For questions, please call: Veolia Philadelphia s customer service at (215) and ask for benchmarking assistance. Thank you for your interest in Veolia Philadelphia s Automated Benchmarking Program. This free service has been created in order to ensure our customers can report their energy data quickly and accurately in accordance with the Philadelphia Benchmarking Ordinance. Each billing period, in addition to sending an invoice, we will upload a participant s steam consumption data to EPA Portfolio Manager. If you wish to have us perform this service for you, please follow the steps below: 1. On the following page indicate New Request if this is the initial enrollment in Veolia s Automated Benchmarking Program. Indicate Change Authorization if this building has already participated in the Automated Benchmarking Program but there s been a change in the Owner/Authorized Management Firm. Mail or the request form to Veolia at helen.silvis@veolia.com. 2. Be sure to review the attached Terms and Conditions on page 4 of this document. Your signature on the Automated Benchmarking Service Request Form indicates acceptance of all Terms and Conditions. 3. Setup Portfolio Manager for Automated Benchmarking Service using the how to guide on page 3 of this document.

3 How to Setup EPA Portfolio Manager for Automated Benchmarking Service Set up EPA Portfolio Manager for Your Steam Service 1. If you are already using EPA Portfolio Manager for your steam service you can skip to Initiate Data Exchange with Veolia Energy in EPA Portfolio Manager. 2. Log into your Portfolio Manager account at 3. Under My Portfolio click on your facility name in the My Properties box. 4. Under the Meters tab, click Add Meter. 5. Select District Steam as the property s energy source and click Get Started. 6. Enter a name for the steam meter, select klbs as the units, enter the date on year ago for First Bill Date, check the In Use box, and click Continue. 7. Next, you will be prompted to enter your steam consumption data. Skip this step by clicking Finish Meter Set Up. 8. You will be alerted that you have successfully added a meter to your property. At this time select the steam meter you just created to as a Meter to add to Total Consumption for Metrics and select Apply Selections. Initiate Data Exchange with Veolia Energy in EPA Portfolio Manager 1. If you have already sent us your Request for Automated Benchmarking we may have already sent your Portfolio Manager Username a connection request. If so, it will appear in your Notifications. Simply accept it and continue to step 6. If we have not yet sent you a request, follow steps 2-5 first. 2. Click on the Contacts link in the upper right of your EPA Portfolio Manager home page. 3. After the My Contacts page loads, click Add Contact. 4. Search for the username VeoliaEnergyPhiladelphia (no space) in the Find Contact in Portfolio Manager field and choose to Connect. 5. You will receive a message in your Notifications section of your Portfolio Manager home page when we have accepted your connection request. 6. Once your request has been accepted, from the My Contacts page click Share. 7. Choose the property you want to share and select VeoliaEnergyPhiladelphia as the contact. Click Continue. 8. Click the grey arrow next to your property name and select Exchange Data for Veolia Energy s row. 9. A window will pop up titled Select Data Exchange Access Permissions. For your steam meter, select Full Access and enter your Meter ID from your invoice. 10. At the bottom of the window click Apply Selections and Authorize Connection. 11. Click Share Property. 4 Terms and Conditions 1. You hereby represent that you are either the owner of the Building specified on the first page of this Agreement or the Building owner s agent authorized to enter into this Agreement ( Owner ). 2. Veolia Energy s Automated Benchmarking Service allows Veolia Energy to create, access, upload, modify, and view data in the EPA Portfolio Manager database on Owner s behalf. By accepting the Terms and Conditions listed herein, Owner authorizes Veolia Energy to release energy usage for your building(s) to the appropriate agencies in compliance with chapter of the Philadelphia code entitled Energy Conservation. 3. Upon Owner s consent to this Agreement, Veolia will send 24 months of the most recent aggregate energy usage to the EPA Portfolio Manager database in aggregate form via electronic method. Thereafter Veolia Energy will automatically create, access, upload, modify or view Owner s meter data on a periodic basis. Energy data will be in klbs (consumption) and will not include lbs/hr (demand). The energy usage data provided reflects the amount of energy usage billed by Veolia Energy. Actual energy usage may vary from billed energy usage. There are times when Veolia Energy may be unable to obtain an actual meter reading of energy usage and therefore will use an estimate based on energy usage history to bill the affected customer(s). Any variance between actual and estimated energy usage will be reconciled in the EPA Portfolio Manager. 