1 Antrak Air Ghana Limited Full Conditions of Carriage General Conditions of Carriage CHECK-IN Check-in starts 2 hours before the flight and closes 45 minutes to departure. A photo ID is required for check-in. STANDARD CONDITIONS You are allowed 20kg check-in luggage plus 5kg hand luggage. Reconfirmation: For international travel, please reconfirm your booking at least 48 hours before departure. Failure to cancel your booking at least 48 hours before departure would result in a "No Show" fee charge of $20 (or Cedi equivalent). Promotional tickets are not refundable. All other ticket refunds attract a fee of $20 (or Cedi equivalent). Excess baggage is charged at GHS 4.00 per kg. Tickets are valid for six months. NOTICE OF BAGGAGE LIABILITY LIMITATIONS Liability for loss, delay, or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. For travel with Antrak, the Montréal Convention will apply. Antrak assumes no liability for fragile, valuable or perishable articles unless declared and appropriate charges paid. Claims will be computed at US$20 per kilogram of the total baggage weight. When more than one piece of baggage is involved, the weight of the missing baggage will be used to calculate the claim. SAFETY AND SECURITY NOTICES All safety and security notices published by the Ghana Airports Company Limited apply to your travel with Antrak. FLIGHT DELAY OR CANCELLATION While Antrak will make every effort to operate according to its published schedule, there may be occasions when Antrak may be forced to cancel or delay flights for reasons beyond our control. Our cherished clients are to note that the following constitutes Antrak s official policy and commitment to clients when flights are cancelled or delayed: Antrak s responsibility is to get you to the ticketed destination, but not necessarily at the scheduled time, since certain events may be out of the airline s control, such as bad weather, mechanical problems, airport congestion or closure, etc. Antrak will make every effort to operate the flight at a later time or date when it is safe to do so. If the flight has to be cancelled, Antrak will make efforts to transfer passengers to another airline or refund PAID-UP fares to passengers for them to make their own alternative travel arrangements. Antrak is not responsible for any extra cost of flights paid on other airlines. Antrak will do its utmost best to operate the delayed or cancelled flight at a re-scheduled time. 1

2 Antrak will NOT be responsible for the transportation to and from the residences of passengers, or any other request or claim other than those explained above, as a result of delay or cancellation of flights. Antrak will NOT be responsible for booking, re-booking, confirmation or re-confirmation of any international flight/travel that is not operated by Antrak. Passengers must take steps to plan their flights with Antrak so as to give themselves enough time to make alternative arrangements for their international travel in case of delay or cancellation of their Antrak flight. DANGEROUS GOODS For safety reasons, dangerous articles such as (but not limited to) those listed below must not be carried in passengers baggage. Compressed gases (deeply refrigerated, flammable, non-flammable and poisonous) such as butane, oxygen, liquid nitrogen, aqualung cylinders. Corrosives such as acids, alkalis, mercury and wet cell batteries. Explosives, fireworks, flares, sparklers or other explosives. Flammable liquids and solids such as lighter fuel, matches, paints, thinner and firelighters. Radioactive materials. Briefcases and attaché cases with installed alarm devices. Oxidizing materials such as bleaching powder, peroxides. Weapons such as disabling sprays, e.g. tear gas, mace, pepper spray. Firearms and a limited quantity of ammunition may be carried subject to proper packaging and prior authorization from the airline. Poisons and infectious substances such as insecticides, weed - killers and live virus materials. Other dangerous articles such as magnetized material, offensive or irritating materials. Many of these listed articles can be carried as air cargo provided they are packed in accordance with cargo regulations. Medicines, toiletries, hairsprays, perfumes, alcohol, and other liquids may be carried in passengers baggage in limited quantities. 3 3.1 General Antrak Air will provide carriage only to persons who possess a valid Ticket (either in manual or electronic form), provided that, for each passenger, such person is named as the Passenger in the Ticket. 3.2 Period of validity Except if it says otherwise in the Ticket, in these Conditions of Carriage, or in Tariffs which apply, a Ticket is valid for six (6) months. 3.3 Open Tickets Our booking system allows customers to pay the lowest fare that is available in the system, at the time of booking, for open tickets. Open tickets are available only to help you because you cannot confirm your travel plans. They are not meant to allow customers to buy cheaper tickets and use them later for peak flights on which there are no available seats for that fare class. If there are available seats for the fare class of your open ticket, you will not be required to make any further payment. If there are no available seats on your chosen flight for the fare class of your open ticket, you will be required to pay a top-up. 3

