We recommend you take note in this guide of the account information as well as key dates and tips for a successful conversion. We recommend you visit the Test My Browser link, on our website at botc.com. O Checks: Use your new Bank of the Cascades checks and discontinue use of your Bank of America checks. O Debit Card: Use your Cascade Debit Mastercard. Your Bank of America Debit/ATM card will be deactivated at 7:30 PM. If you have not received your new debit card by March 7, 2016, please contact our Customer Service department at O Debit Card Security: Once your debit card is activated, sign up for debit card security in Online Banking or Mobile Banking. Select Debit On/Off, and also SMS Guardian for text alerts when your card is used. O ATM: Use any Bank of the Cascades ATM or MoneyPass Network ATM free of charge. You can download the MoneyPass App to find locations near you at no charge. O Online Banking: Log in as a first time user with your Bank of America login ID or sign up for Online Banking. O Online Bill Pay: Confirm that your payees are in place and that your recurring payments are accurate. O Mobile Banking: Download Bank of the Cascades Mobile Banking App at no charge. Log into Online Banking for the first time and establish a new Password, then you can use Mobile Banking. Note: If you own an iphone 5S or later you can establish your fingerprint for login ID to Mobile Banking. O Mobile Deposit: Deposit checks with Mobile Banking. Simply sign up for on the left side of Mobile Banking or Online Banking. O Overdraft Services: If you would like to establish Overdraft Services from a Credit Card, Home Equity Line or Line of Credit, please contact one of our branch bankers so we can explain the options available to you. O Credit Cards, Home Loans, and Business Loans, Lines of Credit: If you have a need for personal or business credit services, please contact any branch for solutions available to you. 4 5

4 Important Information: Things to Know IMPORTANT INFORMATION: THINGS TO KNOW 6 ALL ACCOUNTS The following information applies to both business and personal accounts. Loans Note: If you have business or personal loans, credit card(s), merchant or investment services with Bank of America, these accounts and/or services will remain with Bank of America. They will not transfer over to Bank of the Cascades. Account Numbers Your current account number will not change. It will now be your account number at Bank of the Cascades. Routing Number The routing number on your checks will change to If you utilize automatic payments (other than through Online Bill Pay), wires and direct deposits, you will want to notify these merchants with your new routing number. Please do not set up your new routing information with merchants until after March 4th to avoid returns. Additionally, you can always find the routing number on the bottom of your new checks. Alternative Statements Accounts with a Zero Balance at Conversion Alternative statements such as Foreign Language or Braille will no longer be provided at conversion. CHECKING ACCOUNTS The following information applies to both business and personal accounts. Service Charge Waived for 1st Month: As part of our welcome to Bank of the Cascades, we will automatically waive your checking account Monthly Service Charge for the 1st. Checks For your account, an introductory order of checks will be sent to you, at no charge, the week of February 15. Note: Checks drawn on Bank of America that have NOT cleared by May 6, 2016, will NOT be honored Debit Card Historical bank account activity including check/deposit images will be maintained by Bank of America. Please contact Bank of America Customer Service for assistance with these items. If you have an account with a zero balance for more than 24 hours after conversion, your account will automatically close. If you currently have a Bank of America debit card with your account, you will receive a new Bank of the Cascades Debit MasterCard. It also serves as your ATM card. Bank of the Cascades does not offer an ATM only card or a Deposit only card. You may use your Debit Card for signature, debit PIN based, and ATM transactions. Your debit card will be mailed the week of February 15, 2016, followed by a mailing with your secure PIN. Your debit card may be activated and used beginning March 4, 2016 at 7:00 PM PST. Activation instructions will be noted on your new card. To activate your Bank of the Cascades Cascade debit card complete a debit or ATM transaction using your new PIN any time after 7 PM PST on March 4, 2016 OR after 8 AM PST on March 7, 2016 you can also activate your card by calling For your convenience, you may change your PIN provided after 8 AM PST on March 7, 2016, by calling You must know your original newly mailed PIN to use this automated system. Your current Bank of America Debit Card will become inactive and should be destroyed after 7:30 PM PST on March 4, If you have not received your new Bank of the Cascades Debit Card by March 7, 2016, or have additional questions, please contact Customer Service at or visit any branch. Be sure to review the important Electronic Funds Transfer (EFT) disclosures on page 36 regarding changes to daily purchase limits, ATM withdrawal limits, and changes to Bank contact information for Error Resolution, Event of Unauthorized Transfer/Lost/Stolen Cascade Card. MONEY MARKET ACCOUNTS Your Money Market Account may be accessed through online banking to transfer funds into or out of other accounts. If you would like new checks to use with your Money Market Account, please contact any branch or our Customer Service team at OVERDRAFT SERVICES Personal & Business Banking Please see the overview of overdraft services for personal banking on