee receives proper information, instruction and training before he or she commences that work; and (e) Ensure that any employee who is inexperienced in the performance of any work of a hazardous nature receives such supervision as is reasonably necessary to ensure his or her health and safety; and (f) Ensure that any employee who could be put at risk by a change in the workplace, in any work or work practice, in any activity or process, or in any plant: (i) is given proper information, instruction and training before the change occurs; and (ii) receives such supervision as is reasonably necessary to ensure his or her health and safety; and (g) Ensure that any manager or supervisor is provided with such information, instruction and training as are necessary to ensure that each employee under his or her management or supervision is, while at work, so far as is reasonably practicable, safe from injury and risks to health; and (h) Monitor working conditions at any workplace that is under the management and control of the employer; and (i) Ensure that any accommodation, or eating, recreational or other facility, provided for the benefit of the employer's employees while they are at work, or in connection with the performance of their work, and under the management or control of the employer (either wholly or substantially), is maintained in a safe and healthy condition. Under section 61 of the OHS&W Act 1986, a Body Corporate MUST nominate one or more Responsible Officers and the responsible officer should undertake an approved course of training. What is a Body Corporate? A typical meaning of body corporate for OHS&W purposes would be, a registered company or association. Broadly, this would mean a registrable legal entity other than a natural person. An example may be a Proprietary Limited, Limited or Incorporated company. Who is a Responsible Officer? In simple terms the Responsible Officer is usually a Director, Business Owner, Chief Executive Officer, Managing Director or General Manager. It is the most senior person from the body corporate who resides in the state and is in a position to prevent a contravention of the OHS&W Act 1986 (the Act). The Responsible Officer is the person accountable for safety across the whole organisation. If an employee is hurt or seriously injured in your workplace, the final responsibility lies with the Responsible Officer. According to the Act, the Responsible Officer must be; a member of the governing body of the body corporate who resides in the State; or the chief executive officer of the body corporate, who resides in the State; or if no one is eligible for appointment under the preceding paragraph a senior executive officer of the body corporate who resides in the State; or an officer of the body corporate. Under section 28D of the Workers Rehabilitation and Compensation Act 1986, as of 01/01/09, organisation with 30 or more employees MUST appoint and have trained a Rehabilitation and return to work coordinator. 13 Role and responsibilities of a Rehabilitation and Return to Work Coordinator A Rehabilitation and Return to Work Coordinator is assigned the following functions under section 28D of the Act: Assisting your injured workers to remain at, or return to work, as soon and as safely as possible after injuries occur Assisting the case manager in the preparation and implementation of rehabilitation and return to work plans for your injured workers Liaising with persons involved in rehabilitation or providing medical services to your injured workers Monitoring the progress of your injured workers capacity to return to work Taking steps to prevent secondary injuries. It is the Customers responsibility to ensure sufficient cleared funds are in the nominated debiting account when the payments are to be drawn. 6. If the due date for payment falls on a non-working day or public holiday, the payment will be processed on the next working day. If the Customer is in any doubt, please refer to Point 3 above. 7. For returned unpaid transactions, the following procedure will apply.
