6 EMERGENCY RESPONSE AND EVACUATION PLAN Security and safety is a tp pririty at Tulsa Welding Schl Jacksnville Campus. The purpse f this plan is t establish early warning prcedures fr all types f emergency situatins that impact the nrmal daily peratins f schl business. The supervisr in charge f disaster management (r their designee) during an emergency shall be in the fllwing rder: 1. Campus President 2. Reginal Directr f Facilities 3. Directr f Prgram Training 4. Academic Dean 5. Other emplyees as designated by the Campus President r any Crprate Officer In the event f a serius r life threatening emergency caused by natural disaster r human hands, a supervisr in charge f disaster management, r their designee, will be respnsible fr issuing timely warnings f all threats that represent an nging and cntinuus threat t the campus cmmunity. These ntificatins will be made immediately and withut delay unless ding s wuld cmprmise effrts t assist a victim r cntain, respnd r therwise mitigate the emergency. The safety f the campus will dictate the cntent and methds f ntificatin. When a crime r emergency is reprted t a supervisr in charge f disaster management, r their designee, they will g directly t the scene and assess the situatin. 911 will be cntacted immediately if the situatin warrants it and if necessary, the prcess t begin ntifying the campus will begin. During instances f severe weather, staff at bth lcatins will mnitr weather infrmatin frm the lcal TV/Radi statins and will listen fr the civil defense sirens. Emergency infrmatin will be cmmunicated t the campus bth utdrs and indrs via the verhead intercm and by the phne paging system. If time warrants, the campus vic will be changed t a recrded message ntifying any students, staff, r family members wh are nt n the campus at the time f an emergency abut the situatin. Infrmatin abut when the campus will repen will als be recrded n the message. In the event that a situatin gains media attentin, all inquiries will be referred t the Campus President. Fire Evacuatin Instructins In the event f a fire r ntificatin f a fire by building alarm, it is imprtant t fllw these guidelines: 1. Hurricane Evacuatin Instructins A hurricane by nature is a slw mving event with water damage being the mst cstly part f a hurricane. 9 Safety and Security Measures Tulsa Welding Schl (TWS) recgnizes the imprtance f security fr all students and staff while n campus prperty. Furthermre, TWS supprts law enfrcement agencies and wrks with them where apprpriate t minimize crime. TWS endrses all applicable city, state, and federal laws. Security issues affect all TWS students, visitrs, and staff n campus prperty, which includes the parking lts. TWS des nt have campus husing. The Academic Dean, Directr f Prgram Training, Reginal Directr f Facilities, r ne f the Student Advisrs will make available infrmatin fr staff n safety and security measures. The Reginal Directr f Facilities serves as security crdinatr fr the campus. As such, he des nt have authrity t arrest individuals; hwever, he des wrk with state and lcal plice and ther law enfrcement agencies. His department is respnsible fr pening and clsing the facilities n-campus. Instructrs prvide infrmatin n safety and security precautins fr all new students n the first day f training. Drugs and Alchl Abuse Preventin Pssessin, use, r sale f either alchlic beverages r illegal drugs may be grunds fr terminatin. Vilatin f underage state drinking law r vilatin f state r federal drug laws will be reprted t a law enfrcement agency. Refer t the TWS plicy n bulletin bards as it relates t a drug-free wrkplace. The State f Flrida sets 21 as the minimum age t purchase r pssess any alchlic beverages. The TWS staff is prvided the same infrmatin prir t hire and cntinued annually. Sexual Offense Preventin and Awareness TWS will nt tlerate sexual harassment f a student by an emplyee, anther student r any third party. Sexual harassment is deemed t be unwelcme cnduct f a sexual nature. Any cmplaint in this area shuld be brught t the immediate attentin f the Campus President wh will cnduct an investigatin in line with published prcedures in the TWS Emplyee Handbk. Crimes, arrests, and hate incidents must be reprted immediately! Due t plice reprts being public recrds under the state law, the Jacksnville Sheriff s Office cannt hld reprts f crimes in cnfidence. Cnfidential reprts f a crime can be made t the Crime Stppers at (866) Tulsa Welding Schl encurages students and staff t assume respnsibility fr their wn persnal safety and security by taking cmmn sense precautins. Precautins might include walking t yur car at night with a fellw student r a asking a TWS maintenance emplyee t walk yu ut. Anther is keeping yur car lcked and parked in a well-lit area with valuables placed ut f sight. Tulsa Welding Schl s administrative ffices will be pen t staff, students, prspective students and their families, guests and invitees during business hurs (Mnday thrugh Friday, 8:00 am t 5:00 pm). Students may access the administrative ffices after 5:00 pm t make payments, purchase equipment, r t speak with the Financial Aid department until 7:30 pm. A Student Advisr is als available fr students Wednesday and Thursday until 7:00 pm. The welding lab and student classrms at the main lcatin at 3500 Suthside Bulevard will be pen t staff and students during class hurs (Mnday thrugh Friday, 7:30 am t 11:15 pm and Saturday 8:00 am t 1:00 pm fr makeup time). The lab and student classrms at the satellite lcatin at 1750 Suthside Bulevard will be pen t staff and students during class hurs (Mnday thrugh Thursday 7:30 am t 10:00 pm and Friday 7:30 am t 5:45 pm). 