page 10 and business banking on page 18. ONLINE BANKING If you currently use online banking with Bank of America, all transferring deposit accounts will automatically appear on your new Bank of the Cascades Online Banking service. There is no charge to use Bank of the Cascades Online Banking. Your Bank of America login ID will remain the same. If your login ID is a duplicate with an existing Bank of the Cascades customer, you will be contacted to create a new login ID. You will be asked to register, and set a new password. Note: If you have a credit card, loan, payroll services or investment services remaining with Bank of America, these services will not appear within Bank of the Cascades Online Banking. Important Information about Access to Online Banking during the Conversion Your Bank of America Online Banking access will continue until 9:00 PM PST on Friday, March 4, At that time, your transferring deposit accounts will no longer be available within Bank of America s Online Banking system. Your Bank of the Cascades Online Banking will become available at 8 AM PST on Monday, March 7, There will be no access to online banking between 9:00 PM PST March 4, 2016 to 8 AM PST March 7, Quicken and Quickbooks Direct Connect is not available within Bank of the Cascades Online Banking System. Quicken and Quickbooks Web Connect is still available and will need to be configured to connect to Bank of the Cascades after you successfully register and login to Bank of the Cascades Online Banking system. Online Banking Loan Payments from your Deposit Account Note: if you use a secure token for log-in, our Professional Banking team will reach out to you with transition steps. If you have a transfer setup in online banking to pay a loan from your deposit account, you will need to reset that transfer after your accounts are converted to Bank of the Cascades on March 7, This is due to your loan remaining with Bank of America. Therefore you will need to use our Online Bill Pay service to set up your future loan payment. 7

5 IMPORTANT INFORMATION: THINGS TO KNOW IMPORTANT INFORMATION: THINGS TO KNOW HOW TO USE ONLINE BANKING 1st Time Login Steps MOBILE BANKING Access when and where you need it Download the Bank of the Cascades mobile app 1. On the Login page on botc.com, click or tap I am a new user. 2. On the Login page, enter your current Bank of America Login ID and click or tap Submit. 3. The Enter Secure Access Code page appears. Do the following: 4. Click or tap one of the contact methods to send a Secure Access Code. 5. When the code arrives, enter the code and click or tap Submit. 6. If prompted to register the device, you can click or tap Register Device. After the First Time 1. On the Login page, enter your Login ID in the Login ID field. 2. (Optional) Select the Remember Me checkbox to save your Login ID for the next time that you login. Note: if you are using a device or browser that has not been previously used and registered, you will be prompted to receive and enter a Secure Access Code. This is for your security to ensure there is not unauthorized access to your accounts. Logging off Logging off online banking or the mobile banking app is an important part of keeping your financial information secure. To maximize your online banking security, we recommend you click or tap Log Off In the Menu on the left side of the screen. You should know that the system will automatically time out and log you off if you are not actively using the system. This prevents you from inadvertently leaving it open/on and accessible to others. ONLINE BILL PAY Payees Please verify your current list of payees on your Online Bill Pay as they are scheduled to automatically transfer to your new Bank of the Cascades Online Bill Pay service. Payments Your established recurring payments will automatically transfer to your new Bank of the Cascades Online Bill Pay. One-time or future dated payments scheduled on or before March 7, 2016 will be made by Bank of America. Online Bill Pay There is no charge to use Bank of Cascades Online Bill Pay. Note: We offer business customers Multi-User Bill Pay for a monthly fee. 7. In the Password field, enter the password that you want to use, reenter it in the Confirm Password field, and click or tap Submit. 8. Update your online profile and click or tap Submit Profile. Bill Pay History Six (6) months of bill pay history will be available to you (via link to a pdf) within our Bill Pay platform. Deposit Account Loan Payments Note: Bank of the Cascade password requirements: Must be at least 8 characters and no more than 20 characters. Must contain at least 1 number, 1 lower case character and 1 upper case character. 9. Read the agreement on the Disclaimers screen and click or tap I Accept. When you accept the agreement, the Home Page appears and you are ready to start using online banking. 3. Enter your password in the Password field and click or tap Sign In. When the connection is complete, the Home page appears. If you have an automatic transfer setup in online banking to pay a loan from your deposit account, you will need to setup the transfer after your accounts are converted to Bank of the Cascades system on March 7, Recommendation: Back up Payees & Payments As a backup and best practice, we recommend you make a print copy of your Bill Pay Payees and scheduled payments from your Bank of America Online Banking system before March 1, Mobile banking provides both mobile phone and tablet access to your accounts. We serve both ios and Android systems. There is no charge for Mobile Banking at Bank of the Cascades. Make the most of it Bank of the Cascades mobile banking delivers banking convenience on the go: check your balance, transfer funds, verify a payment, pay a