2 3334 Golfing Green Drive, Farmers Branch, TX ACADEMY REGISTRATION & RELEASE FORMS THIS ACADEMY REGISTRATION ( Registration ) is made by undersigned adult, as parent or legal guardian (the Responsible Party ) of the below listed minor (the Student ) to register the Student in the Academy of Tennis Training (the Academy ) at (the Club ). I. CLASSES. This Registration* is for HIGH PERFORMANCE, ACADEMY PREP, EARLY CHILDHOOD, TENNIS & SWIM CAMP (Please check one) *During the course of training a student may change classes upon meeting performance or/and age criteria at academy coaches discretion only. II. PAYMENT. A. Fees. Responsible Party agrees to pay class fees per each class during a session attended by the Student as set forth in the Schedule of Classes, and other fees described below. B. Payment. Balance Due must be paid BEFORE the end of the session attended by the student. C. Delinquency. Class fees and other charges not paid by non-members when due will be considered delinquent and subject to a $25.00 administrative fee and other applicable finance charges. III. RELEASE AND INDEMNITY AGREEMENT. The Responsible Party acknowledges that a Release and Indemnity Agreement executed by the Responsible Party is a necessary precondition of this Registration. IV. CODE OF CONDUCT. By signing below, the Responsible Party acknowledges that the Responsible Party has read the Academy Code of Conduct (the Code ). Further, the Responsible Party agrees that the Student and any other member of the Responsible Party s family will abide by the Code during the Student s participation in the programs of the Academy. VI. RULES AND REGULATIONS. The Responsible Party agrees that the Student and the Responsible Party will abide by the Rules and Regulations of the Academy and the Club as promulgated and amended from time to time. 3 3334 Golfing Green Drive, Farmers Branch, Texas RELEASE AND INDEMNITY AGREEMENT THIS RELEASE AND INDEMNITY AGREEMENT ( Release ) is made by the undersigned adult, as parent or legal guardian (the Representative ) of the below listed minor (the Participant ), to release and indemnify FREER INCORPORATED, a Texas corporation ( Freer ), and BROOKHAVEN COUNTRY CLUB, INC., a Texas corporation, its parent company, affiliated subsidiary companies, and all their respective officers, directors, agents, contractors, employees, heirs, successors, and assigns (collectively, the Club ), as set forth below. I. ACTIVITY. Representative, on Participant s behalf and on behalf of the other members of Representative s family, including Representative s spouse, parents, children, heirs and assigns, (singularly and collectively referred to as Representative ) hereby grants to Freer and the Club this full release and indemnification as consideration in exchange for permitting Participant to participate in the Program(s) of the Academy of Tennis Training ( Academy ), which includes, but is not limited to, (i) receiving tennis lessons both on and off the tennis courts (Courts), (ii) receiving physical training both on and off the Courts and in the athletic facilities of Freer and the Club, (iii) participation in matches both on and off the premises of the Club, inclusive of transportation thereto (inclusive of matches out of the Dallas Metroplex Area and out of the State of Texas), as well as (iv) participating in any and all recreational and social activities with the Academy and which are sponsored by Freer and the Club ( Activity ). II. III. IV. Activity is provided as a convenience to the members of the Club. Representative agrees to read and cooperate with any and all rules and policies of the Activity, and understands that any and all sick or disciplinary rules shall be enforced at the discretion of the Activity staff. Club policy prohibits