3 Introduction This document. the certificate and any endorsement attached form your contract of insurance. This document sets out the conditions of the contract of insurance between you and us. It should be kept in a safe place. Please read the whole document carefully. It is arranged in different sections. It is important that: you check that the sections you have requested are included you comply with your duties under each section and under the insurance as a whole Our aim is to ensure that all aspects of your insurance are dealt with promptly, efficiently and fairly. At all times we are committed to providing you with the highest standard of service. 4 Cooling Off Period You are entitled to cancel this contract of insurance by writing to your broker within fifteen days of either: the date you receive this contract of insurance; or the start of the period of insurance whichever is the later. Your Right to Cancel You can also cancel this contract of insurance at any time by writing to your broker. Any return premium due to you will depend on how long this contract of insurance has been in force and whether you have made a claim. We can cancel this contract of insurance by giving you fifteen days' notice in writing. Any return premium due to you will depend on how long this contract of insurance has been in force. Overseas Law and Jurisdiction It is hereby agreed that: 1. this insurance shall be governed by the law as stated on the certificate whose Courts shall have jurisdiction in any dispute arising hereunder; and 2. any summons, notice or process to be served upon the Underwriters for the purpose of instituting any legal proceedings against them in connection with this insurance may be served upon the Nominee stated on the certificate. 5 How to make a Claim Your duties In the event of a claim or possible claim under this contract of insurance: 1. you must notify your broker as soon as possible giving full details of what has happened 2. you must provide your broker with written details of what has happened within 30 days and provide any other information we may require 3. you must forward to your broker immediately, but no later than 1day, if a claim for liability is made against you, any letter, claim, writ, summons or other legal document you receive attempted theft or lost property 5. you must not admit liability or offer or agree to settle any claim without our written permission 6. you must take all reasonable care to limit any loss, damage or injury 7. you must provide us with reasonable evidence of value or age (or both) for all items involved in a claim 8. you must not abandon any property to us without our written permission If you fail to comply with any of the above duties this contract of insurance may become invalid. 6 How we deal with your Claim 1. Defence of claims We may take full responsibility for conducting, defending or settling any claim in your name take any action we consider necessary to enforce your rights or our rights under this contract of insurance 2. Other insurance We will not pay any claim if any loss, damage or liability covered under this contract of insurance is also covered wholly or in part under any other insurance except in respect of any excess beyond the amount which would have been covered under such other insurance had this contract of insurance not been effected. 3. Arbitration Should any disagreement arise as to the amount to be paid under this contract of insurance (liability being otherwise admitted), the matter will be referred to an arbitrator to be appointed in accordance with statutory provisions applicable within the Geographical Area. In such circumstances, an award must be made before any proceeding can be initiated against us. 4. Fraudulent claims If you, or anyone acting on your behalf, make a claim knowing it to be false or fraudulent in amount or in any other respect, this contract of insurance shall be invalid and all claims shall be forfeited. 7 Definitions Unless otherwise agreed the language of this contract of insurance shall be English. Definitions Wherever the following words appear in this contract of insurance they will have the meanings shown below. Bodily injury Bodily injury includes death or disease. Buildings the home and its decorations fixtures and fittings attached to the home permanently installed swimming pools, tennis courts, drives, patios and terraces, walls, gates and fences and fixed fuel tanks you own or for which you are legally liable and within the premises named in the certificate. Certificate The certificate is part of this contract of insurance and contains details of you, the premises, the sums insured, the period of insurance and the sections of this contract of insurance which apply. Contents Household goods and personal property, within the home, which are your property or which you are legally liable for. Contents includes: tenant's fixtures and fittings carpets radio and television aerials, satellite dishes, their fittings and masts