1 This policy is developed pursuant to the Transport Coordination Act Small Charter Vehicle Licence Policy 1. OVERVIEW All vehicles operating for hire and reward in Western Australia must hold an appropriate licence issued by the State Government. Passenger Services Unit (PSBU) manages the issuing of all licenses for all passenger vehicles used for hire and reward. PSBU issues four types of licences: Taxi Licence (Country and Metropolitan) Omnibus Licence Small Charter Vehicle Licence (SCV) - Metropolitan Area Private Taxi (PT) - country areas Small Charter Vehicles (SCV) are luxury passenger cars of a prescribed vehicle standard capable of carrying 11 or less passengers (excluding the driver). They must be used solely for charter, with journeys commencing within the Perth metropolitan area. PSBU does not restrict the number of SCV licences that are granted. 2. OPERATING CONDITIONS SCVs have a number of restrictions placed upon their operation to differentiate SCV services from taxi services: SCVs are a higher class of vehicle than is generally available as a taxi. SCVs cannot operate from taxi ranks or `ply for hire or tout on roads or other public places for the purpose of hire. SCVs must not display signage that presents it in a manner resembling a taxi. SCVs are also differentiated from omnibuses: SCVs must not operate along established routes with established pick-up and drop-off points. SCVs cannot operate off-road. 3. VEHICLE STANDARDS The schedule below sets out the 4 categories that a vehicle can be assessed under. For a vehicle to become an SCV, it must meet all the criteria of least one of these categories. Group A Group B Group C Group D Luxury vehicles Vehicles that cost at least the amount of the LCT threshold when new. Note: the following vehicle(s) will always be included in this category irrespective of the value: Ford Fairlane Holden Statesman Holden Caprice Toyota Tarago Modified / Stretched vehicles Classic / Vintage vehicles Aged 25 years or older when Green vehicles Vehicles that have a 5 star rating from the Green Vehicle Guide 8 years from the date of manufacture 8 years from the date of manufacture Specific vehicle standards apply for a vehicle to be registered as an SCV. To standardise the application of SCV policy with regard to vehicle standards, the PSBU has adopted terminology guided by the Australian Taxation Office (ATO) in relation to the terms passenger car and luxury car. An SCV must be a: Car - a vehicle designed for the principle purpose of carrying passengers (including paying passengers). A car includes vehicles for sport or recreation purposes, station wagons, passenger sedans, people movers and sports utility vehicles. It also includes modified/stretched limousines. Holden Statesman, Ford Fairlane (last year of manufacture 2007) and Toyota Tarago vehicles are considered acceptable SCVs no matter what purchase price was paid. For all other vehicles (with the exception of vehicles in groups C & D) an SCV must also be a: Luxury car - A car which will include GST, dealer delivery charges and any standard and statutory warranties. Excluding extras, stamp duty, transfer fees, registration or compulsory third-party insurance which is above the ATO s Luxury Car Tax (LCT) threshold in the year of manufacture, as per LCT is a tax of 25%-33% imposed on luxury cars and is generally payable when the car is sold or imported at the retail level. The threshold figure at which the LCT applies is subject to movement by the ATO as at 1 July each year. It is currently set at $61,884. Objective ID: A10020 Page 2 of 5

This threshold will not be used by the Department when assessing SCV applications. Any vehicle meeting the ATO luxury car tax threshold can be licensed as a SCV including: station wagons, passenger sedans, people movers, 4WD vehicles or sports utility vehicles that cost an amount (GST inclusive) equal to or greater than the LCT threshold figure when new. The maximum vehicle age limit for a vehicle costing at least the amount of the LCT threshold figure when new is 8 years from the date of manufacture. There is no maximum vehicle age limit for a vehicle costing at least twice the amount of the LCT threshold figure when new MODIFIED OR STRETCHED VEHICLES (GROUP B) A modified/stretched vehicle is a vehicle that has been modified so as to lengthen the vehicle s wheelbase by at least 500mm. Stretched/modified vehicles will be issued an SCV licence, irrespective of the number of passengers they are designed to carry. There is no maximum vehicle age limit for modified/stretched vehicles. 