MOTION: That the Board accept the Financial Statements for the Years Ended June 30, 2011 and 2010 as presented by Boyce Furr and Company, LLP. Committee Recommendation/Passed Amelia Ross, MSN, RN, CCNS, Clinical Nurse Specialist, Pulmonary/Critical Care with Cone Health in Greensboro requesting the Board adopt the recommendations of the APRN Advisory Committee. Finance Committee Received and reviewed proposed changes to Fiscal Policies. (Attachment F) MOTION: That the Board approve proposed changes to fiscal policies F2 Risk Management, F3 Financial Review, F6 Investments, F7 Annual Audit, F9 Budgeting and F10 Cash Management. Education & Practice Received update regarding Education and Practice Committee Summary of Activities Received and reviewed proposed changes to policies EP16 Failure to Submit Nursing Education Program Annual Report and EP21 NCLEX Pass Rate Below Standard. Further, proposed approval of new policy entitled Progressive Disciplinary Action for Nursing Education Program Non-Compliance with Law and Rules (Attachment G). MOTION: That the Board approve proposed changes to policies EP16 Failure to Submit Nursing Education Program Annual Report and EP21 NCLEX Pass Rate Below Standard and approve new policy entitled Progressive Disciplinary Action for Nursing Education Program Non- Compliance with Law and Rules. Committee Recommendation/Passed. Board Governance Received and reviewed proposed Implementation of 360 feedback for Board Members. MOTION: That the Board approve implementation of a 360 feedback tool for Board members effective January Further, direct staff to draft a 360 evaluation for approval by the Board Governance Committee at its December meeting and report back to the full Board in January Committee Recommendation/Passed. 3 of 80

MOTION: That the Board approve the recommendation to dissolve the Nominating Committee effective October 1, Further, that the Manager of the Executive Office assume responsibilities related to receiving nominations and preparing Slate of Candidates for officers to be presented by a Board member designated by the Executive Director. Received and reviewed 2011 Board Assessment Action Plan (Attachment H) Received and reviewed 2011 Focus Group Action Plan (Attachment I) Executive Director Received updates as follows: Activities with NCSBN. Recognized members and staff serving on NCSBN Committees as follows: Dan Hudgins - Finance Peggy Walters Education Linda Burhans Institute for Regulatory Excellence Brenda McDougal Leadership Succession Eileen Kugler NCLEX Activities regarding NC Future of Nursing Initiatives in collaboration with NC Nurses Association and Foundation for Nursing Excellence Reported regarding review of all Rules for each occupational and regulatory body in NC. Provided update on progress of initiative to upgrade and re-design licensure system. Projected goal for completion: end of calendar year 2012 Collaborating with legal counsel and staff for quality improvements regarding the process for Administrative Hearings. Received and reviewed 2011 Strategic Plan Roadmap. Highlighted several of the activities under the Strategic Initiatives Provided update on response from Board to the First Church of Christ, Scientist who appeared at the May 2011 Board meeting discussing the Christian Science position that the provision of care in connection with a religious practice based on reliance on spiritual means for healing falls outside the parameters of N.C. Stat. Ann related to the use of the title nurse. Brenda McDougal, Associate Executive Director, Operations, reviewed the Board s insurance and liability coverage. 4 of 80

5 Medication Aide Advisory Committee Received and reviewed recommendation for reappointment of Chair of the Medication Aide Advisory Committee MOTION: That the Board approve the reappointment of Lisa Bare as Chair of the Advisory Committee for an additional 2 years (October 2011 through October 2013). Committee Recommendation/Passed. Members discussed training process and procedures for medication aides. Requested Medication Aide Advisory Committee engage/dialogue ways to communicate to work settings regarding the involvement of nurses related to use of medication aides. Drug Monitoring Programs Received and reviewed activities of the Drug Monitoring Program related to the CAC Action Plan Received and reviewed quarterly statistics showing trends for the Alternative Program Executive Session MOTION: 11:05 am Executive Session for discussion of legal matters. Walters/Passed Open Session MOTION: 11:35 am Open Session Morgan/Passed Results of Election of Officers APRN Advisory Committee Presbyterian School of Nursing at Queens University of Charlotte LRP Appeal Holly Rabinovich, Chair of the Nominating Committee, announced the results of the Chair/Vice-Chair election for the year 2012 as follows: Chair: Nancy Bruton-Maree, RN Vice-Chair: Sara Griffith, RN Received and reviewed final recommendations from the APRN Advisory Committee (Attachment J). William K. Cody, RN, PhD, CNE, FAAN, Dean and Pamela Davies, PhD, President of the Presbyterian School of Nursing at Queens Univeristy of Charlotte requested to be placed on the agenda to request that the Board review the school s Consent Order and revise to removal language regarding closure of the program and provide additional time for compliance. Connie Sue Thompson, RN, appeared alone before the Board. 6 Harrell/Passed Open Session MOTION: 3:15 pm Open Session Jenkins/Passed Presbyterian School of Nursing at Queens University of Charlotte LRP Appeal Personnel Matter MOTION: That the Board direct staff to draft a letter to Presbyterian School of Nursing at Queens University of Charlotte that no action will be taken at this time. Further, the school will be reviewed in January 2012 in accordance with the process and procedures for all education programs in NC. MOTION: In the matter involving Connie Sue Thompson, the Board orders that the decision of the Licensure Review Panel be upheld. Ms. Thompson s request for retirement of her nursing license has been denied. Ms. Thompson s nursing license will be placed in an inactive status. Ms. Thompson s request for a recommendation to work as a NAI, NAII has been denied. Further, Thompson will not be approved to work as a Medication Aide. If Ms. Thompson seeks reinstatement of her nursing license, she must appear before Licensure Review Panel C. Harrell/Passed. Rabinovich/Recused. The course must be completed within three (3) months or the license will be suspended until successful completion of the course. Additionally, Overman will be issued a probationary license for 12 months. A letter of charges was mailed to the licensee certified mail, return receipt requested on April 26, 2011 following a March 25, 2011 pre-employment urine drug screen at the Cherry Point Bay Nursing and Rehabilitation Facility in Havelock, North Carolina. The specimen was collected using chain of custody specifications and was confirmed by the Medical Review Officer (MRO). The specimen was deemed positive for Benzodiazepines. The recommended decision of the Hearing Committee is as follows: Based on the foregoing Findings of Fact and Conclusions of Law, it is Recommended that Ms. Tschan be issued a probationary license for twelve (12) months. 11 of 80