which are attached to the home contents outside the home but within the premises up to USD5,OOO in total (other than radio and television aerials, satellite dishes, their fittings and masts which are attached to the home) deeds and registered bonds and other personal documents stamps or coins forming part of a collection gold, silver, gold and silver plated articles, jewellery and furs domestic oil in fixed fuel oil tanks Contents does NOT include: motor vehicles (other than garden machinery) caravans, trailers or watercraft or their accessories any living creature any part of the buildings any property held or used for business purposes any property insured under any other insurance Credit cards Credit cards, charge cards, debit cards, bankers cards and cash dispenser cards Endorsement A change in the terms and conditions of this contract of insurance. Deductible The amount of each loss for which you are responsible, as detailed in the certificate. Family Any family (including adopted children, stepchildren), fiance(e)s, co habitees or partners. 'family' does not include lodgers or tenants. Home The private dwelling of standard construction and the garages and outbuildings used for domestic purposes at the premises shown in the certificate. Money current legal tender, cheques, postal and money orders postage stamps not forming part of a stamp collection travellers' cheques all held for private or domestic purposes. Occupant A person or persons authorised by you to stay in the home overnight. Period of insurance The length of time for which this contract insurance is in force, as shown in the certificate and for which you have paid and we have accepted a premium. Personal possessions Clothing, baggage, sports equipment and other items normally carried about the person and all of which belong to you. Home Owners Insurance - Policy Wording 7

8 Personal possessions does NOT include: money and credit cards pedal cycles. Premises The address which is named in the certificate. Sanitary ware Washbasins, sinks, bidets, lavatory pans and cisterns, shower trays, shower screens, baths and bath panels. Standard construction Built of brick, stone or concrete and roofed with slates, tiles, asphalt. metal or concrete. Valuables jewellery furs gold, silver. gold and silver plated articles pictures We / us / our The Underwriters as detailed on the certificate who have a share in this contract of insurance. You / your / insured The person or persons named in the certificate and all members of their family who permanently live in the home. Your broker The insurance broker, agent or intermediary that arranged this contract of insurance on your behalf. Home Owners Insurance - Policy Wording 8

9 General Conditions (applicable to the whole of contract insurance) Each home included under this contract of insurance is considered to be covered as if separately insured. Your duties 1. You must take all reasonable steps to prevent loss, damage or an accident and keep the buildings in a good state of repair. When we receive this notice we have the option to change the conditions of this contract of insurance. 2. You must tell your broker before you start any conversions, extensions or other structural work to the buildings. When we receive this notice we have the option to change the conditions of this contract of insurance. If you fail to comply with any of the above duties this contract of insurance may become invalid. Home Owners Insurance - Policy Wording 9

10 General Exclusions (applicable to the whole of this contract insurance) A. Radioactive Contamination and Nuclear Assemblies Exclusion We will not pay for: 1. loss or destruction of or damage to any property whatsoever, or any loss or expenses whatsoever resulting or arising therefrom 2. any legal liability of whatsoever nature directly or indirectly caused by or contributed to by or arising from: i. ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel ii. the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof B. War and Terrorism Exclusion Notwithstanding any provision to the contrary within this insurance or any endorsement thereto it is agreed that this insurance excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any of the following regardless of any other cause or event contributing concurrently or in any other sequence to the loss; 1. war, invasion, acts of foreign enemies, hostilities or warlike operations (whether war be declared or not), civil war, rebellion, revolution, insurrection, civil commotion assuming the proportions of or amounting to an uprising, military or usurped power; or 2. any act of terrorism. For the purpose of this exclusion an act of terrorism means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear. This exclusion also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to (1) and/or (2) above. If the Underwriters allege that by reason of this exclusion, any loss, damage, cost or expense is not covered by this insurance the burden of proving the contrary