4 4.1 Fares The fare paid for Ticket covers carriage and Baggage from the airport at the place of departure to the airport at the place of destination and on the dates specified in the Ticket. The fare does not include ground transport service between airports and between airports and town terminals. 4.2 Taxes, fees and charges A passenger will pay to Antrak Air the total amount of all applicable taxes, fees and charges imposed by a government or other authority, or by the operator of an airport, which Antrak Air is obliged to collect in respect of the carriage. 4.3 Surcharges in exceptional circumstances In exceptional circumstances, charges may be imposed on Antrak Air by third parties, which are of a type or amount not normally applicable to Antrak Air operations (for example, insurance premium supplements or additional security costs triggered by unlawful interference with civil aviation). In addition, Antrak Air may be subjected to significant increases in operational costs (for example, fuel charges) caused by exceptional circumstances beyond our control. In such cases, the passenger will be required to pay, as fare surcharges, all such charges even if imposed after the date of issue of Ticket. 4.4 Currency Fares, taxes, fees, charges and exceptional circumstances surcharges are payable in U.S Dollar or in the currency of the country in which the carriage commences, converted to the currency of the country of payment (if different) at the applicable Banker's Selling Rate. 4

5 5.1 Reservation requirements Reservation can be accepted by direct physical contact, the telephone or the website Antrak Air should know at the time of booking if the passenger has a medical condition or other condition for which he/she may require medical assistance or special assistance during embarkation, disembarkation or aboard an aircraft. 5.2 Fare payment requirement Antrak Air will cancel reservation if the applicable fare for the Ticket has not been paid prior to the ticketing time limit specified. 5.3 Personal data Antrak Air will request personal data for the purpose of making reservation, give flight information or direct marketing. 5.4 Reconfirmation of Reservations It is necessary to reconfirm reservations for international travel forty-eight (48) hours before departure. Failure may result in cancellation of reservations Antrak Air will not be liable for any loss or expense whatsoever resulting from failure to comply fully with reconfirmation requirements. 5

6 6.1 Passengers must present themselves for check-in no later than 45 minutes prior to the scheduled departure time. Check-in period is indicated on the ticket. 6.2 Passengers must comply with the applicable Check-in Deadline. Antrak Air has the right to cancel reservations if a passenger does not comply with the Check-in Deadline. Passengers who arrive late for check-in will miss their flight. 6.3 Antrak Air will not be liable for any loss or expense whatsoever resulting from failure to comply fully with check-in deadline. 6

7 7.1 Right to refuse carriage Antrak Air has the right to refuse to carry a passenger or his Baggage on any flight (even if the passenger holds a valid Ticket and has a boarding pass) if one or more of the events listed in Articles to has happened or Antrak Air reasonably believe might happen, it being understood that Antrak Air has no duty to make any enquiries when determining whether it believes an event might happen Refusal to carry is necessary in order to comply with any applicable government laws, regulations, orders or governmental policy; or A passenger commits a criminal offence during check-in or Failure to observe safety or security instructions of, or obstruct or hinder, any ground staff or crew member in the performance of their duties; or Threatening, abusive, insulting or indecent words or behave in a threatening, abusive, insulting or indecent manner to any person, including ground staff, members of the crew or other Passengers prior to or during any of the operations of embarkation on the flight, or disembarkation from a connecting flight, or on board the aircraft before take-off; or Carriage of a passenger and/or his baggage may endanger or adversely and materially affect, or has endangered or adversely and materially affected, the safety, health, or security of the aircraft, other passengers or members of the crew, or the comfort of other passengers aboard the aircraft; or The passenger appears to be incapacitated by alcohol or drugs; or The passenger's mental or physical state, including his impairment from alcohol or drugs, appears to present a hazard or risk to himself, or to other Passengers, or to crew, or to the aircraft, or any person or property in it, or represents a likely or actual source of material annoyance or discomfort to other Passengers aboard the aircraft; or The passenger refuses to submit to a security check for himself or his Baggage or, having submitted to such a check, he fails to provide satisfactory answers to security questions at check-in or the boarding gate, or he fails a security profiling assessment/analysis, or tampers with or removes any security seals on his Baggage or security stickers on his boarding pass; or Fails to observe Antrak Air safety, security or passenger comfort instructions concerning, for example, seating, storage of Unchecked Baggage, smoking, consumption of alcohol, use of drugs, dress, or use of electronic equipment (for example, mobile/cellular phones, laptop computers, PDAs, portable recorders, portable radios, CD, DVD and MP3 players, electronic games or transmitting devices); or The passenger has made, or attempted to make, a bomb hoax, hijack threat or any other security threat; or The passenger has not paid in full the applicable fare, taxes, fees, applicable charges or exceptional circumstances surcharge for the carriage; or The passenger does not meet the requirements in relation to medical fitness to fly. 7

