3 Friday, August 28, LAWYER S CLAIMS BASELESS Advocate General hits out at allegations Advocate General Haroon Al Zayani affirmed that the statements attributed to a lawyer and in which he cast doubts on the integrity of the investigation of a suspect alleging the questioning was held in the absence of his lawyer clashed with the reality on the ground. Commenting on the statements published by Al Wasat newspaper earlier this week, Al Zayani said they did not at all reflect the procedures taken against the accused since his arrest and until his questioning, with the full knowledge of the Public Prosecution. The allegations were an unjustified arbitrary opinion and a biased view that lacked knowledge about the course of investigations, he said. Even if that lawyer gave himself the right to assess the integrity of investigations for one reason or another, the Public Prosecution accepts criticism of its work only if it is levelled within the courses prescribed by the law and by those with a legal capacity in the specific case. Pretensions by those who are not legally related to the case and are not knowledgeable about the reality are not taken into consideration and are not regarded, he said. The Advocate General added that the suspect mentioned in the newspaper article had been arrested with the knowledge of the General Directorate of Criminal Investigation on Aug 18, and remanded in custody for four days in accordance with the Law, until he was referred to the Public Prosecution where The assertion that the Constitution stipulates the presence of a lawyer as an absolute obligation to ensure the validity of procedures is not true - Advocate General Haroon Al Zayani he was questioned. During the detention, neither the lawyer nor anybody else took the trouble to visit the suspect to be informed about the circumstances and reasons for his arrest, nor did he or anyone else show any desire to attend the questioning session, the Advocate General said. At the same time, the defendant did not take the initiative to name his lawyer, nor did he appoint or request a lawyer to attend the questioning session on Aug 23, Al Zayani added. On August 25, the lawyer to whom the statements were attributed submitted a request to attend the questioning, and that was two days after it took place. His request to be present during the session was approved by the Advocate General who affirmed that the Public Prosecution was committed to applying the law without distinction. The law stipulates that the defendant should name his lawyer at the court or during his detention. It also allows the lawyer to do the naming on his behalf, said Advocate General.

Wide Angle Joel Indrupati That s not Cricket England regained the Ashes this week, on 24 August, after their fifth cricket test match against Australia, played at The Oval in London. By winning this five-match Ashes 2015 series, 3-2, they got the trophy back from the touring Australians. But, as I watched the news, somehow, my mind went back to the traditional over-a-century-old England-Australia cricket rivalry. It had, actually, given rise to the very term Ashes since 1882, when an English newspaper had written a mock obituary stating that English cricket had died, and that the body will be cremated and the ashes taken to Australia! My mind particularly went back to England s role in Ashes series. A series about which I had read much, and I had watched much. And I now thought it might worth a revisit by us. Almost a century has passed since that controversial tour of Australia by English cricketers, but the series, which had caused a huge diplomatic upheaval, will always be remembered for the revisions of the laws of Cricket it had soon evoked. I remember watching Bodyline, a wonderfully-made BBC mini-series on television that showed the controversy surrounding the strategy of England s Captain Douglas Jardine of having his bowlers use some completely ungentlemanly tactics to get the great batsman Don Bradman out. Jardine s attack was a revenge-seeking one because, earlier in 1930, England had lost the series to the touring Australians. And the Australian Don Bradman, during that time, was riding high on the crest of his career. In fact, Australia had, in 1930, won the five-test series 2 1, with Don Bradman scoring 974 runs at a batting average of an astounding , an aggregate record that still stands, even today. By , Bradman s average had hovered around 100, approximately twice that of all other world-class batsmen of that time. Then aged 24, Bradman clearly was not going to retire anytime soon. Therefore, he became the prime target of the English bowlers. Apparently, as soon as Jardine was named captain for the English tour of Australia, Jardine met up with his two fast bowlers Harold Larwood and Bill Voce at London s Piccadilly Hotel to discuss a plan to combat Bradman s extraordinary skills. They knew that Bradman gets uncomfortable facing deliveries which bounced higher than usual at a faster pace, and that he would step back out of the line of the ball. And thus was born a new form of bowling delivery called Bodyline created by them. The ball was bowled close to, or at, the batsman. It was bowled towards the body of the batsman on the line of the leg stump, in the hope of creating leg-side deflections that could be caught by one of the several fielders in the quadrant of the field behind square leg. The English wanted to reduce Bradman s scoring, or get him out, but this dangerous bowling had actually led to a large number of serious injuries on the Australian team. England won the series 3-1. But it made Australians bitter. And what followed was a huge protest that strained