1 CITY OF BONTTA SPRINGS, FLORIDA RESOLUTION NO A RESOLUTION OF THE CITY OF BONITA SPRINGS, FLORIDA; ACCEPTING THE ANNEXATION AGREEMENT AND ANNEXATION PETITION BETWEEN THE CITY OF BONITA SPRINGS AND AGRIPARTNERS LIMITED PARTNERSHIP, A FLORIDA LIMITED PARTNERSHIP, TO ANNEX APPROXIMATELY 2, ACRES INTO THE CITY OF BONITA SPRINGS; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bonita Springs, Florida: Section 1. The Annexation Agreement and Annexation Petition between the City of Bonita Springs and Agripartners Limited Partnership, a Florida Limited Partnership, involving property located contiguous to the boundary of the City, consisting of approximately 2,595.09± acres, copies of which are attached hereto as Exhibits A and B, are hereby approved. The Mayor and the City Clerk are hereby authorized to execute the Agreement on behalf of the City. Section 2. This Resolution shall take effect retroactively to February 4, 2004, the date City Council approved and annexation agreement. 3 This ANNEXATION AGREEM ENT (lierei nafter Agreement ), effective as provided herein, is entered into by and between: Agripariners Limited Partnership, a Florida limited partnership whose address is North Woodward Avenue, Suite 310, Bloomfleld Hills, Michigan (hereinafter Agripartners ); and the CITY OF TAL46251 :5 BSC Property in accordance with the terms of this Agreement. authorized to enter into this Agreement. Recitals and Agreed Findings hereto, Agripartners and the City do hereby agree as follows: NOW, THEREFORE, in consideration of the mutual benefits, covenants, and conditions contained herein, the sufficiency of which is acknowledged by both parties WHEREAS, the Parties wish to express the agreements and understandings reached between them as of the date hereof for their mutual protection and convenience, annexation and future development of the Property, which effort will entail considerable resources of time, energy, and money of the Parties. and to establish mechanisms for resolving any remaining details relating to the the Property on the City s Future Land Use Map, the assignment of zoning categories to terms and conditions stated herein in order to obtain for the Property the benefits and allow the most appropriate development of the Property, and the provision of all services, WHEREAS, Agripartners has agreed to annex the Property into the City upon the privileges of inclusion within the boundaries of the City which include the designation of facilities, and utilities as are available to all residents of the City; and WHEREAS, the City finds that annexing the Property into its boundaries will be beneficial to the City of Bonita Springs; and WHEREAS, the Property is contiguous to the boundary of the City, is reasonably compact, will not result in the creation of an enclave, and otherwise meets the requirements for voluntary annexation established in Chapter 171, Florida Statutes; and located within Lee County legally described in Exhibit A attached hereto and WHEREAS, Agripartners is the owner of approximately 2,595 acres of property incorporated herein by reference (hereinafter the Property ); and purposes of this Agreement is 9220 Bonita Beach Road, Suite Ill, Bonita Springs, Florida (hereinafter City ).
