There being a quorum present, the Chair called the meeting to order at 9:00 a.m. Announcements and Introductions The Chair excused Mr. Inafuku and Dr. Ma and asked the audience to introduce themselves.

Approval of the Previous Minutes May 16, 2013 The Chair called for a motion in regards to the minutes of the May 16, 2013 meeting. There being no amendments, upon a motion by Mr. Lau, seconded by Ms. Kumasaka, it was voted on and unanimously carried to approve the minutes for the May 16, 2013 meeting as circulated. Vice Chair s Report: Report on Attendance at the National Association of Boards of Pharmacy (NABP) 109 th Annual Meeting The Vice Chair reported on his attendance at the National Association of Boards of Pharmacy (NABP) 109 th Annual Meeting in St. Louis. The meeting started with the topic of CE s. Some CE s discussed were about wholesaling, compounding, veterinary medicine, and virtual wholesaling and pill mills. Most of the CE information was to get members of the Boards to know the difference between manufacturing and compounding. There was a CE by a company called Legit Scripts that tries to certify that online CE s are true and legitimate and if they are not, they try to shut them down. There were veterinarian CE s with some veterinarians and a pharmacist in attendance that specializes with veterinary medicine. The discussion pushed for pharmacist to dispense veterinary medications and understand that animals are different than people. The other CE topic of virtual pharmacies discussed how some pharmacies are washing invoices and putting new medications on them so they can pedigree those medications and then sell them. One example used was about an ophthalmologist who was stock buying avastin from the wholesaler. The wholesaler told the state board, who then did some inspections, got some information from the office manager and discovered the avastin was coming from Canada through Turkey. They found the invoices were washed and there was a pedigree on the invoice that looked like it was from one of the big distributors. When they went through everyone who was involved with this they found it was $440 million dollars worth of medications. The EO asked does that mean these medications may not have been FDA approved. The Vice Chair stated yes, they may have been approved in other countries but not by the FDA. In closing, the Vice Chair reported on three business meetings. You attend a business meeting every day. In the meetings they talked about resolutions and changes to the model act and the constitution for the Board of Pharmacy. There were seven resolutions this year; they were sterile compounding inspections, five percent transfer rule, task force for laws in each state regarding PBM s, NABP and FDA partnership regarding electronic records, prescription quota s, nurses doing compounding in hospitals and finally, the definition of manufacturing and compounding.

3 Board of Pharmacy Minutes of the June 20, 2013 Meeting Page 3 Executive Officer s Report on Attendance at the Hawaii Rx Drug Summit 2013 Report: The EO reported on her attendance at the 2013 Hawaii Rx Drug Summit at Dole Cannery. Keith Komida was one of the speakers; they also had speakers from the Dept. of Health. Some of the topics were workers compensation, abuse of opioids, addictions to pain medications and physician dispensing. They talked about how they have discovered teenagers and young adults have what are called skittle parties, where they put different medications into a large bowl and each individual takes a random pill out of the bowl. Correspondence: NABP NABP Newsletter The Chair reported on the following articles: NABP Supports Federal Legislation Creating New Category of Manufacturer Under FDA Oversight, While Maintaining Board of Pharmacy Authority Over Compounding Pharmacies NABP expressed support of draft legislation that would create a new category of manufacturer to include entities that engage in large-scale production of sterile non-patient specific drugs for distribution to be designated as compounding manufacturers. The NABP supports the clear separation of traditional pharmacy compounding from the activities of a compounding manufacturer. The NABP also raised concerns that granting FDA access to pharmacy records for activities, including compounding, that are regulated by the states could create jurisdictional conflicts and impede the states from investigating or prosecuting a case if the FDA has seized needed evidence. Products Produced by The Compounding Shop Should be Quarantined Due to Lack of Sterility Assurance, Warns FDA Preliminary findings from a recent inspection of The Compounding Shop facility raised concerns about a lack of sterility assurance which resulted in an FDA warning for medications produced and distributed by The Compounding Shop should not be administered to patients and should be quarantined. Colorado Deploys NABP PMP InterConnect; 15 State Now Sharing PMP Data The Colorado Electronic Prescription Drug Monitoring Program has now deployed the NABP PMP InterConnect, bringing the total number of live participating state prescription monitoring programs to MPJE Item Pool Review The Chair stated that he was informed by the NABP that he could participate in the upcoming MPJE Item Pool Review in September even though he will no longer be a Board member. The EO asked Mr. Lau if he was also able to attend since both he and the Chair have done this in the past. Mr. Lau said he would be able to attend.

