I am an attorney at law duly licensed to practice before all of the courts of the State of California and am a partner in the firm of Ringler Schmidt, cocounsel of record for Plaintiff Jarett Olson. I am one of the attorneys responsible for the handling of this file and have personal knowledge of the facts contained in this declaration. If called as a witness, I would competently testify as to the matter set forth in this declaration. 2. I graduated from the University of San Francisco School of Law in I was admitted to the California Bar in I have been involved in the active practice of law since such time. 3. I have been admitted to practice before the United States Court of Appeals, Ninth Circuit (in 1974), in addition to the United States District Court Central District of California (in 1975), United States District Court Northern District of California (in 1974), and United States District Court Southern District of California (in 1981). 4. During the past three decades, my practice has been involved exclusively in pre-trial litigation and trial of a wide variety of matters. During the past 5 to 10 years, my practice has focused exclusively in the pre-trial litigation and trial of class actions, business torts, and catastrophic personal torts. My firm therefore has significant experience in complex class action litigation, including experience in litigating privacy related actions, and has negotiated numerous substantial settlements. 5. In my opinion, the settlement presented in Plaintiffs Motion for Final Approval of Class Settlement, filed herewith, is fair, adequate and reasonable. 6. The total lodestar for my firm is $87, My firm s lodestar figures are based upon the firm s billing rates, which do not include charges for expense items. Expense items are billed separately and such charges are not duplicated in my firm s billing rates. 12. I also submitted to the attorneys of Kiesel Law LLP a spreadsheet of expenses formatted pursuant to this Court s Order re Format of Time and Expense Records. These expense submissions have also been incorporated into the spreadsheet attached to the Declaration of Paul R. Kiesel. To date, my firm has incurred a total of $ in unreimbursed out-of-pocket expenses in connection with the prosecution of this litigation, which were advanced with no promise of repayment. 13. The expenses incurred in this action are reflected on the books and records of my firm. These books and records are prepared from expense vouchers, check records, and other source materials and represent an accurate recordation of the expenses incurred. These expenses were reasonable and necessary to achieve the successful result reached in this case. 14. Neither my firm nor any of its attorneys have any interests or involvement in the proposed cy pres recipients, namely, the Berkman Center for Internet & Society at Harvard University and the Electronic Frontier Foundation. That said, I believe both entities are reasonable cy pres recipients because of the work they perform in the privacy arena. Jerome L. Ringler Jerome L. Ringler has personally tried in excess of 75 jury trials to verdict, including a class action in which he received a verdict of $156 million dollars. He has obtained verdicts, which total in excess of $250 million dollars. He has extensive experience in complex litigation where he has tried to verdict not only the class action referenced above, but as well cases involving stock fraud, breach of contract, misappropriation of trade secrets and wrongful termination. In addition to the foregoing he has handled in pre-trial litigation many class action matters in a variety of areas, and negotiated many multi-million dollar class action settlements. Finally, Mr. Ringler was appointed as one of nine lead attorneys to prosecute a national class action against Toyota Motor Corporation arising out of the sudden acceleration claims filed by hundreds of attorneys across the country. Mr. Ringler was President of the Los Angeles Trial Lawyers Association in 1993, where he also served on the Board of Governors from He was the recipient of the Los Angeles Trial Lawyers Association Trial Lawyer of the Year Award in He received this same honor when Verdictum Juris awarded him Trial Lawyer of the Year in Mr. Ringler has achieved the rank of Diplomate, the highest level of achievement in the American Board of Trial Advocates. Catherine Burke Schmidt Catherine Burke Schmidt completed her undergraduate degree at UCLA and received her legal training at the University of San Diego School of Law graduating in Ms. Schmidt s practice has concentrated on complex class action litigation.
