Ingingo ya 2: Uburenganzira bw uregwa Ingingo ya 13 y'itegeko Ngenga n 11/2007 ryo ku wa 16/03/2007 rigena kwimurira muri Repubulika y u Rwanda Imanza zivuye mu Rukiko Mpanabyaha Mpuzamahanga rwashyiriweho u Rwanda n'izivuye mu bindi Bihugu ihinduwe kandi Rwanda, and particularly the requirements to transfer cases from the ICTR to national jurisdictions, including Rwanda; ADOPTS: Article One : The competent Court Article 2 of Organic Law n 11/2007 of 16/03/2007 concerning transfer of cases to the Republic of Rwanda from the International Criminal Tribunal for Rwanda and other States is hereby amended and complemented as follows: «Notwithstanding any other law to the contrary, the High Court shall be the competent court to conduct on the first instance the trial of cases transferred to Rwanda as provided by this Organic Law. At the first instance, the case shall be tried by a single Judge. However, the President of the Court may at his/her absolute discretion designate a quorum of three (3) or more judges assisted by a Court Registrar depending on his/her assessment of the complexity and importance of the case». Article 2: Guarantee of rights of an accused person Article 13 of Organic Law n 11/2007 of 16/03/2007 concerning transfer of cases to the Republic of Rwanda from International Criminal Tribunal for Rwanda and other States is hereby amended and complemented as follows: Rwanda et plus particulièrement les conditions requises pour le transfert de certaines affaires aux juridictions nationales, y compris celles du Rwanda; ADOPTE: Article premier : Juridiction compétente Article 2 de la Loi Organique n 11/2007 du 16/03/2007 relative au renvoi d affaires à la République du Rwanda par le Tribunal Pénal International pour le Rwanda et par d autres Etats est modifié et complété comme suit: «Nonobstant toutes dispositions légales contraires, la Haute Cour est compétente pour connaître en premier ressort des affaires transférées au Rwanda en vertu de la présente Loi Organique. La Cour statue en premier ressort à juge unique Toutefois, le Président de la Cour peut, de sa propre initiative, désigner un siège de trois (3) juges ou plus assistés par un greffier, selon son appréciation quant à l importance et la complexité de l affaire». Article 2: Droits de l accusé Article 13 de la Loi Organique n 11/2007 du 16/03/2007 relative au renvoi d affaires à la République du Rwanda par le Tribunal Pénal International pour le Rwanda et par d autres Etats est modifié et complété comme suit: 6

Igihe nta bushobozi afite bwo kumuhemba ahabwa umwunganira; 7 kwifata no kudahatirwa kuvuga ikintu cyamushinja. «Without prejudice to other rights guaranteed under the laws of Rwanda, including the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date or Laws relating to the Code of Criminal Procedure of Rwanda and the International Covenant on Civil and Political Rights, as ratified by the Decree Law n 08/75 of February 12,1975, the accused person in the case transferred by ICTR to Rwanda shall be guaranteed the following rights: 1 a fair and public hearing; 2 presumption of innocent until proved guilty; 3 to be informed promptly and in detail in a language which he/she understands, of the nature and the cause of the charge against him; 4 adequate time and facilities to prepare his/her defense; 5 a speedy trial without undue delay; 6 entitlement to counsel of his/her choice in any examination. In case he/she has no means to pay, he/she shall be entitled to legal representation; 7 the right to remain silent and not to be compelled to incriminate him/herself. «Sans préjudice Sous réserve d autres droits reconnus par la législation rwandaise, y compris la Constitution de la République du Rwanda du 4 juin 2003 telle que révisée à ce jour, ou le Code de procédure pénale du Rwanda et le Pacte international relatif aux droits civils et politiques tel que ratifié par le Décret-loi n 08/75 du 12 février 1975, les droits qui suivent sont garantis à l accusé dans le cadre des affaires déférées au Rwanda par le TPIR : 1 il a droit à ce que sa cause soit entendue équitablement et publiquement; 2 il est présumé innocent jusqu à ce que sa culpabilité ait été établie; 3 il est informé dans le plus court délai, dans une langue qu il comprend et de façon détaillée, de la nature et des motifs de l accusation portée contre lui; 4 il dispose du temps et des facilités nécessaires à la préparation de sa défense; 5 il est jugé sans retard injustifié; 6 il a droit à bénéficier, pour toute son interrogation de l assistance d un défenseur de son choix. S il est indigent à se voir attribuer sans frais d un défenseur indépendant ; 7 il a droit de garder le silence et de ne pas être contraint à s incriminer; 7