shall be upon the Assured. In the event any portion of this exclusion is found to be invalid or unenforceable, the remainder shall remain in full force and effect. C. Existing and Deliberate Damage Exclusion We will not pay for loss or damage occurring before cover starts or arising from an event before cover starts caused deliberately by you or any permanent member of your home. D. Indirect Loss or Damage We will not pay for any loss or damage that is not directly associated with the incident that caused you to claim, unless expressly stated in this contract of insurance. E. Electronic Data Endorsement B 1. Electronic Data Exclusion Notwithstanding any provision to the contrary within the contract of insurance or any endorsement thereto, it is understood and agreed as follows: a. This contract of insurance does not insure loss, damage, destruction, distortion, erasure, corruption or alteration of ELECTRONIC DATA from any cause whatsoever (including but not limited to COMPUTER VIRUS) or loss of use, reduction in functionality, cost, expense of whatsoever nature resulting therefrom, regardless of any other cause or event contributing concurrently or in any other sequence to the loss. 11 ELECTRONIC DATA means facts, concepts and information converted to a form useable for communications, interpretation or processing by electronic and electromechanical data processing or electronically controlled equipment and includes programmes, software and other coded instructions for the processing and manipulation of data or the direction and manipulation of such equipment. COMPUTER VIRUS means a set of corrupting, harmful or otherwise unauthorised instructions or code including a set of maliciously introduced unauthorised instructions or code, programmatic or otherwise, that propagate themselves through a computer system or network of whatsoever nature. COMPUTER VIRUS includes but is not limited to 'Trojan Horses', 'worms' and 'time or logic bombs'. b. However. in the event that a peril listed below results from any of the matters described in paragraph (a) above, this contract of insurance, subject to all its terms, conditions and exclusions, will cover physical damage occurring during the policy period to property insured by this contract of insurance directly caused by such listed peril. Listed Perils Fire Explosion 2. Electronic Data Processing Media Valuation Exclusion Notwithstanding any provision to the contrary within the contract of insurance or any endorsement thereto, it is understood and agreed as follows: Should electronic data processing media insured by this contract of insurance suffer physical loss or damage insured by this Policy, then the basis of valuation shall be the cost of the blank media plus the costs of copying the ELECTRONIC DATA from back-up or from originals of a previous generation. These costs will not include research and engineering nor any costs of recreating, gathering or assembling such ELECTRONIC DATA. If the media is not repaired, replaced or restored the basis of valuation shall be the cost of the blank media. However this contract of insurance does not insure any amount pertaining to the value of such ELECTRONIC DATA to the Assured or any other party, even if such ELECTRONIC DATA cannot be recreated, gathered or assembled. F. Biological and Chemical Contamination Exclusion We will not pay for: 1. loss or destruction of or damage to any property whatsoever, or any loss or expenses whatsoever resulting or arising therefrom; 2. any legal liability of whatsoever nature; 3. death or injury to any person; directly or indirectly caused by or contributed to by or arising from Biological or Chemical contamination due to or arising from; terrorism; and/or steps taken to prevent, suppress, control or reduce the consequences of any actual, attempted, threatened, suspected or perceived terrorism. For the purposes of this exclusion "terrorism" means any act(s) of any person(s) or organisation(s) involving: the causing, occasioning or threatening of harm of whatever nature and by whatever means; putting the public or any section of the public in fear; in circumstances in which it is reasonable to conclude that the purpose(s) of the person(s) or organisation(s) concerned are wholly or partly of a political, religious, ideological or similar nature. G. Loss of Value Exclusion We will not pay for any reduction in value of the property insured following repair or replacement paid for under this contract of insurance. H. Wear and Tear Exclusion We will not pay for damage caused by wear and tear or any other gradually operating cause. I. Transmission and Distribution Lines Exclusion We will not pay for all above ground transmission and distribution lines, including wire, cables, poles, pylons, standards, towers, other supporting structures and any equipment of any type which may be attendant to such installations of any description, for the purpose of transmission or distribution of electrical power, Home Owners Insurance - Policy Wording 11

