1 Office of Global Education California State University San Marcos San Marcos, California USA Tel: (760) ; Fax: (760) FOREIGN STUDY PROGRAM, SUMMER IN SPAIN 2016 FOREIGN STUDY AGREEMENT AND RELEASE CALIFORNIA STATE UNIVERSITY SAN MARCOS AND STUDENT This Agreement is entered into by and between the State of California through the Trustees of the California State University on behalf of the California State University San Marcos, hereinafter referred to as University, and Participant, hereinafter referred to as Student. University and Student and (if Student is under 18) Parent or Guardian agree as follows: 1. Student shall qualify for admission in the Summer in Spain 2016 Program, hereinafter referred to as "Program," at the University by satisfying all requirements, and paying all fees. University shall enroll Student in the Program if Student otherwise qualifies for enrollment and shall provide appropriate academic credit for the courses that Student successfully completes. 2. Student acknowledges that he/she has been apprised of the academic requirements of the Program and agrees that he/she shall expend his or her best efforts in successfully completing the academic requirements. 3. Student will be enrolled at the University of Valladolid and receive credit from that institution. Upon successful completion of the Program, the University of Valladolid will issue a transcript for Student to CSUSM, which will record the credit and grades for Student. University credit will be recorded as transfer credit. 4. University plans to offer the courses set forth in Attachment A, which by this reference is incorporated as part of this Agreement. University reserves the right to cancel or add courses or to change the academic format of courses at its discretion where student interest, availability of adequate faculty or resources, insufficient enrollment (as determined by University) or other relevant criteria indicate that such cancellation, addition, or change may be appropriate. 5. Student will pay US $2,995 1 to University for University of Valladolid instruction and services, twenty-eight (28) nights single room and meals in host family locations, health insurance, and all CSUSM fees. Optional field trips and extracurricular activities may be arranged by the University of Valladolid, and students electing to participate will be responsible for paying for these optional activities. 6. University shall make necessary arrangements with the University of Valladolid to provide student with host families, who will provide room and full board. 7. Should University not be successful in making the necessary arrangements for the Program, University shall immediately notify Student and shall return all monies received. University shall not be responsible for any penalties incurred by Student in connection with travel reservations. Upon return of such monies to Student, all rights of University and Student under this Agreement are expressly waived. Circumstances that may prohibit the necessary arrangements from being made include, but are not limited to, the failure of a sufficient number of students to enroll (as determined by the University). 8. University reserves the right to terminate the program if the health or safety of the participants is deemed to be at risk. Reasons for such termination include, but are not limited to, U.S. Department of 1 Amount may vary on date of final payment depending on currency fluctuation. 9/15
2 State Travel Warnings for the Program location, outbreaks of contagious diseases at the Program location, or where they might reasonably affect Student, acts of war or terrorism that could affect Student. In the event of such termination, University will make all reasonable efforts to assist Student to return home. In the event University terminates the Program at any time before the end of the Program, any refund made by the University in its discretion shall not include those amounts that have been expended or committed to be expended for the Program, nor may such refund include nonrefundable costs. University will make all reasonable efforts to allow students to earn credit for the terminated program. 9. University reserves the right to alter or change the schedule, itinerary, or the accommodations for room and board when acts, occurrences or events make it necessary or desirable, in the discretion of University, to make the modification. 10. Payments made pursuant to this Agreement do not include any items not expressly identified in Paragraph 5 above, such as airfare, passport fees, expenses for immunizations, medical examination, and insurance of various types, excess baggage charges, laundry, food and beverages not included in homestay, telephone expenses, transportation from home to point of departure and return, tips, personal transportation in Spain, porter services, or optional tours. 11. Except as otherwise provided in this Agreement, any refund may be made at the sole discretion of the University. In the event Student cancels participation in the Program at any time after final payment and before the end of the Program, any refund made by the University in its discretion shall not include those amounts that have been expended or committed to be expended for the Program, nor may such refund include nonrefundable costs. 12. Student acknowledges that the insurance provided as part of the Program and included in the Program fee only covers Student during the period of participation in the Program. University shall not be liable for any medical coverage required prior to or after completion of Program. 13. The Program involves travel to Spain. If Student is a U.S. citizen, he/she shall obtain and have in his/her possession a passport. If Student is not a citizen of the U.S. he/she shall be responsible for having a passport from country of citizenship and any visas required by Spain. 