England-Australia relations. Soon cricket laws were revised and Bodyline bowling tactics were banned soon after the series. An occasional short-pitched ball aimed at the batsman (called a bouncer) has never been illegal and is still in widespread use as a tactic. But a direct bodyline delivery is just not cricket, which is, after all, a gentleman s game. 11 Friday, August 28, A decade after Hurricane Katrina, New Orleans has made a successful comeback as the home of jazz with a boom in tourism. File photo of Louisiana struck by the disaster in 2005, that killed 1,800 people New Orleans The vibrant sounds of brass bands and buskers echo through the streets of New Orleans ten years after the birthplace of jazz was devastated by Hurricane Katrina. But while tourists may find themselves overwhelmed by choice, locals fear some of the Big Easy s spirit of creativity and improvisation may have been lost to the floodwaters. There had been a long line of older musicians passing a culture on to younger musicians, guitarist Jonathan Frelich told AFP. That got uprooted, and the way the city decided to invest in culture didn t have much to do with the way that it had existed before. The loss of neighborhood clubs and an increased emphasis on tourism has shaped the opportunities for musicians and the types of music they play, he said. It became the mode of desperation, and the only game in town, Frelich said. More than 1,800 people were killed across the US Gulf Coast -- the vast majority in New Orleans -- and over a million people were displaced when the Category 5 hurricane struck on August 29, The financial toll topped $150 billion. Katrina flooded 80 percent of New Orleans with water that rose as high as 20 feet (six meters) after the coastal city s poorly built levee system burst from the pressure of a massive storm surge. The city descended into chaos as increasingly desperate people with little food or clean water waited days for help to arrive. It was months before the Big Easy was habitable again and over 100,000 people still have not returned to their homes. When the waters receded, the future looked bleak. City leaders embraced the efforts of the tourism industry to package local culture as a catalyst of the recovery. - Mixing it up - Over a 100,000 people still having returned to their homes It worked. The economy is booming, a whopping nine million tourists visited last year, and there are scores of new festivals and venues offering work to local musicians. But the cost of living has risen sharply as the city still works to rebuild its decimated housing stock. Many musicians find themselves struggling to get by with the cost of renting or owning a home up 30 to 45 percent from pre-storm levels. Plenty of performers find themselves working for tips in the street or even in some of the bars serving tourists. Those who manage to get regular paying gigs find that their work isn t always valued. Some of the newer places aren t as concerned with the quality of music because there s so many people on the street, they re going to get bodies no matter what, said Meschiya Lake, a popular jazz singer who performs regularly on the bustling Frenchmen Street. In recent years, Frenchmen Street has transformed from the hipper alternative to Bourbon Street into a more touristfriendly destination, where a well-lit outdoor market and a giant gourmet hot dog stand welcome visitors. Once known for its diverse, experimental vibe, the strip is now home to more cover bands and traditional jazz. While the hotels and bars catering to tourists may be quite tame, musicians still have places to cut loose. Many, though certainly not all, of the corner bars which helped make New Orleans an early hotbed of rhythm and blues, rock and funk have reopened. The social clubs that support the brass band led neighborhood parades known as second lines have also reformed. New Orleans music always sells, and musicians are skilled at meeting their audience s expectations, said Matt Sakakeeny, a musicologist at Tulane University who specializes in New Orleans brass bands. The system still rewards innovative musicians who know the formula and are mixing it up. I don t see any signs that they are in danger. -- Vibrancy, accidental magic -- Musicians said that while tourism had a homogenizing effect on the music, the city s changing demographics pose another threat to its penchant for improvisation. The black population has fallen by about 115,000 people, dropping from 68 percent of residents in 2000 to 60 percent in 2013, the latest census figures show. Plenty of white residents also found the emotional and financial cost of rebuilding to be too high, though their numbers are harder to measure. The post-katrina influx of new residents included homeowners who were less inclined to join street parades, and more willing to call the authorities. Recently proposed legislation to limit the volume of recorded and live music puzzled many locals accustomed to the late night blasts of trumpets. That s part of the vibrancy, that accidental magic, Lake told AFP. It s like going to France and telling them to stop speaking French. Tuba player Bennie Pete longs for pre-storm New Orleans. You always feel like you re missing something, he said. You re driving through a neighborhood looking for a certain house, and it s not there... the heart of it is what I m looking for. That s why it s so important to make sure that the city s unique culture and sound is protected, he said. We understand our position as musicians and culture bearers is to educate the younger ones so they can grab the torch, he said. Right now, we still have a lot more walking and torch carrying to do.

