AUTHORITY MEMBER/STAFF COMMENTS Community Development Administrative Analyst Sona Mooradian announced that on March 28 th, the SCPH would be opening the waiting list for their affordable housing property, Casa De La Paloma, reserved for low income seniors and/or disabled residents. The Authority recessed to closed session at 2:47 p.m. The Authority reconvened at 6:10 p.m. 8. NEW BUSINESS a. that the City Attorney and outside counsel Burke Williams & Sorensen are hereby authorized to initiate litigation by filing a petition seeking compliance with the legislative subpoenas issued by the Housing Authority to the receiver for Advanced Development & Investment, Inc. (ADI) Pacific Housing Diversified, Inc. (PHD). Said subpoenas pertain to four development projects at 1860 Garden Avenue, 328 Mira Loma Avenue, 3673 San Fernando, and 1814 Vassar Avenue (the Projects ). The City Attorney and outside counsel are further authorized to oppose - whether by intervention, joinder or other appropriate action - the motion brought by the Respondent in the case of Karimi v. Mithaiwala, Case No. BD , which requests a court order prohibiting the disclosure to the Housing Authority of forensic reports prepared by Crowe Horwath pertaining to the Projects. The City Attorney is further authorized to incur any and all expenses necessary in connection with said matters. AUTHORITY MEMBER/STAFF COMMENTS City Manager Starbird clarified the speaker s comments indicating that Police Officers do not make $120/ hour. Chair Quintero also responded, and indicated that the Verdugo Job Center, which is funded by CDBG funds, holds regular job fairs. Councilmember Najarian expressed that he felt the $120/hr overtime fee charged by Police for various programs was excessive, that they should be staffed by volunteers and hourly workers. Councilmember Manoukian agreed that the $120/hr overtime fee was too much. 8. NEW BUSINESS 9. Page 2 RECOMMENDATION Community Development staff recommends that the Housing Authority of the City of Glendale (Housing Authority) approve the motions for amendments to the Professional Services Agreements with Kane Ballmer Berkman, Tierra West Advisors, Inc., and Keyser Marston & Associates in support of affordable housing activities for FY SUMMARY As part of the Housing Authority Program Budget, funding is being appropriated for contractual services in the Redevelopment Set Aside (Fund 242) and HOME (Fund 203) Administration Programs for professional services agreements (PSA's) related to affordable housing activities. A Professional Services Agreement (including all change orders) can not exceed $50,000 without Housing Authority approval. The Housing Authority contracts for professional services with firms that offer specialized expertise in the area of affordable housing. At each stage of development, including negotiations, financing, land acquisition, construction oversight and contract management, legal and financial analysis services are required to assure that the Housing Authority interests are protected and that the requirements of State and Federal regulations governing use of Housing Authority funding sources are met. The need for these services is based upon the number and complexity of projects in development at any time. Currently there are several projects in development and a number of projects proposed that require a high level of legal and financial services in this coming fiscal year. As seen in Exhibit 1, the Housing Authority has 5 projects now under consideration, in predevelopment, or in construction. Continuous service by professional services firms familiar with Housing Authority policies and regulations and projects already in development is important for quick and effective implementation of housing development programs and projects. Funding for these contract amendments would be provided via Redevelopment Set Aside funds and HOME funds specifically designated for affordable housing purposes. No general funds assist with affordable housing activities. 1. Legal Services - Kane Ballmer Berkman Kane Ba llmer Berkman (KBB) is a consulting firm that provides the Housing Authority with specialized affordable housing legal services for affordable housing development projects and specialized programs. Staff has determined that additional professional services will be needed from this firm in and In July 2010, the Housing Authority approved a contract with KBB fo r services in the amount of $90,000 for a term of one year. This contract was amended to increase the amount of the contract to $180,000 in January The contract expires June 30, It is recommended that increased funding of $125,000 and a contract extension of two years (to expire June 30, 2013) be approved for the current KBB contract. In the Housing Program Budget the Housing Authority has budgeted for expenditures of $125,000 for affordable housing legal services tentatively assigned to KBB.

Financial Services Federal and State affordable housing funds have extensive requirements for financial analyses prior to approval, during development, and continuing into operational phases of affordable housing projects. A. Tierra West Advisors Tierra West Advisors (TWA) is a consulting firm that provides the Housing Authority with financial and economic analysis services for affordable housing development projects. Staff has determined that additional professional services will be needed from this firm in and In August 2009, the Housing Authority entered into a PSA with TWA for $50,000. The PSA was amended in 2010 for an additional $50,000. It is recommended that increased funding of $50,000 and a contract extension of approximately one year (to expire June 30, 2013) is recommended for the current TWA contract. In the Housing Program Budget, the Housing Authority has budgeted for expenditures of $50,000 for financial and economic analysis services tentatively assigned to Tierra West Advisors. B. Keyser Marston and Associates. Keyser Marston and Associates (KMA) is a consulting firm that provides the Housing Authority with financial and economic analysis services for affordable housing development projects. Staff has determined that additional professional services will be needed from this firm in and In October 2009, the Housing Authority entered into a PSA with KMA for $30,000. The PSA was amended in 2010 for an additional $20,000. Increased funding of $43,500 and a contract extension of approximately two years (to expire June 30, 2013) is recommended for the current KMA contract. In the Housing Program Budget, the Housing Authority has budgeted for expenditures of $43,500 for financial and economic analysis services, tentatively assigned to KMA. Funding for this contract amendment would be provided via Redevelopment Set Aside funds and HOME funds specifically designated for affordable housing purposes. No general fu nds assist with affordable housing activities. FISCAL IMPACT There is no new fiscal impact associated with th is proposed Housing Authority action. Funding for the necessary change orders were appropriated into the Redevelopment Set Aside and HOME Fund Administrative Budget by the Housing Authority during the FY budget approval process.
