1 Public Disclosure Authorized Public Disclosure Authorized Public Disclosure Authorized MINUTES OF PUBLIC CONSULTATION MEETING HELD FOR ENVIRONMENTAL ASSESSMENT PROCESS UNDER THE SECOND ACCESS TO FINANCE FOR SMALL AND MEDIUM ENTERPRISES LOAN In order to inform all the stakeholders regarding the Environmental Assessment Process for the loans to be financed under the World Bank s Second Turkey Access to Finance for Small and Medium Enterprises Loan a consultation meeting was held at the address of T.C. Ziraat Headquarters Conference Hall, Tando an, Ankara at 14:00 hours on 18 February The meeting was organized jointly by the World Bank, T.C. Ziraat, (TKB) and Türkiye Vak flar T.A.O. The invitation for the meeting was announced to the whole country through the publication of a notice in the nationally circulated edition of Hürriyet newspaper on 15 February 2010 (Annex 1). Various civil society organizations, Professional organizations and financial institutions have been invited to the meeting. The list of participants is provided in Annex 2. The opening speech of the meeting was delivered by Ms. Burcu KURGUN, Director of Commercial Marketing Department of Ziraat. Then, Mr. Carlos PINERUA, Private Sector Projects Country Coordinator from the World Bank Ankara Office delivered a speech, thanking the project partners for their contributions to the project. Thereafter, Mr. Halil Agah, Senior Rural Development Specialist from the World Bank, made a presentation with focus on the following subjects: Safeguard Policies Why do we have SP? Key roles and responsibilities E2404 V4 Practices Environmental Assessment Documents Public Disclosure Authorized Environmental Assessment Practices Actors and Roles Environmental Monitoring Categories Obligations. The highlights from the questions raised by participants during the meeting and the answers given to these questions are as follows: Will the World Bank policies or the national legislation be taken as a basis in the Environmental Assessment Procedures to be followed?

2 The World Bank legislation would be taken as a basis if there were no legal arrangements in place in the country. However, Turkey has a dynamic legislation in effect (Environmental Impact Assessment Regulation published in the Official Gazette No dated 17 July 2008). Due sensitivity should be exerted to create environmental awareness. For example, whether an SME applying with an EIA report has observed the necessary requirements, and whether it has completed the deficiencies identified in the report must be checked. What should be the methodology to be followed and the selection criteria to be applied in determining the categories of projects? The lists of or prequalification criteria will be taken into account for projects in categories 1, 2 and 3. Here, the principles laid down in the EIA Regulation and project capacities are particularly important. Furthermore, project activities included in the prohibited list of the World Bank will not be financed. The example projects and activities relating to these aspects have been defined in the selection criteria posted on the websites of all three banks. Will the definition of SME be based on the European Union standards or the standards applicable in our country? Who will evaluate the investments prepared by SMEs? Will only the investment projects be financed? This project aims at reaching out as many SMEs as possible. It is considered that the definition be formulated primarily on the basis of the standards applicable in our country. Not only investment projects, but also working capital needs will be financed. However, the first two projects will be subject to the World Bank s no objection in any case. Furthermore, the World Bank will review the other projects as well, as part of its supervision activities. Will any regional priority be observed while disbursing the loan proceeds? The Undersecretariat of Treasury has certain requests in this respect. In this direction, there may be certain criteria in favor of regions with priority in development.

Due sensitivity should be exerted to create environmental awareness.

3 Will the sub-unions engaged in agricultural activities be eligible for this finance? There are certain conditions for eligibility for the loan, which primarily include the requirement of the borrower to be a legal entity (company) that fits the definition of SME. Furthermore, such a company must be more 50% privately owned. If they satisfy these conditions, there is no obstacle before eligibility. Will the EIA procedures of our country or the World Bank s EIA procedures be taken as a basis in the preliminary review for loans? The procedures of the Ministry of Environment and Forestry of Turkey will be taken into account. Will any sectoral priorities be observed during the project implementation? There is no sectoral priority, but there will be sectors which we will support. Have the maturities and interest rates of loans to be disbursed under this Project been established? Project appraisal is underway and has not yet been concluded, all stakeholders will be informed shortly after conclusion.

Furthermore, such a company must be more 50% privately owned. If they satisfy these conditions, there is no obstacle before eligibility.
