1 N.R.S. 218H.060. Gift Defined. Nevada Gift Law 1. Gift means a payment, subscription, advance, forbearance, rendering or deposit of money, services or anything of value unless consideration of equal or greater value is received. 2. Gift does not include: (a) A political contribution of money or services related to a political campaign; (b) A commercially reasonable loan made in the ordinary course of business; (c) The cost of entertainment, including the cost of food or beverages; or (d) Anything of value received from: (1) A member of the recipient s immediate family; or (2) A relative of the recipient or relative of the recipient s spouse within the third degree of consanguinity or from the spouse of any such relative. N.R.S. 218H Unlawful acts involving lobbyists and lobbying. 2. A lobbyist shall not give to a member of the Legislative Branch or a member of his or her staff or immediate family gifts that exceed $100 in value in the aggregate in any calendar year N.R.S. 281A Public officer defined. 1. Public officer means a person elected or appointed to a position which: (a) Is established by the Constitution of the State of Nevada, a statute of this State or a charter or ordinance of any county, city or other political subdivision; and (b) Involves the exercise of a public power, trust or duty. As used in this section, the exercise of a public power, trust or duty means: (1) Actions taken in an official capacity which involve a substantial and material exercise of administrative discretion in the formulation of public policy; (2) The expenditure of public money; and (3) The administration of laws and rules of the State or any county, city or other political subdivision. 2. Public officer does not include: (a) Any justice, judge or other officer of the court system; (b) Any member of a board, commission or other body whose function is advisory; (c) Any member of a special district whose official duties do not include the formulation of a budget for the district or the authorization of the expenditure of the district s money; or (d) A county health officer appointed pursuant to NRS Public office does not include an office held by: V 1.2

2 (a) Any justice, judge or other officer of the court system; (b) Any member of a board, commission or other body whose function is advisory; (c) Any member of a special district whose official duties do not include the formulation of a budget for the district or the authorization of the expenditure of the district s money; or (d) A county health officer appointed pursuant to NRS N.R.S. 281A General requirements; exceptions. A code of ethical standards is hereby established to govern the conduct of public officers and employees: 1. A public officer or employee shall not seek or accept any gift, service, favor, employment, engagement, emolument or economic opportunity which would tend improperly to influence a reasonable person in the public officer s or employee s position to depart from the faithful and impartial discharge of the public officer s or employee s public duties. Regulation on Lobbying 6. Monthly expenditure reports must be filed by all lobbyists whether expenditures have been made or not. Expenditures must always be identified by legislator, organization, event or person and categorized in the following manner: A. "Entertainment," which must include the expenditures for any intangible item such as a fee for a membership in a club, the price of admission to a theatrical performance or the cost of food or beverage. Entertainment includes the price paid for admission to a sporting event or other form of entertainment. C. "Gifts and loans." These include money or service on anything of value provided to a legislator, organization, or any other person for benefit of a legislator or organization. "Gift" includes expenditures for any tangible item such as books, hardware, software for computers, plaques or flowers. "Gift" does not include a ticket for admission to a sporting event or other form of entertainment. V 1.2

3 Executive Order ESTABLISHING ETHICS REQUIREMENTS FOR CERTAIN PUBLIC OFFICERS AND EMPLOYEES WHEREAS, the people of the state of Nevada entrust its public officers and employees with the pursuit of the common good; WHEREAS, the pursuit of the common good requires a commitment to the interests of the public at large, not the interests of a few; WHEREAS, high ethical standards are essential in maintaining the integrity of public officers and employees commitment to the public; WHEREAS, public confidence in government is strengthened by ethical standards that assure decisions are made with the interests of the public at large in mind; and WHEREAS, Article 5, Section 1 of the Nevada Constitution provides that, The Supreme Executive Power of this State shall be vested in a Chief Magistrate who shall be Governor of the State of Nevada; NOW, THEREFORE, by the authority vested in me as Governor by the Constitution and laws of the State of Nevada, it is hereby ordered as follows: 1. Subject to the exceptions set forth below, a public officer or employee covered by this order is prohibited from accepting a gift or other compensation, either directly or indirectly, that might be intended to influence or reward the individual in the performance of official business. 2. For purposes of this order and subject to the exceptions set forth below, the term gift includes any gratuity, favor, discount, entertainment, hospitality, loan, forbearance, or other item having monetary value. It includes services as well as gifts of training, transportation, local travel, lodgings and meals, whether provided in-kind, by purchase of a ticket, payment in advance, or reimbursement after the expense has been incurred. 3. The term "gift" does not include: a. campaign contributions received in accordance with State and Federal law; b. food or refreshments of limited value served other than as part of a meal;

4 c. an item presented on behalf of another state or foreign government that becomes the property of the State; d. opportunities, discounts, rewards and prizes open to the general public or all employees and officers of the State of Nevada; e. plaques or mementos recognizing service; f. trinkets or mementos of nominal value; g. gifts from family members, extended family members, or other employees of the State of Nevada; h. gifts from personal friends where it is clear that the gift is motivated by personal friendship and not by the employee or officer s position with the State. i. small efforts of common courtesy or other services of nominal monetary value; j. attendance or participation at events sponsored by other governmental entities; k. attendance or participation at widely attended events that are related to governmental duties; l. travel within the state of Nevada to and from widely attended events related to governmental duties where acceptance of such travel would result in financial savings to the State of Nevada; m. meals, lodgings, transportation and other benefits resulting from the business or employment activities of an employee or officer s spouse when it is clear that such benefits have not been offered or enhanced because of the employee or officer s official position; n. benefits customarily provided by a prospective employer in connection with bona fide employment discussions; and o. anything for which market value is paid. 4. Persons subject to this order include myself, my Senior Staff, my Cabinet and all Division Heads of Cabinet agencies. 5. In addition to the prohibition on gifts, my Cabinet and their Division Heads shall ensure that those who do business with the State of Nevada and those who receive grant funds from the State of Nevada are notified of the terms of Nevada s ethics requirements, including, but not limited to, NRS 281A and this order, upon their initial contact with the State or as soon as practicable thereafter.

5 6. Nothing in this order limits the application of NRS 281A or any other provision of State or Federal law. Failure to comply with this Executive Order will result in appropriate discipline. 7. This order shall expire on my last day as Governor of the State of Nevada.