3.2 CLASSIC / VINTAGE VEHICLES (GROUP C) A classic or vintage vehicle is any vehicle older than 25 years of age. The Luxury Car Tax Threshold does not apply to these vehicles upon assessment to become an SCV. 3.3 GREEN VEHICLES (GROUP D) Green vehicles are petrol-electric hybrids or alternative fuel passenger vehicles licensed for operations within the Perth metropolitan area. To ensure only those vehicles that represent Objective ID: A10020 Page 3 of 5

4 significant environmental benefit are licensed as SCVs, the vehicle must have an overall rating of 5-stars with respect to greenhouse gas emissions, fuel consumption and air pollution, as determined by the Federal Government s Green Vehicle Guide. The maximum age limit for vehicles licensed as an SCV in the metropolitan area, including green vehicles, is eight (8) years from the vehicle s compliance date. The Luxury Car Tax Threshold does not apply to these vehicles upon assessment to become an SCV. 3.4 NON-STANDARD VEHICLES The PSBU has received requests to licence vehicles whose configuration is non-standard, for example, vehicles with side-facing seats or left-hand drive vehicles. The Australian Design Rules (ADRs) set out national design standards for vehicle safety and emissions that all vehicles must comply with. Compliance of vehicles with respect to national standards is ascertained by the Vehicle Safety Branch (VSB). Side-facing seats The ADRs with regard to the construction and installation of additional seats is set out in the Vehicle Standards Bulletin (VSB) 5B. These guidelines do not preclude the installation of side-facing seats, however where they are installed, they must meet national standards of safety in terms of their construction and must be used in conjunction with an approved passenger restraint system. Where the VSB is satisfied that a vehicle with a non-standard configuration is safe to be licensed, and the vehicle meets the PSBU s SCV licensing criteria, the vehicle will be licensed as an SCV by PSBU. Left-hand drive vehicles In accordance with the Road Traffic (Vehicle Standards) Rules 2002 PSBU will not license any left-hand drive (LHD) vehicle less than 30 years of age to carry fare paying passengers. LHD vehicles less than 4.5 tonne and under 15 years of age generally need to be converted to RHD before they can be registered in Western Australia. LHD vehicles less than 4.5 tonne manufactured more than 15 years ago, but less than 30 years ago, may be registered in Western Australia without the need for a RHD conversion, yet such vehicles must be used for personal use only. In the event that a LHD vehicle is under 4.5 tonne, over 30 years of age, does not breech other relevant legislation, for example the Transport Co-ordination Act 1966, and has already passed the Department s Vehicle Safety Branch, Passenger Services may consider granting an SCV licence. 4. ACCESSIBILITY REQUIREMENTS FOR SMALL OMNIBUSES The document ACCESS REQUIREMENTS FOR SMALL OMNIBUSES located at details the accessibility standards that apply to all small omnibuses, including SCVs. 5 5. DRIVER LICENSING To drive an SCV an F or T extension is required on the motor driver s licence. 6. COSTS OF SERVICE MINIMUM HOURLY RATE The minimum hourly rates for SCVs are approved by the Minister for Transport. A two-tier fare structure applies. At present SCVs must charge a minimum of $60/hour for vehicles with 5 or less passenger seats and an hourly rate of $85 for the first two hours and $60 for each additional hour for vehicles with more than 5 passenger seats. A minimum hiring of one hour applies to all bookings. 7. OTHER VEHICLE INFORMATION Vehicles must pass a visual and mechanical inspection at an Authorised Inspection Centre. Modified or stretched vehicles must be taken to the Department s Technical Branch at Welshpool for initial inspection. Vehicles will be issued with SCV plates with British Racing Green characters on a white background with the wording SMALL CHARTER VEHICLE along the bottom. 8.