4 Board of Pharmacy Minutes of the June 20, 2013 Meeting Page 4 NABP News Roundup May 2013 The Chair reported on the following articles: The Missouri Board of Pharmacy recently promulgated 20 CSR , which establishes new requirements for prescription delivery. Under the rule, pharmacies are required to develop and implement written policies and procedures to ensure the safe and appropriate delivery of prescription drugs within the temperature requirements recommended by the manufacture or the United States Pharmacopeia (USP). Oregon licensed pharmacists are required to complete a one time, one hour training module provided by the Oregon pain Management Commission (OPMC). OPMC members have worked to improve the pain management information included in the training, Advancing Pain Management in Oregon. Approximately 30% of the information included in the updated module is new information. New topics include pain assessment, appropriate standards of care for use opioids in pain management, universal precautions in pain medicine; modifiable life factors that affect each other and pain; dentists and pain management; health care professional communication with clients and other providers and health care professional ethical obligations. House bill 2312 passed during the 2013 Virginia General Assembly amends several sections of law affecting pharmacy. In addition to clarifying the definition of compounding, the bill requires the pharmacist-in-charge or owner of a permitted pharmacy or a registered nonresident pharmacy engaging in sterile compounding to notify the Virginia Board of Pharmacy of its intention to dispense or otherwise deliver a sterile compounded drug product into the commonwealth. Request for Prescription Format and Requirements, Megan Charette The Chair asked the Vice Chair to lead the discussion on an inquiry from Ms. Charette. The Vice Chair read the and after some discussion, it was the consensus of the Board to respond to Ms. Charette s questions as follows: 1. Does the state of Hawaii require all prescriptions (both controlled and non-controlled substance) to be printed on tamper-resistant paper? Not specified in pharmacy laws/rules. 2. Is the state law different than the Federal Medicaid Tamper-Resistant Prescription Requirements? The Hawaii pharmacy laws/rules do not address tamper-resistant prescriptions. 3. Do all prescriptions require a manual/hand written signature of the prescribing practitioner? No, pursuant to Hawaii Revised Statutes , electronic prescriptions may include a unique identifier other than the original signature of the prescriber. Oral prescriptions also do not require a signature. 4. Are there any format requirements for a printed prescription? i.e. position requirements of a state Rx logo, signature lines etc.? Hawaii Administrative Rules lists the criteria for a "valid" prescription. 5. Does the prescription, printed and sent electronically through Office Ally s EHR 24/7 program, need to be certified or approved through the state of Hawaii? No.

Questions for prescription requirements for controlled substances should be referred to the Department of Public Safety, Narcotics Enforcement Division. eprescribing for SNFs and ALFs, Yuliya Pruzhanskaya The Chair asked Mr. Lau to lead the discussion on the inquiry from Ms. Pruzhanskaya. Mr. Lau read the and after some discussion, it was the consensus of the Board to respond to Ms. Pruzhanskaya s questions as follows: 1. Does the Hawaii State BOP require an approval process for Skilled Nursing Facility Electronic Health Records that allow their SNF clients to electronically send noncontrolled substance prescriptions to the pharmacy software? NO. If so, what is the process? 2. We provide EHRs for Assisted Living facilities. Are our AL clients allowed to electronically send orders that were put in by nurses as agents of the physician into the AL EHR? Pursuant to Hawaii Revised Statutes , prescription information can be communicated between the prescriber's authorized agent and pharmacies. If pharmacy can t fill until they receive something from physician, might there still be a benefit to electronically sending the order to the pharmacy software? Compounded Drugs for Veterinarians, Angel Jung The Chair asked Ms. Kumasaka to lead the discussion on the from Ms. Jung. After some discussion, it was the consensus of the Board to refer this matter to their Laws and Rules Committee for further discussion and research, and to report back to the Board with a recommendation. Distribution of Manufacturer Drug Samples and Discount Mechanisms, Rachel Garrison The Chair lead the discussion on the from Ms. Garrison and after some discussion, it was the consensus of the Board to respond to the questions as follows: Sample Distribution 1. Has the state of Hawaii enacted statutes and/or regulations that govern the distribution of prescription drug samples (legend and/or controlled substances) by mail to health care practitioners? No. Pharmacy laws and rules do not specifically address the "delivery" on how the distribution of manufacturers drug samples are provided to health care providers. If yes, can you provide a citation to the statutes and/or regulations? 2. Has the state of Hawaii enacted statutes and/or regulations that govern the distribution of prescription drug samples (legend and/or controlled) by a pharmaceutical representative to health care practitioners? No. Current pharmacy laws exempt

6 Board of Pharmacy Minutes of the June 20, 2013 Meeting Page 6 manufacturer's representative from obtaining a permit to distribute drug samples directly to practitioners authorized to receive such samples. If yes, can you provide a citation to the statutes and/or regulations? Hawaii Revised Statutes Are pharmaceutical companies permitted to distribute drug samples (legend and/or controlled) by mail and/or pharmaceutical representative to health care practitioners? The distributions of drug samples by manufacturers representatives are exempt from our wholesale distribution laws/rules. See Hawaii Administrative Rules , under the definition of "Wholesale distribution". Alternatives to Sampling 1. Has the state of Hawaii enacted statutes or regulations that govern the distribution of the following discount mechanisms with respect to prescription drugs (legend and/or controlled): - Coupons (discount at point of sale) - Vouchers (free/limited supply of product) - Rebates (patient/consumer submission of manufacturer rebate for complete reimbursement after point of sale) - Discount/debit card - Other discount mechanisms for prescription drug If yes to any of these can you provide a citation to the statutes and/or regulations? The pharmacy laws and rules do not address this. 2. Does the state follow federal law in the absence of state law regarding the distribution of samples and/or alternatives to sampling? Yes. 3. Who should I contact for more information regarding sample distribution and/or alternatives to sampling? You may contact the Hawaii State Department of Public Safety, Narcotics Enforcement Division at (808) for information on drug samples of controlled substances and the Hawaii State Department of Health, Food and Drug Branch at (808) The Medicine Shoppe Dispensing Medical Products, Randee VanNess The Chair asked the Vice Chair to lead the discussion on an inquiry from Ms. VanNess asking what kind of license/permit is required in order to sell/ship medical products to customers in our State. The Vice Chair read the and stated that any out-of-state pharmacy who wants to dispense a prescription drug or device directly to the end user/patient in this State, must obtain a miscellaneous permit as an out-of-state pharmacy. The Board agreed.