12 telephone or telegraph signals, and all communication signals whether audio or visual. This exclusion applies to all equipment other than that which is on or within 300 metres (or 1000 feet) of an insured structure. This exclusion applies both to physical loss or damage to the equipment and all business interruption, consequential loss, and/or other contingent losses related to transmission and distribution lines, other than contingent property damage/business interruption losses (including expenses), arising from loss and/or damage to lines of third parties. J. Mould Exclusion We will not pay for mould, mildew, spores or other microorganism of any type, nature or description. including but not limited to any substance whose presence poses an actual or potential threat to human health. This exclusion is absolute and applies in all circumstances, regardless of whether there is: i. any physical loss or damage to insured property ii. any insured peril or cause, whether or not contributing concurrently or in any sequence iii. any loss of use, occupancy or functionality; or iv. any action required, including but not limited to repair, replacement, removal, cleanup, abatement, disposal, relocation or steps taken to address medical or legal concerns This exclusion replaces and supersedes any provision in the contract of insurance that provides insurance. in whole or in part, for these matters. K. Climatic Conditions Exclusion This contract of insurance does not cover loss or damage caused by dryness, dampness, extremes of temperature or exposure to the light. l. Sanction limitation and Exclusion No (re)insurer shall be deemed to provide cover and no (re)insurer shall be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose that (re)insurer to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United States of America. M. Vacancy Exclusion It is understood and agreed that in respect of any property or unit that is vacant for more than 30 consecutive days the Insured warrants that: 1. all doors and windows shall be securely locked; 2. all refuse, waste and debris shall be removed from within and about said building and premises; 3. the protections provided for the safety of the insured property shall be maintained in good order throughout the duration of this Contract of insurance and shall be in use at all times when the premises are left unattended. and that such protection shall not be withdrawn or varied to the detriment of the Insurer(s) without consent, as within the control of the insured; 4. Buildings/units must be checked a minimum of once every two weeks; FAILURE TO COMPLY WITH THIS WARRANTY SHALL RENDER ALL INSURANCE UNDER THIS POLICY NULL AND VOID. Nothing herein contained shall vary, alter or extend any provision or condition of the contract of insurance other than as above stated. N. Protections Exclusion It is your duty to ensure that all protections provided for the security of the home and contents: are maintained in good working order, and are in full and effective operation whenever you are absent from the premises. If you fail to comply with the above duties this contract of insurance will become invalid in respect of loss or damage resulting from unauthorised entry. 0. Asbestos Exclusion a. This contract of insurance only insures asbestos physically incorporated in an insured building or structure, and then only that part of the asbestos which has been physically damaged during the Home Owners Insurance - Policy Wording 12

13 contract of insurance term by one of these Listed Perils: Fire; Explosion; Lightning; Windstorm; Hail; Direct impact of vehicle, aircraft or vessel; Riot or civil commotion; Vandalism or malicious mischief; or accidental discharge of fire protective equipment. This coverage is subject to all limitations in the contract of insurance and, in addition, to each of the following specific limitations: 1. The said building or structure must be insured under this contract of insurance for damage by that Listed Peril. 2. The Listed Peril must be the immediate, sole cause of the damage to the asbestos. 3. The insured must report to us the existence and cost of damage as soon as practicable after the Listed Peril first damaged the asbestos. However this contract of insurance does not insure any such damage first reported to us more than 12 (twelve) months after the expiration, or termination of the period of insurance. 4. Insurance under this contract of insurance in respect of asbestos shall not include any sum relating to: i. faults in the design, manufacture or installation of the asbestos or its design or workmanship ii. asbestos not physically damaged by the Listed Peril including any governmental or regulatory authority direction or request of whatsoever nature relating to undamaged asbestos b. Except as set forth in the foregoing Section (P) A. this contract of insurance does not insure asbestos or any sum relating thereto. Home Owners Insurance - Policy Wording 13