8 7.2 Reimbursement of costs If a passenger is refused carriage for any of the reasons set out above, he will reimburse Antrak Air for any costs it incurs resulting from: (a) repair or replacement of property lost, damaged or destroyed by him; (b) compensation Antrak Air has to pay to any Passenger or crew member affected by his/her actions. 7.3 Fitness to fly Before boarding the aircraft for carriage, the passenger must be reasonably satisfied that he/she is medically fit to fly. 7.4 Carriage of pregnant Passengers and newborn children Antrak Air will carry a pregnant passenger after 28th week of gestation only if she produces a medical report or letter, signed by an appropriately qualified doctor or midwife, stating due date, and confirming that the pregnancy is uncomplicated. The report or letter should also advise the latest date up to which the passenger is expected to be fit to travel Carriage of newly born infants will generally not be permitted until 7 Days after delivery. 7.5 Carriage of unaccompanied children Antrak Air will not accept for carriage a passenger under 5 years of age on the date the flight commences unless he/she is accompanied by an escort aged 18 years or above. If he/she is between 5 and 16 years of age, Antrak Air can arrange for an escort, provided Antrak Air receives 3 Days or more notice prior to travel and an extra charge is paid If the passenger is more than 5 years of age, but less than 12 years old on the date the flight commences, he/she will not be accepted for carriage unless the following conditions are met in full: 7.5.2(a) he/she is accompanied at check-in by a parent, guardian or adult responsible who remains in the airport with an allocated member of Antrak Air staff until the passenger has boarded the aircraft and it has taken-off from the airport, and who can prove also to Antrak Air that the passenger will be met at the destination airport by another parent, guardian or adult responsible for the passenger (with full details of that person's identity (b) and into whose custody the passenger can be delivered; 7.5.3(a) the passenger has a confirmed reservation for his/her flight and it is not anticipated by Antrak Air that the flight will terminate at a place other than its destination or make an unexpected stop at any other place due to weather or other operational conditions; and 7.5.3(b) the passenger's ticketed carriage does not involve an en route change of airport. 7.6 On board services For operational reasons, Antrak Air do not make any guarantees about the provision/availability of in-flight entertainment equipment and advertised programmes; advertised special meals or any other type of meals; or the availability of advertised in-flight services. 8

9 Antrak Air does not guarantee that special meals will always conform to their exact description. This is because they have been prepared by third parties to Antrak Air's order. 9

10 8.1 Free Baggage allowance Free baggage allowances are shown on the ticket. 8.2 Excess Baggage A passenger will have to pay an extra charge for carriage of Baggage in excess of the free Baggage allowance. The passenger will also have to pay an extra charge for carriage of any container with an animal inside unless the animal is a service or guard animal. 8.3 Prohibited Items There are certain items which must not be included in the Baggage. Set out below are prohibitions applicable to Checked and Unchecked Baggage, as well as separate and extra prohibitions applicable to Checked Baggage only and to Unchecked Baggage only. If a passenger fails to comply with any of the applicable rules, himself and/or his baggage will be refused carriage. In addition, he/she will not be entitled to claim compensation if any prohibited item wrongfully included in Baggage sustains Damage or causes Damage to his Baggage A passenger must not include any of the following items in his Unchecked Baggage or Checked Baggage: (a) Items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the ICAO Technical Instructions for the Safe Transport of Dangerous Goods by Air and the lata Dangerous Goods Regulations. Details are available at check-in (b) Items which are prohibited from being carried by applicable laws, regulations, orders or Governmental policy of any state to be flown from or to; (c) Items which are reasonably considered by Antrak Air to be unsuitable for carriage because they are dangerous or unsafe or by reason of their weight, size, shape or character, or which are fragile or perishable having regard to, for example, the type of aircraft being used. Please ask Antrak Air about any concerns you may have about the suitability of Baggage before arrival at the airport; A passenger must not include in Checked Baggage fragile or perishable items, valuable items (including, for example, money, jewelry, precious metals), computers, personal electronic devices, stored data, any medication or medical equipment which may be required in-flight or during your trip or which cannot be quickly replaced if lost or damaged, house or car keys, valuable documents (including, for example, business documents, passports and other identification documents, negotiable papers, securities deeds) or samples A passenger must not include in his Unchecked Baggage: (a) Real, replica or toy weapons, arms and ammunition, explosives or anything containing explosives (for example, Christmas crackers, fireworks or fire crackers) and incendiary materials: knives of any kind/type/shapes or size; letter openers; metal cutlery; catapults; slingshots, razor blades and straight razor blades (excluding safety razor and accompanying cartridge blades); tradesmen's tools; darts; scissors; nail files; hypodermic needles and syringes (unless required for medical reasons and accompanied by a medical certificate confirming the medical conditions necessitating carriage); knitting needles; corkscrews; sporting bats and clubs (including, for example, baseball and softball bats, golf clubs, cricket bats but excluding tennis, badminton and squash racquets); hard sporting balls (including, for example, cricket, 10