7 Board of Pharmacy Minutes of the June 20, 2013 Meeting Page 7 Restricted Distribution and Revenue Sharing Between Veterinarians and Pharmacies, Gordon Magee The Chair asked Mr. Lau to lead the discussion on Mr. Magee s . Mr. Magee writes that he attended the NABP annual meeting in St. Louis and wanted to reach out to the Board with some pet medication issues that he believes are important. His concerns fell into two primary areas: The drug manufacturer practice of restricting distribution of prescription and nonprescription pet medications, preventing fully licensed pharmacists from acquiring them to sell. The practice of pharmacies and veterinarians sharing prescription revenues, a practice discouraged in human medicine. The Board discussed and acknowledged Mr. Magee s concerns. Out-of-State DME, Rosemary Berkowitz The Chair read Ms. Berkowitz s June 3, 2013 letter explaining the activities of Medical Solutions Supplier that provides specialty durable medical equipment, including venous and arterial compression pumps and garments. Ms. Berkowitz also stated that they have several licenses and permits in several states that allow them to distribute/dispense their medical equipment directly to the patient. After some discussion, it was the consensus of the Board that this activity may require a miscellaneous permit if they are dispensing a prescription drug or device directly to the end user/patient. Out-of-State Pharmacy Compounding for Office Use, Lois Nash It was the consensus of the Board to refer this matter to their Laws and Rules Committee for further discussion and research and to report back to the Board with a recommendation. Storage of Medications in a Beauty Salon, Debbie Gonzales The Chair read the from Ms. Gonzales in which she asks if there are any rules, regulations or health concerns for the storage of medications in a beauty salon. According to Ms. Gonzales, the drugs will be kept in a medication cart in their original package from the pharmacy but they are unsure if the fumes from dyes and perms may be an issue with the medications. The EO stated that she spoke with Ms. Gonzales because more information was needed for clarification. She stated that the beauty salon was in a care home that did not have a pharmacy on the premises and that the care home wanted to store the medication cart in the salon. The medication cart contains both OTC and prescription drugs, including controlled substances which are double locked in the cart.

8 Board of Pharmacy Minutes of the June 20, 2013 Meeting Page 8 After some discussion, it was the consensus of the Board that since the pharmacy had already dispensed the drugs to the care home, it becomes the responsibility of the facility, not the pharmacy but that the Board would recommend that if the care home had any questions on the storage of certain drugs, to discuss the matter with their servicing/consulting pharmacy. Old Business: HAR Title 16, Chapter 95 Status Report The EO stated that she will try to meet with the DAG before the next Board meeting. Open Forum: A guest had a question about non-legend drugs, for example vitamins, that are dispensed by a compounding pharmacy or manufacturers and are unlikely to be misused. She asked where these fell into the realm of prescription and non-prescription. Greg Edward from the Dept. of Health, Food and Drug Branch answered the question stating if the FDA has deemed that product to be dispensed only pursuant to a prescription, then the pharmacy can only dispense the product upon the receipt of a patient specific prescription. Applications: Ratification List The Chair stated that one of the pharmacies listed on the ratification list for the in-state pharmacies did not include a business address. Upon a motion by the Chair, seconded by the Vice Chair, it was voted on and unanimously carried to approve the attached ratification lists, except for PHY 833 which did not include a business address. Executive Session: At 10:17 a.m., upon a motion by Mr. Lau, seconded by the Vice Chair, it was voted on and unanimously carried to move into executive session pursuant to 92-5(a)(1) and (4), HRS, to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in section 26-9 or both; and To consult with the Board s attorney on questions and issues pertaining to the board s powers, duties, privileges, immunities, and liabilities;. At 10:24 a.m. upon a motion by Mr. Lau, seconded by Ms. Kumasaka, it was voted on and unanimously carried to move out of executive session. Chapter 91, HRS, Adjudicatory Matters: At 10:24 a.m., the Chair called for a recess from the Board s meeting to discuss and deliberate on the following adjudicatory matters, pursuant to Chapter 91, HRS: In the Matter of the Miscellaneous Permit of MED QUEST PHARMACY, PHA L, Settlement Agreement Prior to filing of Petition for Disciplinary Action and Board s Final Order; Exhibit 1 Upon a motion by the Vice Chair, seconded by Ms. Kumasaka, it was voted on and unanimously carried to accept the Board s Final Order.
