2 THE GAMING AND POOL BETTING (CONTROL AND TAXATION) ACT. Statutory Instrument The Gaming and Pool Betting (Control and Taxation) Regulations. (Under sections 4 and 11 of the Act.) 1. Citation. These Regulations may be cited as the Gaming and Pool Betting (Control and Taxation) Regulations. 2. Application for licence. Every application for a promoters licence, principal agents licence or agents licence shall be (a) made in duplicate to the Secretary to the Treasury in the form prescribed in the First Schedule of these Regulations; (b) accompanied by the prescribed annual fee; and (c) made not less than one month prior to the date on which the licence is to commence; except that the Secretary to the Treasury may, in his or her discretion, approve an application made less than one month prior to the date on which the licence is to commence. 3. Form of licence. The Treasury shall, on being satisfied that the applicant is a fit and proper person to be licensed, issue the applicant with a promoters licence, principal agents licence or agents licence, as the case may be, in the appropriate form prescribed in the Second Schedule to these Regulations. 4. Particulars of agents. Every promoter or principal agent licensed under the Act shall notify the Secretary to the Treasury (a) within two weeks of the date of commencement of the licence, of the full names, postal addresses and physical addresses of the agents authorised to represent him or her during that year; and

3 (b) within two weeks of the date of appointment of a new agent, or the termination of appointment or change of address of an existing agent, of the full name, postal address, physical address and date of appointment of the new agent, or the date of termination of appointment, change of address and the new address of an existing agent, as the case may be. 5. Records. The Secretary to the Treasury shall maintain records of every promoter, principal agent and agent licensed under these Regulations. 6. Bookkeeping and accounts. Every promoter, principal agent and agent shall maintain to the satisfaction of the Secretary to the Treasury a system of bookkeeping and accounts so as to afford a proper record of the total amount of bets staked on any gaming and pool and the total amounts received from different territories. 7. Returns. (1) Every promoter and principal agent shall, not later than the Wednesday following the weekly closure of gaming and a pool or such later day in the same week as the Secretary to the Treasury might specify, submit to the Secretary to the Treasury a return in triplicate in the form prescribed in the Third Schedule to these Regulations, duly certified by the promoter or principal agent. (2) Every promoter and principal agent shall, not later than the seventh day of every month, submit to the Secretary to the Treasury a return in the form prescribed in the Fourth Schedule to these Regulations. (3) A return shall be submitted under subregulation (1) of this regulation notwithstanding that no bets have been placed with the gaming and pool. 8. Payment of gaming and pools bets tax. Every promoter and principal agent shall, not later than one week after the weekly closure of gaming and a pool, forward to the Secretary to the Treasury the tax payable on bets placed with that gaming and pool.

4 9. Audit. (1) The Secretary to the Treasury may appoint such person or persons as he or she may think fit to inspect and audit records kept by promoters, principal agents and agents under regulation 5 of these Regulations. (2) Every promoter, principal agent and agent shall at all reasonable times make available to any person or persons appointed under subregulation (1) of this regulation all records kept by him or her under these Regulations.