12 INFORMATION FOR STUDENTS WITH DISABILITIES Tulsa Welding Schl is cmmitted t ensuring equal access t educatinal pprtunities fr students with disabilities. The wrk envirnment in which ur graduates cmmnly wrk demands a full range f physical and mental faculties fr career success. While there are exceptins, mst jbs require the ability t climb, stp, wrk in cnfined spaces, lift and carry in excess f 50 punds, expsure t wet and/r humid cnditins (including utside weather cnditins), expsure t fumes r airbrne particles, txic r caustic chemicals, expsure t electrical hazard and ccasinally wrk in nisy cnditins. Further, manual dexterity and detailed finger manipulatins may be required. Statement f Purpse The primary bjective f the Students with Disabilities Plicy is t prvide an integrated and chesive set f supprt accmmdatins and services fr students with disabilities. This plicy exists in accrdance with the Americans with Disabilities Act f 1990 (ADA) and Sectin 504 f the Rehabilitatin Act f 1973, and mandates that n persn with a disability, will, n the basis f that disability, be denied full and equal access fr participatin in prgrams, services, and activities. An individual with a disability is defined as any persn wh: has a physical r mental impairment which substantially limits ne r mre majr life activities, (including walking, seeing, hearing, speaking, breathing, learning, wrking, caring fr neself, r perfrming manual tasks), has a recrd f such impairment, r is regarded as having such an impairment. All institutins f higher educatin must make reasnable accmmdatins in rder t prvide students with disabilities an equal pprtunity t participate in the institutin s curses, prgrams, and activities. Schls must make certain academic adjustments t ensure that a student has an equal pprtunity t participate. Academic adjustments may include extended time fr test taking; tape recrding f classes; and mdificatin f test taking r perfrmance evaluatins s as nt t discriminate against a persn s sensry, speaking, r mtr impairments, unless that is what is being tested. An institutin must als prvide auxiliary aids and services, such as qualified sign language interpreters, nte-takers, readers, Braille and large print materials, and adaptive equipment. A qualified interpreter is ne wh can cmmunicate expressively and receptively, using any specialized vcabulary in a manner that is effective, accurate, and impartial. Institutins are nt respnsible fr prviding persnal services such as attendants, hearing aids, glasses, etc. Under the applicable regulatins, tutring is a persnal service and is nt mandated by these regulatins. Therefre, it need nt be prvided unless the schl prvides tutring t ther students, in which case it must make that tutring prgram accessible t students with disabilities. Institutins may nt charge mney fr reasnable accmmdatins. Additinally, schls d nt have t prvide accmmdatins that wuld fundamentally alter the educatinal prgram r academic requirements that are essential t a prgram f study r t fulfill licensing requirements. Admissins requirements fr all students are the same, regardless f disability r lack theref. It must be understd that accmmdatins fr disabilities are meant t assure educatin experience and pprtunity. Any accmmdatins deemed necessary and reasnable will be made n a case-by-case basis by taking int accunt institutinal bligatins t prvide equal access t educatinal pprtunities; may nt necessarily incrprate all changes requested; and will nly be made fllwing prvisins f prf f such disability. Students seeking accmmdatins shuld ntify their Admissins Representative, Academic Dean, r the Directr f Student Services f any special needs, requirements, r requests befre enrlling in a prgram f study r as sn as pssible after it is determined that accmmdatin is desired. 14 STUDENT CODE OF CONDUCT Scpe This plicy applies t all students attending any f ur institutins (Institutin). Students are expected t act in a prfessinal and cnsiderate manner with ther students and schl staff. Visitrs, guests, and emplyers frequently spend time n ur campuses and students behavir is a reflectin n the schl and everyne assciated with it. Additinally, students behavir in student-referred husing als reflects upn the schl's reputatin in the cmmunity, thus requiring students t maintain a prfessinal demeanr at all times. Jurisdictin and Applicatin This Cnduct Cde (Cde) shall apply t student cnduct that ccurs n the institutin s premises r at institutin-spnsred activities. At the discretin f the Campus President r delegate, the Cde als shall apply t ff-campus