IS kills two generals in Iraq, advances in Syria Baghdad A suicide attack claimed by the Islamic State group killed two Iraqi generals yesterday in the key battleground province of Anbar, as the jihadists made gains in neighbouring Syria. IS overran large areas of Iraq in 2014 and seized Anbar capital Ramadi earlier this year. Military spokesman Brigadier General Yahya Rasool said a suicide bomber in an explosives-rigged vehicle struck the Al Jaraishi area north of Ramadi as Iraqi forces advanced. IS claimed responsibility for the attack in a statement online. Teary Exit Washington One of the two giant panda twins born at Washington s Smithsonian National Zoo over the weekend died on Wednesday, turning unexpected joy to tragedy in a matter of days. After an ultrasound revealed a possible pregnancy a week ago, zookeepers were greeted with another surprise on Saturday when 17-year-old panda Mei Xiang gave birth to not one, but two baby cubs. But the keepers struggled to keep the smaller of the two healthy as Mei Xiang focused UK migration hits record level over 12 months London Net migration to Britain has hit record levels, official figures showed yesterday, with the difference between migrants leaving and arriving in Britain rising to around 329,000 in the year to March. The net migration figure was a statistically significant increase from 236,000 in year ending March 2014 and is the highest net migration on record, the Office for National Statistics (ONS) said. Immigration Minister James Brokenshire called the figures deeply disappointing. Prime Minister David Cameron had vowed to reduce the numbers to less than 100,000 by May of this year. Some 636,000 people immigrated to Britain over the 12-month period, a rise of 84,000, while 307,000 people emigrated, down 9,000. The net figure is 9,000 more than the previous record, which was set in the year ending June The report found that 269,000 EU citizens had moved to Britain permanently, a statistically significant increase of 56,000. Around 53,000 were Romanian and Bulgarian citizens, almost double the 28,000 in the previous 12 months. Prime Minister Cameron has vowed to hold a referendum on Britain s membership of the European Union by 2017, and is hoping to wrest powers from Brussels, particularly over immigration, before the vote. Brokenshire called the figures a wake-up call. While these figures underline the challenges we need to meet to reduce net migration, they should also act as a further wake-up call for the EU. Current flows of people across Europe are on a scale we haven t seen since the end of the Second World War, he said. This is not sustainable and risks the future economic development of other EU member states. It reinforces the need for further reform at an EU level as well as within the UK. Smaller of newborn panda twins at US zoo dies her attention on the larger cub. The undersize cub - nearly half the weight of the other - passed away on Wednesday, four days after its unexpected birth had made it an Internet sensation. This is a very hard loss for us, zoo director Dennis Kelly told a press conference. It s really hard to keep those little creatures thriving. Zookeepers faced an uphill battle after they had trouble convincing Mei Xiang to swap between caring for the smaller and larger cub. Tiny, blind, nearly hairless and with little ability to regulate their own body temperature, newborn pandas are completely dependent on their mothers. Keepers had stepped into that maternal role by bottle-feeding the cub and administering antibiotics to stave off infections, but their efforts ultimately fell short. After the last swap this morning, we immediately noticed that it appeared weaker, with possible respiratory problems, chief veterinarian Don Neiffer said. We did see some A migrant climbs over a fence near Calais improvements... but things turned and its condition declined. We weren t able to turn things. Prior to its death, the cub had stopped gaining weight and was only 79.8 grams (2.8 ounces) when it died, as opposed to the grams of its larger sibling. Neiffer noted that newborn cubs are extremely fragile and that the cause of death would not be known for sure until an autopsy is performed in the next few weeks. But he also said the larger cub was doing very well. The court ordered the Federal Investigation Agency (FIA), which probed the cases, to apprehend Gilani, who was prime minister from 2008 to 2012, along with ex-commerce minister Makhdoom Amin Fahim and produce them before a judge on September 10. Yes, the court has issued the arrest warrants against them and to produce them into the court on the next hearing, an FIA official said. Gilani can appeal to a higher court to allow him to post bail to avoid arrest before the hearing, but Fahim is unlikely to appear because he is receiving cancer treatment in Britain. Neiffer said. It is too early to determine the sex of either cub.