bill, make a deposit and more. It s easy! Simply go to the App Store if you have an iphone or ipad, or the Play store if you have an Android device. Search for Bank of the Cascades and choose to install the App. There is no charge to install or use the App. Login instructions Your Online Banking login ID and Password will get you into Mobile Banking too. First time users will be provided a secure access code by phone call or text to ensure your security*. *If you have an iphone 5s or later you may also select to securely login with your fingerprint. The steps to establish your fingerprint are provided in Mobile Banking under Settings/Security Preferences. Note: Your smart phone must be set up to accept finger prints within your main settings, Touch ID, and pass code. estatements If you are currently enrolled to receive your monthly periodic statement through an electronically delivered estatement, there will be no change in your delivery service*. *When you receive notification of your statement by , you will be asked to accept the Terms & Conditions for electronic delivery upon your next login to Online Banking. Note: IRA and Time Deposit customers will no longer automatically receive. Past These will no longer be available. We recommend you print or download your past statements and/or history. You will not have access to this information after conversion. Alternative Statements Alternative statements such as Foreign Language and Braille will no longer be provided at conversion. TELEBANKING/VOICE BANKING If you prefer to use telebanking or voice banking, contact us via the Voice Banking number at , available 24 hours per day. Much of our relationship with our depositors is governed by state and federal law (which may change from time to time). This body of law is too large and complex to be reproduced here. The purpose of this brochure is to: (1) summarize the existing rules applicable to the more common transactions; (2) establish rules to govern transactions or events which the law does not regulate; (3) establish rules for certain events or transactions which the law already regulates but permits variation by agreement; and (4) give you our Electronic Funds Transfer and/or Truth- In- Savings policy disclosures. As used in this brochure, the words we, ours, and us mean the financial institution and the words you and your mean the account holder(s) and any authorized signer on your account. Party means a person who, by the terms of the account, has a present right, subject to request, to payment from a multipleparty account. Liability Each of you agrees, for yourself (and the person or entity you represent if you sign as a representative of another), to the terms of this account and the schedule of charges that may be imposed. You authorize us to deduct these charges as accrued directly from account balances. You also agree to pay additional reasonable charges we may impose for services you request which are not contemplated by this agreement. Each of you also agrees to be jointly and severally liable for any account deficit resulting from charges or overdrafts, whether caused by you or another authorized signer to withdraw from this account, and the costs we incur to collect the deficit including, to the extent permitted by law, our reasonable attorney s fees. Deposits Any items, other than cash, accepted for deposit (including items drawn "on us") will be given provisional credit only until collection is final (and actual credit for deposits of, or payable in, foreign currency will be at the exchange rate in effect on final collection in U.S. dollars). We are not responsible for transactions initiated by mail or outside depository until we actually record them. All transactions received after branch closure or 12:30pm (PST) for ATM deposits on a business day we are open, or received on a day in which we are not open for business, will be treated and recorded as if initiated on the next business day that we are open. Withdrawals Unless otherwise clearly indicated to the contrary, any one of you who signs in the space designated for signatures on the signature card, including an Agent signer, may withdraw or transfer all or any part of the account balance at any time on forms approved by us. Each of you (until we receive written notice to the contrary) authorizes each other person signing this form to endorse any item payable to you or your order for deposit to this account or any other transaction with us. We may charge against your account a check, even though payment was made before the date of the check, unless you have given us written notice of the postdating. The fact that we may honor withdrawal requests which overdraw the finally collected account balance does not obligate us to do so, unless required by law. Withdrawals will first be made from collected funds, and we may, unless prohibited by law or our written policy, refuse any withdrawal request against uncollected funds, even if our general practice is to the contrary. We reserve the right to refuse any withdrawal or transfer request which is attempted by any method not specifically permitted, which is for an amount less than any minimum withdrawal requirement, or which exceeds any frequency limitation. Even if we honor a non-conforming request, repeated abuse of the stated limitations (if any) may eventually force us to close this account. We will use the date a transaction is completed by us (as opposed to the day you initiate it) to apply the frequency limitations. Withdrawals from a time deposit prior to maturity or prior to the expiration of any notice period may be restricted and may be subject to penalty. Bounce Service Bounce Service is a special overdraft service for consumer and business