2 December 11, 2014 To: From: Subject: Transit Committee Darrell Johnson, Chief Executive Officer Agreement for the Heating, Ventilating, and Air Conditioning Unit Replacement at the Garden Grove Bus Base Operations Overview The Board of Directors approved replacing the heating, ventilating, and air conditioning unit at the Garden Grove Bus Base operations building as part of the Orange County Transportation Authority s Fiscal Year Budget. Bids were received in accordance with the Orange County Transportation Authority s public works procurement procedures. Board of Directors approval is requested to execute the agreement Recommendations A. Find Stanton Utilities, Inc., the apparent low bidder, as non-responsive due to the failure to meet the federal requirement for Disadvantaged Business Enterprise participation. B. Authorize the Chief Executive Officer to negotiate and execute Agreement No. C between the Orange County Transportation Authority and Interlog Construction, the lowest responsive, responsible bidder, in the amount of $477,000, for the heating, ventilating, and air conditioning unit replacement at the Garden Grove Bus Base operations building. Discussion The Orange County Transportation Authority (OCTA) completed construction of the Garden Grove Bus Base in The heating, ventilating, and air conditioning (HVAC) unit installed during the construction of the bus base was replaced in The existing HVAC unit requires frequent repairs and is beyond its useful life. The project consists of replacing the existing HVAC unit with a new 50-ton roof top unit, including a new boiler and circulating pumps, new variable air volume control boxes, thermostats, and air supply duct system Orange County Transportation Authority 550 South Main Street / P.O. 3 Page 2 modifications in the operations building. The new HVAC system will increase energy efficiency and provide an improved working environment for coach operators and operations building staff. Procurement Approach This procurement was handled in accordance with OCTA s Board of Directors-approved procedures for public works projects. These procedures, which conform to both state and federal requirements, require that contracts are awarded to the lowest responsive, responsible bidder after a sealed bidding process. Invitation for Bids (IFB) was released on September 24, 2014, through OCTA s CAMM NET system. The project was advertised on September 24 and October 1, 2014, in a newspaper of general circulation. A pre-bid conference and job walk was held on October 1, 2014, and was attended by 14 firms. Three addenda were issued to make available the pre-bid conference registration sheets and handle administrative issues related to the IFB. On October 27, 2014, eight bids were received and publicly opened. All bids were reviewed by staff from OCTA s Contracts Administration and Materials Management and Facilities Engineering departments to ensure compliance with the contract terms and conditions, and technical specifications. Los Angeles, California $616,000 $620,000 $626,000 The apparent low bidder, Stanton, was found non-responsive due to the inability to secure the required Disadvantaged Business Enterprise (DBE) participation or demonstrate sufficient good faith efforts as required by the United States Department of Transportation regulations, which is providing funding for this project. Interlog, the next lowest bidder, met the DBE participation goal. The engineer s estimate for this project was $485,000. The recommended firm s bid is 1.6 percent below the engineer s estimate and is considered by staff to be fair and reasonable. State law requires award to the lowest responsive, responsible bidder. As such, staff recommends award to Interlog, the lowest responsive, responsible bidder, in the amount of $477,000. Fiscal Impact The project was approved in OCTA s Fiscal Year Budget, Capital Programs Division, Account D , and is funded through Federal Transit Administration Section 5307 Preventative Maintenance Grant funds, Account D3122-LFK. Summary Based on the information provided, staff recommends the Board of Directors authorize the Chief Executive Officer to negotiate and execute Agreement No. C with Interlog Construction, in the amount of $477,000, for the heating, ventilating, and air conditioning unit replacement at the Garden Grove Bus Base operations building.