11 field, hockey or billiard, snooker or pool balls); billiard, snooker or pool cues; martial art devices (b) Real, replica or toy weapons, arms and ammunition, explosives or anything containing explosives (for example, Christmas crackers, fireworks or fire crackers) and incendiary materials; knives of any kind/type/shape or size; letter openers; metal cutlery; catapults; slingshots, razor blades and straight razor blades (excluding safety razors and accompanying cartridge blades); tradesmen's tools; darts; scissors; nail files; hypodermic needles and syringes (unless required for medical reasons and accompanied by a medical certificate confirming the medical condition necessitating carriage); knitting needles; corkscrews; sporting bats and clubs (including, for example, baseball and softball bats, golf clubs, cricket bats but excluding tennis, badminton and squash racquets); hard sporting balls (including, for example, cricket, field, hockey or billiard, snooker or pool balls); billiard, snooker or pool cues; martial arts devices (c) Any article which in Antrak Air's opinion, or the opinion of airport security personnel, might be used as, or adapted for use as, a weapon with the potential to cause injury or incapacitation or to represent any other security or safety threat. 8.4 Right to Refuse Carriage Antrak Air may refuse to accept Baggage for carriage if it decides that it is unsuitable for carriage, whether because of its size, shape, appearance, weight, content, character, or for safety or operational reasons, or for the comfort of other Passengers Antrak Air may refuse to accept Baggage for carriage if it decide that it is not properly and Securely packed in suitable containers. 8.5 Right of search, Screening and X-Ray For reasons of safety, health and security, and to check that passenger is not carrying in his Baggage any items prohibited by these Conditions of Carriage, Antrak Air may search, screen and x-ray the Baggage. Antrak Air will try to search a passenger s Baggage while present, but if not readily available Antrak Air may search it in his absence. If a passenger does not let us conduct all such searches, scans and x-rays, Antrak Air will refuse to carry his Baggage If a search, screen or x-ray causes Damage to a Baggage, Antrak Air will not be liable for the Damage unless it was caused solely by its negligence. 8.6 Checked Baggage Passenger must fasten a tag, or secure a sticker, containing his name, full address and a telephone number at which he can be contacted, and again inside each item of Checked Baggage. 8.7 Animals Antrak Air will not accept an animal for carriage unless the passenger has applied for, and obtained prior approval and meet all of the following conditions and applicable Regulations: The animal must be properly crated (with necessary supplies of food and water) in a suitable Container for carriage in the cargo holds of an aircraft in accordance with all applicable legal requirements 11

12 8.7.2 The animal is accompanied by valid health and vaccination certificates, entry permits and other necessary documents The passenger has paid the charges applicable, unless the animal is a service animal Unless carriage of the animal is covered by the liability rules of the Warsaw Convention or the Montreal Convention, Antrak Air will not be responsible for its loss, injury, sickness or death unless caused solely by its negligence. 12

13 9.1 Schedule The flight times and flight durations shown in Antrak Air's timetables may change between the date of publication (or issue) and the date of actual travel. Antrak Air does not guarantee flight times and flight durations and they do not form part of your contract of carriage with us. 9.2 Cancellation and delays Sometimes cancellation and delay occur due to circumstances beyond Antrak Air control, e.g., bad weather. Antrak Air will take reasonable measures necessary to avoid cancellation and delay. However if such situations occur, Antrak Air will not be liable for any expenses incurred by the passenger. 9.3 Denied Boarding If a passenger cannot be carried on a flight for which he has a confirmed reservation and have met all applicable check-in and boarding deadlines, Antrak Air will carry him on one of its later flights or will pay compensation under applicable law or Antrak Air denied boarding compensation policy Apart from the rights under Article 9.3, Antrak will have no liability for any loss or expense whatsoever Antrak will refund the fare paid for the ticket in accordance with its regulations. 13