Ingingo ya 3: Ubuhamya bw' abatangabuhamya bukorewe hanze y Igihugu Itegeko Ngenga n 11/2007 ryo ku wa 16/03/2007 rigena kwimurira muri Repubulika y u Rwanda Imanza zivuye mu Rukiko Mpanabyaha Mpuzamahanga rwashyiriweho u Rwanda n'izivuye mu bindi Bihugu ryongewemo ingingo ya 14 bis ku buryo bukurikira: «Bitabangamiye ibivugwa mu ngingo ya 14, iyo umutangabuhamya ku mpamvu zumvikana adashoboye ku giti cye gutanga ubuhamya mu Rukiko Rukuru, umucamanza abisabwe n uwo ariwe wese ashobora gutegeka ko ubuhamya bw uwo mutangabuhamya butangwa mu buryo bukurikira: 1 gushyikiriza ubwo buhamya mu Rwanda cyangwa mu mahanga bikorwa n uwabiherewe ububasha n umucamanza; 2 bikoreshejwe ikoranabuhanga ry amajwi 8 the right to be tried in his/her presence; 9 to examine, or have a person to examine on his/her behalf the witnesses against him/her; 10 to obtain the attendance and examination of witnesses on his/her behalf under the same conditions as witnesses against him/her; Without prejudice to the relevant laws on contempt of court and perjury, no person shall be criminally liable for anything said or done in the course of a trial». Article 3: Testimony of a witness residing abroad Article 14 of Organic Law n 11/2007 of 16/03/2007 concerning transfer of cases to the Republic of Rwanda from the International Criminal Tribunal for Rwanda and other States is hereby complemented by inserting Article 14 bis as follows: «Without prejudice to the generality of Article 14, where a witness is unable or for good reason, unwilling to physically appear before the High Court to give testimony, the judge may upon request of a party order that the testimony of such witness be taken in the following manner; 1 By deposition in Rwanda or in a foreign jurisdiction, taken by a Presiding Officer, Magistrate or other judicial officer appointed/commissioned by the Judge for that purpose; 2 by video-link hearing taken by the judge at trial; 8 il a le droit d être présent au procès; 9 il a droit d interroger ou de faire interroger les témoins à charge; 10 il a droit d obtenir la comparution et l interrogatoire des témoins à décharge dans les mêmes conditions que les témoins à charge; Sans préjudice des dispositions relatives au faux témoignage devant les cours et tribunaux, personne ne peut être poursuivi pour des révélations et témoignages rendus au cours d un procès». Article 3 : Témoignage du témoin résident à l étranger Article 14 de la Loi Organique n 11/2007 du 16/03/2007 relative au renvoi d affaires à la République du Rwanda par le Tribunal Pénal International pour le Rwanda et par d autres Etats est complété en y insérant un article 14 bis comme suit: «Sans préjudice aux dispositions prévues à l article 14, lorsqu un témoin est incapable ou pour de motifs raisonnables de déposer en personne son témoignage devant la Haute Cour, le juge peut sur requête de toute partie intéressée ordonner que le témoignage soit rendu de la manière suivante : 1 déposition du témoignage au Rwanda ou à l étranger par une autorité compétente nommée par le juge ; 2 audition par le biais de vidéo enregistrée par le 8

Ingingo ya 4: Itegurwa n isuzumwa ry iri tegeko ngenga Iri tegeko ngenga ryateguwe mu rurimi rw icyongereza, risuzumwa kandi ritorwa mu rurimi rw ikinyarwanda. Ingingo ya 5: Ivanwaho ry ingingo zinyuranyije n iri tegeko ngenga Ingingo zose z amategeko abanziriza iri tegeko ngenga kandi zinyuranyije na ryo, zivanyweho. 3 by a judge sitting in a foreign jurisdiction for the purpose of recording such viva voce testimony. The request for the taking of testimony in any of the modes described above shall indicate the names and whereabouts of the witness whose testimony is sought, a statement of the matters on which the witness is to be examined, and of the circumstances justifying the taking of testimony in such manner. The order granting the taking of testimony of a witness in any of the modes prescribed above shall designate the date, time and the place at which such testimony is to be taken, requiring the parties to be present to examine and cross-examine the witness. Testimony taken under this Article shall be transcribed and form part of the trial record and shall carry the same weight as viva voce testimony heard at trial». Ingingo ya 4: Drafting and consideration of this Organic Law This Organic Law was drafted in English, considered and adopted in Kinyarwanda. Article 5: Repealing of inconsistent provisions All prior legal provisions contrary to this Organic Law are hereby repealed. juge au procès ; 3 par un juge de l étranger en vue de l enregistrement du témoignage oralement. 