A comprehensive pproch to emergency mngement tht sets frmework to ensure dequte rrngements for prevention nd mitigtion, prepredness, response nd recovery is criticl for reducing the incidence nd dverse impcts of emergencies on the Tsmnin community. Government, communities, fmilies nd individuls ll hve prt to ply in reducing vulnerility nd uilding community resilience to emergencies from ushfires, storms nd floods, s well s the emerging threts from intentionl violence, climte chnge nd pndemics. This pln hs een revised y the Circulr Hed Council in prtnership with its emergency mngement prtners in the privte sector, t the Ntionl level nd with Non-Government Orgnistions. In its ltest form, the pln hs moved from eing focused on response nd recovery rrngements to one which detils roles nd responsiilities for prevention nd mitigtion, prepredness, response nd recovery. It is written to e flexile nd enle consistency so ppropritely uthorised positions nd functions cn dpt the rrngements to suit ech emergency. 19 SECTION 2 Governnce nd Mngement This section records how municipl emergency mngement is governed nd mnged, nd who is involved; tht is, three levels of government with focus on the min municipl roles. Role of Government nd Emergency Mngement Prtners 2.1 In Austrli, the three spheres of government (Commonwelth, Stte nd locl) work in prtnership to chieve sfer, sustinle communities through roust emergency mngement rrngements. The Tsmnin Emergency Mngement Pln (TEMP) provides summry of the different roles of government for emergency mngement. Non Government Orgnistions, industry/professions, communities nd individuls complement the work of Governments for emergency mngement. 2.2 At municipl level, councils hve centrl role in coordinting nd fcilitting rnge of emergency mngement ctivities for ll hzrds with the Municipl Committee, s well s resourcing specific council responsiilities for emergency mngement. Legl Frmework 2.3 In Tsmni, powers nd uthorities for emergency mngement re provided in the Emergency Mngement Act The Act estlishes flexile emergency mngement system including emergency powers for the ppointment of workers for emergency mngement functions including Municipl Coordintors, Deputy Municipl Coordintors nd Municipl Chirpersons. 2.4 The Locl Government Act 1993 nd the ccompnying Locl Government (Building nd Miscellneous Provisions) Act 1993 mke councils responsile for pulic helth, sfety, community welleing, snittion nd clensing. Emergency Power nd Declrtion 2.5 Powers relted to specific hzrds nd/or functions re estlished y specific Stte legisltion or ntionl rrngements (in some instnces Commonwelth legisltion cn lso provide uthority). 2.6 The Emergency Mngement Act 2006 provide dditionl powers for Regionl Controllers, the Stte Controller, the Minister nd the Premier to tke nd/or direct ction for the protection of life, property nd the environment. There re three types of powers estlished y the Act: c risk ssessment powers - snctioned y the Stte Controller (s36) emergency powers snctioned y the Stte Controller (s40) specil emergency powers (under declred stte of emergency) snctioned y the Premier. In this circumstnce, Regionl Controllers utomticlly hve emergency powers conferred to them (s42). 2.7 These powers cn e used t ny time, providing the criteri set out in the Act re met. Municipl Coordintors provide dvice to the Regionl Controller/SES Regionl Mnger if they elieve powers should e snctioned. Conversely if powers under this Act re snctioned the Regionl Controller/SES Regionl Mnger will ssist Municipl Coordintors to perform the functions required of them. 2.8 Any specified uthorised officer, which my include the Municipl Coordintor, my need to implement the powers, s required y the uthoristion.