18 POLICY NUMBER: F-2 AREA: Fiscal AUTHORITY: TOPIC: Risk Management ATTACHMENT F NORTH CAROLINA BOARD OF NURSING Regulatory Policy Manual PURPOSE: To establish policy for providing surety bonds to minimize the effects of losses in the performance of duties and responsibilities. To ensure that the assets of NCBON are protected and maintained and that risks that could adversely affect the Board s resources are properly managed. DATE APPROVED: September 1987 DATE REVISED: May 20, 2004 Policy Statement/Procedure: NCBON shall insure at the appropriate levels against theft and casualty losses and against liability losses to/from Board members and staff. Insurance policies will be reviewed annually to determine the adequacy of coverage and competitiveness of price. Management staff is responsible for detection and prevention of fraud, misappropriation and other irregularities. All employees and the Chairman of the Board are bonded. The cost associated with securing the aforementioned honesty bond coverage shall be that of the North Carolina Board of Nursing. The amount of insurance will be reviewed annually. 19 POLICY NUMBER: F-3 AREA: Fiscal NORTH CAROLINA BOARD OF NURSING Regulatory Policy Manual AUTHORITY: North Carolina Board of Nursing TOPIC: Financial Review PURPOSE: To establish guidelines for the review and oversight of financial reporting. DATE APPROVED: September 1987 DATE REVISED: May 20, 2004 Policy Statement/Procedure: The Finance Committee shall review the financial and investment statements at least three times per year each regularly scheduled meeting. The Board shall maintain an effective accounting system as a basis for fiscal control. These shall to include comparisons of actual and budget amounts with explanations of variances and actual and budget amounts for the same period in the prior fiscal year. A negative variance of actual revenue/expenditure to budget, which is greater than or equal to 15%, shall require written explanation. The explanation shall include reason for the year-to-date variance and a projection of financial status at the end of the fiscal period year. Any Positive variances of actual revenue/expenditure to budget shall be reviewed on an ongoing basis for future budgetary projections. The Board shall annually review the adequacy of operating reserves as they relate to current and long range spending projections. 19 of 80

To establish investment guidelines that provide for prudent management of invested cash. DATE APPROVED: DATE REVISED: May 20, 2004 Policy Statement/Procedure: The primary objectives of the investment program of the North Carolina Board of Nursing is to earn interest on non-operating funds with safety and liquidity being the most important standards of the program shall be safety, liquidity and yield on invested cash, in that order. Investments shall be managed to ensure preservation of capital and to minimize interest rate risk and credit risk. It shall be a practice of the Board to keep all non-operating monies invested at the highest interest rate consistent with the maintenance of financial integrity and security. The Board will minimize credit risk, which is the risk of loss due to the failure of the security issuer, by limiting investments to the types of securities listed below and diversifying the investment portfolio so that the impact of potential losses from any one type of security will be minimized. The Board will minimize interest rate risk, which is the risk that the market value of securities in the portfolio will fall due to changes in market interest rates, by structuring the investment portfolio so that securities mature using a laddered approach thus avoiding the need to sell securities prior to maturity. An exception may be made if a security is sold early to minimize loss of principal. The following investment types are permitted in accordance with N.C.G.S : 1. Obligations of the United States or obligations fully guaranteed both as to principle and interest by the United States. 2. Obligations of the Federal Financing Bank, the Federal Farm Credit Bank, the Federal Home Loan Banks, the Federal Home Loan Mortgage Corporation, Fannie Mae, Government National Mortgage Association, The Federal Housing Administration, the Farmers Home Administration. 3.