23 Isubiye ku itegeko ryo kuwa 27 Nyakanga 1934 ryerekeye igihombo mu bucuruzi; YEMEJE: UMUTWE WA MBERE: INGINGO RUSANGE Ingingo ya mbere : Icyo itegeko rigenga Iri tegeko rigenga uburyo bwose bwakoreshwa mu izahura ry ubucuruzi no kurangiza ibibazo biturutse ku gihombo, byaba bireba umucuruzi cyangwa isosiyete y ubucuruzi. Ingingo ya 2: Ibisobanuro by amagambo Muri iri tegeko amagambo akurikira asobanura: 1 «uberewemo umwenda»: umuntu gatozi cyangwa ikigo gifite ubuzima gatozi bifite uburenganzira bwo kwishyuza ugomba kwishyura, bwabayeho mbere cyangwa ku munsi w itangira ry ikurikirana ryerekeye igihombo; 2 «komite y ababerewemo imyenda»: urwego ruhagarariye ababerewemo imyenda rushyirwaho n urukiko cyangwa n inama y ababerewemo imyenda; 3 «umutungo uvamo ubwishyu»: ibintu bifitwe n ugomba kwishyura bikaba birebwa n uburyo bw ikurikirana ryerekeye igihombo; 4 «uburyo bw ikurikirana bwerekeye igihombo»: uburyo rusange bw ikurikirana Having reviewed the Decree of 27 July 1934 relating to commercial insolvency; ADOPTS: CHAPTER ONE: GENERAL PROVISIONS Article one: Purpose of this Law This Law governs all commercial recovery proceedings and the settling of issues arising from insolvency whether related to a trader or a company. Article 2: Definitions In this Law the following terms shall mean the following: 1 creditor : a natural or legal person that has the right to claim his/ her debt against a debtor that arose before or on the date of commencement of the insolvency proceedings; 2 creditors committee : a body representing a class of creditors established by a Court or by a General Assembly of creditors; 3 insolvent estates : assets of the debtor that are subject to the insolvency proceedings; 4 insolvency proceedings : collective proceedings, subject to Court supervision, either Revu le Décret du 27 juillet 1934 relatif aux faillites ; ADOPTE : CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier : Objet de la loi La présente loi régit toutes les procédures de redressement commercial et de règlement des problèmes liés à l insolvabilité, qu elles impliquent un commerçant ou une société commerciale. Article 2: Définitions Au sens de la présente loi, les termes suivants ont les significations suivantes : 1 créancier : toute personne physique ou morale disposant d une créance à l encontre du débiteur, dès lors que ladite créance est née avant ou au jour du commencement de la procédure d insolvabilité; 2 comité des créanciers : organe représentatif des créanciers désigné par la juridiction ou par l Assemblée Générale des créanciers; 3 masse de l insolvabilité : biens appartenant au débiteur qui sont soumis à la procédure d insolvabilité; 4 procédure d insolvabilité : procédure collective, soumise à la supervision judiciaire en 23

Ingingo ya 3: Ibikorwa bya ngombwa iri tegeko rigamije Iri tegeko rigamije ibikorwa by ingenzi bikurikira: 1 kwita no gushimangira ingamba n uburyo rusange bwihuse bwo gukemura ibibazo bitewe n ubushobozi buke bwo kwishyura n igihombo; for reorganisation or liquidation subsequent to dissolution if possible; 5 temporary administrator : a person appointed by a Court during urgent decisions in order to administer the assets of the debtor or of creditors; 6 administrator : a natural person appointed during insolvency proceedings in order to administer reorganisation or liquidation of the insolvent estates. 7 secured claim : a claim assisted by a security interest taken as a guarantee for a debt enforceable in case of the debtor s default; 8 court : Commercial Court competent to conduct insolvency proceedings; 9 receiver : administrator appointed by a court in case the debtor was not dispossessed of the rights to manage his/her property. Article 3: Principal objectives of this Law The principal objectives of this Law are to: 1 promote and maintain timely collective mechanisms and procedures for dealing with problems that arise from low levels of paying the vue d une liquidation et du partage après la dissolution ou d un redressement si possible; 5 administrateur provisoire d insolvabilité : personne désignée par la juridiction par mesures conservatoires pour sauvegarder le patrimoine du débiteur ou celui des créanciers ; 6 administrateur d insolvabilité : personne physique désignée au cours de la procédure en faillite pour administrer le redressement ou la liquidation de la masse de l insolvabilité ; 7 créance garantie : créance couverte par une garantie à laquelle le créancier a droit lors de la procédure d insolvabilité; 8 juridiction : juridiction de commerce ayant compétence en matière d insolvabilité ; 9 séquestre : administrateur désigné par la juridiction lorsque le débiteur n est pas dessaisi du droit d administration de son patrimoine.
