6 Criminal Justice Immigration Consequences and Criminal Law By Robert Sanger T his month s Criminal Justice column will look at immigration consequences of the criminal law. Any lawyer who handles a criminal matter, even if it is the occasional driving under the influence, is required by the Constitution to advise her or his client of the immigration consequences of whatever action (or inaction) the client might take. If it was not clear already from existing case law in California and from the Rules of Professional Conduct, the duty was made explicit by the United States Supreme Court in Padilla v. Kentucky (2010) 130 S. Ct. 1473, 176 L. Ed. 2d 284. We will discuss some of the significant immigration consequences to anyone who is not a citizen of the United States. Remember, these laws apply to people who are permanent resident aliens and who may have lived here since they were infants. There are many people who give no clue by their appearance, accent or family situation that they are anything but citizens of the United States. The utmost caution is required before giving advice to anyone. Assume Each Client is Not a Citizen The best approach is to assume everyone you represent is not a citizen of the United States. We have represented many people who spoke standard American English who were, nevertheless, permanent resident aliens and not citizens of the United States. While we make stereotypic assumptions that, in Santa Barbara, a non-citizen is liable to be Latina/o and speak with a Spanish language accent, that is not the case. For the purposes of proper legal advice, we are worried about under-inclusion, not over-inclusion. To provide adequate advice in the criminal context, we are concerned that people who are not United States citizens will not be identified and will not be given the proper information. We have seen people who immigrated from English-speaking countries and who have lost any vestige of their original dialect or did not have a discernable dialect to start with. Others, including people from non-english speaking countries, may have just assimilated. And we have people who have been adopted by American families at an early age but who, through choice or neglect, did not take the final steps to become citizens. Therefore, if you do any criminal work at all, you must ask every single client whether or not she or he is a citizen of the United States. Do not assume anything. Furthermore, when considering any plea, re-ask the question, Are you a citizen of the United States? Robert Sanger Consult an Immigration Lawyer in Every Case in which the Client is not a United States Citizen This is not overkill. It is required. Despite the fact that I have been practicing criminal law in Santa Barbara for almost 40 years; despite the fact that I have represented hundreds of non-united States citizens; and despite the fact that I have handled dozens of cases where we have tried to set aside the convictions of non-united States citizens who were not properly advised by prior counsel despite all of this, I advise all such clients to consult with an immigration lawyer. Furthermore, even if they decline to do so, it is our practice to consult immigration counsel ourselves before giving advice so that any course of action will not have adverse immigration consequences. We have intervened after a person represented by other counsel has entered a plea and then been taken into federal immigration custody by Immigration Customs Enforcement (ICE). Sometimes it is too late, sometimes too costly and sometimes we can get the plea in the criminal case set aside so that the person has a fighting chance to remain in the country. The reality of being taken to an immigration detention center in Santa Ana or El Centro by ICE agents and being told after the fact that the plea makes the person deportable is a shocking event for most. Furthermore, after deportation, a person can be subject to 20 years in federal prison for re-entering the United States. Certain convictions, which may not result in deportation, may still render the defendant inadmissible to obtain legal status in the future. For an undocumented defendant, avoiding an inadmissible conviction may be even more important than avoiding a deportable conviction. Continued on page 10 6 Santa Barbara Lawyer