4. Veolia s performance is considered complete once data is transmitted from Veolia Energy to the EPA Portfolio Manager database. Veolia Energy is not responsible and will not be held liable for any data changes or manipulations made to the data after the transfer. Veolia s Benchmarking Services shall be performed in a professional manner consistent with the level of care and skill ordinarily exercised by other providers of such services performing under similar circumstances. Owner s sole remedy for any breach of such warranty shall be a refund of the portion of the fees paid to Veolia Energy, if any, for the deficient Services. EXCEPT AS EXPRESSLY SET FORTH IN THIS PARAGRAPH, VEOLIA ENERGY HAS NOT AND SHALL NOT BE DEEMED TO HAVE MADE ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USAGE AND TRADE. 5. By agreeing to provide the consumption data specified herein, Veolia Energy is not agreeing to discharge, or otherwise assume responsibility for, Owner s legal obligations. In no event shall Veolia Energy be held responsible/liable for Owner s obligation to provide benchmarking compliance data or any consequences to Owner for any failure to comply, or any unfavorable Energy Star rating of the building. 6. Either party may terminate this Agreement at any time, with or without cause, by giving notice to the other at the other party s primary business address. This Agreement will automatically terminate in the event of change in building ownership. 7. By authorizing the release of this data, Owner acknowledges it has received and validated the list of all active meters for which data will be aggregated in the file transferred to EPA Portfolio Manager Database. 8. Owner is responsible for notifying Veolia Energy of the need to update the list of steam accounts/meters associated with the building which are used to generate the aggregated consumption and cost data, due but not limited to events such as new construction, remodeling, or demolition of existing units/structures.

Per EPA s request, Veolia Energy will not perform any weather normalization of the data provided and will not report on any onsite generated steam (i.e. steam generated by Owner). 10. Owner agrees to indemnify, defend (with counsel reasonable acceptable to Veolia Energy), release and hold harmless Veolia Energy from any liability, claims, demands, causes of action, damages or expenses resulting from any release of information or data to the EPA for the energy performance benchmarking program pursuant to this authorization or the unauthorized use of the information or data by the EPA or another party. IN NO EVENT SHALL VEOLIA ENERGY BE LIABLE TO OWNER FOR CONSEQUENTIAL, EXEMPLARY, SPECIAL, INCIDENTAL, RELIANCE, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM FIRST ASSERTED AFTER THE FIRST ANNIVERSARY OF THE TRANSMISSION OF DATA FROM VEOLIA ENERGY TO EPA PORTFOLIO MANAGER DATABASE. IN ANY EVENT, THE AGGREGATE LIABILITY OF VEOLIA ENERGY FOR ANY LOSS OR DAMAGES OF ANY TYPE DIRECTLY OR INDIRECTLY SUFFERED BY OWNER ARISING FROM THE BENCHMARKING SERVICES PERFORMED BY VEOLIA ENERGY OR ANY FAILURE, ACT, OMISSION OR BREACH OF THIS AGREEMENT BY VEOLIA ENERGY SHALL NOT EXCEED THE AGGREGATE FEES, IF ANY, PAID BY OWNER TO VEOLIA ENERGY PURSUANT TO THIS AGREEMENT. 11. These terms and conditions shall be governed and interpreted by the laws of the Commonwealth of Pennsylvania. The parties agree to negotiate any dispute arising out of this Agreement in good faith and for a period not to exceed fourteen days. Thereafter the parties agree any action or claim arising out of or related to this Agreement or terms and conditions shall be filed in Philadelphia County, Pennsylvania and consent and agree to submit to the exclusive jurisdiction of such courts over any action, suit or proceeding arising out of these terms and conditions. Release By signing the Portfolio Manager Automated Benchmarking Consumption Request form or clicking on the I agree to my provider s Terms of Use button on the Portfolio Manager website you represent and warrant that: 1) you have read and agree to the above Terms and Conditions; 2) you are the building owner or his/her authorized agent and hereby bind Owner to this Agreement and submit this request to Veolia Energy to automatically generate and upload aggregated energy usage and cost data for this building to the Environmental Protection Agency s Portfolio Manager Website; and 3) the information you provide, if any, for Veolia Energy s conveyance to the EPA will be true and correct.