14 Complaints Procedure We are proud of the service that we provide and of our careful selection of brokers that we entrust to service this contract of insurance. Occasionally, things may go wrong and if this happens we have a procedure in place to fully investigate your complaint and, where appropriate, to make changes to prevent a recurrence. If you are unhappy with any element of the cover we provide or any aspect of our service or have cause for complaint, please, in the first instance, contact the broker that arranged the contract of insurance for you. Compensation Lloyd's insurers are covered by the Financial Services Scheme. You may be entitled to compensation from the Scheme if a Lloyd's insurer is unable to meet its obligations to you under this contract. If you were entitled to compensation under the Scheme, the level and extent of the compensation would depend on the nature of this contract. 15 Section 01 Buildings What is Covered This contract of insurance covers the buildings for loss or damage directly caused by: 1. fire, lightning, explosion, smoke, thunderbolt, subterranean fire 2. aircraft and other flying devices or items dropped from them 3. a. earthquake and/or volcanic eruption hurricane b. hurricane, cyclone, tornado or windstorm including flood or overflow of the sea caused by these perils 4. flood or overflow of the sea ot caused by point 3. above 5. escape of water from and frost damage to fixed water tanks, apparatus or pipes 6. escape of oil from a fixed domestic oil-fired heating installation and smoke damage caused by a fault in any fixed domestic heating installation 7. theft or attempted theft 8. collision by any vehicle or animal 9. subsidence or heave of the site upon which the buildings stand or landslip 10.breakage or collapse of fixed radio and television aerials, fixed satellite dishes and their fittings and masts 11.falling trees, telegraph poles or lamp-posts This section of the contract of insurance also covers: 12.the cost of repairing accidental damage to fixed glass and double glazing (including the cost of replacing frames) solar panels sanitary ware ceramic hobs all forming part of the buildings 13.the cost of repairing accidental damage to domestic oil pipes underground water-supply pipes underground sewers, drains and septic tanks underground gas pipes underground cables which you are legally liable for 14.loss of rent due to you which you are unable to recover additional costs of alternative accommodation, substantially the same as your existing accommodation, which you have to pay for while the buildings cannot be lived in following loss or damage which is covered under Section expenses you have to pay and which we have agreed in writing for architects', surveyors', consulting engineers' and legal fees the cost of removing debris and making safe the building costs you have to pay in order to comply with any Government or local authority requirements following loss or damage to the buildings which is covered under Section increased domestic metered water charges you have to pay following an escape of water which gives rise to an admitted claim under point 4 of Section anyone buying the home who will have the benefit of Section 01 until the sale is completed or the insurance ends, whichever is sooner 18.the cost of finding the source of an escape of water from any fixed water tanks, apparatus or pipes following loss or damage to the buildings which is covered under Section 01 This extension covers: accidental damage to the buildings What is not covered The Deductible shown on the Certificate. 16 a. for loss or damage to domestic fixed fuel-oil tanks and swimming pools b. for loss or damage while the home is not furnished enough to be normally lived in for loss or damage while the home is not furnished enough to be normally lived in a. for loss or damage to domestic fixed fuel-oil tanks, swimming pools, tennis courts, drives, patios and terraces, walls, gates and fences unless the private dwelling is also affected at the same time by the same event b. for loss or damage to solid floors unless the walls of the private dwelling are damaged at the same time by the same event c. for loss or damage arising from faulty design, specification, workmanship or materials d. for loss or damage which compensation has e. for loss or damage caused by coastal erosion f. for loss or damage whilst the buildings are undergoing any structural repairs, alterations or extensions for loss or damage to radio and television aerials, satellite dishes, their fittings and masts a. for loss or damage caused by trees being cut down or cut back within the premises b. for loss or damage to gates and fences We will not pay: any amount over the sum insured stated on the certificate a. any expenses for preparing a claim or an estimate of loss or damage b. any costs if Government or local authority requirements have been served on you before the loss or damage more than USD750 in any period of insurance. If you claim for such loss under Sections 