14 10.1 Refund Antrak Air will refund the fare paid for Ticket, or any unused part of it, together with applicable taxes, fees, charges and exceptional circumstances surcharges in accordance with fare rules and Tariffs and the following additional rules: Unless stated otherwise, Antrak Air will make a refund only to the person who has paid for the Ticket, provided it is given proof of identification and payment Involuntary refunds Fare refunds will be calculated according to Articles (a) and (b) in case Antrak Air cancels a flight, fails to operate a flight reasonably according to schedule, or fails to carry on a flight for which the passenger has a confirmed reservation and have met the applicable Check-in deadline and boarding deadline and have not been refused carriage for reasons permitted by these Conditions of Carriage. In all of those situations, the refund will be: (a) an amount equal to the fare paid (including taxes, fees, charges and exceptional circumstances surcharges paid) if no portion of the Ticket has been used; or (b) if a portion of the Ticket has been used, an amount equal to the difference between the fare paid including taxes, fees, charges and exceptional circumstances surcharges paid) and the correct fare (including taxes, fees, charges and exceptional circumstances surcharges) for travel between the points for which a passenger has used his Ticket Antrak Air will pay a refund according to Article (b) if it refuses carriage for any of the reasons set out in Article 7.1, except that the passenger will not be entitled to any refund for the flight for which he was refused carriage. Apart from this, Antrak Air will have no Liability for any loss or expense whatsoever Antrak Air will pay a refund according to Article (b) if it terminates carriage for any of the reasons set out in Article 11.4 (unacceptable behaviors aboard aircraft) before it is completed, except that passenger will not be entitled to any refund for the flight during which the unacceptable behavior occurred. Apart from this, Antrak Air will have no Liability for any loss or expense whatsoever Voluntary refunds If a refund of the fare of the Ticket is due for reasons other than those set out in Article 10.2, the refund will be: (a) an amount equal to the fare paid (including taxes, fees, charges and exceptional circumstances surcharges paid) less any applicable cancellation fees if no portion of the Ticket has been used, less also any applicable administration fee(s), if the Ticket is subject to restrictions; or (b) if a portion of the Ticket has been used, an amount equal to the difference between the fare paid (including taxes, fees, charges and exceptional circumstances surcharges paid) and the correct fare (including taxes, fees, charges and exceptional circumstances surcharges) for travel between the points for which the Ticket has been used, less any applicable cancellation fees, less also any applicable administration fee(s), if the Ticket is subject to restrictions. 14

15 10.4 Right to refuse refund Antrak Air will not give a refund if application for the refund is made more than 2 years from the date of issue of the original Ticket Antrak Air will not give a refund on a Ticket for any flight on which the passenger has been refused carriage (for any of the reasons set out in Article 7.1) or from which he has been removed (for any of the reasons set out in Articles 11.1 to 11.3) Currency Antrak Air will pay refunds in the same form and currency that was used to pay for the Ticket By whom Ticket refundable Antrak Air will pay a voluntary refund on a Ticket only if Antrak Air or its Authorized Agents issued the Ticket. 15

16 Conduct aboard the aircraft 11.1 General At all times during carriage, the passenger has a duty to behave in a manner, which is not likely to: Contravene the laws of any state which has jurisdiction over the aircraft; Endanger, or threaten (whether by hoax threats or otherwise) the aircraft or any person or property; Injure or prejudice the health of other persons aboard the aircraft or create the risk or threat of injury or damage to health; Cause distress to, or be complained of as materially objectionable to, other persons aboard the aircraft, such conduct includes, for example, harassment, molestation, sexual assault or abuse; Cause, or be likely to cause, loss of or damage to our property or that of other persons aboard the aircraft; Obstruct, hinder or interfere with the crew in the performance of their duties; Contravene any instruction or direction of the crew or Antrak Air (whether oral or by notice) lawfully issued for the purpose of the safety or security of the aircraft and of persons or property and/or the comfort or convenience of Passengers, including, instructions concerning safety, security, seating, seat belts, smoking, consumption of alcohol or use of drugs, use of electronic equipment including, but not limited to, cellular telephones, laptop computers, PDAs, portable recorders, portable radios, CD, DVD and MP3 players, electronic games or transmitting devices (for example, radio controlled toys and walkie talkies On board alcohol Passengers are not allowed to consume alcohol aboard an aircraft (whether purchased as duty free from Antrak Air; someone else or otherwise obtained) unless it has been served. Antrak Air has the right, at any time for any reason, to refuse to serve alcohol or to withdraw alcohol, which has been served Smoking policy Smoking is not permitted on any of Antrak Air's flights Breach of duty If Antrak Air reasonably believes that a passenger has failed to fully observe all of the duties as per Articles 11.1 to Antrak Air may report the matter to any relevant police or other enforcement authority; and Antrak Air may take such measures necessary to prevent the continuation or repetition of the offending conduct including, for example, physical restraint and/or removal of the passenger from the aircraft Antrak Air may decide to refuse to carry the passenger at anytime in the future. 16