student cnduct when the cnduct, as alleged, adversely affects a substantial institutin interest and either: Cnstitutes a criminal ffense as defined by state r federal law, regardless f the existence r utcme f any criminal prceeding; r Indicates that the student may present a danger r threat t the health r safety f the student r thers. The Institutin is dedicated t the ratinal and rderly reslutin f cnflict. Respnsibilities f Dual Membership By enfrcing its Cde, the Institutin neither substitutes fr nr interferes with ther civil r criminal legal prcesses. When a student is charged in bth jurisdictins, the Institutin will decide n the basis f its interests, the interests f affected students, and the interests f the cmmunity whether t prceed with its disciplinary prcess r t defer actin. Determinatins made r sanctins impsed under the Cde will nt be subject t change because criminal charges arising ut f the same facts were dismissed, reduced, r reslved in favr f the criminal law defendant. Threatening, Harassing, r Assaultive Cnduct: Any unwelcme actin whether physical, verbal, r nnverbal; this is intimidating, hstile r creates an ffensive envirnment, the use f frce r threat f frce t engage a persn in sexual activities withut the persn s willing cnsent, r invlvement in hazing r threatening the physical safety and cmfrt f thers r a display f vilence that results in physical cntact. Dishnesty: Willfully r knwingly lying, cheating academically, claiming the wrk f thers, cperating with anther t falsify data/recrds f academic achievement r prcedures/analysis, giving any type f false/frged infrmatin/recrds t the Institutin, r making a false reprt f a bmb, fire, natural disaster r ther emergency t an institutin fficial r an emergency service agency. Disrderly Cnduct: The use f any type f language r gesture that is ffensive and creates an uncmfrtable envirnment; behaving in a manner that disturbs the peace f thers and/r disrupts, interferes r prevents a staff member frm perfrming their duties. This includes the classrm which extends t any setting where a student is engaged in wrk tward academic credit r satisfactin f prgram-based requirements r related activities. Unsafe Cnduct: Students will bserve all EPA/DEQ/OSHA safety regulatins, eye and hearing/ear prtectin in designated areas, the safety f thers, and adhere t the prper use f tls, equipment, and mtrized vehicles. Refusal t Identify and Cmply (Aiding and Abetting): Students will nt assist, encurage, r incite thers in any vilatin f regulatins. This includes willfully refusing t r falsely identifying ne s self r willfully failing t cmply with a prper rder f summns when requested by an authrized institutin fficial. Tbacc Use: Students are allwed t use tbacc prducts in designated areas nly. Unauthrized Entry: Students will nt enter r attempt t break and enter int any lcked r unauthrized rm, building, strage area, vehicle, cmputer, r data strage device. This als includes using keys, access cards, r access cdes withut authrizatin. Unauthrized Use f Institutin Facilities and Services: Wrngfully using Institutin prperties r facilities; misuse, alteratin, r damage t fire-fighting equipment, safety devices r ther emergency equipment r interfering with the perfrmance f thse specifically charged t carry ut emergency services; acting t btain fraudulently (thrugh deceit, unauthrized prcedures, bad checks, r misrepresentatin) gds, quarters, services, r funds frm Institutin departments r student rganizatins r individuals acting in their behalf. Student Electrnic Equipment: Nn-educatinal electrnic equipment (MP3 players, IPODs, cameras, pagers, etc.) is nt allwed in institutinal training areas. 15

Hazing: Any act taken n the institutins prperty r in cnnectin with any institutin-related grup r activity that endangers the mental r physical health r safety f an individual (including, withut limitatin, an act intended t cause persnal degradatin r humiliatin), r that destrys r remves public r private prperty, fr the purpse f initiatin in, admissin t, affiliatin with, r as a cnditin fr cntinued membership in a grup r rganizatin. Required Cmpliance: Satisfying institutinal requirements, wrk assignments, cmmunity service, r ther discretinary assignments. Cnfiscatin: Cnfiscatin f gds used r pssessed in vilatin f Institutin regulatins r cnfiscatin f falsified identificatin r identificatin wrngly used. Restitutin: Making cmpensatin fr lss, injury, r damage. Restrictin f Privileges: The denial r restrictin f specified privileges. Suspensin: Separatin f the student frm the institutin fr a defined perid f time, after which the student is eligible t return t the Institutin. Suspensin may include cnditins fr readmissin. Expulsin: The permanent separatin f the student frm the Institutin. Withhlding f Diplma r Degree: The withhlding f diplma r degree therwise earned fr a defined perid f time r until the cmpletin f assigned sanctins. 16