8 Legal News The Best Day Ever By Danielle De Smeth, SBWLF President, 2012 S anta Barbara Women Lawyer s Foundation (SBWLF) organized a fun Friday for 10 enthusiastic Girls Inc. participants, including a meeting with Judge Dandona, courthouse tour and mentoring lunch. On September 28, fifth and sixth graders from the Goleta Valley Girls Incorporated program met SBWLF board members and attorney volunteers at the offices of Brownstein Hyatt Farber Schreck. After introductions over snacks in Brownstein s lovely office, the group walked to Department 11. Judge Jean Dandona sat the girls in the jury box to observe the morning s misdemeanor calendar. Wide-eyed and a little nervous, they watched District Attorney Hanna Lucy and Public Defender Ryan Peabody negotiate while Judge Dandona narrated the backdrop and introduced Department 11 staff, including the clerk, bailiff, and court reporter. All fielded questions from the pint-sized jury, whose curiosity spanned topics from the presumption of innocence to Judge Dandona s most interesting job. (The answer to the latter was worth the price of admission.) Next up: historic courthouse tour. The girls admired the library s black and white photographs, the mural room s grandeur and the observation tower s view. Climbing the tower s stairs shifted the focus to lunch. Brownstein Hyatt Farber Schreck graciously fed the voracious group at Chase Bar & Grill on State Street. Shirley Temples and chicken alfredo fueled debate over juror qualifications and restitution payment deadlines. The Chase staff surprised the girls with chocolate cake to top-off, as one Girls Inc. participant put it, the best day ever. SBWLF Vice President Stephanie Ball of Brownstein Hyatt Farber Schreck coordinated the event, which would not have been possible without Brownstein s continued support of the Foundation. SBWLF thanks volunteer mentors Jennifer Smith, Naomi Dewey, Virginia Arciniega, Rebecca Eggeman, Judge Dandona and Department 11 staff, Chase Bar & Grill, and Brownstein Hyatt Farber Schreck for their generous support. 10 Legal News Sanger, continued from page 6 There are Consequences other than Deportation Many lawyers say that they are not really criminal defense lawyers, but that they will do drunk driving cases or other minor misdemeanors. Conviction of driving under the influence can have an effect on naturalization. A single DUI is not likely to result in deportation if a person is a permanent resident alien, however, any booking may result in deportation of a person who is here without documentation or who is here on a visa. Always assume that there could be immigration consequences. Interestingly, even United States citizens may suffer consequences in other countries. The Canadian Border Services Agency (the Canadian version of ICE) will not allow a person to enter Canada if they have a conviction for a garden variety DUI. Many United States citizen travelers have had their vacation or business plans ruined by being turned away at the border. If conviction cannot be avoided, immigration lawyers can help in the case of Canada. The Border Service Agency has an application process that, if done sufficiently in advance, can result in an exemption to travel despite the conviction. In addition, convictions, especially felony convictions or convictions for other serious matters, can interfere with international travel. Increasingly, foreign countries are being given access to federal NCIC information which can lead to detention at another country s point of entry. If the client travels internationally, or intends to, these consequences should also be explored with immigration counsel who has contact with the appropriate foreign jurisdictions. Some of the Issues to Watch The following is a list of common areas where a criminal defense lawyer can avoid or minimize adverse immigration consequences. The criminal defense lawyer should always refer the non-united States citizen client to an immigration lawyer and have that lawyer review any plea or other significant criminal law event. Aggravated Felony An aggravated felony need be neither particularly aggravated nor need it be a felony under California law. It is defined as an offense with a sentence of one year or more. Most misdemeanors in California carry up to one year in the county jail and therefore can be considered aggravated felonies. In a proper case, again with immigration counsel s advice, it may be possible to plead to a sentence of 364 days or less and avoid these consequences. Oddly, this may even be effective if the case is an actual felony in California. Crimes of Moral Turpitude Certain offenses are classified as crimes of moral turpitude (CMT) based on the elements of the offense as opposed to the actual facts of the case. CMTs typically involve theft, fraud, intent to cause bodily harm, recklessness, malice or lewdness. Both misdemeanor and felony offenses can be CMTs for immigration purposes. Domestic Violence A domestic violence offense may lead to deportation or exclusion simply based on the nature of the offense. Again, with advice of immigration counsel, it might be appropriate to plead to false imprisonment or some other non-domestic violence charge, if necessary. However, it is important not to incorporate domestic violence language in the plea. Drug Offenses Many drug offenses are deportable. There are some nuances that can avoid, at least at the moment, the harshest consequences. For instance, for certain drug offenses, it may be possible to strike reference to the specific drug in the charging document and to enter a plea to simply violating the code section. Because not all drugs prohibited under California codes sections are deportable, this strategy while risky and a last resort may work. The immigration lawyer can advise in the particular case. Conclusion There are many other subtleties and nuances that are not addressed here. The main thing to take away from this article is that anyone handling a criminal matter (even a DUI or other minor offense) must assume that 1) the client is not a United States citizen unless and until the client affirmatively answers that direct question; 2) that an immigration attorney must be consulted before any action is taken on behalf of a non-united States citizen; 3) there are immigration (or emigration) consequences even to United States citizens; and 4) there are things that a criminal defense lawyer can do, or at least try to do, to avoid immigration consequences for the client. 