01 and 02, we will not pay more than USD750 in total if the buildings are insured under any other insurance more than USD2,500 in any period of insurance. Accidental damage to the buildings The following applies only if the certificate shows that Accidental Damage to the buildings is included. We will not pay: a. for damage or any proportion of damage which we specifically exclude elsewhere under Section 01 b. for the buildings moving, settling, shrinking, collapsing or cracking c. for damage to outbuildings and garages which are not of standard construction d. for damage while the home is lent, let or sub-let e. for the cost of general maintenance f. for damage caused by infestation, corrosion, damp, wet or dry rot, mould or frost g. for damage arising from faulty design, specification, workmanship or materials h. for damage from mechanical or electrical faults or breakdown for damage caused by dryness, dampness, extremes of temperature or exposure to light j. for damage to swimming pools, tennis courts, drives, patios and terraces, walls, gates and fences and fuel tanks k. for any damage caused by or contributed to by or arising from any kind of pollution and/or contamination. Conditions that apply to Section 01 (buildings) only (See how to make a claim) Settling claims How we deal with your claim 1. If your claim for loss or damage is covered under Section 01, we will pay the full cost of repair as long as: the buildings were in a good state of repair immediately prior to the loss or damage, and the sum insured is enough to pay for the full cost of rebuilding the buildings in their present form and the damage has been repaired or loss has been reinstated If the buildings were not in a good state of repair we may deduct an amount from your claim. 2. We will not pay the cost of replacing or repairing any undamaged parts of the buildings which form part of a pair, set, suite or part of a com mon design or function when the loss or damage is restricted to a clearly identifiable area or to a specific part. 17 Your sum insured 3. We will not reduce the sum insured under Section 01 after we have paid a claim as long as you agree to carry out our recommendations to prevent further loss or damage. 18 Section 02 Contents What is Covered This contract of insurance covers the contents for loss or damage directly caused by; 1. tire, lightning, explosion, smoke, thunderbolt. sub terranean tire 2. aircraft and other flying devices or items dropped from them 3. a. earthquake and volcanic eruption b. hurricane, cyclone, tornado or windstorm including flood or overflow of the sea caused by these perils 4. flood or overflow of the sea not caused by above (3) 5. escape of water from fixed water tanks, apparatus or pipes 6. escape of oil from a domestic fixed oil-tired heating installation and smoke damage caused by a fault in any fixed domestic heating installation 7. theft or attempted theft 8. collision by any vehicle or animal 9. any person taking part in a riot, violent disorder, strike, labour disturbance, civil commotion or acting maliciously 10.subsidence or heave of the site upon which the buildings stand or landslip 11.falling trees, telegraph poles or lamp-posts. This section of the contract of insurance also covers: 12.accidental damage to televisions. radios. gaming consoles. This extension covers: accidental damage to the contents within the home. What is not covered The deductible shown on the certificate. We will not pay: Smoke damage resulting from any gradually operating cause for contents outside the home a. for loss or damage whilst the home is lent, let or sublet unless the loss or damage is caused by a violent and forcible entry; b. any amount over USD5OO or 3% of the sum insured for contents whichever is greater, within detached domestic outbuildings and garages a. for loss or damage following damage to solid floors unless the walls of the private dwelling are damaged at the same time by the same event b. for loss or damage arising from faulty design, specification, workmanship or materials c. for loss or damage which but for the existence of this contract of insurance would be covered under any contract or a guarantee or by law d. for loss or damage whilst the buildings are Home Owners Insurance - Policy Wording 18