checking account customers. The Bank authorizes and pays overdrafts for checks, in person withdrawals, ATM withdrawals, or other electronic means. Once selected, Bounce Service will be activated the day following the initial deposit to your new account. Upon enrollment, a Bounce Service limit of $500 for consumer accounts and $750 for business accounts is assigned. You may revoke at any time by signing a Bounce Service Revocation form. Current regulations require the Bank to provide an ATM/Debit card Opt In Consent form if you choose Bounce Service to be included for ATM and Cascade Card transactions on consumer accounts. Business accounts will have access to ATM and debit card transactions automatically. These services may be more suitable for your needs. Overdrafts above and beyond your assigned limit may result in items being returned to the payee. The Bank s normal Returned Item fee of $35.00 will be charged to your account for each item presented. Normally, the Bank will not approve an Overdraft for you in excess of your assigned limit, including our Overdraft fee charge(s). We may refuse to pay an Overdraft for you at any time, even though we may have previously paid Overdrafts for you. An Overdraft or Returned Item notice will be sent to notify you of any items paid or returned. On an account with more than one owner on the signature card, each owner or agent (if applicable) drawing/presenting the item(s) creating the Overdraft shall be jointly and severally liable for such Overdraft and any Overdraft fees. Limitations: We reserve the right to limit participation to one account per customer and to discontinue the product without prior notice. Daily Order of Transactions Processed The order in which your transactions are processed can affect the total amount of Returned Item and Overdraft fee(s). Transactions, as applicable, are posted to your account in the following order: Deposits and credit transactions Returned Item and Overdraft fees Overdraft sweep arrangement fee Account service charge Deposited return item fee Posted return item debit ATM withdrawals Cascade Card transactions In-person debit transfers Pre-authorized/internet debit ACH debits Checks (by check number sequence) Ownership of Account and Beneficiary Designation These rules apply to this account depending on the form of ownership and beneficiary designation, if any, specified on the account records. Individual Account is owned by one person. Joint Account-With Survivorship (And Not As Tenants in Common) is owned by two or more persons. Each of you intend that upon your death the balance in the account (subject to any previous pledge to which we have consented) will belong to the survivor(s). If two or more of you survive, you will own the balance in the account as joint tenants with survivorship and not as tenants in common. Joint Account-No Survivorship (As Tenants in Common) is owned by two or more persons, but none of you intends (merely by opening this account) to create any right of survivorship in any other person. We encourage you to agree and tell us in writing of the percentage of the deposit contributed by each of you. This information will not, however, affect the number of signatures necessary for withdrawal. Revocable Trust or Pay-on-Death Account If two or more of you created such an account, you own the account jointly with survivorship. Beneficiaries acquire the right to withdraw only if: (1) all persons creating the account die, and (2) the beneficiary is then living. If two or more beneficiaries are named and survive the death of all persons creating the account, such beneficiaries will own this account in equal shares, without right of survivorship. The person(s) creating either of these account types reserve the right to: (1) change beneficiaries, (2) change account types, and (3) withdraw all or part of the deposit at any time. Corporate, Partnership, and other Organizational Accounts We will usually require a separate authorization form designating the person(s) permitted and conditions required for withdrawal from any account in the name of a legal entity such as a partnership, corporation, or other organization. We will honor such authorization according to its terms until it is amended or terminated in writing by the governing body of such organization. Stop Payments A stop payment order must be given in the manner required by law and must be received in time to give us a reasonable opportunity to act on it before our stop payment cutoff time. Our stop payment cutoff time is one hour after the opening of the next banking day after the banking day on which we receive the item. Additional limitations on our obligation to stop payment are provided by law. A stop payment order must precisely identify the number, date and amount of the item, and the payee. We will honor a stop payment request by the person who signed the particular item, and, by any other person, even though such other person did not sign the item, if such other person has an equal or greater right to withdraw from this account than the person who signed the item in question. A release of the stop payment request may be made only by the person who initiated the stop payment. Telephone Transfers A transfer of funds from this account to another account with us by telephone, if otherwise permitted or arranged for, may be made by the same persons and under the same conditions generally applicable to withdrawals made in writing. Please see Transaction Limitations on Money Market & Savings Accounts for detailed information on transfer and withdrawal restrictions. Wire and ACH Transfers We may allow you to withdraw funds from your accounts with us by wire transfer. We may require that you sign a wire transfer