14. Student shall properly conduct himself or herself at all times during the course of the Program. Student understands that he/she will be expected to show sensitivity to the host culture, demonstrate culturally appropriate behavior, and observe local rules and laws. Student shall obey all applicable laws of the host country/countries and shall hold University blameless and not responsible for any liability or consequences caused by Student s violation of law. 15. Conduct that will subject Student to student discipline is specified in Title 5, California Administrative Code, Sections and In the event the Program Supervisor determines, after informing Student of an alleged violation and discussing it with him or her, that Student has violated a student conduct regulation, the Supervisor may terminate Student from the Program. Such termination shall not affect the obligation under the Agreement to pay to University an amount due University pursuant to this Agreement nor shall University be required to refund any payment that has been made. However, University may make such refunds as are consistent with Board of Trustees policy. 16. Student hereby grants the University, and its agents, full authority to take whatever actions they may consider to be warranted under the circumstances regarding Student s health and safety, and fully releases them from any liability for such decisions or actions as may be taken in connection therewith. Student authorizes the University and its agents, at their discretion, to place him/her, at his/her own (or parents ) expense, and without further consent, in a hospital within or outside the United States for medical services and treatment, or, if no hospital is readily available, to place Student in the hands of local medical doctor for treatment. If deemed necessary or desirable by the University or its agents, Student authorizes them to transport Student back to the United States, by commercial airline or
3 otherwise, at his/her (or parents ) expense for medical treatment. If possible, such evacuation shall be under the terms of the insurance provided by the program. 17. Student understands that medical evacuation and repatriation of remains are covered by the Program insurance, but only if arranged by the insurance provider. No arrangement for evacuation or repatriation should be made on behalf of the student without first consulting University officials responsible for the Program. 18. The University is not responsible for Student s welfare during periods of independent travel or during absences from the program. 19. Student releases, holds harmless and agrees to indemnify the University and its agents with regard to any financial obligations or liabilities that he/she personally incurs, or any damage or injury to the person or property of others that he/she may cause or be accused of causing, while participating in the Program. 20. In the event the University or its agents advance or loan any monies to Student or incurs special expenses on Student s behalf while abroad or in relation to the Program abroad, Student agrees to make immediate repayment. 21. Student understands that he/she cannot expect and may not receive the same services and conditions abroad that are normally enjoyed while at the University campus. 22. All references in this Agreement and Release to University and agents shall include California State University San Marcos and all of its officers, directors, staff members, campus directors, counselors, group leaders, employees, agents and affiliated institutions and organizations. All references herein to the parents of the Student shall include legal guardian or other adult responsible for the applicant. 23. This Agreement is subject to all applicable laws and regulations. If performance of this Agreement involves violation of applicable law or regulation thereby making it legally impossible to perform and such illegality is not the fault of Student, University shall refund to Student all fees paid pursuant to this Agreement as authorized in Section of Title 5 of the California Administrative Code. Upon payment of said refund, all rights of University and Student, are expressly waived under this Agreement. 24. Student agrees that the State of California, the Trustees of California State University, San Marcos, and each and every officer, employee, authorized volunteer, and agent of each of them (hereafter in this paragraph collectively referred to as the State) shall not be responsible for any injury, damages or loss to Student or Student s property which occurs from any cause beyond the control of the State or which does not occur from the sole negligence of the State. Student further agrees to hold harmless, defend and indemnify the State from any and all claims, injuries, damages, losses, causes of action and demands and all costs and expenses incurred in connection therewith (hereafter in this paragraph collectively referred to as liability) resulting from or in any manner arising out of or in connection with any negligence on the part of the Student, his or her agents, or employees, in the performance of this Agreement, irrespective of whether such liability is also due to negligence on the part of the State. 25. This Agreement contains the sole and entire Agreement between University and Student and shall supersede any and all other agreements between the parties. University and Student acknowledge and agree that any statements or representations that may have heretofore been made by either of them to the other are void and of no effect and that neither of them has relied thereon in connection with his or her or its dealings with other. No alteration or variation of the terms of this Agreement shall be valid unless made in writing and signed by the parties hereto.
4 26. The laws of the State of California shall govern the interpretation of this Agreement.