children under the age of 12 from remaining unsupervised by a parent or guardian outside of their program times. Children under 12 will not be allowed to travel alone on property transportation. When minors are being transported on or off property, they must be accompanied by a parent/guardian or by a person the parent or guardian deems responsible. Representative, on Participant s behalf, is entering into this Release after (i) having viewed or having the opportunity to view the premises of the Club, the equipment of Freer and the Club, and the qualifications of the Academy Coaching Staff; and (ii) having the opportunity to receive a full explanation of the Activity and the risks associated with the Activity. RELEASE AND INDEMNITY. A. REPRESENTATIVE PERMITS PARTICIPANT TO PARTICIPATE IN THE ACTIVITY WITH FULL KNOWLEDGE, UNDERSTANDING AND APPRECIATION OF THE RISKS OF INJURY INHERENT IN ANY PHYSICAL EXERCISE, MASSAGE OR THERAPY PROGRAM, PHYSICAL ACTIVITY OR ATHLETIC ACTIVITY, AND EXPRESSLY ASSUMES ALL RISKS OF INJURY AND EVEN DEATH WHICH COULD OCCUR BY REASON OF PARTICIPANT S PARTICIPATION IN THE ACTIVITY. B. REPRESENTATIVE AGREES TO RELEASE, INDEMNIFY, DEFEND, AND HOLD HARMLESS, AT REPRESENTATIVE S SOLE COST, FREER AND THE CLUB FROM ANY CLAIM FOR LOSS, COSTS, DAMAGES, OR EXPENSES, ARISING FROM DEATH, BODILY INJURY, OR ANY OTHER DAMAGE TO PERSONS OR PROPERTY, INCLUDING LOSS OR THEFT OF PROPERTY THAT OCCURS BY REASON OF PARTICIPANT S PARTICIPATION IN THE ACTIVITY, OR IS CAUSED BY: i. THE NEGLIGENT ACTS OR OMISSIONS OF FREER OR THE CLUB; OR, ii. THE NEGLIGENT, GROSSLY NEGLIGENT OR INTENTIONAL ACTS OR OMISSIONS OF REPRESENTATIVE, PARTICIPANT, REPRESENTATIVE S GUEST(S), OR PARTICIPANT S GUEST(S); iii. THE NEGLIGENT, GROSSLY NEGLIGENT OR INTENTIONAL ACTS OR OMISSIONS OF ANY THIRD PARTY PARTICIPATING IN THE ACTIVITY; OR, iv. ANY CONDITIONS EXISTING ON THE PREMISES INCLUSIVE OF EQUIPMENT WHETHER CAUSED BY THE INADVERTENT, NEGLIGENT, GROSSLY NEGLIGENT OR INTENTIONAL ACTS OR OMISSIONS OF FREER OR THE CLUB, OR, v. ALL PERSONAL PROPERTY BROUGHT TO THE ACTIVITY, IS BROUGHT AT THE SOLE RISK OF PARTICIPANT AS TO ITS THEFT, DAMAGE, OR LOSS. C. REPRESENTATIVE, BY SIGNING BELOW, CERTIFIES THAT REPRESENTATIVE FULLY UNDERSTANDS THAT THIS RELEASE WILL PROVIDE AN ABSOLUTE DEFENSE TO ANY LAWSUIT OR CLAIM AGAINST FREER OR THE CLUB FOR ANY INJURIES OR DAMAGES THAT REPRESENTATIVE OR PARTICIPANT MAY INCUR BY REASON OF THE PARTICIPANT S PARTICIPATION IN THE ACTIVITY. MEDICAL. Representative consents to emergency medical care and transportation in order to obtain treatment in the event of injury or illness to Participant as the Freer or the Club may deem appropriate. This Release extends to any damage, loss or liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency, including the negligent acts or omissions of any health care providers, their agents, employees, or Representatives. SEVERABILITY. Representative expressly agrees that the terms of release and indemnity contained herein are intended to be as broad and inclusive as is permitted by the laws of the state in which Freer and Club operates its business. Any provision or portion of this Release found to be invalid by the courts having jurisdiction shall be invalid only with respect to such provision or portion. The offending provision or portion shall be construed to the maximum extent possible to confer upon the parties the benefits intended thereby. Said provision or portion, as well as the remaining provisions or portion hereof shall be construed and enforced to the same effect as if such offending provision or portion thereof had not been contained herein. V. SIGNATURE. By voluntarily signing below, Representative certifies that Representative, (I) has read and understands this Release, (ii) agrees to its terms and conditions, (iii) acknowledges that execution of this Release is a necessary precondition of the Participant s participation in the Activity, and finally (iv) is the parent or legal guardian of the Participant. 