form or separate wire transfer agreement before you use this service. When processing a wire transfer, we may rely on the account number of the designated beneficiary, even if the name of the beneficiary does not match the beneficiary s account title. You agree to be bound by Automated Clearing House Association rules. These rules provide, among other things that payments made to you, or originated by you, are provisional until final settlement is made through a Federal Reserve Bank or otherwise made as provided by Uniform Commercial Code. If we do not receive such payment, we are entitled to a refund from you in the amount credited to your account and the party originating such payment will not be considered to have paid the amount so credited. If we receive a credit to an account you have with us by wire or ACH we are not required to give you any notice of the payment order or credit. Amendments and Termination We may change any term of this agreement. Rules governing changes in interest rates have been provided separately. For other changes we will give you reasonable notice in writing or by any other method permitted by law. We may also close this account at any time upon reasonable notice to you and tender of the account balance personally or by mail. Notice from us to any one of you is notice to all of you. View your account statements, including check images, online through Online Banking. Statements will be available for 12 months, once 12 months history is established, to review. It's a safe and secure means of accessing your statements electronically. Selecting this option will replace your paper statements. Statements/ You must examine your statement of account with reasonable promptness. If you discover (or reasonably should have discovered) any unauthorized payments or alterations, you must promptly notify us of the relevant facts. If you fail to do either of these duties, you will have to either share the loss with us, or bear the loss entirely yourself (depending on whether we exercised ordinary care and, if not, whether we substantially contributed to the loss). The loss could be not only with respect to items on the statement but other items forged or altered by the same wrongdoer. You agree that the time you have to examine your statement and report to us will depend on the circumstances, but that such time will not, in any circumstances, exceed a total of 30 days from when the statement is first made available to you. You further agree that if you fail to report any unauthorized signatures, alterations, forgeries or any other errors in your account within 60 days of when we make the statement available, you cannot assert a claim against us on any item in the statement, and the loss will be entirely yours. This 60-day limitation is without regard to whether we exercised ordinary care. The limitation in this paragraph is in addition to that contained in the first paragraph of this section. Account Transfer Accounts may not be transferred or assigned without our prior written consent. Direct Deposits If, in connection with a direct deposit plan, we deposit any amount in this account which should have been returned to the Federal Government for any reason, you authorize us to deduct the amount of our liability to the Federal Government from this account or from any other account you have with us, without prior notice and at any time, except as prohibited by law. We may also use any other legal remedy to recover the amount of our liability. Temporary Account Agreement If this option is selected, this is a temporary account agreement. Each person who signs in the space designated for signatures on the signature card (except as indicated to the contrary) may transact business on this account. However, we may at some time in the future restrict or prohibit further use of this account if you fail to comply with the requirements we have imposed within a reasonable time. Setoff You each agree that we may (without prior notice and when permitted by law) setoff the funds in this account against any due and payable debt owed to us now or in the future, by any of you having the right of withdrawal. The amount subject to setoff is that proportion to which you are, or were immediately before your death, beneficially entitled, and in the absence of proof of net contributions, to an equal share with all parties having present rights of withdrawal. If the debt arises from a note, any due and payable debt includes the total amount of which we are entitled to demand payment under the terms of the note at the time we setoff, including any balance due date for which we properly accelerate under the note. This right of setoff does not apply to this account if: (a) it is an Individual Retirement Account or other tax-deferred retirement account, or (b) the debt is created by a consumer credit transaction under a credit card plan, or (c) the debtor s right of withdrawal arises only in a representative capacity. We will not be liable for the dishonor of any check when the dishonor occurs because we setoff a debt against this account. You agree to hold us harmless from any claim arising as a result of our exercise of our right of setoff. Agent (Individual Accounts Only) An agent is someone you designate to conduct transactions on your behalf but does not have any ownership of rights at death unless named as a Pay-on-Death or Revocable Trust beneficiary. Restrictive Legends We are not required to honor any restrictive legends on checks you write unless we have agreed to the restriction in writing signed by an officer of the financial institution. Examples of restrictive legends are must be presented within 90 days or not valid for more than $1,000. ATM/NIGHT DEPOSIT SAFETY TIPS Here are some important safety tips to keep in mind whenever you conduct ATM or night deposit banking. 