1 + D I N BVRG H + THE CITY OF EDINBURGH COUNCIL Lochend Care Home The Executive of the Council 31 January 2006 I Purpose of report 1.I To outline to the Executive the options available to the Council for the operation of the new Lochend Care Home and to recommend that this new Care Home is operated by the Council. 2 Summary 2.1 The Council is commissioning four new care homes (240 places) for older people, as part of the Joint Capacity Plan for older people's accommodation in the city. 2.2 This report relates to the first new care home at Restalrig Drive, Lochend, Edinburgh, which is due for completion in March It considers the options for running this care home, based on the criteria of continuity and quality of care, costs and timescale, and recommends that Lochend Care Home is operated by the Council. 3 MainReport Background 3.1 The business case for 240 additional care home places (in four new care homes) for older people, was agreed by the Council Executive and the Board of NHS Lothian in September On 27 January 2004, the Executive agreed that the first new 60-bedded care home would be constructed at Restalrig Drive, Lochend. On 8 November 2005 the Executive of the Council approved the appointment of a contractor for Lochend, with the estimated completion date of March Full occupancy is estimated at 6-8 weeks after completion date. 3.3 The Council is currently leasing and operating two interim care homes at Kirklands House and Greenfield Park. These homes have a total capacity of 52 places. The residents in these care homes have been advised that they will move to the new Lochend Care Home when it opens. Staff have been given the same assurances. 3.4 It is currently estimated that the second care home at Craigmillar will become fully operational by July 2007, with the construction of the remaining two homes by late 2008/early The completion of the remaining two homes is,

2 however, dependent on the availability of suitable sites. The process to select an external organisation to operate and maintain the new care homes is subject to the EU contract regulations which restrict the length of the contract to five years. Tender documents are due to be issued to the four short-listed bidders within the next few weeks to ensure that the contract is in place for the opening of the first care home in Options for operating Lochend Care Home 3.5 The following options have been considered and appraised: Option I : Include Lochend within the tender for the operation of the series of care homes (240 places) This option would include Lochend in an overall 240-bed contract for care and facilities management (FM). The advantage of this option is that it could maximise market interest in the wider project by offering economies of scale for the provision of all 240 places. However, this is unlikely to follow through in cost advantages with regard to staff costs - legal advice given indicates that TUPE rules would apply to any existing staff transferring from the Council s two interim care homes. Moreover, the Scottish Executive Staffing Protocol also applies to any staff outwith the scope of TUPE -this is to avoid a 2-tier workforce, in terms of pay and conditions of service. This could be managed by re-deploying staff from the interim homes within the existing CEC care home sector, with an entirely new staff team recruited by an external provider, but this would negatively affect continuity of staffing and care for the transferring residents (see 3.3 above). It could also slow down the transfer of these residents - timing is critical due to the short period available to transfer residents from the interim care homes to Lochend. Despite the best intentions of any successful external provider, difficulties in staff recruitment could delay the opening of Lochend - registration with the Care Commission would not be granted if the unit was not suitably staffed. An additional factor is that process of registration with the Care Commission should be commenced at least 6 months before operation. It is anticipated that the contract for operating the subsequent care homes will not be fully concluded until December this would constitute an additional risk on the home being fully operational by the projected date of May Option 2: Tender only for the Facilities Management of the care home and provide the care service in-house This option would not be compatible with the procurement process for the other three care homes.

3 Option 3: Provision of both the care service and FM services by the Council The welfare of the residents transferring to Lochend is paramount and continuity of care is known to be crucially important for the wellbeing of vulnerable older people. Operating the Lochend Care Home in-house would keep faith with the commitment given to residents of the Council s two interim care homes that they would move, together with their staff group, to Lochend. It would also reduce the risk of delay in getting the new care home fully operational - residents could be better supported and prepared, and moved more quickly with a staff team who already know them and can meet their needs. Additional staff recruitment would also be minimised, reducing the risk of delays arising from any recruitment difficulties. The possible risks associated with the option of running Lochend in house relate in the main to costs. A public sector comparator figure has been established for Lochend, but clearly it has not yet been possible to measure this against any external bids for a similar care home as none have yet been received. It is therefore not possible to say whether any external bid price would be lower or higher than the public sector comparator. Operating Lochend in-house would however enable benchmarking to take place, over a longer period, against the successful tenderer for the other 3 care homes Having considered the three options against the criteria of commitments given to continuity, quality of care for and welfare of residents, timescales and cost, it is recommended that the Council operates Lochend Care Home in-house, and that the care and facilities management of care homes 2, 3 and 4 are subject to the tendering process described in 3.4 above. Financial Implications The revenue costs of Lochend can be contained within the Departmental budget for Homes for Older People. This includes the transfer of all budgets for the Kirklands House and Greenfield Park Interim Care Homes, which will close when Lochend opens. Recommendation It is recommended that the Executive: 5.1 agrees that Lochend Care Home is operated by the Council. Director of Health
