8 European policy of quality give some instrument tools WICH ARE IN EUROPE THE POSSIBILITIES TO DEVELOP QUALITY and PROTECT PRODUCTIONS? Art. 16 Regulation EU 1305/2013 PUBLIC LABELS ON ORIGIN, METHOD OF PRODUCTION, QUALITY, are; based on a product specifications for production process or for a high quality level of the final product; Have to be verified by an independent inspection body; Have to be accessible to all producers. PRIVATE LABEL, MARKS, PRIVATE CERTIFICATIONS OF SYSTEMS AND PRODUCTS 7

9 WHY PUBLIC QUALITY SYSTEM & LABELS? For the possibility to have public aid and financial supports for investments, promotion, costs of controls; For public publicity and institutional promotion to consumers But also: They give a best imagine for the product, best visibility to consumers and distribution Administrative support and information for diversification Best competitiveness in front of distributions, international competitors protecting consumers with high level of quality, certifications and controls defence of producers & consumers from frauds, imitations and misleading labels more standardisation at high level, more interest from buyers All these aspects give good motivations and organization to producers 8

12 PDO Protected Designation of Origin Is the term used to describe foodstuffs which are produced, processed and prepared in a given geographical area, using recognised know how Quality is strictly related to origin area characteristics PGI Protected Geographical Indication the geographical link must occur in at least one of the stages of production, processing or preparation. Furthermore, the product benefits of good reputation. TSG Traditional Speciality Guaranteed a TSG does not refer to the origin but highlights traditional character, either in the composition or means of production which distinguishes the product. It s generally used to protect traditional recipes and typical dishes 11

16 FIRST STEP for the CLUSTER: Organise an association (group / claster) of producers (farmers and cheese producers) choose the scheme more appropriate for the situation of the product; Write together the quality specification (rules), to have the agreement of the most part of the producers; Decide the roles and responsibilities of this cluster for the defence of this cheese and its promotion; Decide a common label for the cheese, a collective marks ; Write the rules to use the label: only the farmer who produce applying the cheese specification, have the possibility to use the label; Decide a system of controls, to ensure that the product allows the specification and to ensure correct labelling in the market place; Organise the activities for valorisation and promotion of the quality cheese 15

18 DOCUMENTS FOR THE REGISTRATION of a G.I. 1. CONSTITUTION OF THE ASSOCIATION Articles of association (statute) Document of constitution or regulation 2. SUPPORT DOCUMENTS Historical documentation of the reputation Geographical environment aspects relates to quality Technical aspects (description of the product characteristics and of obtaining method) Social and economic situation, trends, markets Maps 3. SPECIFICATION the summery of support documents the fixed rules 4. UNIQUE DOCUMENT 17

19 THE PRODUCT SPECIFICATION It shall include, at least: a) the name of the agricultural product or foodstuff comprising the designation of origin or the geographical indication; b) description of the agricultural product or foodstuff, including raw materials, if appropriate, and principal physical, chemical, microbiological or organoleptic characteristics of the product c) the definition of the geographical area and, where appropriate, details indicating compliance with the requirements d) evidence that the agricultural product or the foodstuff originates in the defined geographical area referred; e) a description of the method of obtaining the agricultural product or foodstuff 18

20 f) details bearing out the following: the link between the quality or characteristics of the agricultural product or foodstuff and the geographical environment; the link between a specific quality, the reputation or other characteristic of the agricultural product or foodstuff and the geographical origin; g) the name and address of the authorities or bodies verifying compliance with the provisions of the specification and their specific tasks; h) any specific labelling rule for the agricultural product or foodstuff in question; I) any requirements laid down by Community or national provisions. 19

THE NAME of the CHEESE - HISTORICAL REPUTATION To prove: - the fame/reputation of the cheese and - the use of consolidated geographical name ORIGINAL DOCUMENTS shall be provided: texts and historical photos showing the name of the cheese or producers association; labels, advertising, posters and photos of festivals, newspaper articles, awards and plaques for the quality of the product, traditional recipes, typical procedures, invoices or sales contracts, price lists, text and poems highlighting the designation of the product. 20

30 EUROPEAN STEPS FOR THE G.I. CERTIFICATION in UE Members: Regional & national analysis Preparation of the documents by producers Application sent to competent national authorities (Regions & Ministry of agriculture) Formal evaluation in a third country: Application sent to the Commission Formal investigation Commission analysis Publication on OJ (6 months) Objection procedure No publication Registration of main points of the application Final publication of names 29

31 BUT BE CARFULL!! PDO, PGI, in certain situations, could also give problems to producers: Farmers have to follow the rules or the specification Some consumers don t agree to pay a fair price for PDO-PGI products The costs of the controls are too high for farms A part of the production could not reach the level of quality asked (refuse) Before begin a path for PDO-PGI certification, you have to: analyze advantages & problems of IG labels; sometimes, it s better to valorize your own collective mark; Evaluate also other possibilities to use one of the next European new possibilities of valorization 30

32 Other new possibilities: European Policy of quality : new reserved terms PRODUCT OF MY FARM to assist farmers selling directly to consumers. A common symbol and scheme identity will be established in the Regulation PRODUCT OF MOUNTAIN FARMING For producers in mountain areas to better identify the mountain attribute of their product. Only for products composed of raw materials from mountain areas and transformed in mountain areas The mountain attribute is clearly a value adding quality for consumers. To help producers to secure the marketing advantages of their disadvantaged region. 31

33 Registered names shall be protected against: any direct or indirect commercial use of a name registered; any misuse, imitation or evocation, even if the true origin of the product is indicated or the protected name is translated or accompanied by expressions such as 'style`, 'type`, 'method`, 'as produced in`, 'imitation`; any other false or misleading indication as to the provenance, origin, nature or essential qualities of the product, on the inner or outer packaging, any other practice liable to mislead the public as to the true origin of the product 32

34 Other new possibilities: NATIONAL QUALITY SYSTEMS approved by the states and the regions, allowed with UE regulation MUST BE COMPATIBLE with the EU Treaty and the Community rules on the single market, free competition, state aid. = May not lead to benefits based on the national / local producers a) The production methods ensure: specific characteristics including the processes of production; quality of the final product significantly beyond the normal commercial standards (for public health, plant and animal health, animal welfare or environmental protection): b) They have binding product specifications and controlled by independent inspection body; c) systems open to all manufacturers and do not pose any geographical limitations; d) transparent and assure complete traceability of products; e) respond to current and foreseeable market opportunities 33

37 PROBLÈMES ET DIFFICULTÉS FOR PRODUCERS and USEFUL HELP from local Institution or University: 1 ORGANISATION Help producers to understand advantages; give motivations, organize an association 2 DOCUMENTATION Prepare the specifications and others documents RELATIONS NEW SCHEMES COUTS & CONTRÔLS relations among Institutions (Region, Minister, UE Commission) Help farms to choose amongst opportunities: mountain label, local market label, Organic, PDO- PGI, regional and national quality schemes for qualification and promotion Organise not expensive controls to let them able to pay the costs 6 TUTELLE & PROMOTION Organize and manage of consortium defence Help to valorise and promote quality products 36

38 Next RURAL DEVELOPMENT PROGRAM Aid to support the cost of control for quality system productions Co-financing for the information and promotion to consumers Training courses to farmers Technical assistance measures Investment to improve farms structures Aid to support small farms to develop: - educational farms, social farms, bed and breakfast and multi-activity - roads and circuits to promote typical products - direct selling activities in the farm or in city markets 37