1. Keep your ATM card in a safe place. Treat your card as you would cash or a credit card. If your card is lost or stolen (or if you suspect someone used it without your permission), contact us immediately. 2. Keep your personal identification number (PIN) secret. To protect your account from unauthorized use, memorize your PIN. Do not write your PIN on your ATM card or carry it in your wallet. Do not tell your PIN to anyone. Someone you trust today may not be trustworthy tomorrow. 3. Be aware of your surroundings. Be especially careful at night. Use ATMs and night depositories that are well lit and visible. When using an ATM after dark, consider having another person accompany you. If you notice any suspicious activity near the ATM, postpone your banking or go to another location. 4. Special tips for drive-up ATMs: When using drive-up ATMs be sure car doors are locked and all windows, except the driver s, are closed. Keep your car engine running and be aware of anyone loitering or in nearby vehicles. 5. Minimize your time at the ATM. Have your card and all forms completed before you approach the ATM. Put your money and ATM receipt away as soon as your transaction is finished and move away from the ATM. Wait until you are in the safety of your home or car to count your money. 6. When in doubt, leave the ATM. If someone makes you feel uncomfortable or concerned while using the ATM, cancel your transaction, take your card and leave immediately. 7. Maintain your privacy. Never give information about your ATM card or PIN to strangers or to 34 35

19 36 anyone over the telephone. When you make a transaction, stand directly in front of the ATM so others can t see you enter your PIN or make your transaction. 8. We want the ATM to be safe and convenient for you. Please tell us if you know of any problem with our ATM facility. For instance, let us know if a light is not working or there is damage to a facility. Please report any suspicious activity or crimes to us and the local law enforcement officials immediately. ELECTRONIC FUNDS TRANSFER- Personal Accounts Only Your Rights and Responsibilities-The Electronic Funds Transfers we are capable of handling are indicated as follows, some of which may not apply to your account. Please read this disclosure carefully because it tells you your rights and obligations for these transactions. Direct Deposits You may make arrangements for certain direct deposits to be accepted into your checking or savings account(s). Pre-authorized Withdrawals: You may make arrangements to pay certain recurring bills from your checking or savings accounts. Telephone Transfers: You may access your account(s) by telephone using your account numbers and personal identification number to: Transfer funds between checking and savings accounts. Make payments from checking and savings accounts to loan accounts with us. Get information about checking and savings account balances. ATM Transfers: You may access your account(s) by using your Cascade Card (ATM card) and personal identification number to: Make deposits to checking or savings account(s) with a Cascade/ATM card at Bank of the Cascades ATMs only. Get cash withdrawals from checking or savings account(s). You may withdraw no more than $505 per day. Transfer funds from savings to checking or from checking to savings account(s). Get information about the account balance of your checking or savings account(s). Some of these services may not be available at all terminals. Point-of-Sale Transactions: Using your Cascade Card, you may access your checking or savings account to purchase goods or pay for services in person, by telephone or by computer. You may also get cash from a merchant, if the merchant permits, or from a participating financial institution, and do anything that a participating merchant will accept. The amount of these transactions will be deducted electronically from your checking account. You may not exceed more than $2,000 in transactions per day. Computer Transfers: You may access your account(s) by computer using your Online Banking login ID and password to: Transfer funds between checking, savings and loan accounts. Make payments from checking and savings accounts to loan accounts with us. Get information about checking, savings and loan account balances. Electronic Check/Draft Conversion: You may access your checking account(s) by electronic check or draft conversion. Your authorization to make these types of electronic funds transfers may be expressed in writing or implied through the posting of a sign. Please see Transaction Limitations on Money Market & Savings Accounts for detailed information on transfer and withdrawal restrictions. Electronic Funds Transfer Initiated by Third Parties You may authorize a third party to initiate an electronic funds transfer between your account and the third party s account. These transfers to make or receive payment may be one-time occurrences or may recur as directed by you. These transfers may use the Automated Clearing House (ACH) or other payments network. Your authorization to the third party to make these transfers can occur in a number of ways. In some cases, your authorization can occur when the merchant posts a sign informing you of their policy. In all cases, the transaction will require you to provide the third party with your account number and financial institution information. This information can typically be found on your check as well as on a deposit or withdrawal slip. You should only provide this information to trusted third parties whom you have authorized to initiate an electronic funds transfer. Charges for Electronic