5 3334 Golfing Green Drive, Farmers Branch, TX PAYMENT POLICY 1. Payment for each session is due on or before the last day of each session. Please keep track of how many times your child attends class within a session and pay the appropriate amount before the end of the session. Members of Brookhaven will have their accounts billed based on the attendance records. Guests may keep a credit card on file for junior program billings only. We accept MasterCard and Visa. 2. Any payment made after the end of a session will be charged a $25 late fee and a credit card will be required to be put on file for future academy payments. The card will be billed automatically on the last day of the session, based on the attendance records. 3. A drop-in rate is charged if a student attends less than 4 classes per session. This rate is reflected on the individual price charts on the class sheets. We do not allow drop-ins to the program on bad weather days due to limited space. 4. Payment for any private lessons taken is due at the time of the lesson. Once again, member accounts will be billed. We do not hold credit cards on file for private lessons, so please make arrangements for payment at the front desk at the time of the lesson. 5. All payments for travel team are due prior to the travel team departing. You must sign-up to participate on the travel team at least one week prior to the tournament so that plans can be made for the number of coaches travelling to the tournament. ( ClubCorp ) with respect to photographs and/ or testimonials taken of Member/Guest and Member's/Guest s child or children by ClubClub or its parent, subsidiaries, and/or a third party or in which Member/Guest or Member's/Guest s child or children are included ("Photographs and/ or Testimonials"). Member/Guest agrees Club has the right to: (i) (ii) (iii) copyright the Photographs and/ or Testimonials in any name ClubCorp may choose; use, reuse, reformat, cut, trim, modify, publish, and republish the Photographs and/ or testimonials, in whole or in part, individually or in conjunction with other photographs and/ or testimonials, in any medium, including, but not limited to, ClubCorp s and/or its affiliates website(s) or publications, including, but not limited to, electronic format and for any purpose whatsoever, including, but not limited to, illustration, promotion, publicity, advertising, and trade; and use Member's/Guest's name in conjunction with the use of the Photographs and/or testimonials Member/Guest further agrees to: (i) (ii) (iii) (iv) make no claim for compensation for the ownership or ClubCorp's other or continued use of the Photographs and/or testimonials; RELEASE CLUBCORP, ITS PARENT, SUBSIDIARIES, AND/OR AFFILIATES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, CONTRACTORS, EMPLOYEES, HEIRS, SUCCESSORS, AND ASSIGNS ( RELEASED PARTIES ) WITH RESPECT TO ANY CLAIMS, DEMAND, OR LAWSUITS WHICH ARE DIRECTLY OR INDIRECTLY ATTRIBUTABLE TO THE PHOTOGRAPHS AND/OR TESTIMONIALS OR USE OF THE PHOTOGRAPHS AND/ OR TESTIMONIALS, INCLUDING (BUT NOT BY WAY OF LIMITATION) LIBEL, SLANDER, INFRINGEMENT, OR OTHER DEFAMATION; THE ABOVE RELEASE ON MEMBER'S/GUEST'S OWN BEHALF, AS WELL AS ON BEHALF OF MEMBER'S/GUEST'S HEIRS, LEGAL REPRESENTATIVES OR OTHER ASSIGNS, AND ON BEHALF OF ANY THIRD PARTIES ACTING BY, THROUGH OR UNDER MEMBER/GUEST; AND INDEMNIFY, DEFEND, AND HOLD HARMLESS, AT MEMBER'S/GUEST S SOLE COST, THE RELEASED PARTIES FROM ANY AND ALL CLAIMS OF INFRINGEMENT ARISING OUT OF CLUBCORP S USE OF THE PHOTOGRAPHS AND/OR TESTIMONIALS.
