School Board of Volusia County- Orange County Circuit Court CASE NO.: CIDL Opposing Counsel: Ted Doran, Esq. and Michael Kundid, Esq Judge Raul Zambrano In this case I represented a 13 year old bullied at a Volusia County middle school. The experience was significant because the litigation lasted for 3 years, with protracted discovery, numerous depositions, extensive motion practice and resulted in a 5 day jury trial - my longest jury trial to date. It was also the first time I was forced to manage the media interest and public scrutiny surrounding a trial of siginifcant community impact. In this case I represented a developer accused of breaching an oral agreement for a broker's fee. The case was significant because it represented my first time first chairing a trial for a siginificant client and with a substantial amount in controversy (greater than $100,000). Again, there were numerous discovery issues, extensive motion practice, and an important Summary Judgment ruling that framed the issues before trial. The summary judgment ruling was later appealed to the 5th DCA. AdvantaClean v. Anne Bradshaw, Osceola Co. Circuit Court CASE. :Cl Judge James Stroker Opposing Counsel: Michael Magruder, Esq. This case was siginificant because it represented my first trial after becoming a solo practitioner. There was also siginifcant post judgment practice, including attachment of personal property in satisfation of the judgment, post judgment attorney's fees, a second lawsuit brought against the principal of my corporate client, an appeal to the 5 1 h DCA, a subsequent trial (where I was also lead counsel} on the related matter. All matters were resloved in favor of my client. Bank of the Ozarks v. Kirtland, Esq., 300 N. Maitland Ave., Maitland, FL ;Michael Gay, Esq., 111 N. Orange Ave., Suite 1800, Orlando, FL 32801; David M. Landis Esq., 225 East Robinson Street, Suite 600, Orlando, Florida This case, and the related case that was eventually consolidated, represents my most significant litigation in terms of the amount In controversary to date. I represented a commercial condominium association against the master development association regarding competing claims of breach under the condo agreement, and simultaneously a multi million dollar replevin of HVAC equipment by the financing authority. The case was litigated for mutiple years with numerous lawyers and three different Orange County Circuit Business Court judges. The case included attmepts at receivership, personal claims against board members and a bankruptcy filing prior to settlement. I was able to avoid receivership for my client, and assist with the negotiation of a global settlement for all parties. Medallion Convenience Stores, Inc. v. Wilson Capital Group, Inc. - Orange County Circuit Court CASE NO.: 09-CA Judge Fred Lauten Opposing Counsel: Claude R. Walker, Esq., P.O. Box 12500, Tallahassee, Florida This case, and a related case (together, representing millins of dollars in controversy) filed and litigated simultaneously in the rthern District of New York (requiring my pro hac vice admission) was significant in that it required the vacation of a default in the Orange County Court, and significant discovery and motion practice through summary judgment in New York for a former brokerage firm and its principals accused of various fraud-related torts regarding certain investment transactions. I believe my work as a career litigator - for Plaintiffs and Defedants and at the trial and appellate level - and as a quasi judicial officer give me a unique perspective both of what a judge demands. and what is demanded of a judge. It is the embodiment of leading by serving; providing the example of expected conduct, preparation and performance. Candidly, I also believe that the fact that I am African American could serve to bolster the confidence of many in our community who question the fairness of the judicial system - not because of unpopular decisions, but simply becaue of the lack of judicial officers who look like them. 52. If you have previously submitted a questionnaire or application to this or any other judicial nominating commission, please give the name of the commission and the approximate date of submission. N/A 53. Give any other information you feel would be helpful to the Commission in evaluating your application. The first attorney I ever met - the attorney that inspired me to go to law school - was a Volusia County county court judge. Ever since then, the idea of becoming a judge has stayed with me. I believe I've finally worked hard enough to gain the requisite legal knowledge and experince to merit consideration for such a high honor and calling. I look forward to serving not only for the professional satisfaction it would give me, but so that I too may provide some inspiration to kids like me - who never knew or met a lwayer - that they too can be what they see.