17 12.1 The passenger will reimburse Antrak Air for any costs it incurs in order to: (a) Repair or replace Property lost, damaged or destroyed by him; (b) Compensate any Passenger or crew member affected by his actions; and (c) Divert the aircraft for the purpose of removing him from the aircraft. Antrak Air may use the value of any unused carriage on his Ticket or any of his funds in its possession to pay sums due. 17

18 Travel documents, customs & security inspections 13.1 General The passenger is responsible for obtaining and holding all of the travel documents he needs for any country he is visiting (even as a transit Passenger) The passenger must obey all laws, regulations, orders, and other requirements of all countries he will exit or enter If requested, the passenger must present all passports, visas, permits, health certificates and other travel documents needed for the journey, to Antrak Air to take photocopies of those documents or deposit those documents against receipt. Antrak Air has the right to require the passenger to present to it any of these documents at any time before or during the passenger's carriage Antrak Air will not be liable if the passenger do not have all passports, visas, health certificates and other travel documents needed for the journey or if any of those documents are out of date or if the passenger has not obeyed all laws, regulations, orders, and other requirements of all countries the passenger will exit or enter Antrak Air will not accept a passenger or his Baggage for carriage if his visas or travel documents do not appear to be in order or if he has not complied with the other requirements of this Article Antrak Air has the right to refuse carriage in this way even if the passenger has started or completed part of the carriage before it becomes clear to Antrak Air that the passenger has not complied with Article Refusal of entry If a passenger is refused entry to a country, he must reimburse Antrak Air in full on request, the amount of any fine, penalty or charge assessed against Antrak Air by the government concerned (including detention costs) as well as the fare for transporting the passenger, and an escort if required, from that country. Antrak Air will not refund the fare paid for carriage to the airport where entry was refused Passengers responsible for fines, detention costs and other charges The passenger must reimburse Antrak Air in full on request, the amount of any fine, penalty, detention costs, deportation or removal expenses, escorting charges (if any), cost of ticket(s) issued for the passenger, or any other expenditure Antrak Air incurs because of his failure to comply with any laws, regulations, orders or other travel requirements of the country the passenger has traveled to or because he has failed to produce the required travel documents on seeking entry to a country or he has been refused admission into the country. Antrak Air may use the value of any unused carriage on the Ticket or any of his funds in our possession to pay sums due to Antrak Air 13.4 Return of confiscated travel documents Antrak Air will not be liable for the return of any of the travel documents, identification documents or Tickets confiscated by a governmental or other authority Customs inspection If required, the passenger will attend inspection of his Baggage by customs or other government officials. Antrak Air will not be liable for Damage suffered by the passenger in the course of such inspection or as a result of his failure to attend. 18

19 13.6 Security inspection The passenger must allow security checks, searches and scans of his person by Antrak Air, its handling agents, government officials, airport officials, police or military officials and other airlines involved in his carriage. If the passengers do not allow all such security checks, searches and scans to be conducted, Antrak Air will refuse to carry the passenger and his Baggage. 19

20 Liability for Damage 14.1 Applicable rules Antrak Air liability will be determined by applicable law and this Conditions of Carriage. Where other airlines are involved in the journey, their liability will be governed by applicable law and, unless this Conditions of Carriage state otherwise, their conditions of carriage. Applicable law may comprise the Warsaw Convention or the Montreal Convention and/or laws which apply in individual countries. The Warsaw Convention and the Montreal Convention apply to international carriage as defined in those Conventions. Provisions concerning our liability are set out in Articles 14.2 to Scope of liability Antrak Air will be liable only for damage occurring during carriage performed, or in relation to which Antrak Air has a legal liability General limitations Wherever the Warsaw Convention or the Montreal Convention applies to the carriage, Antrak Air's Liability will be subject to the rules and limitations of the applicable Convention Antrak Air will be wholly or partly exonerated from liability for damage if it prove that the damage was caused or contributed to by the passenger s negligence or other wrongful act or omission Antrak Air may be wholly or partly exonerated from liability for damage if it prove that the damage did not result from its negligence or that it resulted from the negligence of a third party, or that Antrak Air took certain measures to avoid the damage or that it was impossible to take such measures Antrak Air will not be liable for any damage arising from its compliance with applicable local law or government rules and regulations or from the failure of the passenger to comply with the same, except as may be provided by the Warsaw Convention or the Montreal Convention Except where stated otherwise in these Conditions of Carriage, Antrak Air will be liable to only compensatory damages entitled to recover for proven losses and costs under the Warsaw Convention or the Montreal Convention or local laws which may apply The passenger's contract of carriage applies for the benefit of Antrak Air authorized Agents, servants, employees and representatives to the same extent as applies. As a result, the total amount recoverable from Antrak Air and its Authorized Agents, servants, employees and representatives will not be more than its own liability, if any Nothing in these Conditions of Carriage: l4.3.7 (a) gives up or waives any exclusion or limitation of Antrak Air liability available under the Warsaw Convention, or the Montreal Convention or applicable local law unless otherwise expressly stated in writing by Antrak Air ; or (b) prevents Antrak Air from excluding or limiting its liability under the Warsaw Convention, or the Montreal Convention, as applicable, or under any other laws 20