17 Interim Suspensin The Campus President r delegate may impse an immediate suspensin n a pending hearing befre the apprpriate disciplinary cmmittee if any f the fllwing apply: T ensure the safety and well-being f members f the Institutin cmmunity r t preserve the institutins prperty, T ensure the student s wn physical r emtinal safety and well-being, r If the student pses an nging threat f disrupting r interfering with the peratins f the institutin. During the interim suspensin, the student may be denied access t all Institutin activities r privileges fr which the student might therwise be eligible, including access t Institutin prperty. The student has a right t a prmpt hearing befre the Campus President r delegate n the questins f identificatin and whether the interim suspensin shuld remain in effect until the full hearing is cmpleted. Hearings and Appeals Any student charged with vilatin f the Cde shall have the pprtunity t receive a fair hearing upn submissin f an appeal petitining fr recnsideratin f their enrllment standing. The appeal must be in writing and must include an accurate and fair accunt f the actins that led up and included the vilatin. Upn receipt, the Appeal Review Bard shall prvide bth substantive and prcedural fairness fr the student r student rganizatin alleged t have vilated the Cde. The bard will determine the status f the appeal and will render a decisin as sn as practical, but n lnger than 30 days frm the date f receipt. Once a decisin is reached, the student r student rganizatin will be ntified f the decisin and if apprved, a plan fr cntinuance will be prvided t the student alng with the decisin. Otherwise, if the appeal is denied, the student will be terminated. Appearance Cde The Institutin Appearance Cde is established t prvide an atmsphere that enhances the prfessinal develpment f ur students and avids safety hazards while preventing disruptin t the learning prcess. The fllwing are the minimum standards while n campus: A. Attire: Lng sleeves must be wrn at all times in the lab area. 100% cttn material is required. B. Prtective Items: Prper eyewear must be wrn at all times in the lab area. C. Piercings: Wearing f earrings, psts, studs and dangling jewelry is nt permitted. Facial skin, tngue r bdy piercing rings, studs, psts, rnaments and chain wallets/belts are als prhibited. Delegatin f Authrity The Campus President r delegate shall implement this plicy, including publishing and distributing the Cde and the prcedures gverning the student disciplinary prcess at the Institutin. 17

18 DRUG AND ALCOHOL ABUSE PREVENTION PROGRAM Statement f Purpse The purpse f the Drug-Free Schls and Campuses Regulatins is t implement sectin 22 f the Drug-Free Schls and Cmmunities Act Amendments f 1989, which adds sectin 1213 t the Higher Educatin Act and Sectin 5145 t the Drug-Free Schls and Cmmunities Act. These amendments require that, as a cnditin f receiving funds r any ther frm f financial assistance under any Federal prgram, an institutin f higher educatin must certify that it has adpted and implemented a drug preventin prgram. As a result, Tulsa Welding Schl has implemented the fllwing drug preventin prgram, which applies t all students and emplyees. Plicy fr Prviding a Drug-Free Wrkplace A. Emplyees r students wh are fund in vilatin f this plicy will be given a letter f reprimand which will becme a part f their recrds until such time as said emplyee r student seeks and successfully cmpletes drug r alchl cunseling, rehabilitatin, r an assistance prgram. 1) Upn a secnd and subsequent vilatin f this plicy ccurring in r affecting the schl, the emplyee may be placed n prbatin r terminated dependent n the individual circumstances f the case. A student in this circumstance will be dismissed. 2) On the third vilatin f this act, the emplyee will be dismissed. C. Tulsa Welding Schl has established a drug-free awareness prgram with the lcal and state agencies t infrm emplyees and students abut: 1) The dangers f drug abuse in the wrkplace r n schl prperty. 2) Tulsa Welding Schl s plicy n maintaining a drug-free wrkplace. 3) The Schl s agreement t assist any emplyee r student wh is in need f drug cunseling, rehabilitatin, and assistance prgrams by direct r indirect referrals and prviding brchures t emplyees and students seeking help frm apprved agencies. 4) In additin, biannual meetings will be held lasting at least ne (1) hur in duratin fr speakers t assess the success f ur prgram. D. The persns s using are respnsible fr knwing f the pssible side effects f prescriptin and nn-prescriptin drugs they intend t use while wrking and must ntify their instructr r supervisr if such use culd affect their jb perfrmance, judgment, and physical reactin time. All prescriptins must be in the persn s name and must be carried in their riginal cntainers. There are many types f financial aid available fr thse qualifying applicants which include grants that dn t have t be paid back, as well as lwinterest, gvernment-backed lans that must be repaid. Federal Student Aid eligibility is based n individual student infrmatin and all students may nt be eligible fr all types f aid that is available fr applicatin. 