19 undergoing any structural repairs, alterations or extensions e. for loss or damage by coastal erosion for loss or damage caused by trees being cut down or cut back within the premises. We will not pay: a. for damage or deterioration caused in the process of cleaning, repair, renovation, or dismantling b. for damage to tapes, records, cassettes, discs or computer software c. for mechanical or electrical faults or breakdown for the cost of repairing, removing or replacing frames any amount over 10% of the sum insured under Section 02 for the contents of the buildings damaged or destroyed any amount over 10% of the sum insured under Section 02 for the contents of the buildings damaged or destroyed any amount over USD250 in any period of insurance more than USD750 in any period of insurance. If you claim for such loss under Sections 01 and 02. we will not pay more than USD75O in total. Accidental damage to the contents The following applies only if the Certificate shows that accidental damage to contents is included. We will not pay: a. for damage or any proportion of damage which we specifically exclude elsewhere under Section 02 b. for damage to contents within garages and outbuildings with the exception of guest cottages and staff housing c. for damage or deterioration of any article caused by dyeing, cleaning, repair, renovation or whilst being worked upon d. for damage caused by chewing, tearing, scratching or fouling by animals e. any amount over USD1,000 in total for porcelain, china, glass and other brittle articles f. for money, credit cards, documents or stamps g. for damage to contact, corneal or micro corneal lenses h. for damage while the home is lent, let or sub let i. for damage caused by insects, vermin, infestation, corrosion, damp, wet or dry rot, mould or frost j. for damage arising out of faulty design, specification, workmanship or materials k. for damage from mechanical or electrical faults or breakdown I. for damage caused by dryness, dampness, extremes of temperature and exposure to light m. for any loss or damage caused by or contributed to by or arising from any kind of pollution and/or contamination Conditions that apply to Section 02 (contents) only (See how to make a claim) Settling claims How we deal with your claim 1. If you claim for loss or damage to the contents we will at our option repair, replace or pay for any article covered under Section 02. For total loss or destruction of any article we will pay you the cost of replacing the article as new, as long as: the new article is as close as possible to but not an improvement on the original article when it was new; and you have paid or we have authorised the cost of replacement. The above basis of settlement will not apply to clothes pedal cycles where we will take off an amount for depreciation. 2. We will not pay the cost of replacing or repairing any undamaged parts of the contents which form part of a pair, set or suite or part of a com mon design or function when the loss or damage is restricted to a clearly identifiable area or to a specific part. 20 Your sum insured 3. We will not reduce the sum insured under Section 02 after we have paid a claim as long as you agree to carry out our recommendations to prevent further loss or damage. 21 Section 03 Accidents to Domestic Staff This section applies only if the contents are insured under Section 02. What is Covered We will indemnify you: for amounts you become legally liable to pay, including costs and expenses which we have agreed in writing, for bodily injury by accident happening during the period of insurance anywhere in the world to your domestic staff employed in connection with the premises shown in the certificate. What is not covered We will not indemnify you: for bodily injury arising directly or indirectly from any vehicle outside the premises from any vehicle used for racing, pacemaking or speed testing from any communicable disease or condition in Canada or the United States of America after the total period of stay has exceeded 30 days in the period of insurance Limit of insurance We will not pay more than USD 100,000 for any one accident or series of accidents arising out of any one event, plus the costs and expenses which we have agreed in writing. 22 Section 04 Legal Liability to the Public This Section applies only if the certificate shows that either the buildings are insured under Section 01 or the contents are insured under Section 02 of this contract of insurance. Part A Part A of this Section applies in the following way: if the buildings only are insured, your legal liability as owner only but not as occupier is covered under Part A(i) below. if the contents only are insured, your legal liability as occupier only but not as owner is covered under Part A(i) and Part A(ii) below. if the buildings and contents are insured, your legal liability as owner or occupier is covered under Part A(i) and Part A(ii) below. What is Covered We will indemnify you: i. as owner or occupier for any amounts you become legally liable to pay as damages for bodily injury damage to property caused by an accident happening at the premises during the period of insurance OR ii. as a private individual for any amounts you become legally liable to pay as damages for bodily injury damage to property caused by an accident happening anywhere in the world during the period of insurance Part B What is Covered We will pay for: sums which you have been awarded by the local court and which still remain outstanding three months after the award has been made provided that: Part A(ii) of this section would have indemnified you had the award been made against you rather than to you there is no appeal pending you agree to allow