12 Legal News Successful MCLE Conference Held by Santa Barbara Paralegal Association By Barbara Liss, 2012 President, Santa Barbara Paralegal Association T he Santa Barbara Paralegal Association held its third annual MCLE conference on Saturday, September 22 nd at the Santa Barbara County Courthouse, and it was a raging success by all accounts! With more than 100 attorney and paralegal registrants, 11 speakers, over 20 local high school volunteers, additional volunteers from the UCSB Extension paralegal program, and 22 exhibitor tables, the corridors of the courthouse were teeming with people who enjoyed the day. We were fortunate to have the Honorable Jim Herman as our opening speaker on the perils of social networking, and Deedrea Edgar of the Public Defender s office, who provided our closing talk about serving the mentally ill in civil and criminal cases. The presentations were wellattended, to the gratification of our talented speakers, because they were on varied and timely topics. We are very thankful to our speakers, who gave their time and effort for this special event! We served delicious breakfast and lunch offerings, and had an end-of-event wine and cheese reception. The day culminated with a private tour of the courthouse facility given by Robert Ooley and Rodney Baker of the Courthouse Legacy Foundation, which was spectacular. As the SBPA board and committee recovers from the work involved in mounting this event, we will turn our attention to employing the income derived from the conference in ways that benefit the association and the communityat-large. We will soon announce our plans for donating a portion of the proceeds to several deserving non-profit interests, as well as using some to fund our ongoing scholarship programs. SBPA thanks the Santa Barbara legal community for its support in making our conference as successful as it was and pledges to continue our role in bringing high quality continuing legal education to our area at an affordable cost. We particularly thank the Santa Barbara County District Attorney s Office, without whose sponsorship the event would not have been possible. 16 Legal News CPR Hands-Only Training at the Santa Barbara Courthouse By Catherine Swysen T he numbers are sobering: nearly 400,000 people suffer an out-of-hospital cardiac arrest every year in the United States; 89% die because they did not receive immediate CPR from somebody at the scene. Yet, it takes only a few minutes to learn how to administer Hands-Only CPR. The Santa Barbara County Bar Association sponsored a CPR Hands-Only Training during the lunch hour on Friday, September 21, Firefighters from Santa Barbara Fire Station 7C and paramedics from American Medical Response were on hand to teach this simple, life-saving technique. Judges Hill, Eskin, Anderle, Geck and Supervisor Jane Wolfe were among the 80 people who stopped by to learn how to administer chest compressions to the beat of the classic disco song Stayin Alive. According to the American Heart Association, Hands- Only CPR is an easy, effective way to double or triple a cardiac arrest victim s chance of survival. 20 Legal News Naomi Dewey, Editor of Santa Barbara Lawyer, has been re-elected as Governor of District 6 for California Women Lawyers. District 6 covers San Luis Obispo, Santa Barbara, Ventura, Riverside and San Bernardino counties. Ms. Dewey, who serves on the executive committee for CWL, was sworn in as Secretary of that organization by Chief Justice Cantil-Sakauye on October 11, District 6 is one of the most challenging, and exciting, districts to represent, said Ms. Dewey. The issues facing attorneys in the Inland Empire are not always that different from those facing lawyers working in coastal communities. By bringing all of these counties together, we create a powerful and effective voice at the statewide level and can effect real change. Brandi Redman will serve as CWL s Affiliate Governor for Santa Barbara Women Lawyers. The Santa Barbara College of Law is delighted to announce that, with a generous grant from the Santa Barbara Barristers, it has purchased a 60 digital television that is now available for use by Bar Association sections holding meetings at 20 E. Victoria St. The television can be used with a digital projector or, with the user s compatible HDMI cable, a tablet such as an ipad.
