25 COPYRIGHT INFRINGEMENT / PEER-TO-PEER FILE SHARING POLICY Backgrund The Higher Educatin Opprtunity Act (HEOA) was enacted n August 14, 2008, and reauthrizes the Higher Educatin Act f 1965, as amended (the HEA). The HEOA requires educatinal institutins t implement plans f actin in rder t deter and cmbat unauthrized distributin f cpyrighted materials. Institutins are t als create plicies directly targeting Peer-t-Peer (P2P) file sharing which include disciplinary actins. Institutins that are required t adhere t the PPA (Prgram Participatin Agreement) must certify t the U.S. Department f Educatin that plicies have been created and are in place t deter cpyright vilatin. The PPA gverns institutin participatin in Title IV and vilatins f the PPA may result in administrative actins by the Department f Educatin, including limitatin, suspensin, r terminatin f participatin in Title IV. Definitins Cpyright Cpyright is an area f law that prvides creatrs and distributrs f creative wrks with an incentive t share their wrks by granting them the right t be cmpensated when thers use thse wrks in certain ways. Specific rights are granted t the creatrs f creative wrks in the U.S. Cpyright Act (title 17, U.S. Cde). If yu are nt a cpyright hlder fr a particular wrk, as determined by the law, yu must rdinarily btain cpyright permissin prir t reusing r reprducing that wrk. There are sme specific exceptins in the Cpyright Act fr certain academic uses, and permissin is never required fr certain ther actins, such as reading r brrwing riginal literary wrks r phtgraphs frm a library cllectin. Fair Use A prvisin fr fair use is fund in the Cpyright Act at Sectin 107. Under the fair use prvisin, a reprductin f smene else's cpyright-prtected wrk is likely t be cnsidered fair if it is used fr ne f the fllwing purpses: criticism, cmment, news reprting, teaching, schlarship, and research. If the reprductin is fr ne f these purpses, a determinatin as t whether the reprductin is fair use must be made based upn fur factrs: The purpse and character f use (principally, whether fr cmmercial r nnprfit educatinal use); The nature f the cpyright-prtected wrk; The amunt and substantiality f the prtin used; and The effect f the use being evaluated upn the ptential market fr r value f the cpyright-prtected wrk. Peer-t-Peer (P2P) Peer-t-Peer (P2P) is file sharing f cpyrighted materials thrugh nline netwrks and cmmunities (examples: Napster, KaaZa, and Limewire). P2P file sharing in itself is nt illegal; hwever, it is ften used fr unauthrized dwnlading and uplading f cpyright-prtected material such as music, mvies, vide games, cmputer sftware, and phtgraphs.
