1 SECTION I: GENERAL INFORMATION POSITION DESCRIPTION MOWER COUNTY Position Title: Grade: Lead Criminal County Attorney 14 Immediate Supervisor s Position Title: County Attorney CLASS SUMMARY: Department: County Attorney FLSA Status: Eempt Incumbents are responsible to perform the duties of a senior member of the department. Some of which includes, preparing and presenting the most comple and difficult criminal cases on behalf of the county. Also assists County Attorney in preparing and presenting civil and criminal cases and for providing legal advice to other County departments. Duties include: making court appearances; determining whether to bring criminal charges; reviewing reports from County facilities and departments; conducting interviews and preparing witnesses; performing legal research; assisting in development and implementation of training; and, acting on behalf of other attorneys in their absence. DISTINGUISHING CHARACTERISTICS: The Lead County Attorney is the second of a three level County Attorney series and is distinguished from the Assistant County Attorney by having responsibilities to provide training and supervision of criminal cases being handled by the Assistant County Attorneys and support staff of the County Attorney s office. The Lead County Attorney is assigned the most comple cases that can end in serious litigation. This position varies from the Assistant level in that it is the primary for cases that go to the MN Supreme Court and the Court of Appeals. These are cases that require decision making of the highest level in the office of the County Attorney. The Senior County Attorney varies from the Lead County Attorney in that it has responsibility for providing managerial assistance to the County Attorney and acts as the County Attorney as needed. SECTION II: ESSENTIAL DUTIES AND RESPONSIBILITIES: Represents the County in comple legal matters. Gives advice and direction to junior staff members. Evaluates criminal and civil cases and approves charges and dispositions within professional standards Investigates and prepares for trials and tries criminal and civil cases in superior and lower courts. Prepares and presents at pretrial and trial, criminal and other matters Presents matters to Grand Juries Page 1

2 for Reviews legislation, case law, and related documents and assists in developing appropriate policies and procedures Performs comple legal research and prepares legal briefs and opinions, reviews contracts and related agreements legality. Advises law enforcement officers on investigation of criminal cases Prepares cases for judicial and administrative proceedings by investigating facts; researching law; drafting subpoenas, search warrants and pleadings; interviewing victims, witnesses, and law enforcement officers; analyzing the opposition s case, and writing legal memoranda and briefs. Acts on behalf of other attorneys in their absence Performs other duties of a similar nature or level SECTION III: WORK REQUIREMENTS AND CHARACTERISTICS RESPONSIBILITY FOR DIRECT SUPERVISION OF THE FOLLOWING POSITIONS Titles of Positions Directly Supervised # of Employees TOTAL INDIRECT SUPERVISION: Number of employees indirectly supervised: Total: HAZARDOUS WORKING CONDITIONS: The essential duties of the work are performed under various physical hazards or environmental conditions noted. There are minimal hazards and risks associated with the performance of this classification. May require occasional travel to off-site locations and minimal attendance at morning or evening meetings. 3 EDUCATION/KNOWLEDGE REQUIREMENT: Minimum education required to perform adequately in position could reasonably be attained only by completing the following: REQUIRED EDUCATION/TRAINING (choose one) less than high school diploma High school diploma or GED. 1 year college 2 years college DEGREE INFORMATION: Type of degree: (B.S., M.A., etc.) Must have valid license to practice law in the state of Minnesota Major field of study or degree emphasis: Juris doctorate or doctorate in law 3 years college X 4 years college Skills (position requirements at entry): 1st year graduate level Skilled in: 2nd year graduate level Skilled in the knowledge of the duties, powers, limitations and authority of the County Attorney & County Government Skillful at presenting and conducting comple trials effectively Able to represent the Office of the Mower County Attorney at public and private functions and convey a positive image of law enforcement and the prosecutor Able to appraise, interpret and apply legal principles and precedents to difficult legal issues Able to present statements of fact, law and argument clearly and logically in written and verbal form General knowledge of civil law and procedures and negotiation and litigation techniques Very mature judgment and discretion consistent with decision making authority that has significant impact on the lives of persons accused of or victimized by crimes Able to manage time and workload effectively Knowledge of the Minnesota and United States Constitutions Skillful in directing the work of other professional and nonprofessional staff members Required Work Eperience in Addition to Formal Education/Training: Minimum of Juris Doctorate or doctorate in law and at least 5 years full-time eperience with criminal/civil eperience in a County Attorney s office. OR 5 years of full time eperience as a prosecutor in criminal/civil/military cases. Has been admitted or can be certified within 6 months to present before Minnesota Supreme Court or Federal Court. LICENSE/ CERTIFICATION Identify licenses/certification required: Must have valid license to practice law in the state of Minnesota. Requires a valid driver s license in the State of MN. Page 3