35 NOTIFICATION OF RIGHTS UNDER FERPA The Family Educatinal Rights and Privacy Act (FERPA) affrds students certain rights with respect t their educatin recrds. These rights include: I. The right t inspect and review the student's educatin recrds within 45 days f the day the schl receives a request fr access. a) The student, r in the case f the student being a minr, the parent, shuld submit t the registrar r ther apprpriate fficial, a written request that identifies the recrd(s) the student wishes t inspect. b) The schl fficial will make arrangements fr access and will ntify the student f the time and place where the recrds may be inspected. c) If the recrds are nt maintained by the schl fficial t whm the request was submitted, that fficial shall advise the student f the crrect fficial t whm the request shuld be addressed. II. The institutin is nt required t recrd the disclsure f such infrmatin in the student s file. Further, if the institutin has prvided this infrmatin in gd faith in cmpliance with an ex parte rder issued under the amendment, it is nt liable t any persn fr the disclsure f infrmatin. c) The schl disclses infrmatin frm a student s educatin recrds withut the written cnsent r knwledge f the student r parent in rder t cmply with a lawfully issued subpena r curt rder in the fllwing three cntexts: i. Imminent danger t student r thers must be present. e) The schl disclses infrmatin frm a student s educatin recrds withut the written cnsent f the student r parent "directry" infrmatin, such as a student's name, address, telephne number, date and place f birth, hnrs and awards, and dates f attendance. Hwever, schls must tell eligible students and parents abut directry infrmatin and allw eligible students and parents a reasnable amunt f time t request that the schl nt disclse directry infrmatin abut them. Schls may nt, hwever include certain directry infrmatin, such as scial security numbers, citizenship status, gender, ethnicity, religius preference, grades, GPA, and daily class schedule. IV. The right t file a cmplaint with the U.S. Department f Educatin cncerning alleged failures by the schl t cmply with the requirements f FERPA. 37 STUDENT GRIEVANCE PROCEDURE Statement f Purpse The primary bjectives f this Student Grievance Prcedure are t ensure that students have the pprtunity t present grievances t the Institutin regarding a certain actin r inactin by a member f the Institutin. The Institutin has a cnsistent way f reslving thse grievances in a fair and just manner. A student may pursue a grievance if he r she believes that a member f the Institutin has vilated his r her rights. This Student Grievance Prcedure applies t all frmal grievances. The definitin f a grievance is vilatin f written campus plicies, prcedures, r arbitrary, capricius, r unequal applicatin f written campus plicies r prcedures. Infrmal Reslutin Prir t invking the prcedures described belw, the student is strngly encuraged, but is nt required, t discuss his r her grievance with the persn alleged t have caused the grievance. The discussin shuld be held as sn as the student first becmes aware f the act r cnditin that is the basis f the grievance. Additinally r in the alternative, the student may wish t present his r her grievance in writing t the persn alleged t have caused the grievance. In either case, the persn alleged t have caused the grievance must respnd t the student prmptly, either rally r in writing. Initial Review If a student decides nt t present his r her grievance t the persn alleged t have caused the grievance r if the student is nt satisfied with the respnse, he r she may present the grievance in writing t the directr r designee f the department r area where the persn alleged t have caused the grievance is emplyed. Any such written grievance must be received by the directr n later than 30 calendar days after the student first became aware f the facts that gave rise t the grievance. If the grievance is against the directr f a department r area, the student shuld address his r her grievance t the next level directr, Campus President, r apprpriate authrity. The directr shuld cnduct an infrmal investigatin as warranted t reslve any factual disputes. Based upn the results f directr s investigatin, the directr shall make a determinatin and submit his r her decisin in writing t the student and t the persn alleged t have caused the grievance within ten calendar days f cnclusin f their investigatin. The written determinatin shall include the reasns fr the decisin, shall indicate the remedial actin t be taken if any, and shall infrm the student f the right t seek review by the Campus President r designee. Appeal Prcedures Within ten calendar days f receipt f the directr s decisin, a student wh is nt satisfied with the respnse f the directr after the initial review may seek further review by submitting the written grievance, tgether with the directr s written decisin, t the Campus President r designee. Within 15 calendar days f receipt f the request fr review, the Campus President shall submit his r her decisin in writing t the student and t the persn alleged t have caused the grievance. The written dispsitin shall include the reasns fr the decisin, and it shall direct a remedy fr the aggrieved student if any. 37