us to enforce any right which we shall become entitled to upon making payment What is not covered We will not indemnify you for any liability: a. for bodily injury to you any other permanent member of the home any person who at the time of sustaining such injury is engaged in your service b. for bodily injury arising directly or indirectly from any communicable disease or condition c. arising out of any criminal or violent act to another person or property d. for damage to property owned by or in the charge or control of you any other permanent member of the home any person engaged in your service e. in Canada or the United States of America after the total period of stay in either or both countries has exceeded 30 days in the period of insurance f. arising directly or indirectly out of any profession. occupation, business or employment g. which you have assumed under contract and which would not otherwise have attached h. arising out of your ownership, possession or use of: i. any motorised or horsedrawn vehicle other than: domestic gardening equipment used within the premises and pedestrian controlled gardening equipment used elsewhere ii. any power-operated lift other than stairlifts iii. any aircraft or watercraft other than manually operated rowing boats, punts or canoes iv. any animal other than cats, horses, or dogs We will not indemnify you for any liability: i. in respect of any kind of pollution and/or contamination other than: caused by a sudden, identified, unexpected and unforeseen accident which happens in its entirety at a specific moment of time during the period of insurance at the premises named in the Home Owners Insurance - Policy Wording 22

23 certificate; and reported to us not later than 30 days from the end of the period of insurance in which case all such pollution and/or contamination arising out of such accident shall be deemed to have happened at the time of such accident j. arising out of your ownership, occupation, possession or use of any land or building that is not within the premises k. if you are entitled to indemnity under any other insurance, until such insurance(s) is exhausted; We will not indemnify you: for any amount in excess of USD50,000 Limit of insurance We will not pay more than more than USD1,000,000 in all for Part A and USD50,000 for Part B for any one accident or series of accidents arising out of any one event, plus the costs and expenses which we have agreed in writing. 24 Section 05 Valuables and Personal Possessions What is Covered This contract of insurance covers: Valuables and personal possessions listed in the certificate (or specitication(s) attached) against physical loss or damage within the geographical limits shown in the certificate What is not covered The deductible shown on the certificate. We will not pay: a. for damage caused by moth or vermin b. for damage from electrical or mechanical faults or breakdown c. any amount over USD1,000 for any one item unless stated otherwise in the certificate or the specitication(s) attached to the certificate d. for damage or deterioration of any article caused by dyeing, cleaning, repair, renovation or whilst being worked upon e. for damage to guns caused by rusting or bursting of barrels f. for breakage of any sports equipment whilst in use g. for any loss of or damage to contact, corneal or micro corneal lenses h. for theft or disappearance of jewellery from baggage unless such baggage is carried by hand and under your personal supervision i. for mobile telephones and computer equipment unless otherwise stated in the specitication(s) attached to the certificate j. any amount over USD500 in total in respect of theft or disappearance of property from any vehicle when such vehicle is left unattended without an authorised occupant k. any amount over USD2,000 in total in respect of theft or disappearance of jewellery from hotel or motel rooms during your absence from such rooms Conditions that apply to Section 05 (valuables and personal possessions) only (See how to make a claim) How we deal with your claim 1. We will at our option repair, replace or pay for any article lost or damaged. 2. If any insured item which is part of a pair or set and has an insured value of USD1,000 or over: we will not pay for the cost of replacing any undamaged or remaining items that form part of such pair or set we will not pay more than the proportion that the lost or damaged item bears to the insured value of such pair or set Your sum insured 3. If the total value of unspecified items at the time of the loss or damage is more than your sum insured for such items, then we will only pay for a proportion of the claim. For example if your sum insured only represents one half of the total value of unspecified items we will only pay one half of the cost of repair or replacement. However, if personal possessions are lost or damaged away from the home we will not take account of the value of personal possessions in the home at the time of such loss or damage.