Internal memos from Dan Dennison, then news chief of WDBJ7, show concerns about Vester Flanagan s aggressive behaviour towards colleagues. They indicate the station tried to help him before firing him in February Flanagan shot dead Alison Parker and Adam Ward at a shopping centre in Moneta on Wednesday. He filmed the attack and posted it on social media. He sent a rambling manifesto to ABC News, saying he was a human powder keg... just waiting to go BOOM!!!! Flanagan voiced a host of anger-laced grievances, as well as some praise, in a disjointed 23-page document that authorities say he faxed after shooting the two WDBJ- Tragic end TV journalists live on air - killings that he attempted to explain. In one document that he called a suicide note for friends and family, Flanagan, wrote, I am so sorry for dumping on you... I am just so sick of this s*** man. Flanagan talked about his past, including his time growing up in Northern California and his claims to have worked as a teen model and later as a male escort in addition to his time in television news. He delved into his personal life, including his being a gay black man, offering praise for some relatives, friends and one romantic interest and condemnation for others. He admits to being somewhat racist against whites, blacks and Latinos. He referenced a number of grievances, some of them decades old, and mentioned being bullied and suffering other injustices. Some of This TV video frame grab courtesy of WDBJ7-TV in Roanoke, Virginia shows Alison Parker (L) the moment shots ring out during an interview on tourism with Vicki Gardner Vester Lee Flanagan these involve places where he worked, including WDBJ. The document does not mention either of Wednesday s victims by name, though it does detail his gripes with the Roanoke television station. Flanagan expressed his admiration for Seung-Hui Cho, who killed 32 people at Virginia Tech in He also referenced the June shootings at a predominantly black African-American church in Charleston, South Carolina, carried out by Dylann Roof. Roof claimed he wanted to start a race war. Gun control debate The brazen killing of two US journalists during a live television broadcast by a former reporter who was fired by the station reignited calls for tougher gun control in America - though hope for change is limited. Parker s father Andy made an impassioned plea for change, saying his daughter s death had left his heart broken. I m for the Second Amendment, but there has to be a way to force politicians that are cowards and in the pockets of the NRA to come to grips and make sense - have sensible laws so that crazy people can t get guns, he said. It can t be that hard, and yet politicians from the local level to the state level to the national level, they side step the issue. They kick the can down the road. This can t happen anymore. Colleagues at WDBJ7 in Roanoke, Virginia, held a moment of silence at 06:45 (10:45 GMT) yesterday- 24 hours on from the exact moment the reporter and cameraman were shot dead as they broadcast live from a shopping centre in Moneta. Flowers are left for the two journalists Three health officials have been suspended over the incident New Delhi newborn has died after A being bitten by rats in a government-run hospital in southern India where he was undergoing treatment, the baby s mother alleged yesterday. Three health officials have been suspended over the incident at the Guntur Government Hospital in Andhra Pradesh state where the 10-day-old boy was being treated for a urinary tract problem. His mother, Chavali Lakshmi, said she alerted staff after noticing some of her son s fingers appeared to have been nibbled off during his stay in the neonatal intensive care unit. Our son was about to undergo a surgery, but we noticed wounds on his right hand on Wednesday, she said. Rats had nibbled them (fingers) off, Lakshmi added. Andhra Pradesh Chief Minister N. Chandrababu Naidu said he has suspended three officials and ordered an inquiry into the incident. Shocked and deeply disturbed after learning that a baby boy died after bitten by rats in Guntur hospital, Naidu said on Twitter. Warned officials that such an incident should not recur. The hospital s top official, medical superintendent T. Venugopala Rao was quoted in the Times of India newspaper as saying the boy s death occurred despite putting up rat mesh in the neonatal intensive care unit after receiving complaints about rodents. It is an unfortunate incident, he added. Most of India s 1.2 billionstrong population rely on under-staffed and run-down government hospitals for free treatment. Last year, a hospital in the central state of Madhya Pradesh hired pest controllers after incidents of rodents damaging hospital equipment and biting patients.