Funds Transfers We do not charge for electronic funds transfers. If you use an ATM that is not owned by us, you may be charged a fee by the operator of the ATM. Right to Documentation Terminal Transfers: You can get a receipt at the time you make any transfer to or from your account using a Bank of the Cascades ATM. Direct Deposits: We will notify you of the receipt of payments in the periodic account statements we provide to you. Periodic Statements: You will get a monthly account statement from us for your checking account(s). You will get a monthly account statement from us for your savings account(s), unless there are no transfers in a particular month. In any case, you will get a statement at least quarterly. If you have opted for, these will be available electronically. Stop Payment Procedures and Notice of Varying Amounts Right to stop payment and procedure for doing so: If you have told us in advance to make regular payments out of your account, you can stop any of these payments. Here is how: Call or write us at the telephone number or address listed in this brochure in time for us to receive your request three business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after you call. Notice of varying amounts: If these regular payments vary in amount, the person you are going to pay will tell you 10 days before each payment when it will be made and how much it will be. (You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment or when the amount would fall outside certain limits you set.) Liability for failure to stop payment of pre-authorized transfer: If you order us to stop one of these payments three business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages. Our Liability Liability for failure to make transfers. If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will NOT be liable, for instance: (1) If, through no fault of ours, you do not have enough money in your account to make the transfer. (2) If the transfer would go over the credit limit on your overdraft line (Bounce Service or Personal Line of Credit limit). (3) If the ATM where you are making the transfer does not have enough cash. (4) If the terminal or system was not working properly and you knew about the breakdown when you started the transfer. (5) If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions we have taken. (6) There may be other exceptions in our agreement with you. Disclosure of Account Information to Third Parties We will disclose information to third parties about your account or the transfers you make: (1) Where it is necessary for completing transfers; (2) In order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant; (3) In order to comply with a government agency or court orders; or (4) If you give us written permission. Unauthorized Transfers Tell us AT ONCE if you believe your card and/or code has been lost or stolen, or if you believe that an electronic fund transfer has been made without your permission using information from your check. If you tell us within two business days, you will lose no more than $50 if someone used your card without your permission. Telephoning us is the best way of keeping your possible losses down. If you do not tell us within two business days after you learn of the loss or theft of your card and/or code, and we can prove we could have stopped someone from using your card and/or code without your permission if you had told us, you can lose as much as $500. Also, if your statement shows transfers that you did not make, including those made by card, code, or other means, tell us at once. If you do not tell us within 60 days after the statement was mailed to you or sent electronically, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time period. MasterCard Debit Card Additional limits on Liability for Cascade Card. You will not be liable for any unauthorized transactions using your MasterCard debit card if: (i) you can demonstrate that you have exercised reasonable care in safeguarding your card from the risk of loss or theft, and (ii) upon becoming aware of a loss or theft, you promptly report the loss or theft to us. If you believe your card and/or code has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call or write us at the telephone number or address listed in this brochure. Error Resolution In case of errors or questions about your electronic transfers or your statement, call or write us at the telephone number or address listed in this brochure as soon as you can. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared. (1) Tell us your name and account number (if any). (2) Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information. (3) Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days. We will tell you the results of our investigation within 10 business days (five business days if involving a Visa transaction or 20 business days if the transfer involves a new account within 30 calendar days after the opening deposit is made) after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days (90 days if the transfer involves a point-of-sale transaction, a foreign-initiated transfer or the claim is within 30 calendar days of the opening deposit of a new account) to investigate your complaint or question. If we decide to do this we will credit your account on a provisional basis within 10 business days (five business days if involving a Visa transaction or 20 business days if the transfer involves a new account within 30 calendar days after the opening deposit is made) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or questions in writing and we do not receive it within 10 business days, we may not credit your account. We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation.