21 which apply, or gives up any defense available to Antrak Air there under against any public social security body or any person liable to pay, or who has paid, compensation for the death, wounding or other bodily injury of a Passenger Death or injury of Passengers Antrak Air liability for damage sustained by a passenger, in the event of death, wounding or other bodily injury caused by an accident is subject to the rules and limitations of applicable law as well as the following supplementary rules: Antrak Air liability for proven damages will not be subject to any financial limit, be it defined by law, the Warsaw Convention or otherwise; For any proven damages up to the National Currency Equivalent of 100,000 SDRs, any defense based on proof that Antrak Air and its agents have taken all necessary measures to avoid the damage, or that it was impossible for such measures to have been taken, will not apply Antrak Air agrees to make advance payments to the passenger or his heirs subject to the following terms and conditions: (a) the person receiving payment is a natural person (that is to say, a person in the ordinary sense of the word as opposed to artificial persons or corporations); (b) laws; (c) The passenger is, or the person receiving payment is, entitled to compensation under applicable loss. Payments will be made only in respect of immediate economic needs; l4.4.3 ( d) The amount of a payment will be proportional to the economic hardship being suffered as a result of the death, wounding or bodily injury, save that, in the case of death, it will not be less than the National Currency Equivalent of 10,000 SDRs per Passenger; l4.4.3 (e) Payment will not be made later than 30 Days after the identity of the person entitled to compensation has been established under applicable laws; l4.4.3 (f) No person will be entitled to receive a payment if he or she or the passenger to whom the payment relates, caused or contributed to the Damage to which the payment relates by his or her negligence; (g) All payments will be made subject to the condition that they will be returned to Antrak Air on proof that the recipient has not complied with or satisfied Article l4.4.3(b) or he or she or the Passenger to whom the payment relates, caused or contributed to the damage to which the payment relates; (h) Payments will be off-set against any subsequent sums payable in respect of our liability under applicable laws; l4.4.3(i) Except for payment of the minimum sum specified in Article l4.4.3(d) in respect of death, a payment will not exceed the maximum damages for which Antrak Air be liable to pay the recipient; (j) The making of a payment will not constitute recognition or admission of liability by Antrak Air; 21

22 14.4.3(k) No payment will be made unless the person receiving payment gives us a signed receipt which also acknowledges the applicability of Articles l4.4.3(g), (h) and U); and (l) Save to the extent in conflict with any applicable law, and subject to payment of the minimum sum specified in Article ( d) in the case of death, Antrak Air decision in relation to the payment amount will be final Baggage Antrak Air will not be liable for damage to unchecked baggage unless Antrak Air caused the damage by its negligence Antrak Air will not be liable for damage to baggage resulting from the inherent defect, quality or vice of the Baggage. Likewise, Antrak Air will not be liable for fair wear and tear of baggage resulting from the usual and normal rigors of transportation by air (see also Article regarding the suitability of the baggage for transportation by air) Antrak Air is not liable for Damage to any item included in the Baggage which it prohibited from including in the Baggage by Articles 8.3 and 8.4. For Checked Baggage, those items include, for example, fragile or perishable items, valuable items (for example, money, jewelry, precious metals), computers, personal electronic devices, stored data, any medication or medical equipment which may be required in-flight or during your trip or which cannot be quickly replaced if lost or damaged, house or car keys, valuable documents (for example, business documents, passports and other identification documents, negotiable papers, securities deeds) or samples Antrak Air Liability for Damage to Baggage is limited to the maximum amounts stated in Articles (a) to (e) unless it is proved that the Damage resulted from Antrak Air act or omission either done with the intention of causing Damage or recklessly and with knowledge that Damage would probably result. The passenger may wish to make a special declaration of value (see Article ) or buy insurance to cover instances where the actual value or replacement cost of Checked Baggage or Unchecked Baggage exceeds Antrak Air liability (a) The National Currency Equivalent of 332 SDRs (approximately US$400) per Passenger applies to damage to unchecked baggage where the Warsaw Convention applies to the carriage; (b) The National Currency Equivalent of 17 SDRs (approximately US$20) per kilogram, or any higher sum agreed by Antrak Air pursuant to Article , applies to damage to checked baggage where the Warsaw Convention applies to the carriage; (c) The National Currency Equivalent of 1000 SDRs (approximately US$1375) per passenger, or any higher sum agreed by Antrak Air pursuant to Article , applies to damage to both unchecked and checked baggage where the Montreal Convention applies to the carriage; (d) The limit of liability for damage to both unchecked and checked baggage laid down by local law applies to the baggage where local law applies to the carriage instead of the Warsaw Convention or the Montreal Convention. 22

23 (e) The limits of liability for damage to both unchecked and checked baggage specified in Articles (a) and (b) apply to damage to unchecked baggage and checked baggage respectively where neither the Warsaw Convention nor the Montreal Convention applies to the carriage and no limit of our liability is laid down by applicable local law Antrak Air will increase its liability for damage to checked baggage to an amount specified by the passenger and agreed by Antrak Air at the time he hands his checked baggage at check-in, but only if he pay an additional charge calculated in accordance with Antrak Air regulations. This is known as a "special declaration of value" If the weight of checked baggage is not recorded on the baggage check, Antrak Air will presume that it is not more than the free baggage allowance for the class of carriage for which the passenger was booked Advice to International Passengers on limitation of liability Where the journey involves an ultimate destination or stop in a country other than the country of origin, the passenger is advised that the Warsaw Convention or the Montreal Convention may be applicable to the entire journey, including any section entirely within the country of origin or destination. Where the Montreal Convention is applicable, the airline is liable for proven damages for death or personal injury, and certain defenses to Liability specified by that Convention will be inapplicable for damages not exceeding the National Currency Equivalent of 100,000 SDRs. Where the Montreal Convention is not applicable, the conditions of carriage of many airlines (including Antrak Air, as specified in Article 15.4 above) provide that the liability for death or bodily injury will not be subject to any financial limit defined by the Warsaw Convention and that, in respect of such damage up to a maximum of the National Currency Equivalent of 100,000 SDRs, any defense to Liability based on proof that they have taken all necessary measures will not apply. Where no such provisions are included in the airline's conditions of carriage, please note that; (i) for such Passengers on a journey to, from or with an agreed stopping place in the USA, the Warsaw Convention and special contracts of carriage embodied in applicable Tariffs provide that the Liability of certain airlines, parties to such special contracts, for death of or personal injury to Passengers is limited in most cases to proven damages not to exceed US$75,OOO per Passenger, and that this liability up to such limit will not depend on negligence on the part of the airline; and (ii) for such Passengers travelling by an airline not a party to such special contracts or on a journey to which the Warsaw Convention applies which is not to, from or having an agreed stopping place in the USA, the liability of the airline for death or personal injury to Passengers is limited in most cases to US$IO,OOO or US$20,OOO; and (iii) some countries impose higher limits than those stated in (i) and (ii). Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the airline's Liability under the Warsaw Convention or the Montreal Convention or such special contracts of carriage of the type mentioned in (i) above. Note: The limit of Liability of US$75,000 specified in (i) above of this Article 14.6 is inclusive of legal fees and costs except that, in case of a claim brought in a state where a provision is made for separate award of legal fees and costs, the limit will be the sum of US$58,OOO exclusive of legal fees and costs. 23

24 15.1 Time limit for Baggage claims The passenger, or the person holding the Baggage Check and Baggage Identification Tag with Authority, receives Checked Baggage without complaint; the absence of complaint will be sufficient evidence that the Checked Baggage was received in good condition unless the passenger proves otherwise If the passenger wants to claim compensation for Damage to Checked Baggage, he must notify Antrak Air as follows ( a) if the Damage to Checked Baggage is physical in nature he must notify Antrak Air in writing within 7 Days of receipt of the Checked Baggage; (b) if the Damage consists of total or partial loss of Checked Baggage he must notify us in writing within 7 Days of the date the Checked Baggage arrived or should have arrived; (c) if the passenger wants to claim compensation for delay of Checked Baggage, he must notify Antrak Air in writing within 21 Days from the date the Baggage was placed at his disposal Processing of Baggage claims Claims will be computed at USD$20 per kilogram of the total baggage weight When more than one piece of baggage is involved, the weight of the missing baggage will be used to calculate the claim Time limit for all actions for damages The passenger will have no right to compensation for any damage if an action is not brought within 2 years of the date of his arrival at the place of destination, or the date on which the aircraft was scheduled to arrive, or the date on which the carriage stopped. 24
